Dear Mr. Broward:
As requested, we have performed a review of the attached site plan to determine parking demand and
the relationship of this demand to minimum parking requirements as set forth in the City of
Clearwater's Development Code. The current zoning of the proposed credit union facility ("C"
District) requires that a proposed retail sales and services use have a minimum of five (5) off-street
parking spaces per 1,000 square feet of gross floor area. As such, a minimum of 21 parking spaces
will be required for the proposed 4,100 square foot credit union facility.
Due to physical limitations on site, only 17 parking spaces can be constructed to serve the credit
union facility. The City of Clearwater maintains a Flexible Standard Development Code that relaxes
the minimum off-street parking space requirement to four (4) off-street parking spaces per 1,000
square feet of gross floor area. Under the flexible standards provision the proposed credit union
facility would meet the required number of parking spaces (16 parking spaces).
To further assess the adequacy of parking on site, estimates for parking demand were obtained from
the Institute of Transportation Engineer Parking Generation manual. Using the fitted curve equation
contained in the manual [Ln (P) = 1.01 Ln (X) + 1.38] to estimate parking demand, indicates that 17
parking spaces are typically occupied during a weekday by similar banking facilities. Therefore, the
manual suggests that the 17 parking spaces provided on site are adequate to meet future parking
demand. Copies of the relevant pages of this manual are included in Attachment A.
Based on the above-mentioned information, we believe that there are an adequate number of parking
spaces to serve the proposed credit union facility. It should be noted that the recommendation we
have provided is based on the information included in the proposed site plan (see Attachment B).

The flexible standards on page 2-73 Article 2 Division 7 of the City Land Development
Code allows reduction of the parking spaces to a minimum four (4) parking spaces per 1000 sq.
ft. of gross floor area from the requirement of 5/1000. It is requested that the use of Flexible
Standards be granted since the proposed development is in harmony ~nd complimentary with the
adjacent properties. Additionally, the employees and customers of the bank are likely to bring more
business to the adjacent restaurants.
The request, in general, is not self imposed by the applicant since the property is vacant
and an attempt is made to use the existing facilities with least amount of modifications.

Development Code. On August 14,2003, the Development Review Committee (DRC) reviewed your
application for Flexible Development to reduce the required number of parking spaces from 5 per
1,000 square feet at 21 to 4 per 1,000 square feet to 17 spaces per Section 2-703.R.The DRC
recommended approval of the application with the following bases and conditions:
Bases for approval:
1. The proposal complies with the Flexible Standard Development criteria for the Commercial
District per Section 2-703.R.
2. The proposal is in compliance with other standards in the Code including the General Applicability
Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other redevelopment
efforts.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plan and application dated received July 18, 2003.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (September 23, 2004). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any

perimeter trees required which constitute a more lush, complete landscape design, additional
shrubs/groundcover has also been added along US 19 to keep with the more complete design vs

ANALYSIS:
The 0.67-acre site is located on the eastern side of US Highway 19N, approximately 300 feet south
of Northside Drive. The site contains an existing 4,100 square foot, commercial dwelling. The
proposed use will be an Eastern Financial Florida Credit Union bank. This is a permitted use
within the Commercial Zoning District under Section 2-701.
The proposal includes a reduction in the required number of parking spaces from 5 per 1,000
square feet at 21 spaces to 4 per 1,000 square feet at 17 spaces. The reduction in the amount of on-
site parking is due to a proposed drive through canopy on the rear (eastern) portion of the building.
This will accommodate two stacking lanes of traffic for drive through teller services. As a result,
the proposed parking layout is optimally designed to create a one-way flow of traffic on site. The
proposal will otherwise meet all other applicable Code requirements.

C. FLEXIBILITY CRITERIA FOR COMMERCIAL DISTRICT (Section 2-703.R):
1. Lot size and width: The parcel proposed for development was an existing lot of less
than 10,000 square feet and was not in common ownership with any contiguous
property on May 1, 1998.

D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The area is characterized as a commercial strip center with predominately retail sales and
service uses. The redevelopment is to utilize the same building, which is vacant at the
current time. Retail to Bank use modification will be in harmony with adjacent commercial
properties in the "Northside Square".
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the value
thereof.
Adjacent land is already developed. The value of adjacent buildings will not be impaired
since the redevelopment will be an enhanced site with improved landscaping along with
new building fayade and conforming sign.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The redevelopment will not adversely affect the health and safety of the neighborhood
since the proposed Bank site is a similar (retail) use to the previously existing site.
4. The proposed development is designed to minimize traffic congestion.
The average daily trips are expected to be similar and per calculations submitted to the
City, were shown to decrease the Traffic Impact Fee compared to the Jewelry Store
existing previously on this site. Site circulation and parking layout have been optimized.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The proposed redevelopment is consistent with the existing Northside Square Shopping
Center.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The proposed redevelopment includes utilizing the existing building with no changes on
the west, south, and north side. Addition of a canopy will be minimal change and the hours
of operation are expected to be similar or less than the previous tenant Gold and Diamond
Source Store.

14,2003, we are sending to you one (1) copy of Site Plan Sheet S-1, which is revised to show the
following changes:
1. A proposed 5' concrete sidewalk is shown on the plans in order to provide access
from the public sidewalk along U.S.19 to the entrance of the building.
2. The dumpster enclosure is noted to require that the door is to remain closed
adjacent to the parking space to the west of the dumpster enclosure. The dumpster
itself will be a 3 cubic yard dumpster.
3. The curbed island along the drive thru' median where exit and drive isle meet is
extended to maintain parking spaces room for entering and exiting parking spaces.

Without knowing the entire configuration of the site plan, I believe the request for reduction of
parking spaces should be denied. The traffic on US 19 in the area is unbelievable. I can foresee
a traffic backup onto US 19 if spaces are full. My opinion might be different if there is direct
access to other parking from this property.

To Surrounding Property Owners:
As a property owner within 200 feet of 29383 US Highway 19N, the City of Clearwater Planning
Department gives notice that an application for Flexible Standard Development has been filed for that
property. The request is to reduce the required number of parking spaces at 29383 US Highway 19N
from 21 to 17 for a bank as retail sales and service under Section 2-703.R.
On August 14, 2003 the Development Review Committee (composed of the City's professional staff) will
review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determination, the Planning Director will issue a
Development Order approving, approving with conditions or denying the application. The earliest date
that the City will make a decision on the application will be August 14,2003.
The City encourages you to participate in the review process of this application. You may phone me at
727-562-4539 for further information, visit our office to review the files and/or submit written comments
to be considered in the City's review of the application.
An appeal of the decision of the Planning Director may be initiated by the applicant or property owners
within the required notice area who present competent substantial evidence at, or prior to, the
Development Review Committee meeting (August 14, 2003). An appeal must be filed, including an
appeal fee, with the Planning Department within seven days of the date of the Development Order.

The Planning staff has reviewed your application to reduce the required number of parking spaces
from 21 to 17 under Section 2-703.R. The proposal includes a bank as retail sales and service use.
After a preliminary review of the submitted documents, staff has determined that the application is
complete.

The Development Review Committee (DRC) will review the application for sufficiency on August
14, 2003 in the Planning Department conference room - Room 216 - on the second floor of the
Municipal Services Building. The building is located at 100 South Myrtle Avenue in downtown
Clearwater. Please call Sherrie Nicodemus, Administrative Analyst at 727.562.4582 no earlier
than one week prior to the meeting date for the approximate time that your case will be reviewed.
You or your representative (as applicable) must be present to answer any questions that the
