Dear Mr. Fleisch:
On April 30, 2004, the Planning Staff reviewed your application for a Comprehensive Sign Program to
permit a seven square foot, cabinet sign (one sided) to read "NO VACANCY". The sign will be located
on the east elevation of the existing motel building over a window. The cabinet color is white and the
text is red. The application for the Comprehensive Sign Program has been approved for the sign as
submitted (on file), subject to the following conditions:
Conditions of Approval:
1. That any additional signs (freestanding or attached) be submitted for review by the Planning
Department as part of an amended Comprehensive Sign Program; and
2. That all other requirements of Section 4-1803 (Signs) of the Community Development Code are
met.
The approval is based on and must adhere to the sign plan received dated April 26, 2004.
Pursuant to Section 4-303, an application for a building permit shall be made within one (1) year of the
date of this Development Order (April 30, 2005). All required building approvals shall be obtained
within one (1) year of the date of issuance of the initial building permit. Permitted time frames do not
change with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any fees that may be required. In order to facilitate the issuance of any permit or license
affected by this approval, please bring a copy of this letter with you when applying for any permits or
licenses that require this prior development approval.

E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be
reviewed for the business and/or the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each far;ade
with no protrusions above roof lines, over windows, trim, cornices or other building features.

3. Lighting. Any lighting proposed as a part of a Comprehensive Sign Program is automatically controlled so that the
lighting is turned off when the business is closed.

4. To\al Area of Sign Faces. Height, Area, Number and Location of Signs. The height, area, number and location of
signs .permitt~d through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
10cati6n, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from one percent up to a maximum
of six percent of the building fayade to which the sign is to be attached.
ii. Freestanding signs - The maximum permitted area of all freestanding signs on a site shall not exceed the range of
sign area permitted by the street frontage or building fayade calculation methods set forth in Section 1806.B.1.c.i.

Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shaH not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be
reviewed for the business andlor the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenantsluses within

All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated

4. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height, area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from one percent up to a maximum
of six percent of the building fa~de to which the sign is to be attached.

to show height and width. The specifications sheet needs to show the side of the sign.
3. Provide a color photograph showing existing signage on site, with dimensional arrows to show height and width.
4. Provide a calculations sheet/site data table to show how facade area was computed and how the proposed sign
area was determined to fit within the limits of the Comprehensive Sign Program.
5. The site plan and building elevations/photographs from the August 11, 2003 CSP submittal are sufficient to

E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be
reviewed for the business and/or the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each fayade
with no protrusions above roof lines, over windows, trim, comices or other building features.
o Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandina and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated into/with the
design of the building and/or site using similar and coordinated design features, materials and colors, etc.

FYI - this was the gentleman who came in to City Hall several months ago asking for approval on his illegal
sign. When that request failed - Mr. Shah asked for additional time to get complete and submit his application

Mike, Just let me know when you want a meeting I will be happy to attend. Mr.Shah was issued a courtesy
letter on Dec.13,2003 with a compliance date of Jan.4,2004. Compliance has not been met, so a Notice of
Violation was issued on Jan.15,2004 with a compliance date of Jan.30, 2004. If compliance has not been met
by the 30th OR a completed CSP application submitted by this date then fines can be issued. According to
Richard Banton at Sign X-Press, Mr.Shah is refusing to pay them the 300. plans review fee for them to submit
the CSP amendment. Mr.Shah is pleading ignorance to me stating he does not understand the reasons for
the citation. The last case with Mr.Shah dragged on for over a year and I hope we don't allow a repeat
situation to occur.

Can we set a time to talk about this item? I spoke with Mr. Shah today about what exists on site versus
what was approved for signage. In order for the No Vacancy sign to be permitted it first needs to be
reviewed through the Comprehensive Sign Program.
No CSP amendment has been submitted to date. I offered to schedule a meeting with staff and Mr. Shah
to discuss the sign but he has not agreed to such.

I reviewed the photos that you e-mailed me on Tuesday. I do not have any issues with the old freestanding sign base
being used as a landscaping planter. However, the former sign base has no permit to be a part of any sign. A notation will
be placed in Permit Plan regarding such.
As I stated to you in an earlier e-mail, the repositioned sign (now a projecting sign) generally appears to have been located
in the correct place, but the wood pieces give a visual impression that the sign could be in a precarious position. The
wood pieces are visible in electronic photos sent by you on October 6 and November 4. This projecting sign should be
inspected by a City sign inspector for both safety and compliance to Section 3-908, Permitted encroachments into
setbacks and over street rights-of-way, of the Community Development Code.

Thank you for your e-mail regarding the Sea Star Beach Resort CSP, SGN2003-08007. Thanks for sending the photos.
compared the photos to the approved CSP application materials (which included photos of the proposed sign location).
Condition # 1. of the Development Order for the Sea Star Beach Resort CSP reads, "The existing freestanding sign is to
be completely removed within 30 days (by September 28,2003)." This means that all of the sign needed to be removed,
including the base and foundation. Photos provided by you show that the foundation/base was not removed (at least as of
the date of the photos).
The projecting sign generally appears to have been located in the correct place. However, the photos provided by you
show some wood pieces placed in between the bottom of the projecting sign and the pink/beige colored ledge attached to
the facade. The pieces of wood give a visual impression that the sign could be in a precarious position. This projecting
sign should be inspected by a City sign inspector for both safety and compliance to Section 3-908, Permitted
encroachments into setbacks and over street rights-of-way, of the Community Development Code.

Hello all, Just wanted to update everyone on the status of the Shah's CSP application. There is none. Mr. Shah hired sign
company "Sign X-Press" to do their sign work. The Shah's failed to inform the sign company that a CSP application was
required for them to install an attached wall sign of greater than 24 sq.ft. in area. The sign company said they could have
submitted all the necessary paperwork by Monday August 11,2003, but now won't be ready since the Shah's failed to tell
them about the CSP. Richard Fleish from Sign X-Press said the Shah's also haven't paid the additional $300.00 plans
review fee or for his time to prepare one. I then called the Shah's and Mr. Jay Shah was not available. I informed Mrs.
Shah about my conversation with the sign company and informed her that I would be issuing them another $156.00 NT A
fine on Tuesday August 12,2003 if their entire CSP application and fee was not submitted by end of business day on
Monday August 11 tho

Mary Jo Fox, from Code Enforcement, requested a field survey on June 12 , 2003 to determine if a commercial
sign at this location is encroaching into the city Right of Way. The business owner installed the new sign without a permit
on the old sign foundation, which is what prompted this survey request. The official project name will be the same as
reflected above. The project tracking number is ( 00 - 0002 - SR ) , and the project Survey and CAD. number is #
2003045. I am anticipating an encroachment; so be prepared ( Novo) , to provide a simple drawing for Mary Jo to bring to
her hearing. Party Chief, Steve Reid will perform the field survey.

COMMENT
I have been asked to provide a set of options toward remedying a sign code violation at
326 Harnden Drive. This property is within the Tourist Zoning District. The City
observed a freestanding sign, approximately 18 to 20 feet high, in February of this year.
We do not have detailed dimensions of this existing freestanding sign. This sign does not
have a sign permit. The property owners need to propose a sign remedy to the City
through a Comprehensive Sign Prograrn application. A set of six options follows here.
1. Reconfigure the freestanding sign to meet code. The sign needs to meet
height and area requirements. Establish a minimum of a 12 square foot
landscaped area to house the base of the sign. This location can be directly
behind (west of) the existing sign, but out of the Harnden Drive Right of Way.
2. Same as Option 1., except location is parallel to Option 1 and further north on
the lot.
3. Same as Option 1., except location is parallel to Option 1 and further south on
the lot.
4. Reconfigure the freestanding sign to meet code. The sign needs to meet

The property is located at 326 Harnden Drive. This property is within the Tourist Zoning
District.
We do not have detailed dimensions of the existing freestanding sign. This sign does not
have a sign permit. A site visit was conducted on June 16,2003. Those in attendance at
the site visit: Bob Hall, Mary Jo Fox, Mike Reynolds, Manna Shah, and Jay Shah. The
sign area is greater than 32 square feet. Based on the site visit and a rough sketch
provided in the file, the sign height might be 18 feet. The October 1990 survey provided
by the Shahs shows that the sign is encroaching into the Harnden Drive Right-of-Way.
Mr. Shah stated that there were two other locations where freestanding signs once stood.
According to Mr. Shah, there was a sign located along the property line on the southeast
corner of the lot, on the west side of Harnden Drive. This sign was for a stand-alone
motel that is now part of the Sea Star Beach Resort. The other earlier sign location is on
property across the street, owned by the Shahs.
The best option might be Option 1. Reconfiguring the sign within its present sign base is
not recommended, as the sign base encroaches within the Hamden Drive Right-of-Way.

. February 18. 2003 -Initial inspection
Sign Inspector Mary Jo Fox went to the site and found a large
freestanding sign. Upon researching the files, she discovered there was
no permit for the erection of the sign. (Sign is approximately 20 feet tall
and has a sign face area of several hundred square feet. Current sign
code allows for monument style signs up to 4 feet tall with a maximum
sign face area between 20 square feet and 40 square feet, depending on
the size of the building and street frontage).
. February 20. 2003 - Notice of Violation was sent
A compliance date of March 31, 2003 was specified.
. March 28. 2003 - Phone call from sign company
Inspector Fox received a telephone call from Jose Stephanie, R & W Sign
Company, informing her that he had installed the freestanding sign without
a permit and that he knows he did the wrong thing by doing so. He said
that Mr. Shah has called him, asking him to call Inspector Fox and say that
the sign was a "face change only" to a previously existing sign; otherwise,
Mr. Shah would sue him. Further, Mr. Stephanie said he knows the sign
was erected illegally, and he "doesn't want to dig his whole any deeper by
lying about the sign to the city."
. March 31. 2003 - Re-inspection
Inspector Fox re-inspected the freestanding sign, finding it was still up
and that no application has been submitted yet to obtain a permit. To
date, there has no response from the property or business owner.
. March 31. 2003 - Phone call
Inspector Fox called to speak with Mr. Shah, but he was not available.
She left a message for him to return her call, but he hasn't returned it.
. April 1 . 2003 - First "Notice To Appear" Fine
The City issued the first "Notice to Appear" fine on April 1, 2003 to Mr.
Shah for non-compliance to. Mr. Shah pleaded guilty and paid this $81.00
fine to the County Court on April 28, 2003.
. April 4. 2003 - Phone call from Mr. Shah
Mr. Shah telephoned Inspector Fox about his "Notice to Appear" fine. Mr.
Shah requested several months additional compliance time to handle the
freestanding sign because it was Spring Break time and he needed the
sign to attract customers. Inspector Fox told him that she would not issue
any more fines as long as the sign company of his choice would call her
and give her a date of removal or date of applying for new permits. She
told him that she could extend his compliance date for

several weeks, but not months. She explained to Mr. Shah that he could
apply for the Comprehensive Sign Program (CSP) for larger signs and
more square footage, etc. However, she explained that the CSP only
allows signs in the Tourist District to go to a maximum height of 6 feet
instead of 4 feet. Mr. Shah was not happy with the 6 feet height restriction
because he said the sign would not be visible over the vehicles parked in
his parking lot.
· April 1 O. 2003 - Phone call from Attorney Jerry Cobb
Attorney Jerry Cobb, representing Mr. Shah, called Inspector Fox saying
he wanted to discuss the possibilities or alternatives on how Mr. Shah can
retain the current freestanding sign involved in the citation. Inspector Fox
informed Mr. Cobb that the sign was too large and was erected without
permits and she saw no way to permit the illegal sign under the current
sign code. She explained the sign code restrictions and the
Comprehensive Sign Code size allowances and said Mr. Shah does have
these two options from which to choose. However, none of the
regulations would permit this large of sign. Mr. Cobb seemed to
understand the options and said he would pass the information on to Mr.
Shah.
· April 18. 2003 - Phone call from Commissioner Hibbard
Commissioner Hibbard called Inspector Fox to say Mr. Shah called him
requesting his assistance about his sign violation. Inspector Fox
explained to Commissioner Hibbard the situation.
· April 24. 2003 - Meeting in the Planning Department
Inspector Fox had a meeting in the Planning Department with Mr. Shah
and one of his friends, Marian King. Marian King wanted an explanation
on why Inspector Fox cited Mr. Shah for the freestanding sign. Inspector
Fox explained to her that the sign was erected without a permit and that it
was too large. Ms. King argued about the fact that if Mr. Shah applies for
a sign permit according to code, that the sign would not be visible over the
vehicles parked in his parking lot. Inspector Fox explained to her that she
was following the Community Development Code and the height of 4 feet
to 6 feet is the absolute maximum with special approval. Ms. King made
statements to Inspector Fox that the City is trying to put small business
owners out of business, that Mr. Shah is a really nice guy who's wife is
suffering with Cancer treatments, that he did not know the sign was
erected without permits, and that after 911 all businesses have been
suffering and now Inspector Fox was there giving him a tough time.
Inspector Fox tried to assure her that it was not the case and that she was
just trying to assist Mr. Shah with information on getting his signage
properly permitted.
· May 5. 2003 - Visit by Mr. Shah to Zoning
Mr. Shah went to the Zoning Counter of Planning Department to request
an extension of the time for his sign. Mr. Bob Hall, Development Services
Manager was called over to speak with him about the matter. Mr. Hall told
him that the department was in the process of responding to his letter that

he sent to the City Manager's Office. He advised him that this was not
permission to keep the sign and that the City would get back with him after
the letter was prepared for City Manager's Office. Mr. Hall informed Mr.
Shah that his application for the comprehensive sign program was
incomplete and was returned to him to complete.
. Mav 9. 2003- Meeting with Mr. Shah at 326 Harnden Dr.
Inspector Fox and Bob Hall, Development Services Manager, drove to 326
Hamden Dr. and spoke with Mr. Shah about City Hall's decision to hold off
on enforcement until May 16, 2003 in order to grant Mr. Shah an
additional week to submit a completed Comprehensive Sign Program
application and plans review fee of $300.00.
. Mav 19. 2003- Second "Notice To Appear" Fine Issued
The City issued the second "Notice to Appear" fine on May 19. 2003 to
Mr. Shah for non-compliance and for failing to submit a completed
Comprehensive Sign Program application and Plans Review fee by May
16, 2003.
Note: The above synopsis does not include all telephone contacts made since
initial inspection on February 18, 2003.
