08/29/1988 TRUSTEES OF THE EMPLOYEES' PENSION FUND MEETING August 29, 1988 The City Commission, meeting as the Board of Trustees of the Employees Pension Fund, met in regular session at the City Hall, Monday, August 29, 1988, at 9:01 a.m., with the following members present: Rita Garvey Mayor/Commissioner James Berfield Vice-Mayor/Commissioner (arrived 9:05 a.m.) Lee Regulski Commissioner Don Winner Commissioner William Nunamaker Commissioner (arrived 9:10 a.m.) Also Present were: Joseph R. McFate Acting City Manager Milton A. Galbraith, Jr. City Attorney Shirley A. Corum Assistant City Clerk ITEM #2 - Minutes: Commissioner Regulski moved to approve the minutes of July 18 and August 15, 1988, meetings. Motion was duly seconded and carried unanimously. ITEM #3 - Request for Acceptance into Membership: The Acting City Manager presented the recommendation of the Advisory Committee to approve membership for thirteen (13) employees listed below: Name Classification Department Stephen Bigley Rec. Police Commissioner Regulski moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously. ITEM #4 - Request for acceptance into membership: The Acting City Manager presented the recommendation of the Advisory Committee to approve membership for one (1) employee listed below: Name Classification Department James L. McCulley, Jr. Tree Trimmer Parks & Rec. This employee was approved on August 15, 1988, under the name Joseph McCulley. He now must be approved under his correct name. Commissioner Winner moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously. ITEM #5 - Request for acceptance into membership: The Acting City Manager presented the recommendation of the Advisory Committee to approve membership for one (1) employee listed below: Name Classification Department Charles Kettell Police Officer Police This employee was reinstated as a Police Officer as a result of an Arbitrator's decision rendered in the appeal of his dismissal. Officer Kettell has agreed to pay back all pension monies he received at the time of his dismissal. On August 17, 1988, the Pension Advisory Committee unanimously reinstated him to the Pension Plan, effective October 19, 1981, with reasonable interest to be paid for the period he was not contributing to the plan. Commissioner Winner moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously. ITEM #6 - Request for job-connected disability pension: The Acting City Manager presented the recommendation of the Advisory Committee, General Employees' Pension Fund that the employees listed below be granted a job-connected disability pension under Section 26.35 of the Employees' Pension Plan. Danny Alley, Water Distribution Service Worker II, Water Division, effective November 7, 1987, in an amount to be computed at a later date. Dennis Babini, Police Officer, Police Department, effective at the expiration of his leave time, in an amount to be computed at a later date. Discussion ensued regarding the lack of medical documentation proving the injuries to be job related. The Personnel Director stated Danny Alley's knee injury occurred while employed. Commissioner Regulski moved to accept the recommendation of the Advisory Committee regarding Danny Alley. Motion was duly seconded and carried unanimously. Commissioner Regulski moved to accept the recommendation of the Advisory Committee regarding Dennis Babini. Motion was duly seconded and carried unanimously. ITEM #7 - Request for job-connected disability pension: The Acting City Manager presented the recommendation of the Advisory Committee, General Employees' Pension Fund that the employee listed below be granted a job-connected disability pension under Section 26.35 of the Employees' Pension Plan. John Welch, Police Officer, Police Department, effective April 16, 1986. Mr. Welch was granted a non-job-connected disability pension in 1987. At the same time, this was remanded to the Pension Advisory Committee (PAC) for determination as to whether or not the disability was job-connected. After approval by the PAC of a job-connected disability, the matter came before the Trustees in February for approval of the job-connected disability pension. At that time, the Trustees again remanded this back to the PAC with the request that Mr. Welch's doctor receive and review additional information submitted by the Internal Affairs Division of the Police Department. All the doctors reviewed the information and submitted letters to the PAC substantiating their earlier conclusion that Mr. Welch's condition is job-connected. On August 17, 1988, the PAC approved a job-connected disability pension for Mr. Welch, effective April 16, 1986. Commissioner Regulski moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously. ITEM #8 - Vesting of employee's pension: The Acting City Manager presented the recommendation of the Advisory Committee, General Employees' Pension Fund that the employee listed below be granted vesting of the Employee Retirement Pension under Section 26.49 of the Employees' Pension Plan as approved by the PAC Jacqueline Sulek, Assistant Purchasing Manager, Purchasing Division, effective July 18, 2002, in an amount to be calculated at a later date. Commissioner Regulski moved to accept the recommendation of the Advisory Committee. Motion was duly seconded and carried unanimously. ITEM #9 - Other Business: A question was raised regarding why the City's Pension Plan doesn't require retraining for other jobs in lieu of granting job-related disability pensions. The Personnel Director stated the 75% of salary is a powerful incentive for an employee to pursue a job-related disability pension. Staff is attempting to address the problem, however.
