Re: Seashell Community Development Site Plan Extension Update
Dear Lisa:
We formally request that the site plan approved for our 1.63 acre site on Clearwater Beach be
extended at the February 19th meeting of the Community Development Board. Thank you for
your communication alerting us to this matter, since your call, we have had ongoing discussions
with Ralph Stone and Pam Akin conceming the maintenance of our development agreement
and project approvals. We have every interest in maintaining the current status of approval and
have made no significant changes to the physical plan as of the date.
Pam Akin, City Attomey, recognized in discussions with me that it is important to cover all bases
and extend the development order for the site plan even though the Development Agreement
recognizes a multiyear schedule, allows for litigation extension, addresses conditions of war and
has a timeframe different than the code deal process. While the two documents are linked the
actions of the Board are subject to the code and we should keep the site plan current.
The following is a list of actions we have taken subsequent to the COB approval of the site plan
in February 2001 is as follows:
. Approval of the Development Agreement recommended to City Commission.
. Adoption of Beach by Design.
. Amendment to the City Comprehension Plan.
· Amendment Recommendations of the PPC Plan to recognize Beach by Design as a
redevelopment plan.
· Designation recommendation Beach Redevelopment District and the 400 unit resort
development unit pool.
· Vacation approval of both 3rd Street and one-half of Gulfview Boulevard.
. Approval of Beach by Design and associated amendments by the Board of County
Commissioners functioning as the Countywide Planning Agency (July 2001).
The COB approvals were conditioned on accomplishment of the above approvals and we are
pleased to recognize that at this time that all conditions precedent have been successfully
approved. Additional justification for continued extension is that we jointly defended four suits
brought by Tony Markopolus against the Board, the City of Clearwater Commission and
Seashell from March through their dismissal with prejudice in November 2001.
At this time, the project schedule is subject to completion of our financing, which is occurring
subsequent to Sept. 11th and its impact on tourism, travel and resort development. The
Seashell group is moving forward with the continued support of Marriott, and a commitment to
implement. A number of encouraging development programs are in process and we're working
with the City and its interim parking strategy to expedite Beach Walk and commence action on
the Beach.
Thank you very much to all concerned for the effort extended to accomplish quality
redevelopment of Clearwater Beach

Clearwater. Signage which is proposed as part of a Comprehensive Sign Program m~ deviate from the
minimum sign standards in terms of numbers of signs per business or parcel of land, maxknum area of sign face
per parcel of land and the total area of sign faces per businesS or parcel, subject to compliance with the
following Fle)libility Criteria. The use of site plans. sections/elevations, renderings and perspectiveS may

facilitate the issuance of any permit or license affected by this approval, please bring a
copy of this letter with you when applying for any permits or licenses that require this

On October 9, 2001, the Planning Staff reviewed your application for a Comprehensive
Sign Program (CSP) to permit an increase in the area of an attached sign from 24 square
feet to 45 square feet. The sign will read "Marriott FAIRFIELD INN & SUITES" and
will be attached to the east facade of the newly constructed Fairfield Inn. The word
"Marriott" will be in red letters with "FAIRFIELD INN & SUITES" in blue letters. All

permitted, freestanding sign will be shared by the Fairfield Inn and up to two future
outparcels. The sign will read "Marriott FAIRFIELD INN & SUITES" with all letters in
white on a dark blue background. The application also includes two, four square foot
directional signs three feet in height. One sign will read "Enter" in white letters on a dark
blue background and the other directional sign will read "Lobby" in white letters on a
dark blue background with a white arrow.

Dear Mr. Benderson:
The purpose of this letter is to clarify the City of Clearwater's expectations regarding landscaping at the
Fairfield Inn. A temporary certificate of occupancy permit was issued by the City on October 11, 2001
with eight conditions (see attached). One of the conditions requires passing a final landscape inspection.
As you may be aware, this requires that, first, a landscape plan be submitted that meets City Code
requirements. Second, the Planning Department will review the plan for Code conformity and make any
notations necessary to achieve compliance. Third, once a plan is approved by the department, the required
plant material must be installed in accord with the approved plan. Fourth, once installed, an inspection of
the site is to be requested by the owner/contractor and the City will inspect the property. All landscaping
must be installed in complete compliance with the approved landscape plan prior to issuance of a final
certificate of occupancy. If the landscaping (and other outstanding items) is not completed by the
expiration date of November 30, 2001, the temporary certificate of occupancy may be revoked.
The City is excited about your presence in Clearwater and wants to extend its welcome to you. Clearly,
landscaping is one of the key components that will enhance your site and the City for years to come. I trust
