BASIS FOR APPEAL
CASE NO. FL 01-01-02
1. The applicant met the standards and criteria for the granting of his request
for flexible development approval as part of a residential infill project.
2. The Community Development Board (Board) considered impermissible
criteria in denying the appellant's request. Section 2-104 D of the City's
Land Development Code sets forth the criteria to be considered in
determining whether to grant flexible development approval as part of a
residential infill project. The Board considered two criteria not listed in the
code, specifically, the effects of (i) deed restrictions that are not binding on
the subject property and (ii) a potential zoning "overlay" district that might
be considered for Island Estates.
3. The Board was under the misimpression that those who spoke in
opposition to the applicant's request represented the official position of the
Island Estates Property Owners Association and/or the residents of Island
Estates.
4. The reduction in setback requested by the applicant is minor compared to
setback encroachments common throughout Island Estates.
5. The criteria for granting or denying flexible development approval as part
of a residential infill project are so subjective as to permit the Board to act
in an arbitrary and capricious manner. They therefore constitute an
unconstitutional delegation of authority and cannot serve as the basis for
denying appellant's request.
