01/13/1999BOARD OF ADJUSTMENT AND APPEAL ON BUILDING/FLOOD CONTROL MEETING CITY OF CLEARWATER January 13, 1999 Present: John H. Logan, Jr. Chair Edward H. Corcoran Board Member Carroll Nall, Jr. Board Member Also Present: Kevin Garriott Building Official Brenda Moses Board Reporter The Chair called the meeting to order at 2:06 p.m. at the Municipal Services Building. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. ITEM A - Approval of Minutes Member Shah moved to approve the minutes of the regular meeting of August 12, 1998, as recorded and submitted in written summation to each board member. The motion was duly seconded and carried unanimously. The meeting recessed from 2:07 to 2:25 p.m. ITEM B - Continued Requests - None. ITEM C - New Requests C1) 124 Brightwater Drive, Clearwater, Florida, Viking Motel/Clearwater Beach, Inc., Owner; Patrick T. Maguire, Representative. To request a variance to the requirements of Chapter 39 of the Clearwater Code of Ordinances for an 18 foot setback where no construction is allowed. Parcel #08-29-15-04932-000-0520 This request for a 12.4 foot variance is to allow a pool equipment storage building to be constructed 5.6 feet from Clearwater Harbor where 18 feet is required. Patrick T. Maguire, representative, said in 1994, DCAB (Development Code Adjustment Board) had approved the requested variance, subject to approval of a variance by BAABF (Board of Adjustment & Appeal on Building/Flood Control). In response to a question, it was stated BAABF will review the request to build within the setback and near seawall tiebacks. In response to a question, Viking Motel Manager Willie Besler said although they are not visible, he knows the location of the seawall tiebacks, stating they will be easily accessible after the 48 square foot storage unit is built. In response to a question, Building Official Kevin Garriott predicted no accessibility problems related to the seawall tiebacks after the addition of the storage unit provided the unit is built to the enclosed detail raised above grade with foundation piers to make the unit somewhat movable. One person spoke in favor of the variance. Member Nall moved to approve a variance to the requirements of Chapter 39 of the City Code of Ordinances for a structure to be located at 124 Brightwater Drive with a condition: construction shall use wood floor framing system and be anchored by tie-downs in lieu of a poured concrete slab. The motion was duly seconded and carried unanimously. ITEM D - Pending Matters - None. ITEM E - Adjournment The meeting adjourned at 2:35 p.m.
