Myrtle Avenue, Suite 210 Clearwater, Florida 33756 RE: RESPONSE TO DRC REVIEW COMMENTS McDONALD'S RESTAURANT – CLEARWATER MALL 2871 GULF TO BAY BOULEVARD CLEARWATER, FLORIDA 33759 CASE NUMBER: FLD2014-03009 Dear Mr. Jackson: In response to DRC review comments dated March 28, 2014, High Point Engineering (HPE) is providing the following: Planning Review Prior to CDB: 1. Please clarify how in the parking demand study a double drive-thru lane is expected to reduce the number of off-street parking spaces needed. Response: McDonalds has established that approximately seventy (70) percent of the orders generated are drive-thru orders with the addition of the side-by-side drive-thru lane. Customers will be able to place orders and be served faster which creates less of a demand to go into the restaurant to place orders. 2. Revise to read "Setbacks" not "Building Setbacks" as setbacks are measured to all structures, not just buildings. Response: Please see sheet C-1 for revision. 3. Revise these numbers to include setbacks to structures, not just building. Response: Please see sheet C-1 for revision. 4. Provide the distance from the property line to the north edge of the bicycle rack pad. Response: Distance added, please see sheet C-4.1. 6. Revise the 3.2 foot dimension to reflect the distance from the east property line to the outside edge of the curb. Response: Dimension has been revised to reflect the distance from the property line to the back of curb. Refer to sheet C-4.1. 7. Staff only requires a 12 foot wide travel lane on the east side of the drive-thru lane. As such, reduce the width of the drive-thru lane to provide the required five foot landscape buffer along the east property line. Response: The by-pass lane adjacent to the east side of the drive-thru lane has been reduced in width to 14 feet to allow the delivery truck access. This allows for a 4.5 foot landscape buffer along the east side of the property. Refer to sheet C-4.1. 8. Can two additional off-street parking spaces be placed in the location shown? Response: McDonalds needs a sidewalk and ramp to accept deliveries, therefore adding two (2) additional parking spaces in this location isn't feasible. 9. Remove all detail sheets which do not require review until building permit. Response: Acknowledged. 10. Clarify if the typical wall section is for the wall for the dumpster enclosure only or if also for the proposed eight foot tall wall. Response: The wall section shown on sheet C-7.2 is for the dumpster enclosure only. 11. Pursuant to CDC Section 3-1204.D, provide wheel stops for all off-street parking spaces adjacent to landscaped areas. Response: Landscape areas having off-street parking adjacent to them have been revised such that the two (2) foot overhang of the vehicle does not encroach into the landscaping 12. Pursuant to CDC Section 3-1302.C.1, the heights of the lamps shall not exceed 35 feet, or one foot in height for each one foot the light fixture is setback from the setback line. Along the north property line the setback line is 15 feet and along the east and west property lines the setback line is five feet. Response: Will be addressed during building plan review. 14. Add a note to the plan that all signs will be reviewed under separate application request. Response: Note has been added, please see sheet C-4.2. Engineering Review Prior to Building Permit: 1. Please add the following demolition notes to the plans: - All utilities shall be cut and capped prior to demolition. The Wastewater Supervisor shall be notified. - Demolition shall not cause any service interruptions for other utility customers. - Water meters, double-detector checks and backflow preventers are owned by the City of Clearwater. The City shall remove and retain these items. Response: Notes have been added, please see sheet C-3. 1. As per Community Development Code Section 3-1701B, Sidewalks required, Plan considerations, if the remodeling of an existing structure will exceed by 50% of the assessed evaluation of the property where a sidewalk does not exist, an applicant shall provide for construction of a sidewalk in an easement or right-of-way. If the property owner qualifies for an exception, the property owner shall pay a fee in lieu of constructing the sidewalk to be used to construct a sidewalk at a future date. Please show sidewalk in the Cross Boulevard right of way. Response: Owner will pay a fee in lieu of constructing the sidewalk along Cross Boulevard. 2. As per Community Development Code Section 3-1907B, Sidewalks/Bicycle paths and City Construction Standard Index No. 109 for Sidewalks, Applicant shall bring all sub-standard sidewalks and sidewalk ramps adjacent to or a part of the project up to standard, including A.D.A. standards (raised detectable tactile surfaces or truncated domes per most recent FDOT Indexes 304 and 310). Response: Acknowledged. 3. If the proposed project necessitates infrastructure modifications to satisfy site-specific water capacity and pressure requirements and/or wastewater capacity requirements, the modifications shall be completed by the applicant and at their expense. If underground water mains and hydrants are to be installed, the installation shall be completed and in service prior to construction in accordance with Fire Department requirements. As per Clearwater Code of Ordinances, Article IX., Reclaimed Water System, Section 32.376, Use of potable water for irrigation is prohibited, no person shall use potable water for irrigation through a new or existing lawn meter on property where reclaimed water distribution facilities are available. If potable water is currently used for irrigation, then a connection to the reclaimed water line in Cross Boulevard shall be established. Response: Acknowledged, connection to the reclaimed water line in Cross Boulevard has been shown on sheet C-6. Prior to C.O.: 5. A right of way permit from FDOT for any work in Highway 60/Gulf to Bay Blvd shall be provided. Response: Acknowledged. Prior to Building Permit: 6. Only Sheet C-4.1 was reviewed for General Engineering criteria. The additional details provided in the plan set may have been necessary for other departmental reviews to provide flexible development approval. Construction plans shall be reviewed in more detail prior to receipt of the building permit. Response: Acknowledged. 7. Any work in the Cross Boulevard right of way will require a city right of way use permit which is permitted through the Engineering Department. Right of way permits can be found online at http://myclearwater.com/gov/depts/pwa/engin/FormsApplications.asp Response: Acknowledged. 8. DRC review is a prerequisite for Building Permit Review. Offsite discharge of produced groundwater from dewatering shall comply with dewatering guidelines from Florida Department of Environmental Protection (FDEP), F.A.C. 62-621(2). Response: Acknowledged, no dewatering is anticipated being required as part of this project. 3. Additional permits from State agencies, such as the Southwest Florida Water Management District or Florida Department of Environmental Protection, maybe required. Approval does not relieve the applicant from the requirements to obtain all other required permits and authorizations. Response: Acknowledged. 4. An Asbestos Survey is usually required prior to conducting any demolition or renovations. Contact Pinellas County Air Quality (727/464-4422) for more information. Response: Acknowledged. 5. Continue to provide erosion control measures on plan sheets and provide notes detailing erosion control methods for Building Permit review. Response: Acknowledged. Land Resource Review 1. DRC review is a prerequisite for Building Permit Review, prior to issuance of a building permit any and all performance based erosion and sedimentation control measures must be approved by Environmental and or Stormwater Engineering, be installed properly, and inspected. Response: Acknowledged. 2. Consider the type and location of potential freestanding signage in the front (north) landscape buffer. Magnolias are great shade trees, however a tree that naturally is more limbed up (such as a high rise live oak) may offer better visibility of signage without hacking the tree later. Acknowledge. Response: The 4 Little Gem Magnolias along Gulf to Bay Boulevard have been replaced with 6 Royal Palms and 4 accent trees. Please see sheet L-1. 3. Some of the landscape islands do not appear to be 10 feet wide, yet they have shade trees proposed. Shade trees must be a minimum of 5 feet away from impervious. Clarify the dimension from back of curb to back of curb on the islands and revise the island or the shade trees. Response: Island dimensions have been clarified and adjusted to be a minimum 10 feet wide, back of curb to back of curb. Please see sheet C-4.1. There is a 312 inch deficit proposed (which may change in response to comments and is subject to a final landscape inspection) and must be paid to the tree bank at a rate of $48 per inch for a total of $14,976. Acknowledge. Response: Acknowledged, the total inch deficit is 263. 5. Provide details of the perimeter wall that is proposed. Specifically if tree #25 and #29 can be retained the wall may need to be pier and lintel. Response: Details of the perimeter wall will be provided sheet C-7.2. 6. Absolutely no trees are being retained. Understood it is a tight site to design. Why are trees #29 and #25 being removed? It appears there may be as much as 10 feet between the trees and the top of the stormwater bank. Consider trying to shift the storm water pond away from the trees. Response: Trees 32, 33 and 36 along Cross Boulevard have their roots highly exposed due to soil erosion. Trees 32, 33, 34, 36 and 38, location under the power lines, show signs of abuse due to trimming. Modify the layout of the 8 ft screen wall in the back of the property to save tree 25 is not feasible due to cost. Also, trees 25 and 29 will be very difficult to protect with lintels since the proposed pond will imposed a 3 ft berm over the root system. In addition, the foundation of the 8 ft screen wall on the western end (approx. 50 feet) has to be installed deep due to the existing topography. Traffic Engineering Review 1. Minimize vehicular conflict points by removing one of the two right turn only egress. If a full access driveway is desired along S.R. 60 (Gulf to Bay Blvd.) then applicant shall acquire FDOT approval. Traffic Engineering recommends that the driveway operate as a right-in and right-out only. Response: Please note that the proposed driveway connection has a left out and right out lanes. The applicant has applied to FDOT for a Driveway Connection Permit. 2. Provide hand railing to comply with 2012 Florida Accessibility Code For Building Construction. Response: Please note that hand railing is not required along the sidewalk connecting the proposed building to the public sidewalk on Gulf to Bay Boulevard. 3. The submitted traffic impact study is not acceptable at this time, please see Traffic Engineering for comments. Response: Traffic Impact Study comments have been resolved. Obtain FDOT permit for driveway access or other work within the state road right-of-way. Response: Acknowledged. General Note(s): 5. Applicant shall comply with the current Transportation Impact Fee Ordinance and fee schedule and paid prior to a Certificate of Occupancy (C.O.). Response: Acknowledged. 6. DRC review is a prerequisite for Building Permit Review; additional comments may be forthcoming upon submittal of a Building Permit Application. Response: Acknowledged. 7. Provide wheel stops where parking stalls abut a sidewalk to prevent a parked vehicle from over hanging onto the pedestrian walkway. Response: Wheel stops are not needed. The minimum required width for the ADA accessible path is 3 ft. The proposed sidewalk adjacent the building is 6.7 ft so even with parked vehicles over hanging 2 ft onto the sidewalk there will be sufficient space available for pedestrians. 8. Provide slope of ADA ramp. ADA ramp shall comply with 2012 Florida Accessibility Code For Building Construction. Response: Acknowledged. 9. Install no left turn symbol (R3-2) sign at the bottom of stop sign per current MUTCD standards. Response: Please note that the proposed driveway connection has a left out and right out lanes. R3-2 sign is not required. 10. Truck tracks impact the circled parking stalls. Is this restaurant a 24 hour, 7 days a week business? If so vehicle(s) parked in the impacted parking stalls are unacceptable. Furthermore, the drive through operation will be impacted, if is a 24/7 a week operation. Response: Truck tracks will not run over parking stalls. Please see sheet TP-1 for revision. Stormwater Review Prior to Building Permit 1. Where are cross sections A-A and B-B located in plans? Prior to certificate of occupancy issuance, please submit a copy of the approved FDOT drainage connection permit. Response: Please see attached FDOT drainage connection permit exemption letter. 4. Please use City's rational method to calculate the required attenuation. Response: Please refer to drainage calculations. 5. The site is required to provide not only water quality but also quantity for attenuation. Response: Please refer to drainage calculations. 6. Please verify that there will be no adverse impacts to adjoining properties. Response: Please refer to drainage calculations. 7. Show roof drain collection system and direct to pond for treatment and attenuation. Response: Please refer to Paving Grading and Drainage sheet C-5.1. 8. Finished work at the existing driveway and any areas within the City's R-O-W shall not result in ponding issues. Temporary flooding of the restored area within the R-O-W may be needed for thorough inspection. Response: Acknowledged. 9.
