08/13/1997BOARD OF ADJUSTMENT AND APPEAL ON BUILDING/FLOOD CONTROL MEETING CITY OF CLEARWATER August 13, 1997 Present: John H. Logan, Jr. Chair Edward H. Sullivan Board Reporter Absent: Carroll Nall, Jr. Board Member The Chair called the meeting to order at 2:07 p.m. at City Hall. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. ITEM #1 - Approval of Minutes Member Shah moved to approve the minutes of the regular meetings of July 9, 1997, as recorded and submitted in written summation to each board member. The motion was duly seconded and carried unanimously. ITEM #2 - Continued Requests - None. ITEM #3 - New Requests a) 603 Cedar Street, Clearwater, Florida; Bobcat of Tampa Bay, Inc., Owner; Patrick Enruquez, Representative Applicant requires additional time to comply to unsafe building code, Section 47.161 City Code of Ordinances. Located at Ira E. Nicholson’s Sub, Blk 2, Lot 1 less W 75 feet, MOL The applicant requested additional time to hire a contractor and begin rehabilitation work on the property. The applicant reported difficulty in finding a competent contractor, noting unsatisfactory bids had been received from 2 contractors. Robert Fernandez said his company now owns the property. He stated all required permits have been pulled. In response to a question, he said he intended to refurbish the structure and bring it up to code. Building Construction Inspector Bill Wright distributed photograph sheets from the Unsafe Structure Report. He said a contractor had pulled the permits on August 5, 1997. The building was cited as an unsafe structure in February 1997. Mr. Fernandez said he recently became aware of that citation. He requested as much time as possible to repair the building. Mr. Wright noted a building can be boarded up for a maximum of 30 days. He indicated the City is willing to work with the property owner as long as steady progress on repairs is evident. The City wants the property removed from the unsafe structure list. Member Shah moved to approve a 60-day extension for the structure at 603 Cedar Street to meet Section 47.161 City Code of Ordinances regarding unsafe buildings. The motion was duly seconded and carried unanimously. b) 1609 N. Ft. Harrison Avenue, Clearwater, Florida, Todd Kugler/Multimedia, Owner Applicant requires additional time to comply to unsafe building code, Section 47.161 City Code of Ordinances. Located at Leslie Sub, E.A. Marshall’s Sub, Lot 14 The applicant indicated he needs more time to get work done, to raise funds, and to hire a contractor. He indicated he was out of town for most of the 7-day grace period. Todd Kugler, an owner of Multimedia, said the residential structure is zoned commercial. Due to that zoning, he indicated a contractor must pull the required permits. He said he is selling the property to Robert Troisi, with closing expected this week. Mr. Troisi indicated he plans to rent the structure for small business use. He noted major damage to the structure’s back porch needs to be repaired. In response to a question, Mr. Wright said an extension is attached to the property, not the owner. He distributed photograph sheets from the Unsafe Structure Report. Mr. Troisi said he intends to make required repairs within 60 days. If the structure is to be used for a business, it was noted paved parking will be required and the structure also must meet ADA (Americans with Disabilities) regulations. In response to a question, Central Permitting Supervisor Kevin Garriott stated it would not be necessary to comply with commercial requirements if the structure is repaired as a residence. Mr. Wright said the commercial zoning would not be converted to residential if this is done. He reported an asbestos survey is required for all properties zoned commercial when walls are disturbed. Mr. Garriott recommended Mr. Troisi visit the Central Permitting Department for advice. Member Walker moved to approve a 60-day extension for the structure at 1609 North Ft. Harrison Avenue to meet Section 47.161 City Code of Ordinances regarding unsafe buildings. The motion was duly seconded and carried unanimously.
