05/15/1989 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING
May 15, 1989
The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at the City Hall, Monday, May 15, 1989, at 9:05 A.M., with the following
members present:

ITEM #2 - Minutes: Commissioner Winner moved to approve the minutes of the April 17, 1989, meeting. Motion was duly seconded and carried unanimously.
ITEM #3 - Request for Acceptance into Membership:
The City Manager presented the recommendation of the Advisory Committee to approve membership for two (2) employees listed below:

Commissioner Regulski moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously.
ITEM #4 - Other Business: Approval of procedure to accept Current Employees Over 45 to Pension Plan
On 11/8/88 Ord 4595-88 was approved by the voters. The Ordinance removes the 45 year age limitations in the Pension Plan and provides that current employees who were excluded from
the plan due to their age at time of hire can now enter the plan as new hires.
Staff has devised a procedure to implement this provision. The proposal requires that employees wishing to enter the plan apply to do so within 6 months of being notified of the ability
to apply. The employee would be required to have a physical exam at the City's expense. If the employee passes the exam, the would be admitted to the plan as a new hire. If they fail
the physical they would remain under Social Security and have an opportunity for a re-examination with in the six (6) month time frame.
Concerns were raised regarding the number of employees that would be affected and requiring a re-examination within the six (6) month period if the physical is failed.
John Nicholson, representing the Pension Advisory Committee, stated the Committee recommends allowing the employee to join retroactive to the date of the referendum.
Discussion ensued regarding not establishing a time limit for re-
examinations for failed physicals and whether or not the employees could be allowed to enter retroactively to the date of the referendum.
The Personnel Director indicated an employee cannot be covered by Pension and Social Security.
Consensus of the Trustees was for staff to provide additional information re the procedure for re-examination in the case of failed physicals, whether or not an employee can be covered
by Pension and Social Security at the same time and the number of employees that would be affected by this procedure and the item would be considered further at the next Trustees meeting.
