E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land, maximum area of sign face par parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the ffexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be

All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each far;ade
with no protrusions above roof lines, over windows, trim, comices or other building features.

Dear Ms. Petys:
This letter constitutes a Development Order pursuant to Section 4-202.E of the
Community Development Code. On June 22, 2004, the Planning Staff reviewed your
Comprehensive Sign Program (CSP) application that includes removing all existing
attached and freestanding signage. This proposal is a request for two attached signs. One
attached sign is proposed to be located on the west building elevation, with 63.18 square
feet and 4.8 percent of the building fac;ade. The other attached sign is proposed to be
located on the south building elevation, with 63.18 square feet and 4.6 percent of the
building fac;ade. Both signs will read "RUBY TUESDAY" in red channel letters.

The proposal also includes a request for a freestanding (monument-style) sign with~ F(!:

will be ~eet high. The monument-style sign will include a green base and green /'
Fe:, message face, with address and sign message in white characters. The sign will read

The Comprehensive Sign Program has been approved. The approval is based on, and
must be consistent with, the application plan set for SGN2004-02009, last revision
received on June 21, 2004, subject to the following conditions:

greater than 50 percent of the sign structure (consider changing the base area
to 41.25 square feet and the sign message area to 43.125 square feet);

2. That when attached signs are removed/replaced, all wall penetrations be
repaired/painted to match the approved wall finish and color;
3. That the freestanding signs be five feet from all property lines and not within
the required sight visibility triangles;
4. That the freestanding sign is to be located within a 12 square foot landscaped
area;
5. That the landscaping be maintained;
6. That the visibility of the address numbers on the freestanding sign base be
maintained; and
7. That all other Code requirements/restrictions of Division 18 (Signs) be met,
including but not limited, to grand opening banners, window, temporary,
construction, sale/leasing signs, etc.
Pursuant to Section 4-303, an application for abuilding permit shall be made within one
(1) year of the date of this Development Order (June 22, 2005). All required building
approvals shall be obtained within one (1) year of the date of issuance of the initial
building permit. Permitted time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any fees that may be required. In order to
facilitate the issuance of any permit or license affected by this approval, please bring a
copy of this letter with you when applying for any permits or licenses that require this
prior development approval.

Dear Ms. Petys:
This letter constitutes a Development Order pursuant to Section 4-202.E of the
Community Development Code. On June 22, 2004, the Planning Staff reviewed your
Comprehensive Sign Program (CSP) application that includes removing all existing
attached and freestanding signage. This proposal is a request for two attached signs. One
attached sign is proposed to be located on the west building elevation, with 63.18 square
feet and 4.8 percent of the building fa~ade. The other attached sign is proposed to be
located on the south building elevation, with 63.18 square feet and 4.6 percent of the
building fa~ade. Both signs will read "RUBY TUESDAY" in red channel letters.
The proposal also includes a request for a freestanding (monument-style) sign with 41.25
square feet on each side. The sign will be located on the south side of the building and
will be 11.25 feet high. The monument-style sign will include a green base and green
message face, with address and sign message in white characters. The sign will read
"RUBY TUESDAY" and will be internally illuminated.
The Comprehensive Sign Program has been approved. The approval is based on, and
must be consistent with, the application plan set for SGN2004-02009, last revision
received on June 21, 2004, subject to the following conditions:
Conditions of Approval:
1. That the freestanding sign "sign message face" be increased so that it is
greater than 50 percent of the sign structure (consider changing the base area
to 41.25 square feet and the sign message area to 43.125 square feet);

repaired/painted to match the approved wall finish and color;
3. That the freestanding signs be five feet from all property lines and not within
the required sight visibility triangles;
4. That the freestanding sign is to be located within a 12 square foot landscaped
area;
5. That the landscaping be maintained;
6. That the visibility of the address numbers on the freestanding sign base be
maintained; and
7. That all other Code requirements/restrictions of Division 18 (Signs) be met,
including but not limited, to grand opening banners, window, temporary,
construction, sale/leasing signs, etc.
Pursuant to Section 4-303, an application for a building permit shall be made within one
(1) year of the date of this Development Order (June 22, 2005). All required building
approvals shall be obtained within one (1) year of the date of issuance of the initial
building permit. Permitted time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any fees that may be required. In order to
facilitate the issuance of any permit or license affected by this approval, please bring a
copy of this letter with you when applying for any permits or licenses that require this
prior development approval.

Ruby Tuesday Restaurants has locations all over the country from California to
Maine. Great effort, care and consideration by design professionals has been given
to the design of their restaurants and signage. Like the city, their desire is to create
a pleasant and appealing presence and look, not only for their benefit, but for the
benefit of other businesses in the area.
From a design viewpoint, consistancy, or "sameness" is not the only design
element that creates acceptable design. The element of contrast also makes good
design. As far as the city's concerns that the colors be consistent, there is red LED
t~im around the top of the bUilding.---;'
The Ruby Tuesday logo is a registered trademark and as such, the Federal
Lanham Trademark Act (15 D.S.C., section 1051, et seq) protects federally
registered names, marks, emblems, slogans, and colors, if included in the
registration, from government interference. The first clause of section 1121 (b) of
the Lanham Act reads as follows:

permanent, withstand weather conditions, and
shall have permanent supports appropriate for its
size.
Sign, abandoned means any sign and/or sign
structure which no longer advertises a bona fide
business activity conducted or product available,
is no longer licensed, no longer has a certificate of
occupancy, or is no longer doing business or main-
taining a presence on the premises where the sign
is displayed and such circumstances have contin-
ued for a period of 30 days.
Sign, adopt a park means a sign that recog-
nizesa sponsoring agency which has been given
the opportunity to install and maintain landscap-
ing in city rights-of-way or on a city-owned prop-
erty.
Sign, animated means any sign which includes
. action, motion, or color changes, or the optical
illusion of action, motion, or color changes, includ-
ing signs set in motion by movement of the
atmosphere, or made up of a series of sections
that tUrn.
Sign area or surface area means the area, in
square feet, enclosed by a rectangle, parallelo-
grlUU.,triangle, circle, semicircle, cross, other geo-
metiic figures, or other architectural design, the
side of which make contact with the extreme
points or edges of the sign, excluding the support-
ing Structure which does not form part of the sign
proper or of the display. Unless otherwise indi-
cated,area means area per sign face. Illuminated
portions of a sign structure shall be considered
part of the sign area. Also, any portion of the
surface area of a freestanding sign structure that
exceeds 50 percent of the permitted area of the
sign face shall be considered part of the sign area.
The area of a sign for attached signs is based on
~he smallest geometric shape(s) around the graph-

signs shall be based on the entire sign cabinet.

Sign, auxiliary freestanding means an addi-
tional freestanding sign allowed due to excep-
tional property frontage characteristics.
Sign, banner means a sign backed by fabric,
paper or similar material and attached to one or
more poles, halyard, rope, wire, string, cord or
similar device or to a building at one or more
'edges or by one or more corners, not including
flags.
Signs, bench signs means a bench upon which a
sign is drawn, painted, printed, or otherwise
affixed thereto.
Sign, billboard means a non-point-of-sale sign
which advertises a business, organization, event,
person, place or thing.
Sign, changeable message means a sign or
portion of a sign where the message copy is
changed manually or automatically through the
utilization of attachable, reflective or illuminated
letters, numbers, symbols, images and other sim-
ilar characteristics. Changeable message signs
shall include electronic reader boards and chang-
ing copy on billboard signs.
Sign, construction means a temporary sign
which identifies those involved in construction of
any building or structure.
Sign, directional means any permanent sign
which exclusively contains information providing
direction or location of any object, place, or area
including but not limited to those signs indicating
avenues of ingress/egress.

E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land. maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outHned below. Monument signs, pursuant to Sections 3-1806.B.1.g and 3-1806B.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached. windows, interior site directional. etc.) shall be
reviewed for the business and/or the development palCel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors. etc. Attached signs shall be horizontally and vertically proportionately located on each fat;ade
with no protrusions above roof lines, over windows. trim, cornices or other building features.
Q Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandina and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated into/with the

concerns, I have marked some pages of the application form and will FAX to you.
1. Please clarify what is intended for proposed wall signage. One or two signs? Label the graphics by elevation
names.

Thank you for your FAX. You asked me if you are okay to proceed based on two specification sheets attached to your
transmittal cover sheet. I cannot review your question as submitted, as information and details are missing. The two
specification sheets provided with your FAX are illegible.
You need to show how any proposed signage is approvable by submitting a calculation sheet. The calculation sheet
needs to show dimensions for any building facade facing a street and roadway frontage. The roadway frontage needs to
be indicated both on the calculation sheet and on a site plan. On the site plan, provide dimensional arrows to show the
frontage. Specification sheets need to be in color. Proposed signage needs to be architecturally integrated to the building.
Please review the City of Clearwater sign code, Sections 3-1801 through 3-1807 within the City of Clearwater Community
Development Code. You can access this code through the City's website at www.myclearwater.com , go to City
Departments, Planning, then to Code Information. The Comprehensive Sign Program application form is available online
as well. The application form has a built-in applicant checklist which should be completed.
I will be happy to answer any questions about the process, but I cannot issue a preliminary approval for an application yet
to be submitted. Please submit one copy of your application with all required materials and the $300 Comprehensive Sign
Program fee to the City of Clearwater Planning Department. Include your e-mail address with the application. If you submit
your application in person, please submit it to the Development Services counter.
