05/13/1991 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING
May 13, 1991
The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at City Hall, Monday, May 13, 1991 at 1:08 P.M., with the following members
present:
Rita Garvey Chairperson
Lee Regulski Trustee

Also Present were:
Michael J. Wright City Manager
Milton A. Galbraith, Jr. City Attorney
Cynthia E. Goudeau City Clerk
ITEM #2 - Minutes:
Trustee Fitzgerald moved to approve the minutes of the April 29, 1991, meeting. The motion was duly seconded and carried unanimously.
ITEM #3 - Request for Acceptance into Membership:
The City Manager presented the recommendation of the Pension Advisory Committee to approve membership for the employee(s) listed below:
a) Thomas Mahony
b) Steven Hansen
c) John Weppler
d) Michael Hofstetter
e) Thomas Findley
f) Isaac Hinson
Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously.
ITEM #4 - Denial of Pension:
The City Manager presented the recommendation of the Pension Advisory Committee that the employee(s) listed below be denied membership in the Employees' Pension Plan:
a) Deborah Nash - rheumatoid arthritis
b) Sharon Goff - high blood pressure
Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously.
ITEM #5 - Request for Pension:
The City Manager presented the recommendation of the Pension Advisory Committee that the employee(s) listed below be granted a regular pension under Section 26.34 and/or 26.37 of the
Employees' Pension Plan.
a) Richard Sheldon
b) Arthur R. Smith
c) John H. Richter, Jr.
Trustee Fitzgerald moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously.
ITEM #6 - Request for Pension:
The City Manager presented the recommendation of the Pension Advisory Committee that Jay Unora be granted a job-connected disability pension under Section 26.35 and/or 26.27 of the
Employees' Pension Plan.
Mr. Unora's injury, described as a herniated disc, occurred on September 2, 1989, while he was trying to open a stuck cabinet door. He turned and felt a sharp pain in his lower left
spine.
The Personnel Director indicated Mr. Unora has had two operations on his back which have not alleviated his problems. Two doctors have reported they feel Mr. Unora's injury is permanent
and he can no longer perform the duties of a firefighter.
Concern was expressed that one of the doctors seemed to indicate the injury was due to scarring resulting from the surgeries. Mr. Laursen responded that persistant pain is caused by
the scarring but the herniated disc is the injury that prevents Mr. Unora from lifting, stooping, etc.
Discussion ensued regarding whether or not surgery was sought too quickly. It was reported whether or not to have surgery is the option of the employee.
Trustee Regulski moved to accept the recommendation of the Pension Advisory Committee. The motion was duly seconded and carried unanimously.
Questions were raised regarding whether or not the City could implement a program that would keep employees, especially those in the Police and Fire Departments, in good physical condition.
It was stated this would be a union bargaining issue.
