May 14, 1990
The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at City Hall, Monday, May 14, 1990 at 1:02 P.M., with the following members
present:

ITEM #2 - Minutes:
Trustee Fitzgerald moved to approve the minutes of the April 30, 1990, meeting. The motion was duly seconded and carried unanimously.
ITEM #3 - Other Business:
Pension Entitlement Forms for Disability Pensioners
The payroll division sends out annual certification of pension entitlement forms to those receiving a city pension. The form states that the information requested is essential in the
administration of the pension plan and must be supplied each year to ensure that benefits are properly received and conform to the pension ordinance.
The Pension Advisory Committee has reviewed the forms returned by the disability pensioners as of late March and has determined that many of the forms are incomplete. In some instances,
they did not respond to the question asking if they are employed and in some instances, they indicated they were employed but did not provide additional information relating to the nature
of the employment.
The Pension Ordinance provides that a disability pensioner may not accept employment in an occupation or line of work similar to the occupation or line of work which resulted in the
employee being placed on disability pension. In order to ensure the pensioners are not engaged in an similiar occupation or line of work, it is necessary to know in what line of work
they are involved.
At the PAC meeting of April 18, 1990, the Committee passed a motion recommending to the Trustees that people returning a form which was incomplete be forwarded new forms by certified
mail and if the form is not returned within 30 days, properly completed, the pension payments will be withheld until such time as the form is returned properly completed.
Discussion ensued regarding whether or not it was legal to ask some of the questions regarding the disability and the City Attorney indicated he saw no problems with the form.
A suggestion was made that a requirement to have certification of tax returns submitted would give proof of occupation. It was indicated that the City needs to know the job in order
to determine whether or not it is a similar occupation to the one under which the disability was granted.
Trustee Regulski moved to approve Pension Advisory Committee's recommendation to mail, by certified letter, new certification of pension entitlement forms to thoses pensioners who have
submitted this year's annual form incompletely filled out and advising those pensioners they have 30 days to resubmit a completed form or failure to comply will result in the withholding
of their subsequent pension check until the properly completed form is returned. The motion was duly seconded and carried unanimously.
The Personnel Director reported that medical standards have been developed and are being reviewed by Risk Management and Doctor's Walk-In Clinic. It is hoped that the reviewers will
be able to respond regarding these standards within two weeks.
