Location: 0.98 acres on the east side of Hillcrest Avenue, approximately 250 south of Druid
Road.

Zoning: LMDR, Low Medium Density Residential District.
Request: Preliminary Plat for four lots.
Proposed Use: Four lots (including one developed with an existing single-family dwelling).
Presenter: Mark T. Parry, Planner.

The DRC reviewed this application with the following comments:
1) No comment to replat however a $200 Recreation Facility impact fee will be due prior to building permit for
each additional new single family residential unit (Hillcrest Gardens).
2) There are 3.5 feet on the south side of the house adjacent to the proposed property line - need to have five feet.
This creates a nonconforming lot - need to make three lots not four lots OR move the house to respect the
required side setback - Ron Hughes says the overall site will grow with an extra four feet or so on the south side
3) Need to demolish/eliminate the shed from Lot Three - Ron Hughes says this has already been done
4) Update tree survey - four inches or greater, trees on parcel are rated #5 as tree stand - need to see easements
how trees can be preserved; trees need to be shown on the proposed plat
5) Ron Hughes says the lots will be serviced from the front of the lots, only drainage easements will be located
along the proposed lots lines
6) Staff recommends the applicant hire an arborist to assist with the future planning efforts
7) Trees will not tolerate a lot of grade changes, cuts and fills -
8) Engineer needs to provide signed and sealed supplementary drawing which shows finished floor elevations and
grading plan for review before city commission approval - now is the time to get the infonnation before these
lots are sold - this needs to be done in concert with tree preservation efforts
9) SWFWMD permit or permit exemption must be provided before city commission approval - Ron Hughes says
no exemption permitted by SWFWMD; Brian Barker suggested otherwise
10) No comments from traffic engineering-
11) Legal description - need to add this to the boundary description on the plat
12) Rosa is listed twice in the signature line on the plat - need to delete one and add Gregory

To Whom It May Concern:
The Clearwater Planning Department has received an application for Flexible Standard
Development from Mr. & Mrs. Gregory E. Sollecito for the property located at 901 Hillcrest
Avenue. The request is for a preliminary plat - four lots. If the application demonstrates
compliance with the requirements of the development code, the Planning Director will approve or
approve with conditions the application. If the application does not demonstrate compliance, the
Planning Director will deny the application.
Pursuant to Section 4-202 C. of the Clearwater Community Development Code, the Planning
Department shall notify the owners of the properties with in 200 feet of the property that is the
subject of the application that an application has been filed. You have the right to appeal the
decision of the Planning Director to the Community Development Board regarding the above-
referenced application. Should you choose to appeal the decision, an application for appeal must
be received by the Planning Department within seven days of the date the development order is
issued. A fee of $250 (Non-Residential) must accompany the application for appeal.

The subject property is zoned LMDR, Low Medium Density Residential District and is consistent with its
underlying land use designation of RU, Residential Urban Classification. Detached dwellings are
permitted within this zoning district provided all dimensional criteria are met. Additionally, a plat was
approved by the Development Review Committee on June 15, 2001 and was recorded with official
records of Pinellas County, Florida on November 9, 2001.
As of January 21, 1999, the City adopted the Community Development Code. These changes may have
created non-conformities, if so they are legal non-conformitIes and may continue. In the event a structure
in which a non-conforming use is located is destroyed or damaged to the extent of less than 50 percent of
the assessed value of such structure, the non-conforming use may be re-established if a complete and
legally sufficient application for all required permits to repair or restore is submitted within six months of
the date of the damage. In the event a structure in which a non-conforming use is located is destroyed or
damaged to 50 percent or more of the assessed value, these structures may be repaired or restored only if
the structure and the use conforms to the standards of this development code for the zoning district in
which it is located.
