Dear Mr. & Mrs. Legters:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On August 14,2003, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development to reduce the rear (south) setback from 15 feet to 10
feet for a bathroom addition, under the provisions of Section 2-203.B. The proposal includes a pool,
screenroom and bathroom addition in association with an existing single-family dwelling. The DRC
recommended approval ofthe application under the following bases:
Bases for approval:
1. The proposal complies with Flexibility criteria for detached dwellings under the provisions of
Section 2-203.B.;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plan and application dated received July 16,2003.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Development approval (August 18, 2003). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not change
with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.

The 0.17 acres is located on the south side of Warwick Drive, approximately 200 feet west of
Moorehaven Drive. The site contains an existing 2,100 square foot, one-story, single-family
dwelling. The existing dwelling is located fifteen feet from the rear (south) property line.
The site is located in a stable, residential neighborhood of well-maintained single-family homes.
The comparable sales value of similarly sized lots in the W oodgate of Countryside subdivision is
$137,000 based on sales from 2000-2001.
The application includes an addition of approximately 250 square feet at the rear of the house.
The applicant is requesting to reduce the rear (south) setback from 15 feet to 10 feet for a

bathroom addition (approximately 30 square feet) and to expand an existing screen porch (220
square feet) to the allowed ten-foot rear setback. Other properties within the Woodgate of
Countryside subdivision have similarly proposed additions that were approved under previous
code that allowed the primary structures to go to a minimum rear setback of ten feet. The
proposed addition will be in harmony with the scale and character of adjacent properties, and
should positively affect surrounding property values.

C. FLEXIBILITY CRITERIA FOR DETACHED DWELLINGS IN THE LMDR, LOW
MEDIUM DENSITY RESIDENTIAL DISTRICT (Section 2-203.B.2):
1. The reduction in rear setback will allow for the preservation of existing vegetation
which could not otherwise be preserved;

2. The reduction in rear setback will allow the development or redevelopment of a
substandard lot which would otherwise not be feasible;
The addition is not feasible due to the house originally being constructed with a I5-foot
rear setback.
3. The reduction results in an efficient house layout;
The house layout has been planned to support the therapeutic swimming pool being
installed for rehabilitative purposes.
4. The structures located within the rear setback otherwise required in the LMDR
District are buffered with landscape material or fences to protect the privacy and
value of adjacent properties;
The structures located in the rear setback are buffered on the east (side) and south (rear)
property lines by a six-foot wood fence. There is no landscaping along the west (side)
property line at this time.
D. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposal includes the addition of a bathroom and screen room and therapeutic
swimming pool in association with an existing single-family dwelling. The immediate
area consists of single-family homes. The development will be in harmony with the scale
and character of adjacent properties.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned LMDR District and the proposed use will be in compliance with that
zoning. The proposed development should not discourage appropriate development and
use of adjacent land buildings.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The use will not change with this proposal. The development will not negatively affect
the health or safety or persons residing or working in the neighborhood.

4. The proposed development is designed to minimize traffic congestion.
The use does not change with this proposal and will have no increased effect on traffic.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.

6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
There will be no adverse effects generated by the proposed development.
STAFF RECOMMENDATION:
Based on the on the application, the proposal is in compliance with the standards and criteria for
Flexible Standard Development approval, with the maximum development potential and with all
applicable standards of the Community Development Code.
Therefore, staff recommends APPROVAL of the application for Flexible Standard Development
approval to reduce the rear (south) setback from 15 feet to 10 feet for a 30 square foot bathroom
addition, in association with an existing single-family dwelling at 2377 Warwick Drive.
Basis for Approval:
1. The proposal complies with Flexible Standard Development under the provisions of Section
2-203.B.2.;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913;
and
3. The proposed development is compatible and consistent in character with the surrounding
area.

To Surrounding Property Owners:
As a property owner within 200 feet of 2377 Warwick Drive, the City of Clearwater Planning
Department gives notice that an application for Flexible Standard Development has been filed for that
property. The request is to reduce the rear (south) setback from 15 feet to 10 feet for a bathroom
addition, under the provisions of Section 2-203.B. The proposal includes a pool, enclosure and
bathroom addition in association with an existing single-family dwelling.
On August 14,2003, the Development Review Committee (composed of the City's professional staff)
will review and determine whether the application demonstrates compliance with the City's
Community Development Code. Following that review and determination, the Planning Director will
issue a Development Order approving, approving with conditions or denying the application and a
copy of this Development Order will be mailed to you. The earliest date that the City will make a
decision on the application will be August 22, 2003.
The City encourages you to participate in the review process of this application. You may visit our
office to review the files and/or submit written comments to be considered in the City's review of the
application.
An appeal of the decision to the Planning Director may be initiated by the applicant or property owners
within the required notice area who present competent substantial evidence at, or prior to, the
Development Review Committee meeting (August 14, 2003). An appeal must be filed, including an
appeal fee, with the Planning Department within seven days of the date of the Development Order.
