The only comment I have on this is can we identify in the future what "any vertical structure or material" is?
"Vertical structure" does not seem to be defined in the CDC.
If the language is meant to allow, e.g., a parking lot, stormwater treatment facilities, etc. perhaps those allowable uses
should be spelled out.

DECLARATION OF RESTRICTIONS
KNOW ALL MEN BY THESE PRESENTS, that pursuant to the ordinances of the
City of Clearwater pertaining to the issuance of building permits and regulating land
development activities, the undersigned (collectively, "Owners"), being all of the owners
of the real property situated in the City of Clearwater, County of Pinellas and State of
Florida, more particularly described on Exhibit "A" attached hereto and incorporated
herein ("Property"), do hereby make the following declaration of conditions, limitations
and restrictions on the Property, hereafter to be known and referred to as a Declaration
of Restrictions, as to the following particulars:
1. Hereafter, in perpetuity, the construction or placing of any vertical
structure or material upon the Property is hereby prohibited.
2. This Declaration of Restrictions shall constitute a covenant running with
the land, as provided by law, and shall be binding upon the undersigned, and the heirs,

Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Commission hereby accepts the
dedication of all easements, parks, rights-of-way and other dedications to the public, which have
heretofore been made by plat, deed or user within the annexed property. The City Engineer, the
City Clerk and the Planning Director are directed to include and show the property described
herein upon the official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk
shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the
Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after
adoption, and shall file a certified copy with the Florida Department of State within 30 days after
adoption.

CORPORATE LIMITS OF THE CITY, AND REDEFINING THE
BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of Clearwater
and the boundary lines of the City are redefined accordingly:

Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Commission hereby accepts the
dedication of all easements, parks, rights-of-way and other dedications to the public, which have
heretofore been made by plat, deed or user within the annexed property. The City Engineer, the
City Clerk and the Planning Director are directed to include and show the property described
herein upon the official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk
shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the
Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after
adoption, and shall file a certified copy with the Florida Department of State within 30 days after
adoption.

RE: Application for Annexation (ANX2004-01002) approval to permit one parcel of land,
totaling 1.08-acres, into the City of Clearwater for a site at 1871 Keene Road, and an
application for rezoning and Future Land Use Plan amendment (LUZ2004-01001)
approval to rezone two parcels of land at 1825 Sunset Point Road, totaling 3.265-acres
from the 0, Office District to the C, Commercial District and to amend the Future Land
Use Plan classification from the Residential/Office General (RIO G) Classification to the
Commercial General (CG) Classification.
Dear Mr. Armstrong:
The Planning Department has reviewed your applications for the Annexation (ANX2004-01002)
for the site at 1871 Keene Road and you application for Future Land Use Plan/Zoning
amendment (LUZ2004-01001) for the site at 1825 Sunset Point Road. After a preliminary
review, staff determined that the application is complete. The applications have been entered
into the Department's filing system and assigned the case numbers: ANX2004-01002 and
LUZ2004-0 1 00 1.
The following schedule has been tentatively established for the review of your application by
various City boards. These meetings are necessary in order to process your request
appropriately. The attendance by you or your representative is required at the Development
Review Committee and Community Development Board meetings. Should any of the following
meeting times and/or locations change you will be contacted immediately.

Dear Mr. Healey & Mr. Smith:
Pursuant to Section 6(2) of the County Ordinance No. 00-63, the City of Clearwater is hereby
notifying the Pinellas Planning Council of its receipt of three (3) new applications for voluntary
annexations of real properties located at 3290 McMullen Booth Road, 2135 Bumice Drive and
1871 North Keene Road, respectively, into its jurisdiction. The subject properties are located
within the City of Clearwater Planning Area and upon the annexation will be served by City of
Clearwater sanitary sewer service. The proposed annexations are consistent with Florida law
regarding municipal annexations through their adjacency with existing city boundaries and are
compact in concentration. One of the proposed annexations, ANX2003-12034, has a Future
Land Use Plan amendment involved with it.
A warranty deed including the legal description, survey site plan and maps associated with these
properties are enclosed.

Attached please find a draft of declaration of restrictions that will be recorded upon annexation of 1871 Keene
Rd. (ANX2004-01002). Planning told the applicant of LUZ2004-01001 (1825 Sunset Point Road) that the only
way we would support the LUZ is if a buffer could be provided to the south. This annexation and declaration of
