06/13/2000BOARD OF ADJUSTMENT AND APPEAL ON BUILDING/FLOOD CONTROL MEETING CITY OF CLEARWATER June 13, 2000 Present: John H. Logan, Jr. Chair Edward H. Sullivan Board Reporter The meeting was called to order at 2:00 p.m. at the Municipal Services Building. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. ITEM #1 – Approval of Minutes Member Nall moved to approve the minutes of the regular meeting of April 12, 2000, as recorded and submitted in written summation to each board member. The motion was duly seconded and carried unanimously. ITEM #2 – Continued Requests – None. ITEM #3 – New Requests a) 633-637 Woodlawn Street, Roger Crane, Owner. To request an extension of time to raze or repair structure. Time needed to obtain architect drawings and repair work. Located at Lot 3, less south 50 feet and less north 77.61 feet of the west 10 feet of P.C. Well’s Sub Parcel 21-29-15-95922-000-0030. Building Construction Inspector Bill Wright distributed photograph sheets from the Unsafe Structure Report, dated December 2, 1999. Problems included roof leaks, deteriorated roofing system, broken concrete on floor, broken lock system, open windows, broken doors and garage door, deteriorated sanitary facilities, falling ceilings, missing parts of walls, missing and open doors, windows boarded with roof nails, exposed wiring, deteriorated rest room building, significant amounts of trash, debris, broken glass, and overgrown landscaping. Roger Crane, owner, said he has removed approximately 4 tons of trash, debris, and broken glass, the part of the roof that was collapsing, and part of a wall. He said although new wiring had been installed, some of the old wires remain. He said he has installed new front windows and secured the building. He said the site originally had 3 buildings with separate addresses and meters. Mr. Wright said all work on the building must be permitted and done by a contractor. The building is not secure according to City specifications. The site has been nonconforming for years and currently is zoned single-family residential. He said a commercial use cannot be permitted if the cost of bringing the structure up to code is more than 50% of the building’s assessed value. All portions of the structure must meet current Code. The appraised value of the structure is $24,200, allowing only $12,100 in repairs Alan Kay, representative, reviewed the structure’s history, indicating it had served as a train station in the 1920s and was constructed with stucco covering hollow tiles. He said it can be repaired. He suggested the site could serve as a medical clinic or ACLF (Assisted Care Living Facility) for the community. He noted many nearby nonresidential uses. He said the property was in terrible shape when Mr. Crane purchased in April 2000. Mr. Wright said Mr. Crane had been advised of the structure’s unsafe rating during his 3 visits to the City prior to the purchase. In response to a question, Mr. Kay said Mr. Crane had not gotten a permit to perform work due to a delay in obtaining the survey. Discussion ensued regarding options. Mr. Wright said the Police Department has responded to calls related to vagrants on the property. It was felt repair costs would be significant. It was recommended time be granted for the property owner to determine a feasible action. It was suggested the board grant a 60-day extension to apply for permits for a residential use. Mr. Wright said the commercial use would have been grandfathered if the structure met current code, including parking, ADA (Americans with Disabilities Act) regulations, and landscaping. Residential use requires indoor bathrooms and a kitchen. Member Walker moved to grant a 60-day extension from June 14, 2000 to August 13, 2000 for Roger Crane to obtain building permits to either repair or raze the structures at 633-637 Woodlawn Street to meet Section 47.161 City Code of Ordinances regarding unsafe buildings. The motion was duly seconded and carried unanimously. ITEM #4 – Pending Matters – None. ITEM #6 - Adjournment The meeting adjourned at 2:55 p.m.
