E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel ot"Jand, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, inferior site directional, etc.) shall be
reviewed for the business anellor the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for sho~ping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building anellor site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each
far;ade with no protrusions above roof lines, over wIndows, trim, cornices or other building features.
o Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandinq and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated Into/with the
design of the building and/or site usin simil r and coordinated design features, materials and colors, etc.

2. Height. The height of all freestanding signs proposed\throU9h the Comprehensive Sign Program shall relate to the
design of the sign and shall not exceed 14 feet in height.

3. Lighting. Any lighting proposed as a part of. a Comprehensive Sign Program is automatically controlled so that the
lighting is turned off when the business is closed.

4. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height. area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the' project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evalu~ted against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from one percent up to a maximum
of six percent of the building fatrade to which the sign is to be attached.

ii. Freestanding signs - The maximum permitted area of all freestanding signs on a site shall not exceed the range of
sign area permitted by the street frontage or building fatrade calculation methods set forth in Section 1806.B.1.c.i.

E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Signage proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in tenns of numbers of signs per
business or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.B.1.g and 3-1806B.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be
reviewed for the business and/or the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each
fayade with no protrusions above roof lines, over windows, trim, cornices or other building features.
o Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandina and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated into/with the
design of the building and/or site usin simil r and coordinated design features, materials and colors, etc.

2. Height. The height of all freestanding signs proposed\thrOUgh the Comprehensive Sign Program shall relate to the
design of the sign and shall not exceed 14 feet in height.

3. Lighting. Any lighting proposed as a part of a Comprehensive Sign Program is automatically controlled so that the
lighting is turned off when the business is closed.

_ 4. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height, area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from one percent up to a maximum
of six percent of the building fa9ade to which the sign is to be attached.
ii. Freestanding signs - The maximum permitted area of all freestanding signs on a site shall not exceed the range of
sign area permitted by the street frontage or building fa9ade calculation methods set forth in Section 1806.B.1.c.i.

On August 26, 2003, the Planning Staff reviewed your application for a Comprehensive
Sign Program to enable sign age as follows:
Freestanding Sign, 64 square feet on each side, 14 feet in height, located at least five
feet back from the property line and outside of the visibility triangle, near the comer
of McMullen Booth Road and Daniel Street.
The application for the Comprehensive Sign Program has been approved for the sign as
submitted (on file), subject to the following conditions:
Conditions of Approval:
1. That the existing 12 square foot attached cabinet-style sign, with maroon letters on
a white background and interior lit, reading "SURETY TITLE SERVICES OF
FLORIDA, INC." be removed from the building prior to final inspection of the
proposed freestanding sign; .
2. That the freestanding sign shall be placed in a landscaped setting of no less than
12 square feet in area;
3. That all tenant panels of the freestanding sign shall be of similar color, cordwood
dark brown letters on a white background;
4. That all future attached signs must be approved through an amended
Comprehensive Sign Program, showing specific elevations, dimensions, colors,
materials, and proposed locations;
5. That all future attached signs be coordinated with each other (and with the
freestanding sign) in terms of color, style, design, materials, and etc.; and

horizontally and vertically proportional to the design of the building, with no
protrusions above rooflines, over windows, trim, cornices, or other features.
The approval is based on and must adhere to the signage plans received by the City on
August 11,2003 and the letter from you to the City, dated August 26,2003.
Pursuant to Section 4-303, an application for a building permit shall be made within one
(1) year of the date of this Development Order (August 27, 2004). All required building
approvals shall be obtained within one (1) year of the date of issuance of the initial
building permit. Permitted time frames do not change with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain
any building permits or pay any fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this
letter with you when applying for any permits or licenses that require this prior
development approval.

Last week I spoke with you by telephone regarding your Comprehensive Sign Program application to erect a freestanding
sign at 2750 McMullen Booth Road. You indicated to me that the proposed sign height and setback will comply with City of
Clearwater sign code and that you will pursue a 64 square foot sign area. The submitted application material shows 17
feet for sign height and a zero foot setback distance. On Friday, July 25, you asked me if the application could still go
forward in review.
In order for the application to be reviewed further, the application/application materials will need to be revised/updated.

RE: Amendment #2 - Development Order - Case FLS 01-12-93 at 20505 U.S. Highway 19 North
(Clearwater Mall)
Dear Mr. Armstrong:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. The original Flexible Standard Development application, approved on May 20,
2002, included a comprehensive redevelopment of the Clearwater Mall with 788,948 square feet of
mixed retail sales, service and restaurant use within 13, one-story structures with the following
requests: a) reduce the required front (west and north) setbacks along US Highway 19 North and Gulf
to Bay Boulevard, respectively, from 25 feet to 15 feet to pavement; b) increase in building height from
25 feet to 35 feet; c) permit an automotive service station within the Commercial District; d) and
reduce the required number of parking spaces from 3,973 spaces (five spaces per 1,000 square feet of
gross floor area) to 3,812 spaces (4.83 spaces per 1,000 square feet of gross floor area).
The application was amended and approved with some minor changes including: building footprint,
dumpster location, landscaping and building facades/architecture amendments. The overall building
area has increased to 795,902 square feet (including common areas, garden centers, and Ouparcels "d",
"e", "f') and the number of buildings increased to 14. A second Development Order was issued on
September 20,2002 (Amendment #1).
The current request is for additional minor amendments including those detailed in your letters of April
21,2003 and May 27,2003 and as reflected on revised plans LP2.0 (which supercedes LP1.9) and LS-
7, AC1.0, L-3 and A-6.
The DRC recommended approval of the amended application with the following bases and conditions:

Bases for approval:
1. The proposal complies with the Flexible Standard Development criteria per Section 2-703. *
2. The proposal is in compliance with other standards in the Code including the General Applicability
Criteria per Section 3-913. *
3. The development is compatible with the surrounding area and will enhance other redevelopment
efforts. *
Conditions of Approval:
1. That all Florida Department of Transportation (FDOT) permits are secured prior to the issuance of
first Certificate of Occupancy *;
2. That permission from the City of St. Petersburg (which may be in the form of an appropriate
easement) for parking and landscaping and all obstacles within their water main easement be
submitted to Staff, prior to the issuance of any building permits*;
3. That the final plat be recorded with the County prior to the issuance of first building permit*;
4. That the site plan and landscape plan be amended to address the PST A concerns (as stated in the
April 15,2002 letter to The Sembler Company) regarding the turning radii and width of travel lanes
for buses, prior to issuance of the first building permit*;
5. That a phasing plan, including all aspects of the development with buildings, pavement,
landscaping, etc., be submitted to and approved by Staff prior to the issuance of any building
permi ts *;
6. That a revised drainage, water and sanitary plan be submitted that reroutes utilities to preserve all
existing and proposed trees, to the satisfaction of Staff, prior to the issuance of any building
permi ts *;
7. That all dumpsters be fully enclosed and accessible in accord with Code Section 32.284*;
8. That architectural elevations, colors, materials and details of all buildings be consistent with the
submittal dated received September 18, 2002, unless otherwise approved by Staff or through
separate permit/application*;

I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above 15 conditions. The approval is
based on and must adhere to the site plan, landscape plan and building elevations as previously /
approved and amended with the current changes reflected on revised plans LP2.0, LS-7, AC1.0, L-3
and A-6. (received May 28,2003).
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (July 8, 2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not change
with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property (which is the subject of the approval) within
seven days of the date the Development Order is issued. A copy of the Development Order is being
sent to the surrounding property owners. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. The appeal period for your case will
expire on July 17,2003.

4.' Total Area of Sign Faces. Height. Area, Number and Location of Signs. The height. area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage. access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project. and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:

A. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height, area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from ~ne percent up to a maximum
of six percent of the building fac;:ade to which the sign is to be attached.

sign program for sho~ping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parce/. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building andlor site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each
fa9ade with no protrusions above roof lines, over windows, trim, cornices or other building features.
o Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandinQ and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated into/with the

4. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height. area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site. relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage. scale and use
of the project. and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from CIne percent up to a maximum
of six percent of the building fa~ade to which the sign is to be attached.

Freestanding signs - The maximum permitted area of all freestanding signs on a site shall not exceed the range of
sign area permitted by the street frontage or building fa.;:ade calculation methods set forth in Section 1806.8.1.c.i.
