CHARACTER OF THE
IMMEDIA TE VICINITY: The immediate vicinity is dominated by residential uses.
ANALYSIS:
The site is 0.84-acres located on the east side of McMullen Booth Road approximately 1,500 feet
north of Gulf to Bay Boulevard. The site contains three, 4,672 square-foot buildings, with two
attached dwellings in each building. The project is configured with a private drive that bifurcates
the site providing access to and from McMullen Booth Road. It was approved as part of a
Residential Infill Project through a Level Two, Flexible Development review on April 17, 2001
(case FL 00-11-53). The adjacent site to the north contains multi-family dwellings (Bayshore
Townhomes). An access road to Bayshore Townhomes runs along the side (north) and rear (east)
property line of the site. Single-family homes exist to the west, across McMullen Booth Road,
and to the south. A mobile home park is located farther to the south. McMullen Booth Road, a
six lane divided, collector road, provides access the site to the west.
The proposal includes a seven-foot high brick wall ten feet from the front (west) property line
along McMullen Booth Road. The wall will be approximately 40 feet from the edge of curb
along McMullen Booth Road. The proposed wall meets all site visibility triangle requirements
under the provisions of Section 3-904. Fences and walls within the LMDR District are limited to
three feet in height within front setbacks under the provisions of Section 3-804 (A). The only
option available is to have the proposal reviewed as a Residential Infill Project.
Surrounding, residential properties with fences and walls similar in size and scale include a
single-family development to the south with a six foot, wood fence along the front (west)
property line along McMullen Booth Road. Another single-family development exists
approximately 500 feet to the north of the subject and includes a six-foot masonry block wall
along the McMullen Booth Road. A third single-family development exists north of Drew Street
on the west side of McMullen Booth Road approximately 2,400 feet north of the subject site.
That development also includes a wood fence six feet in height along McMullen Booth Road.
The proposed wall will be finished with a medium tan, brick fa<;ade with brick columns and brick
caps. It will compliment the wood-like, colonial-style building exteriors. The wall will be more
attractive than other walls and fences currently along McMullen Booth Road including wood and
chainlink fencing to the north on either side of McMullen Booth Road. The proposed wall will
be located ten feet from front (west) property line along the road, approximately 40 feet from the
edge of curb. It will be situated among existing landscaping. The proposed wall will provide
additional privacy for the two units along McMullen Booth Road and help reduce the auditory
impact of McMullen Booth Road on the overall development.

A security gate is not proposed with this development. Should the applicant desire a gate in the
future, resubmission of this application will be required as part of a minor amendment to an
approved site plan. It would be reviewed through the Development Review Committee only.
Staff, however, has concerns with regard to adequate stacking space and emergency vehicle
access.

There are no outstanding code enforcement violations for this site.

C. FLEXIBILITY CRITERIA FOR RESIDENTIAL INFILL PROJECTS:
1. The development or redevelopment of the parcel proposed for development is
otherwise impractical without deviations from intensity and development
standards.
The site contains six attached dwellings as part of the Colonial Village condominium
project. A privacy wall is proposed along the front (west) property line along McMullen
Booth Road, a significant, six lane corridor running north-south along eastern Pinellas
County. Two of the newly constructed buildings have been located 25 feet from the
front (west) property line along McMullen Booth Road. The only solution available to
reasonably decrease noise levels for the complex and increase privacy for the western-
most dwelling units is to provide a solid wall, along the road frontage. Due to the
location of the existing buildings, there is no opportunity to locate the proposed wall
outside of the required 25-foot front setback.

2. The development of the parcel proposed for development, as a Residential Infill
Project will not materially reduce the fair market value of abutting properties.
Surrounding, residential properties along McMullen Booth Road have been developed
with a mixture of fences and walls similar in size and scale ranging from wood to
masonry block to chainlink. Walls and fences on surrounding properties are generally
located directly along McMullen Booth Road with no buffer. The proposed wall will be
well situated on the site and landscaped in excess of Code requirements. The proposal
will result noise reduction and increased privacy for the newly constructed development.
The proposal also includes landscaping along McMullen Booth Road and all perimeters
that will exceed the requirements of Code.
3. The uses within the Residential Infill Project are otherwise permitted in the
District.
The LMDR District permits accessory walls. The proposed use is permitted in the
district.
4. The uses within the Residential Infill Project are compatible with adjacent land
uses.
Surrounding uses include single and multi-family dwellings. The proposal includes a
seven-foot wall, 10 feet from the front (west) property line along McMullen Booth
Road, in association with a condominium project. The wall will be finished with a
medium tan, brick fa~ade with brick columns with brick caps brick fa~ade to
compliment the wood, colonial-style building exteriors. The scale, character and design
of the wall is consistent with surrounding, residential and non-residential properties.
5. The development of the parcel proposed for development as a Residential Infill
Project will upgrade the immediate vicinity of the parcel proposed for
development.
The proposed wall is similar in size and scale to other walls and fences in the area.
Extensive landscaping consistent with the previously approved site plan will further
buffer the site from neighboring properties and soften the wall. The proposal is
consistent with the adjoining neighborhoods and will upgrade the immediate vicinity by
providing a neutral backdrop for the existing landscaping. The proposed wall will also
create more desirable residential development through enhanced privacy and decreased
auditory impact for and on the residents of the development.

6. The design of the proposed Residential Infill Project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole.
The proposed layout will result in a design that is similar to and consistent with other
developments in the area. The wall will also increase privacy and decrease noise levels
for the development. The design of the wall will enhance the condominium complex
and is integrated well with existing colonial-style buildings making the development a
more attractive place to live. The proposed wall will be approximately 40 feet from the
edge of curb and well landscaped. The wall will increase the value of the development
by providing additional privacy and reducing the impact of the noise generated by
McMullen Booth Road.
7. Flexibility in regard to lot width, required setbacks, height, off-street parking
access or other development standards are justified by the benefits to community
character and the immediate vicinity of the parcel proposed for development and
the City of Clearwater as a whole.
The proposal will benefit the immediate neighborhood through enhanced aesthetics, and
a more enjoyable living environment for the condominium residents. The proposed
wall, although located within the required setback, will be well-buffered with
landscaping on its external side in excess of Code requirements. Walls and fences on
surrounding properties are generally located along their respective properties lines along
McMullen Booth Road, the proposed wall will be located ten feet from front (west)
property line along the road. There is also an additional 30 feet of right-of-way between
the edge of the road and the subject property.

D. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
Walls and fences on surrounding residential properties, while similar size and scale, are
generally located directly along McMullen Booth Road with no buffer. The proposed
wall will be situated approximately 40 feet from the edge of pavement and landscaped
on its external side. The proposal will result noise reduction and increased privacy for
the newly constructed development.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned LMDR District and the proposed use will be in compliance with the
zoning. The proposed development will result in a development in keeping with the
character of the surrounding neighborhood which includes single- and multi-family
developments with walls and/or fences six feet in height along the front property lines
along McMullen Booth Road.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The use is similar to other uses in the area. The development will not adversely affect
the health or safety of persons residing or working in the neighborhood. It will enhance
the livability of the condominium units for the residents of the complex.
4. The proposed development is designed to minimize traffic congestion.
The proposal will have no impact on traffic. The wall will not encroach the site
visibility triangles at the entrance of the complex. A security gate is not proposed with
this development. Any such request would need to address vehicular stacking and
emergency access concerns.

5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The surrounding community character includes single-family dwellings, mobile homes
and townhomes. The character of this development is similar to other developments in
the area. The proposal includes a seven-foot high brick wall ten feet from the front
(west) property line along McMullen Booth Road and landscaping on the external side.
It will further buffer the site from neighboring properties and soften the wall. The wall
will be finished with a medium tan, brick fac;ade with brick columns with brick caps
brick fac;ade to compliment the wood, colonial-style building exteriors. The proposal is
consistent with the community character.
6. The design of the proposed development mmInllZeS adverse effects, including
visual, acoustic and olfactory and hours of operation impacts, on adjacent
properties.
The design will be architecturally-integrated with the design of the buildings on the site.
The wall will be further enhanced with landscaping on its external side. It will provide
a visual buffer for the residents of the complex from McMullen Booth Road. The
proposed wall meets all sign visibility triangle requirements.
SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on June 13, 2002. The Planning Department recommends APPROVAL of the Flexible
Development approval to increase the height of a wall from three feet to seven feet, within the
required 25-foot front setback, 10 feet from the front (west) property line along McMullen Booth
Road, in association with an existing attached dwelling complex, as part of a Residential Infill
Project under the provisions of Section 2-204 for the site at 7 McMullen Booth Road, with the
following bases and conditions:
Basis for Approval:
1. The proposal complies with the Flexible Development criteria for a Residential Infill Project
per Section 2-204.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area.
Conditions:
1. That any plants damaged by the construction of the wall be replaced prior to final inspection;
and
2. That any changes to the proposal including the addition of a gate be reviewed by the DRC as
part of an amended site plan.

Dear Mr. Pressman:
This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On July 23,2002, the Community Development Board
reviewed your application for Flexible Development approval to increase the height of a
wall from three feet to seven feet, within the required 25-foot front setback, 10 feet from
the front (west) property line along McMullen Booth Road, in association with an
existing attached dwelling complex, as part of a Residential Infill Project under the
provisions of Section 2-204. The proposal includes a seven-foot high brick wall ten feet
from the front (west) property line along McMullen Booth Road. The wall will be
approximately 40 feet from the edge of curb along McMullen Booth Road.
Based on the application and the staff recommendation, the Community Development
Board (CDB) APPROVED the application with the following bases and conditions:
Bases for approval:
I. The proposal complies with the Flexible Development criteria for a Residential Infill
Project per Section 2-204.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area.

Conditions of approval:
1. That any plants damaged by the construction of the wall be replaced prior to final
inspection; and
2. That any changes to the proposal including the addition of a gate be reviewed by the
DRC as part of an amended site plan.
Pursuant to Section 4-407, an application for a building permit shall be made within one
year of Flexible Development approval (July 23, 2003). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building
permit. Time frames do not change with successive owners. The Community
Development Board may grant an extension of time for a period not to exceed one year
and only within the original period of validity.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
In addition, please be aware that an appeal of a Level Two approval (Flexible
Development) may be initiated by a property owner abutting the property, which is the
subject of the approval within 14 days of the date of the CDB decision. The filing of an
application/notice of appeal shall stay the effect of the decision pending the final
determination of the case. The appeal period for your case expires on August 6, 2002.
