BASIS OF APPEAL
On April 9, 1999, Applicant, Carlisle Motors, Inc., filed an Application for Site Plan
Approval for new signage at its Lincoln-Mercury dealership located at 2085 Gulf-to-Bay
Boulevard comprising 11.03 acres in Clearwater. The new signs are proposed for installation as
part of a renovation project on the dealership property which includes construction of a new
59,200 square foot building which will house its showroom, administrative offices and service
department. Another 28,000 square foot building will house the body shop. Applicant has
existing signage on the property with square footage in accordance with previously approved
vanances.
The Applicant's sign permit application sought approval of five freestanding signs and six
wall flush signs. The new signage requested in the sign permit application is essential to allow the
dealership's existing and potential customers to locate the dealership and the various buildings and
services housed on the property. Applicant sought consideration of the application under the
Comprehensive Sign Program as provided in Section 3-1807 ofthe City of Clearwater
Community Development Code. By letter dated April 21, 1999, the entire application was
denied.
The intent of the City of Clearwater's sign regulations is to enhance the urban
environment and promote the continued well-being of the City. The express purpose of the sign
regulations stated in the Community Development Code, is to reduce the number of signs to "the
minimum reasonably necessary to identify a...business location and nature of any such

business," to "Establish sign size in relationship to the scale of the lot and building on
which the sign is to be placed or to which it pertains," and to "Preserve and enhance the
natural and scenic characteristics" of the City of Clearwater.
In recognition of the many circumstances in which there may be innovative and creative
alternatives to minimum standard signage which are desirable, attractive and will enhance
community character and individual property values, the Community Development Code includes
a Comprehensive Sign Program which is intended to provide an alternative to minimum standard
signage and allow private property owners and businesses with flexibility to develop innovative,
creative and effective signage and to improve the aesthetics of the City of Clearwater. Applicant
believes that it complies with the general intent and purposes ofthe Comprehensive Sign Program
and should therefore be allowed to deviate from minimum sign standards. Applicant is required
to utilize signage provided by a specific manufacturer. This manufacturer provides only
five specific sign sizes. If Applicant is unable to obtain approval for the signs as requested, next
smaller size signs would be significantly smaller and would be inadequate given the size of
Applicant's lot and building(s). The signs requested in the permit application are the minimum
number necessary to identify the business.

On April 9, 1999, the applicant's representative submitted an application for a comprehensive sign
program. The application contained blueprints for the following signs:

The Planning staff gave Carlisle Lincoln Mercury the option of either complying with the sign
regulations of the Community Development Code or of complying with previously approved variances
for signs that were granted to Carlisle Motors in 1992 and in 1996.
Pursuant to Section 3-1806 B of the Community Development Code, Carlisle Motors is permitted to
have one freestanding sign of 64 square feet per sign face and one attached sign of 24 square feet.
By utilizing the Comprehensive sign program, Carlisle Motors may double the square footage of both
the attached and the freestanding signs. Thus, they may have 128 square feet per sign face of

freestanding signage and 48 square feet of attached signage. Under the comprehensive sign program,
Carlisle may also increase the number of signs permitted and reduce the required 10 foot front setback.
The square footage of attached signage proposed by Carlisle Lincoln Mercury is nearly 10 times the
amount allowed: 48 square feet allowed vs. 453.7 square feet proposed. The proposed freestanding
signage exceeds the maximum square footage permitted by the Code by 34 square feet: 128 square feet
allowed verses 162.92 square feet proposed. Therefore, the comprehensive sign program proposal did
not comply with the Community Development Code and was denied by the Planning staff.
Carlisle Lincoln Mercury was granted two variances to increase the square footage of their signage.
Pursuant to the transitional rules enumerated in Section 1-106 of the Community Development Code,
the variances are still in effect. Therefore, Carlisle is entitled to directional signs for 'parking of 16
square feet, for 'service' of 16 square feet, for 'paint/body' of32 square feet and for 'entrance' of 10
square feet (3/7/96 minutes of the City Commission meeting, attached). Based on another variance
granted on 12/3/92 (minutes attached), Carlisle is also entitled to a freestanding sign of73 square feet,
20 feet high. The 1992 sign code also allowed Carlisle to construct an auxiliary sign of32 square feet,
10 feet in height due to the length of their street frontage.
The comprehensive sign program proposal does not comply with the variances. Carlisle could reduce
the 'Carlisle Used Cars Lincoln Mercury' sign from 77.85 square feet and 21.9 feet in height to 73
square feet and 20 feet in height and comply with the variance approval. They could also reduce the
two directional signs. The 'Carlisle Service' sign must be reduced from 21.9 square feet to 16 square
feet. Assuming the sign with the unidentified message is a directional sign, it must be either 16 square
feet or 32 square feet. Carlisle would then have to bring the attached signs into compliance with the
Community Development Code because no variances were granted for attached signage.
AUTHORITY OF THE COMMUNITY DEVELOPMENT BOARD TO HEAR APPEALS:
The Community Development Board has the authority to hear appeals from orders, requirements,
decisions or determinations made by an administrative official in the administration of the Community
Development Code pursuant to Section 4-501 A. 2. of the Code. In this case, the decision by an
official was the April 21, 1999, letter from Antonia Gerli, Development Review Manager, to the
appellant's representative, Susan Johnson-Velez denying the application for the comprehensive sign
program.
Pursuant to Section 4-504 C. of the Community Development Code, in order to grant the appeal or
overturn or modify the decision being appealed, the Board must find:
That the decision appealed from misconstrued or incorrectly interpreted the provisions of the
Development Code;
That the decision will be in harmony with the general intent and purpose of the Development
Code; and
Will not be detrimental to the public health, safety and general welfare.
RECOMMENDATION:
Based on the above-referenced information, the Planning staff recommends that the Community
Development Board uphold the denial of the application for approval of a comprehensive sign program
for Carlisle Lincoln Mercury.

Dear Mr. Lawson:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On November 14, 2002, the Development Review Committee reviewed your
application for Flexible Standard Development approval to reduce the front (west) setback along
US Highway 19 North from 25 feet to 15 feet to pavement, as part of a Comprehensive Infill
Redevelopment Project under the provisions of Section 2-703. The proposal is to add an
additional showroom and a body shop building to the site. The buildings and site improvements are
for Dimmitt Rolls Royce - Bentley, including the outdoor and indoor display and sales of vehicles.
The Development Review Committee (DRC) APPROVED the application with the following bases
and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-703.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other redevelopment
efforts.
Conditions of Approval:
1. The outdoor vehicle display shall not encroach into any customer or employee parking space,
drive aisles or green space area and be confined to the westernmost parking area and new
circular parking pads;
2. That the on-loading or off-loading of vehicles from any transport vehicle occur on-site and
not within any abutting right-of-way;

3. That no building permit be issued until the existing billboard is removed and compliance is
achieved with all applicable sign ordinances;
4. That signage meet Code and be architecturally integrated into the design of the site and
building;
5. That the SWFWMD letter be submitted to the engineering department removing the City of
Clearwater as co-applicant on the 3rd Avenue permit;
6. That the stormwater treatment and attenuation required for additional parking utilizing
Florida Power ROW south of proposed showroom be resolved prior to CO;
7. That the design of the buildings be consistent with the conceptual elevations submitted to, or
as modified by the DRC, and that color of the buildings be similar to the submitted color
schemes; and
8. That no outdoor loud speaker/public address or phone ringer system be permitted.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Standard Development approval (July 11, 2004). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Coordinator may grant an extension
oftime for a period not to exceed one year and only within the original period of validity.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.

the site.
Site plan, when certified will be subject to the following:
1. The requisite permits for the project shall be obtained within one (1) year of the date of
certification of the site plan to prevent expiration of the site plan,
2. The requisite certificate(s) of occupancy shall be obtained for the project within three
(3) years from the date of certification of the site plan, and
3. Review of signs, fences and walls is subject to separate review and permitting
procedures.

Prior to certification of the site plan,
1. Show on the site plan the installation and maintenance of uniform traffic control
devices at appropriate locations in accordance with the standards set forth by the
Manual on Uniform Traffic Control Devices as adopted by the F.D.O.T. under Rule

2. Adjust handicap spaces to meet governmental standards with the correct handicap signs,
3. Adjust parking stalls and/or driveways on the plan to the satisfaction of the Traffic
Engineer,

Dear Antonia:
Enclosed please find an application for site plan approval for signage at the Carlisle
Lincoln Mercury car dealership located at 2085 Gulf-to-Bay Boulevard in Clearwater. As we
have discussed, we would like this application to be considered under the Comprehensive Sign
Program pursuant to Section 3-1807 of the City of Clearwater Community Development Code.
We believe that our proposed signage is consistent with the general principles of this program in
that it will provide creative and effective signage consistent with the size of our lot and buildings,
and will greatly improve the athstetics of the City of Clearwater generally and this portion of
Gulf-to-Bay Boulevard specifically. In addition, our proposed signs will have an overall positive
impact on the community character and quality of life of the City of Clearwater. Approval of this
application will result in the elimination of existing signage and an improvement to the appearance
of our parcel in comparison to signs which would otherwise be permitted under the minimum sign
standards.

On April 9, 1999, the applicant's representative submitted an application for a comprehensive sign
program. The application contained blueprints for the following signs:

The Planning staff gave Carlisle Lincoln Mercury the option of either complying with the sign
regulations of the Community Development Code or of complying with previously approved variances
for signs that were granted to Carlisle Motors in 1992 and in 1996.
Pursuant to Section 3-1806 B of the Community Development Code, Carlisle Motors is permitted to
have one freestanding sign of 64 square feet per sign face and one attached sign of 24 square feet.

By utilizing the Comprehensive sign program, Carlisle Motors may double the square footage of both
the attached and the freestanding signs. Thus, they may have 128 squarefeet per sign face of
freestanding signage and 48 square feet of attached signage. Under the comprehensive sign program,
Carlisle may also increase the number of signs permitted and reduce the required 10 foot front
setback.
The square footage of attached signage proposed by Carlisle Lincoln Mercury is nearly 10 times the
amount allowed: 48 square feet allowed vs. 453.7 square feet proposed. The proposed freestanding
signage exceeds the maximum square footage permitted by the Code by 34 square feet: 128 square
feet allowed verses 162.92 square feet proposed. Therefore, the comprehensive sign program
proposal did not comply with the Community Development Code and was denied by the Planning
staff.
Carlisle Lincoln Mercury was granted two variances to increase the square footage of their signage.
Pursuant to the transitional rules enumerated in Section 1-106 of the Community Development Code,
the variances are still in effect. Therefore, Carlisle is entitled to directional signs for 'parking of 16
square feet, for 'service' of 16 square feet, for 'paint/body' of 32 square feet and for 'entrance' of 10
square feet (3/7/96 minutes of the City Commission meeting, attached). Based on another variance
granted on 12/3/92 (minutes attached), Carlisle is also entitled to a freestanding sign of73 square
feet, 20 feet high. The 1992 sign code also allowed Carlisle to construct an auxiliary sign of 32
square feet, 10 feet in height due to the length of their street frontage.
The comprehensive sign program proposal does not comply with the variances. Carlisle could reduce
the 'Carlisle Used Cars Lincoln Mercury' sign from 77.85 square feet and 21.9 feet in height to 73
square feet and 20 feet in height and comply with the variance approval. They could also reduce the
two directional signs. The 'Carlisle Service' sign must be reduced from 21.9 square feet to 16
square feet. Assuming the sign with the unidentified message is a directional sign, it must be either
16 square feet or 32 square feet. Carlisle would then have to bring the attached signs into compliance
with the Community Development Code because no variances were granted for attached signage.
AUTHORITY OF THE COMMUNITY DEVELOPMENT BOARD TO HEAR APPEALS:
The Community Development Board has the authority to hear appeals from orders, requirements,
decisions or determinations made by an administrative official in the administration of the
Community Development Code pursuant to Section 4-501 A. 2. of the Code. In this case, the
decision by an official was the April 21, 1999, letter from Antonia Gerli, Development Review
Manager, to the appellant's representative, Susan Johnson-Velez denying the application for the
comprehensive sign program.
Pursuant to Section 4-504 C. of the Community Development Code, in order to grant the appeal or
overturn or modify the decision being appealed, the Board must find:
That the decision appealed from misconstrued or incorrectly interpreted the provisions of the
Development Code;
That the decision will be in harmony with the general intent and purpose of the Development
Code; and
Will not be detrimental to the public health, safety and general welfare.

Based on the above-referenced infonnation, the Planning staff recommends that the Community
Development Board uphold the denial of the application for approval of a comprehensive sign
program for Carlisle Lincoln Mercury.

BASIS OF APPEAL
On April 9, 1999, Applicant, Carlisle Motors, Inc., filed an Application for Site Plan
Approval for new signage at its Lincoln-Mercury dealership located at 2085 Gulf-to-Bay
Boulevard comprising 11.03 acres in Clearwater. The new signs are proposed for installation as
part of a renovation project on the dealership property which includes construction of a new
59,200 square foot building which will house its showroom, administrative offices and service
department. Another 28,000 square foot building will house the body shop. Applicant has
existing signage on the property with square footage in accordance with previously approved
vanances.
The Applicant's sign permit application sought approval of five freestanding signs and six
wall flush signs. The new signage requested in the sign permit application is essential to allow the
dealership's existing and potential customers to locate the dealership and the various buildings and
services housed on the property. Applicant sought consideration of the application under the
Comprehensive Sign Program as provided in Section 3-1807 of the City of Clearwater
Community Development Code. By letter dated April 21, 1999, the entire application was
denied.
The intent of the City of Clearwater's sign regulations is to enhance the urban
environment and promote the continued well-being of the City. The express purpose of the sign
regulations stated in the Community Development Code, is to reduce the number of signs to "the
minimum reasonably necessary to identify a...business location and nature of any such

business," to "Establish sign size in relationship to the scale of the lot and building on
which the sign is to be placed or to which it pertains," and to "Preserve and enhance the
natural and scenic characteristics" ofthe City of Clearwater.
In recognition of the many circumstances in which there may be innovative and creative
alternatives to minimum standard signage which are desirable, attractive and will enhance
community character and individual property values, the Community Development Code includes
a Comprehensive Sign Program which is intended to provide an alternative to minimum standard
signage and allow private property owners and businesses with flexibility to develop innovative,
creative and effective signage and to improve the aesthetics of the City of Clearwater. Applicant
believes that it complies with the general intent and purposes of the Comprehensive Sign Program
and should therefore be allowed to deviate from minimum sign standards. Applicant is required
to utilize signage provided by a specific manufacturer. This manufacturer provides only
five specific sign sizes. If Applicant is unable to obtain approval for the signs as requested, next
smaller size signs would be significantly smaller and would be inadequate given the size of
Applicant's lot and building(s). The signs requested in the permit application are the minimum
number necessary to identify the business.

BASIS OF APPEAL
On April 9, 1999, Applicant, Carlisle Motors, Inc., filed an Application for Site Plan
Approval for new signage at its Lincoln-Mercury dealership located at 2085 Gulf-ta-Bay
Boulevard comprising 11.03 acres in Clearwater. The new signs are proposed for installation as
part of a renovation project on the dealership property which includes construction of a new
59,200 square foot building which will house its showroom, administrative offices and service
department. Another 28,000 square foot building will house the body shop. Applicant has
existing signage on the property with square footage in accordance with previously approved
vanances.
The Applicant's sign permit application sought approval of five freestanding signs and six
wall flush signs. The new signage requested in the sign pennit application is essential to allow the
dealership's existing and potential customers to locate the dealership and the various buildings and
services housed on the property. Applicant sought consideration of the application under the
Comprehensive Sign Program as provided in Section 3-1807 of the City of Clearwater
Community Development Code. By letter dated April 21, 1999, the entire application was
denied.
The intent of the City of Clearwater's sign regulations is to enhance the urban
environment and promote the continued well-being of the City. The express purpose of the sign
regulations stated in the Community Development Code. is to reduce the nwnber of signs to "the
minimum reasonably necessary to identify a...business location aDd nature of any such

busines~. II to "Establish sign size in relationship to the scale of the lot and building OD
whkh the sign is to be placed or to which it pertains," and to "Preserve and enhance the
natural and scenic characteristics" of the City of Clearv.rater.
In recognition of the many circumstances in which there may be innovative and creative
alternatives to minimum standard signage which are desirable, attractive and will enhance
community character and individual property values, the Community Development Code includes
a Comprehensive Sign Program which is intended to provide an altemative to minimum standard
signage and allow private property OWneIl> and businesses with flexibility to develop innovative,
creative and effective signage and to improve the aesthetics of the City of Clearwater. Applicant
believes that it complies with the general intent and purposes of the Comprehensive Sign Program
and should therefore be allowed to deviate from minimum sign standards. Applicant is required
to utilize signage provided by a specific manufacturer. This manufacturer provides only
five specifio sign sizes. If Applicant is unable to obtain approval for the signs as requ.esred, next
smaller size signs would be significantly smaller and would be inadequate given the size of
Applicant's lot and building(s). The signs requested in the permit application are the minimum
number necessary to identify the business.

Dear Ms. Johnson-Velez:
As we discussed this afternoon, Carlisle Lincoln Mercury is permitted to have 265 square feet of total
signage for the property located at _Gulf to Bay Boulevard. The signage may be any combination of
attached and freestanding signage provided that the number of freestanding signs does not exceed four.
This determination is in accordance with the previous Land Development Code and the variance for
freestanding signs approved by the _-Board on _ date. The height for the freestanding signs
shall not exceed _ feet in accordance with the previously approved variance.
Directional signs of less than four square feet are not included in the 265 square feet of signage.
The directional sign on Bamboo Street may be comprised of either a one-sided eight square foot sign or a
two-sided sign of four square feet per sign face.
All freestanding signs must be installed in a landscaped area of not less than 12 square feet. The code
does not specify the type of landscaping that must be provided so you may choose any type of vegetation.
Sod, however, is not considered landscape material.

Status of Carlyle Lincoln Motors Appeal
At the May 18, 1999, meeting of the Community Development Board, Carlyle
Lincoln Motors requested an appeal of a decision of the Community Development
Coordinator regarding a Comprehensive Sign Program. The Board requested that the
Planning staff meet with representatives of Carlyle to discuss alternatives to possibly
resolve the outstanding issues. On June 2, 1999, I met with Carlyle's legal counsel
and the Carlyle management team along with Cyndi Hardin and Antonia Gerli. Several
options were discussed and Carlyle and the staff are exploring these options to
possibly develop a solution. Although we cannot at this time confirm a resolution, we
have a second meeting scheduled with Carlyle for Friday, June 11 to discuss the
options. We will update you at the Community Development Board meeting on June
15. Thank you.

On April 9, 1999, the applicant's representative submitted an application for a comprehensive sign

The Planning staff gave Carlisle Lincoln Mercury the option of either complying with the sign
regulations of the Community Development Code or of complying with previously approved variances
for signs that were granted to Carlisle Motors in 1992 and in 1996.
Pursuant to Section 3-1806 B of the Community Development Code, Carlisle Motors is permitted to
have one freestanding sign of 64 square feet per sign face and one attached sign of 24 square feet.

By utilizing the Comprehensive sign program, Carlisle Motors may double the square footage of both
the attached and the freestanding signs. Thus, they may have 128 square feet per sign face of
freestanding signage and 48 square feet of attached signage. Under the comprehensive sign program,
Carlisle may also increase the number of signs permitted and reduce the required 10 foot front
setback.
The square footage of attached signage proposed by Carlisle Lincoln Mercury is nearly 10 times the
amount allowed: 48 square feet allowed vs. 453.7 square feet proposed. The proposed freestanding
signage exceeds the maximum square footage permitted by the Code by 34 square feet: 128 square
feet allowed verses 162.92 square feet proposed. Therefore, the comprehensive sign program
proposal did not comply with the Community Development Code and was denied by the Planning
staff.
Carlisle Lincoln Mercury was granted two variances to increase the square footage of their signage.
Pursuant to the transitional rules enumerated in Section 1-106 of the Community Development Code,
the variances are still in effect. Therefore, Carlisle is entitled to directional signs for 'parking of 16
square feet, for' service' of 16 square feet, for 'paint/body' of 32 square feet and for 'entrance' of 10
square feet (3/7/96 minutes of the City Commission meeting, attached). Based on another variance
granted on 12/3/92 (minutes attached), Carlisle is also entitled to a freestanding sign of 73 square
feet, 20 feet high. The 1992 sign code also allowed Carlisle to construct an auxiliary sign of32
square feet, 10 feet in height due to the length oftheir street frontage.
The comprehensive sign program proposal does not comply with the variances. Carlisle could reduce
the 'Carlisle Used Cars Lincoln Mercury' sign from 77.85 square feet and 21.9 feet in height to 73
square feet and 20 feet in height and comply with the variance approval. They could also reduce the
two directional signs. The 'Carlisle Service' sign must be reduced from 21.9 square feet to 16
square feet. Assuming the sign with the unidentified message is a directional sign, it must be either
16 square feet or 32 square feet. Carlisle would then have to bring the attached signs into compliance
with the Community Development Code because no variances were granted for attached signage.
AUTHORITY OF THE COMMUNITY DEVELOPMENT BOARD TO HEAR APPEALS:
The Community Development Board has the authority to hear appeals from orders, requirements,
decisions or determinations made by an administrative official in the administration of the
Community Development Code pursuant to Section 4-501 A. 2. of the Code. In this case, the
decision by an official was the April 21, 1999, letter from Antonia Gerli, Development Review
Manager, to the appellant's representative, Susan Johnson-Velez denying the application for the
comprehensive sign program.
Pursuant to Section 4-504 C. of the Community Development Code, in order to grant the appeal or
overturn or modify the decision being appealed, the Board must find:
That the decision appealed from misconstrued or incorrectly interpreted the provisions of the
Development Code;
That the decision will be in harmony with the general intent and purpose of the Development
Code; and
Will not be detrimental to the public health, safety and general welfare.

RECOMMENDATION:
Based on the above-referenced information, the Planning staff recommends that the Community
Development Board uphold the denial of the application for approval of a comprehensive sign
program for Carlisle Lincoln Mercury.

The neighborhood Is frustrated problems with this issue continue. He said the memorial
has driven a racial wedge between neighbors and claimed the child's parents continue to
deal drugs. He indicated plans to join the North Greenwood Association to address this
issue further.
Commissioner Berfield recommended more enforcement in the neighborhood. The
City Manager said she would review this situation with the Police Chief. Mr. Baier said
staff Is reviewing all alleys in Plaza Park and will come forward in two weeks with
recommendations regarding vacation. Commissioner Thomas said for three year. he has
heard concerns expressed about activities at a specific house. He questioned how this
could be an ongoing problem if the Police are aware of it. Commissioner Clark requested
appropriate staff attend the March North Greenwood Community meeting. He noted the
majority of the neighborhood has been cleaned up and questioned why one problem house
remains as the root of neighborhood adversity.
~l Paoaleo referred to Babe Ruth Baseball and girls' softball. He said the
organization is trying to get fields to play but were advised all City fields have been
allocated to Little League. He said the Babe Ruth Leagues accept players from age 5
through 18. He said the program keeps children off the street and is one of the largest
youth organizations in the country. The Mayor said the City has no fields open at this time
but will work with the organization.<,. - -

The applicant requests area variances of 16, 12, 12, and 28 square feet for four
directional signs. The subject property, on the South side of Gulf-to-Bay Boulevard at ,
Bamboo Lane, is zoned General Commercial, Multiple-Family Residential "Eight," and
Single-Family Residential "Eight." The sign code allows directional signs up to four square
feet in area, per sign. The automobile dealership has four nonconforming directional signs
with areas of 20, 16, 16, and 32 square feet. The applicant is requesting variances to
allow the signs to remain without reducing the sizes.
Staff feels existing conditions support variance approval for three of the signs. The
"Parking," "Service," and "Paint/Body" signs are interior to the property and produce a
nominal effect on Clearwater's aesthetic environment as viewed from City streets and
sidewalks. The "Entrance" sign, adjacent to Gulf-to-Bay Boulevard with unobstructed
visibility, impinges upon the aesthetic interests of the City and may affect City safety
interests. With few exceptions, signs marking driveway entrances in the City adhere to
the four square foot code limit. The request is for a sign five times greater than permitted
by Code. The request is not minimum but represents a wholesale departure from code.

Dan Carlisle, representative of Carlisle Lincoln Mercury, verified photographs of the
property presented him by Mr. Shuford. Mr. Carlisle said the Entrance sign is needed due
to high traffic speeds on Gulf-to-Bay Boulevard and the difficulty for elderly customers to
locate the entrance. The signs are only directional and do not feature logos or advertising.
He suggested for safety, the sign's size be scaled to the lot's size. He felt the requested
variance met City standards as they were not based on a desire for economic gain nor are
they detrimental to public welfare.
Commissioner Johnson said he is a frequent visitor and has had no problem locating
the business' entrance. Commissioner Thomas felt the entrance sign is most important
and noted the property's large size. He said sign pollution has been reduced in the City
and felt it was critical for Gulf-to-Bay Boulevard businesses to have signage visible to the
public. He supported the variances as requested.
Commissioner Thomas moved to approve area variances of 12, 12, 28, and 16
square feet from the 4 square feet permitted to allow "Parking," "Service," "PaintlBodyW
and "EntranceW directional signs with areas of 16, 16, 32, and 20 square feet,
respectively, on property identified as Bamboo Sub Replat, Lots 1 and 2, together with
Sec. 13-29-15, M&B 42.01 and 41.04, along with Bamboo Sub, Lots 2, 3, 8, 9, 10, ",
and 12 for meeting Sec. 45.24 Standards for Approval, items (1) - (4). The motion was
duly seconded.
Commissioner Clark felt the entrance sign is most critical and the requested
variance is relatively small. Mayor Garvey said the entrance sign should be smaller and the
service sign lower. She expressed concern other businesses will request similar variances
if this one is approved. Commissioner Thomas noted some of the elderly population
Carlisle serves have vision problems. Commissioner Clark felt denying the entrance sign
variance would be detrimental to the public welfare. Commissioner Berfield suggested
decreasing the entrance sign's size but maintaining its height. Mr. Shuford said the
business can work with City Engineering to make the entrance more visible. Commissioner
Berfield questioned if Mr. Carlisle would reduce the sign's size if he could retain the he~ght.
Mr. Carlisle said he could replace the sign with one 10 square feet in size.
Commissioner Thomas amended his motion to approve area variances of 12, 12,
28, and 6 square feet from the 4 square feet permitted to allow "Parking,. .Servlce,.
"PaintJ8ody" and "EntranceW directional signs with areas of 16, 16,32, and 10 square
feet, respectively, on property identified as Bamboo Sub Replat, Lots 1 and 2, together
with Sec. 13-29-15, M&B 42.01 and 41.04, along with Bamboo Sub, Lots 2, 3, 8, 9, 10,
11, and 12 for meeting Sec. 45.24 Standards for Approval, items (1) - (4). The seconder
agreed.
Upon the vote being taken, the amended motion carried unanimously.
Mr. Carlisle said the code is hard to understand and recommended making it clearer.

Commissioner Deegan moved to grant the square footage variance for the main
freestanding sign wilh all other reGuests being withdrawn. The motion was duly
seconded.
It was stated thOlt the mOlion was being made not as a argument for changing the
Code but as it was felt there was a good reason for the variance.

Staff review of the business licenses associated with this site indicates attached
signs containing up to 64 sq. ft. each are permitted for twO businesses on the site; one
attached sign allocation for the dealership and one for the parts sales building. The total
attached signage requested by the applicant is 162 sq.ft. which is considerably over the
maximum of 128 sq.ft. allowed by Code. While the property consists of several separate
buildings, there are no exceptional setbacks for the main buildings to warrant granting the
request: in fact, one building is closer to GulHo.8ay than is currently permitted. Staff
leel~ the site can be adequately identified with conforming signage.
While the applicant's proposal would bring signage on this site into substantially
greater compliance thall is currently the case, there is nothing unique about the property to
warrant granting tho requested variances. The subject property is indeed a relatively large
parcel for the General Commercial zoning district, however. the sign regulations take into
account the existence of such large parcels through the allowance of auxiliary freestanding
signs. Staff also feels the entrance to the property can be adequately identified with
conforming 4 sQ.ft. directIOnal signs.
Staff feels the applicant has not met the following standards for approval: 11 The
variance requested arises from a condition which is unique to the property in question and
is neithtll ordinarily or uniformly applicable to the zoning district nor created by an action
or actions of the property owner, predecessor in title, or the applicant. Any mistake made
in the execution of a building permit or work performed without the benefit of a permit
shall not be considered to be s,t~hOllS which support the granting of a variance; 21 The
particular physical surroundings, Shape or topographical conditions of the property involved
and the strict application of the prOVISIonS of this development code would result in an
unnecessary hardship upon the applicant; 31 The variance is the minimum necessary to

Mr. Carlisle indicated that under his franchise agreement with Ford Motor Company.
he must install signs in accordance with their standards. He stated he cannot get. \
smaller sign. He also Questioned where in the Code directional signs are addressed. It .
was indicated these signs are addressed in Code Section 134.009.
In response to Questions. Mr. Carlisle indicated he is limited by the franchise for all
pole signs but he would investigate whether or not he could comply in regard to the
attached signs. He felt the dirE-ctional signs would enhance safety.
In response to a Question regarding how many directional signs are allowed. the
Planning and Development Director indicated they are not limited in number except by the
number of entrances and roadways for the facility. In response to a Question. he also

applicant wishes a variance to allow three new directional signs containing 10 sq.ft.
apiece. The Code allows a maximum area of 4 sQ.ft. for directional signs.
The applicant states the proposed freestanding sign will replace an existing sign
which is currently 42' tall and contains 225 sQ. ft. The applicant also indicates he would
like to erect new llttached and directional signage.
Despite the reduction in area proposed for the freestanding sign, and the relatively
large size of the subject property. staff finds nothing about the property which creates a
unique. hardship situation which would warrant granting the variance. The building is not
setback far enough from Gulf-to.Bay to Qualify for . sign bonus for the attached signage.
nor is there anything unusual about the driveway design that requires larger directional
signs.

the entrance to Clearwater, a
city official says.

CLEARWATER - Carlisle Lincoln-Mer-

renovation that will create a lot more green
space along Gulf-to-Bay Boulevard.
The renovation, planned in phases to start
in mid-April and be completed in the summ~r
of 1999 is aimed at making the dealership
more efficient and more appealing to custom-
ers, said Carlisle Motor Co. president Scott
Wilkerson.
The dealership has five buildings, four of
which have only one story. Plans call for two
large, two-story buildings, one with parking
on top.
Of the five current buildings, only the
body shop will remain after the work is done,
reducing the number of buildings from five to
three.
The rooftop parking will make more space
and also will offer more security for custom-
ers' cars left overnight for servicing, Wilker-
son said.
"Right now, every square inch of this is
blacktopped," Wilkerson said. "There will be
a lot more green space." .
The company's pIans fit well with the city's
efforts to make Gulf-to-Baya more attractive

ler, assistant city manager for eco-
nomic development.
He said the city would like to
see more businesses take steps to
beautify Gulf-to-Bay. "(City Man-
ager) Mike Roberto has a phrase:
You're not the only one; you're
simply the first one," Keller said.
Wilkerson said the work will
be done in phases so customers
will not. be inconvenienced. The .
dealership's 225 employees are
the ones who are most likely to be
put out by the work.
"We may be sitting two to a
desk" during the changes, WIlker-
son said.
The dealership moved from
downtown Clearwater, where
Stone Buick is today, to Gulf-to-
Bay about 40 years ago. It has
grown gradu~lly, starting with
about 4 acres on Gulf-to-Bay and
growing to about 11 acres - 8 on
the south side of the road and 3 on
the north side.
WIlkerson said when .the work
is done, the company may consid-
er selling the 3 acres on. the n~rth
side of the street. He said Carlisle
would like to stop shuttling cars
and employees across Gulf-to-Bay
Boulevard.
He said the renovations are
part of the deal Carlisle. struck
when Republic Industries bought
the dealership a year ago. .
WIlkerson said he expects the
renovation costs to be made up by
increased efficiency and by a more
attractive dealership bringing in
more customers.
The Clearwater dealership al-
ready is the seventh largest in the
nation in tenns of new Lincoln-
Mercuries'sold, said lincoln-Mer-
cury spokeswoman Julie Metea of
Detroit
The five largest dealers are in
Detroit, where many cars are sold
to company employees who have
discounts, she said. The sixth-larg-
est dealer is in San Antonio, Tex-
as.
WIlkerson said the Clearwater
dealership sold about 2,700 . new
Lincoln-Mercuries in 1997 and
. about 1,600 used cars.
