Dear Mr. Comer:
The Planning staff has reviewed your application to reduce the front south setback from 25 feet to 15
feet (to pavement), the front east setback from 25 feet to 20 feet (to pavement), the side north setback
from 10 feet to 2 feet (to building), the side west setback from 10 feet to 0 feet (to building), a
reduction in the amount of required parking from 5 to 4 spaces per 1,000 square feet for retail and from
15 to 7 spaces per 1,000 square feet for restaurant under the provision of Section 2-703. After. a
preliminary review of the submitted documents, staff has determined that the application is complete
pending the receipt of the following material:
1. The submitted elevations only depict one building (i.e. the proposed retail lease and future Panera
Bread). Please submit additional elevations of the proposed SunTrust Bank.
2. Banks are considered a retail sale and service use requiring 5 spaces per 1,000 square feet or
through a Flexible Standard Development (Levell) application, 4 spaces per 1,000. Restaurant use
is 15 spaces per 1,000 square feet or through a Flexible Standard Development (Levell)
application may be reduced to as few as 7 spaces per 1,000. The Zoning Compliance Notes: on
sheet 1 of 8 has office and retail uses for parking. These need to be revised showing the correct city
requirements and updated in the overall parking calculations for the plaza.
3. Clarify property ownership between the two parcels and how the sites will be tied together. It is
unclear based on deeds provided for the property and the proposed site plan.
4. Clarify the uses (i.e. retail sales and service, office) on site plan for proposed lease area due to
discrepancies in the amount of parking required for retail sales and service versus a restaurant use.

E. WRITTEN SUBMITTAL REQUIREMENTS: (Code Section 3-1807.C)
Sign age proposed as part of a Comprehensive Sign Program may deviate from the minimum sign standards in terms of numbers of signs per
business or parcel of land, maximum area of sign face per parcel of land and the total area of sign faces per business or parcel of land,
subject to compliance with the flexibility criteria outlined below. Monument signs, pursuant to Sections 3-1806.8.1.g and 3-18068.2 shall not
be eligible for this program. As part of the program, all sign types (freestanding, attached, windows, interior site directional, etc.) shall be
reviewed for the business and/or the development parcel to achieve compliance in so far as possible with these current regulations. A master
sign program for shopping centers, including all out parcels, and office complexes shall include all types of signs for all tenants/uses within
the development parcel. These will be reviewed as a Comprehensive Sign Program application.
All existing and proposed signs must be architecturally integrated into the design of the building and/or site using similar and coordinated
design and style features, materials and colors, etc. Attached signs shall be horizontally and vertically proportionately located on each
fagade with no protrusions above roof lines, over windows, trim, cornices or other building features.
o Provide complete responses to the COMPREHENSIVE SIGN PROGRAM CRITERIA including how the criteria are met:
1. Architectural Theme. The design, character, location and/or materials of all freestandinQ and attached signs proposed
in a comprehensive sign program shall be demonstrably more attractive than signs otherwise permitted on the parcel
proposed for development under the minimum signs standards. All signs must be architecturally integrated intolwith the
design of the building and/or site using similar and coordinated design features, materials and colors, etc.
The. theme of the proposed signs :j:s integrated with the proposed redevelopment of the
SunTrust Bank parcel. The design has been coordinated with the design of the
proposed buildings.
2. Height. The height of all freestanding signs proposed through the Comprehensive Sign Program shall relate to the
design of the sign and shall not exceed 14 feet in height.
All buildings and site lighting shall be controlled in accordance with C:j:ty codes.
3. Lighting. Any lighting proposed as a part of a Comprehensive Sign Program is automatically controlled so that the
lighting is turned off when the business is closed.

4. Total Area of Sign Faces. Height, Area, Number and Location of Signs. The height, area, number and location of
signs permitted through the Comprehensive Sign Program shall be determined by the Community Development
Coordinator based on the following criteria: overall size of site, relationship between the building setback and sign
location, frontage, access and visibility to the site, intended traffic circulation pattern, hierarchy of signage, scale and use
of the project, and submittal of a master sign plan for the development parcel/project. Additionally, the maximum
permitted sign area shall be based on the following formula when evaluated against the above criteria:
i. Attached signs - The maximum area permitted for attached signage shall range from one percent up to a maximum
of six percent of the building favade to which the sign is to be attached.
ii. Freestanding signs - The maximum permitted area of all freestanding signs on a site shall not exceed the range of
sign area permitted by the street frontage or building favade calculation methods set forth in Section 1806.B.1.c.i.
and ii.
The proposed signs conform to the calculation methods set forth. in the above
referenced sections.
5. Community Character. The signage proposed in the Comprehensive Sign Program shall not have an adverse impact on
the community character of the City of Clearwater.
The proposed signage is an improvement ovex the existing signage and will
therefore have a positive impact on the. community.
6. Property Values. The signage proposed in the Comprehensive Sign Program will not have an adverse impact on the
value of the property in the immediate vicinity of the parcel proposed for development.
All of the properties i.n the iII)Illediate vicinity are commercial, and the
proposed redevelopment w.ill have a positive impact on tbe surrounding
properties.

Site Plan with the following items:
(a) Location of the sign in relation to property lines, public rights-of-way, easements, buildings, and other signs on the property including dimensions.
(Freestanding signs must be a minimum of five (5) feet from any property line.)
(b) Lot frontage on all street rights-of-way.
ADDITIONAL SIGN PERMIT REQUIREMENTS:
(c) Inventory of all existina sians on the same property and/or building on which the sign is to be located, indicating the number, type, use e.g. property
identification, business identification, etc.) location and surface area. .(If "none", so indicate);
(d) Maximum and minimum height of the sign, as measured from finished grade;
(e) Dimensions of the sign's supporting members;
(f) For illuminated signs, the type, placement, intensity and hours of illumination. (Not more than five (5) foot-candles of light intensity for commercial signs.);
(9) Dimensions and eievations (including the message and color(s)) of the sign; and
(h) Construction and electrical specifications, for the purpose of enabling determination that the sign meets all applicable structural and electrical requiremenu

32 square feet in size shall have structural drawing signed and sealed by licensed Florida engineer or architect.

The following are comments generated from the preliminary Development
Review Committee on September 8,2003. Please be prepared to address these and any
other comments generated at the scheduled Development Review Meeting for 2500
McMullen Booth Road on September 18,2003 at 10:25. The city requests that yourself or
a representative be present for the Development Review Meeting at 100 South Myrtle
Avenue in Clearwater, FL on the second floor of the Municipal Services building. Please
call and verify your time with Sherrie Nicodemus at 562-4582. I look forward to meeting
with you.
The DRC reviewed this application with the following comments:
1. Parks and Recreation:
a) No Comments
2. Stormwater:
a) Prior to issuance of a Development Order the Engineer is to provide
drainage calculations to show that the additional impervious area meets
city storm water attenuation requirements taking into account storm water
retrofit 1/2 credit for existing impervious area that is being reworked.
b) Cross sections on page 5 need to show top of bank of retention pond.
c) Prior to issuance of a building permit a copy of the approved SWFWMD
permit is to be submitted to Development Services for the project file.
3. Traffic En2ineerin2:
a) Construct accessible path from public sidewalk to accessible building.
Also from building to building.
b) Show 20'x 20' sight visibility triangles at all driveway intersections and/or
street intersections. Objects in the sight visibility triangles cannot be
taller than 30" in height from the ground.
c) Will the request for the reduction of parking spaces for these sites keep
customers from parking off site? Submit a parking study to validate.
d) Can the drive through lanes for the bank able to comply with City
standards?
e) Show vehicles stacking along drive through lanes complying with current
City standards.
f) All drive aisles must be 24' wide. See 23' and 22' drive aisle along
proposed retaining wall.
g) All Drive Through lanes must be a minimum of 12' wide.
h) All Drive aisles for bank must be 24' wide. (see 22' for drive through
lane).
i) Need signs and markings to inform customers of the bank the direction of
traffic flow?

4. General Ene:ineerine::
a) How is Panera Bread Company being served with sanitary sewer service?
b) Proposed outdoor seating is shown on adjacent property: Is there an
agreement between properties for the "cross outdoor seating"?
c) Required parking shown within 50 ft. right-of-way easement?
d) Are there recorded storm easements for the storm pipes and structures to
connect to the shared existing detention area?
e) Proposed retail sign shown within the 50 ft. right-of-way easement and
over an existing 24" sanitary sewer main?
f) Building being constructed over an existing drainage and retention pond
easement? Does the existing have to be vacated and new easements
granted?
g) 5/8" meters should be sufficient for bank and lease area if retail.
h) Separate service connections for water for each water meter.
5. Plannine::
a) Provide table-showing amount of available parking spaces accounted for
per unit and the amount of excess available spaces for the Plaza in
relation to the proposal and parking needed.
b) Comprehensive Sign Application is incomplete. Need to provide the
specifics such as colors, type of lettering, etc. See Bryan Berry about
details.
c) Clarify property ownership in relation to the Plaza?
d) Need to provide elevations ofthe proposed SunTrust Bank.
e) Provide bicycle rack on the eastern half of the sidewalk directly in front
of the proposed lease area.
f) Note on plan that curb cut along the east end of site on McMullen Booth
Road will be closed.
g) 50-foot county easement runs along the west side of parcel where
proposed parking is.
h) All design and colors are to be consistent with the overall shopping center
and other outparcels; what is the intended theme of the center (this was to
be resolved at the time StarbuckslNicholson house were approved per
FLS 01-07-57);

a) Need to show Dumpsters enclosures built to city spec, 3 enclosures are
needed.
7. Land Resources:
a) 1. A tree inventory should have been conducted prior to any site design. It
appears that this design accommodates very few of the highly rated trees

on this site. An arborist should be part of the design team to ensure proper
design parameters for tree preservation. Utilize the tree inventory
provided to accommodate additional trees and revise parking stalls, grade
changes within the critical root zones and utility locations.
b) Provide a Tree Preservation Plan prepared by a Certified Arborist. This
plan must show how the proposed building, parking, storm water and
utilities impact the critical root zones (drip lines) and how you propose to
address these impacts i.e.; crown elevating, root pruning and/or root
aeration systems. Other data required on this plan must show actual tree
barricade limits (2/3 of the drip line and/or in the root prune lines if
required), and the tree barricade detail. And any other pertinent
information relating to tree preservation.

a) There are plants and trees shown on the south end of the retention area
(located to the north of the parking lot improvements) which seem to be
in the retention pond since there is a retaining wall at the edge of the
parking pavement;
b) The large existing oak to the NW of the Panera Bread has too many
things happening (paver decking, pipes, building wall, etc.) that can
impact the health of this tree, a possible solution is to incorporate three of
the parking spaces to the east of the are shown as outdoor seating and
relocate the pavers to that area, discuss with Rick Albee for his ideas to
preserve the tree;
c) Some of the plants along Enterprise Rd beneath the trees are larger
container sizes that will disturb the roots of those trees, mainly the purple
Crepe Myrtle in the center grouping as they are directly under the canopy
of existing trees it is recommended that they be replaced with Bird of
Paradise or other plant that will not compete for the area with the trees;
d) There are several large oak trees being removed, depending on their
rating the site plan should be worked around the healthiest trees (parking
can be reduced by Code to preserve trees); and
e) Submit revised plan and letter oftransmittal stating changes for review.O.

RE: NOTICE OF FILING OF AN APPLICATION FOR FLEXIBLE STANDARD DEVELOPMENT
APPROVAL AT 2500 McMullen Booth Road (FLS2003-08040)
To Surrounding Property Owners:
As a property owner within 200 feet of 2500 McMullen Booth Road, the City of Clearwater Planning
Department gives notice that an application for Flexible Standard Development has been filed for that
property. The request is to 1) reduce the front (south) setback from 25 feet to 15 feet (to pavement)
along Enterprise Road, the front (east) setback from 25 feet to 20 feet (to pavement) along McMullen-
Booth Road, the side (north) setback from 10 feet to two feet (to building), the side (west) setback
from 10 feet to zero feet (to building); and 2) reduce the required number of parking spaces from five
to four spaces per 1,000 square feet for retail and from 15 to seven spaces per 1,000 square feet for
restaurant, under the provisions of Section 2-703.
On September 18, 2003, the Development Review Committee (composed of the City's professional
staff) will review and determine whether the application demonstrates compliance with the City's
Community Development Code. Following that review and determination, the Planning Director will
issue a Development Order approving, approving with conditions or denying the application. The
earliest date that the City will make a decision on the application will be September 18,2003.
An appeal of the decision to the Planning Director may be initiated by the applicant or property owners
within the required notice area who present competent substantial evidence at, or prior to, the
Development Review Committee meeting (September 18,2003). An appeal must be filed, including an
appeal fee, with the Planning Department within seven days ofthe date of the Development Order.

Dear Mr. Comer:
The Planning staff has reviewed your application to reduce the front south setback from 25 feet to 15
feet (to pavement), the front east setback from 25 feet to 20 feet (to pavement), the side north setback
from 10 feet to 2 feet (to building), the side west setback from 10 feet to 0 feet (to building), a
reduction in the amount of required parking from 5 to 4 spaces per 1,000 square feet for retail and from
15 to 7 spaces per 1,000 square feet for restaurant under the provision of Section 2-703. After a
preliminary review of the submitted documents, staff has determined that the application is complete
pending the receipt ofthe following material:
1. The submitted elevations only depict one building (i.e. the proposed retail lease and future Panera
Bread). Please submit additional elevations of the proposed SunTrust Bank.
2. Banks are considered a retail sale and service use requiring 5 spaces per 1,000 square feet or
through a Flexible Standard Development (Levell) application, 4 spaces per 1,000. Restaurant use
is 15 spaces per 1,000 square feet or through a Flexible Standard Development (Levell)
application may be reduced to as few as 7 spaces per 1,000. The Zoning Compliance Notes: on
sheet 1 of 8 has office and retail uses for parking. These need to be revised showing the correct city
requirements and updated in the overall parking calculations for the plaza.
3. Clarify property ownership between the two parcels and how the sites will be tied together. It is
unclear based on deeds provided for the property and the proposed site plan.
4. Clarify the uses (i.e. retail sales and service, office) on site plan for proposed lease area due to
discrepancies in the amount of parking required for retail sales and service versus a restaurant use.
