COMPREHENSIVE PLAN AMENDMENT
1825 SUNSET POINT RD.
January 28,2004
The proposed Comprehensive Plan Amendment is consistent with the goals and
objectives of the Comprehensive Plan, and is appropriate and compatible for its location
and the general neighborhood.
The property is already a portion of an older mixed use office/retail development at the
SEC of Sunset Point Rd. & Keene Rd. The purpose of the proposed Plan Amendment is
to facilitate the commercial redevelopment of the entire comer. This redevelopment will
be similar in character to the existing buildings on the site, although of a much improved
construction and design quality, and will not adversely impact the general area. As part
of the redevelopment, a vacant residential lot will be purchased and utilized as a buffer
between the commercial land and the low density residential lots to the south.
The Keene Rd. extension is scheduled to be completed and open within the next 60 days.
The road improvements completed by this construction will be more than sufficient for
the proposed commercial redevelopment. The other public facilities currently at the site
are also more than adequate for the anticipated commercial redevelopment.
Negotiations are underway with the City of Clearwater and SWFWMD regarding the
wetlands on the eastern end of the property. Much of the existing wetlands have been
substantially degraded. The proposed redevelopment plan will upgrade and modify the
wetland area, with no adverse effect to the environment, resulting in an enhanced visual
amenity for the development and the neighborhood.

COMPREHENSIVE PLAN AMENDMENT
1825 SUNSET POINT RD.
January 28, 2004
The proposed Comprehensive Plan Amendment is consistent with the goals and
objectives of the Comprehensive Plan, and is appropriate and compatible for its location
and the general neighborhood.
The property is already a portion of an older mixed use office/retail development at the
SEC of Sunset Point Rd. & Keene Rd. The purpose of the proposed Plan Amendment is
to facilitate the commercial redevelopment of the entire comer. This redevelopment will
be similar in character to the existing buildings on the site, although of a much improved
construction and design quality, and will not adversely impact the general area. As part
of the redevelopment, a vacant residential lot will be purchased and utilized as a buffer
between the commercial land and the low density residential lots to the south.
The Keene Rd. extension is scheduled to be completed and open within the next 60 days.
The road improvements completed by this construction will be more than sufficient for
the proposed commercial redevelopment. The other public facilities currently at the site
are also more than adequate for the anticipated commercial redevelopment.
Negotiations are underway with the City of Clearwater and SWFWMD regarding the
wetlands on the eastern end of the property. Much of the existing wetlands have been
substantially degraded. The proposed redevelopment plan will upgrade and modify the
wetland area, with no adverse effect to the environment, resulting in an enhanced visual
amenity for the development and the neighborhood.

COMPREHENSIVE PLAN AMENDMENT
1825 SUNSET POINT RD.

The proposed Comprehensive Plan Amendment is consistent with the goals and
objectives of the Comprehensive Plan, and is appropriate and compatible for its location
and the general neighborhood.
The property is already a portion of an older mixed use office/retail development at the
SEe of Sunset Point Rd. & Keene Rd. The purpose of the proposed Plan Amendment is
to facilitate the commercial redevelopment of the entire comer. This redevelopment will
be similar in character to the existing buildings on the site, although of a much improved
construction and design quality, and will not adversely impact the general area. As part
of the redevelopment, a vacant residential lot will be purchased and utilized as a buffer
between the commercial land and the low density residential lots to the south.
The Keene Rd. extension is scheduled to be completed and open within the next 60 days.
The road improvements completed by this construction will be more than sufficient for
the proposed commercial redevelopment. The other public facilities currently at the site
are also more than adequate for the anticipated commercial redevelopment.
Negotiations are underway with the City of Clearwater and SWFWMD regarding the
wetlands on the eastern end of the property. Much of the existing wetlands have been
substantially degraded. The proposed redevelopment plan will upgrade and modify the
wetland area, with no adverse effect to the environment, resulting in an enhanced visual
amenity for the development and the neighborhood.

Per your request, the Division has reviewed the above referenced application. Based
upon this review, the Division has found that this Land Use Amendment and Rezoning request
is generally NOT in conformance with the goals and objectives of the Transportation Element of
the 2000 Comprehensive Plan in respect to:
· Mass Transit Policy 8.1.1 : No consideration to provide for mass transit facilities.
· Traffic Circulation Policy 5.4: The applicant did not submit a traffic impact study.
The following details the Division's analysis ofthe application.
I. TECHNICAL BACKGROUND
The proposal for the 3.265 acre site is:
(a) Land Use Plan amendment from the ResidentiaVOffice General (RlOG) Classification to
the Commercial General (CG) Classification and the Preservation (P) Classification; and
(b) Rezoning from the 0, Office District to the C, Commercial District and the P,
Preservation District.
The site is located at Sunset Point Road, approximately 300' east of the intersection of Sunset
Point Road and Keene Road. The land is designated as Residential/Office General (RIO G) 15
dwelling units per acre; FAR .50; ISR .75, in the 2000 Comprehensive Plan. The objective of
this zone is to provide for and encourage development of medium density residential and office.
To date the applicant has not submitted a Traffic Impact Study to justify the rezoning to a higher
density.

II. LEVEL OF SERVICE ANALYSIS
The 2000 Comprehensive Plan contains levels of service (LOS) standards for transportation. The
LOS standards were developed based on existing traffic conditions within the immediate vicinity
of each site; the future impacts from any new proposed development of each site, and citizen
expectations.
Development of this specific site, as proposed, will generate significant additional trips from the
site, and these should be adequately catered for within the existing conditions of the road
network.

The current 3-leg signalized intersection of Sunset Point and Keene Road will dramatically
evolve and function as a 4-leg intersection sometime in early April 2004. As a result, the LOS of
the intersection will change as well, therefore a study will be needed if the site proposes any land
use type that will generate over 1,000 vehicles per day or 100 vehicles per hour.
Conceptual Trip Volume Analvsis:
Based on the applicant's proposal, the following is the expected vehicle trip volumes from the
site using the Institute of Transportation Engineers Trip Generation, 6th Edition (ITE) and the
Pinellas Planning Council Trip Rates (PPC).

III. STRENGTHS
1. The applicant will provide traffic impact fees into the general fund, which will be used for off
site improvements within the city's roadway network.
2. The extension of Keene Road from Sunset Point to S.R. 60 will reduce traffic volumes along
the property's frontage on Sunset Point Road.
IV. WEAKNESSES
1. The proposed development is not in accordance with the County's long range land use
plan.
2. The applicant has not provide a Traffic Impact Study for the site to determine whether or
not any mitigation for roadway improvements is needed.
3. The applicant has not provided a site plan showing proposed driveway access along
Sunset Point Road. Sunset Point Road is an access class of 4, whereby driveway spacing
must be a minimum of240' (City's Community Development Code, page CD3:5,
(Section 3-102 C. 1. & 2.).
4. No provisions for mass transit i.e. bus shelter.
V. RECOMMENDATIONS
Based on the City's need to reduce or prevent congestion in the public streets, to facilitate the
provision of adequate transportation facilities, and to protect against congestion in travel and
transportation, the application for land use plan amendment to Commercial General (CG),
planned Residential/Office General (R/OG) in accordance with LUZ # 2004-01001 is supported
contingent upon a submittal of a Traffic Impact Study prior to a "Building Permit" when the
applicant has firm indication on what will be constructed on the said parcel.

RE: Application for Annexation (ANX2004-01002) approval to permit one parcel of land,
totaling 1.08-acres, into the City of Clearwater for a site at 1871 Keene Road, and an
application for rezoning and Future Land Use Plan amendment (LUZ2004-01001)
approval to rezone two parcels of land at 1825 Sunset Point Road, totaling 3.265-acres
from the 0, Office District to the C, Commercial District and to amend the Future Land
Use Plan classification from the Residential/Office General (R/OG) Classification to the
Commercial General (CG) Classification.
Dear Mr. Armstrong:
The Planning Department has reviewed your applications for the Annexation (ANX2004-01002)
for the site at 1871 Keene Road and you application for Future Land Use Plan/Zoning
amendment (LUZ2004-01001) for the site at 1825 Sunset Point Road. After a preliminary
review, staff determined that the application is complete. The applications have been entered
into the Department's filing system and assigned the case numbers: ANX2004-01002 and
LUZ2004-01001.
The following schedule has been tentatively established for the review of your application by
various City boards. These meetings are necessary in order to process your request
appropriately. The attendance by you or your representative is required at the Development
Review Committee and Community Development Board meetings. Should any of the following
meeting times and/or locations change you will be contacted immediately.

Development Review Committee, time to be determined (Please call 727-562-
4582 no earlier than one week prior to the meeting date for the approximate time
that your case will be reviewed.); in the Planning Department conference room -
Room 216 - on the second floor of the municipal service building, 100 South
Myrtle Avenue in Clearwater. The case will be forwarded to the Community
Development Board when it is deemed sufficient.
