Dear Mr. Dubois:
This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On April 18, 2001, the Community Development Board
reviewed your application for Flexible Development approval to increase the height of a
fence from four feet to six feet as replacement fencing for outdoor patio areas, as part of a
Residential Infill Project.
Based on the application and the staff recommendation, the Board found that the proposal
is in compliance with the standards and criteria for a Residential Infill Project, the
maximum development potential standards and all other applicable standards of the
Community Development Code. The Community Development Board approved the
application with the following three conditions:
1. That a continuous hedge be planted along the patio fences near Countryside
Boulevard and Winding Wood Drive to improve their appearance as seen from the
rights-of-way;
2. That the existing hedge along the Countryside Boulevard frontage be augmented
with additional plantings to create a continuous buffer; and
3. That the existing split rail fence along Countryside Boulevard be repaired, as
needed.
Pursuant to Section 4-407, an application for a building permit shall be made within one
year of Flexible Development approval (April 17, 2002). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building
permit. Time frames do not change with successive owners. The Community

The following is a brief history of the Winding Wood X Condominium
Association Board of Directors efforts to replace the patio fences.
October 18, 1999. The Winding Wood X Condominium Association Board of
Directors (WWX) voted to replace patio fences. Property manager was asked to
seek bids.
May 22,2000. WWX Board voted to approve the bid from Fence Men at
$47,000. The property manager was to have a contract drawn up for Board
approval.
June 19, 2000. WWX Board asked the property manager to send them a copy
of the Fence Men contract for approval.
November 20, 2000. The fence contractor was to put up a sample fence but
could not get a permit from the City of Clearwater because of City Development
Code policies. An application for a variance is needed. The WWX Board voted to

Response to quelns I concerns regarding proposed resi.ial infill project.

G. Residential inflll projects.
1. The development or redevelopment of the parcel proposed for development is otherwise impractical without deviations from
intensity and development standards.
The proposed project is solely for the purpose of replacing privacy fences around the existing seventy-two (72) individual patio areas
of our condominium community. The patio area and existing wood fence (approximately six-feet six-inches in height) were built
when the property was first developed more than twenty years ago. Our development is a condominium complex and the current
regulation for "attached dwellings" limits the height of replacing the fences to four feet (Division 8. Fences and Walls; Section 3-804.
Setback and height requirements, F. Exception for attached dwellings).
2. The development of the parcel proposed for development as a residential infill project will not materially reduce the fair market
value of abutting properties.
The adjacent properties are also condominium communities with similar building designs and tall privacy fences (none less than six
feet) around the patio area of each unit. Allowing us to replace our existing fences with six-foot fences of the same existing design
will recreate the already existing continuity of appearance between our community and the adjacent condominium communities. In
addition, the taller fences help maintain the value of our property by keeping a great deal of privacy for the patio area.
3. The uses within the residential infill project are otherwise permitted in the district.
Were our community buildings not defined as "attached dwellings" the replacement of our current fences with six-foot fences would
not be an issue requiring a variance. The adjacent condominium communities have patio area fences greater than four-feet in height
(most greater than six-feet in height), as do many single-family homes within one-quarter mile of our community. The fences we want
to replace are located in side and/or rear setback areas and a six (6) foot fence height maximum is allowed in those areas within the
district, with the sole exception of attached dwellings.
4. The uses within the residential infill project are compatible with adjacent land uses.
As previously mentioned, the adjacent properties are also condominium communities with similar building designs and tall privacy
fences around the patio area of each unit. Many of those existing fences are identical to our current fences.
5. The development of the parcel proposed for development as a residential infill project will upgrade the immediate vicinity of the
parcel proposed for development.
Our current fences are twenty-years-old and definitely show their age, particularly when compared to the fences of our neighboring
condominium communities. Many fence posts are rotted and we worry that one storm with high winds may cause them to break and
someone's fence to fall. Replacing the existing fences will immediately improve the appearance of our community and the safety
for our residents.
6. The design of the proposed residential infill project creates a form and function which enhances the community character of the
immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole.
The new fences will be the same design (shadow box style) as the existing fences and will match many of the fences in our adjacent
condominium communities.
7. Flexibility in regard to lot width, required setbacks, height, off-street parking access or other development standards are justified
by the benefits to the community character and the immediate vicinity of the parcel proposed for development and the City of
Clearwater as a whole.
Flexibility of the development codes in our case is justified and necessary to recreate the existing visual continuity of our community
and adjacent communities, and to recreate the value of privacy for our individual patio area's currently provided by our existing
fences.
Response to queAs I concerns regarding proposed I. two application.

A. Conditions which are imposed by the community development coordinator and the community development
board pursuant to a level one or a level two approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density, and character of
adjacent properties in which it is located.

existing design will recreate the already existing continuity of appearance between our community and the adjacent
condominium communities.
3. The proposed development will not adversely affect the health or safety or persons residing or working in the
neighborhood of the proposed use.
We are going to replace the existing wood fences with new wood fences. The location of each fence will remain the same.
The health or safety of persons residing or working in the neighborhood will not be adversely affected by the new fences.
On the contrary, the new fences will be stronger than our current fences due to the removal of rotted fence posts currently
supporting many fences in our community. Our current fences are twenty-years-old and defmitely show their age,
particularly when compared to the fences of our neighboring condominium communities.
4. The proposed development is designed to minimize traffic congestion.
The new fences will replace existing fences. Foot-traffic is not impeded along the fences and will not change.
5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed
for development.
As already mentioned, the adjacent properties (condominium communities) have similar building designs with tall privacy
fences around the patio area of each residence. Allowing us to replace our existing fences with six-foot fences of the
same existing design will recreate the already existing continuity of appearance between our community and the adjacent

6. The design of the proposed development minimizes adverse effects, including visual, acoustic, olfactory, and hours
of operation impacts, on adjacent properties.
The replacement fences will improve the appearance of our community and increase the safety of our residents. The
adjacent properties can only benefit from having our current fences replaced with the new fences.

Dear Mr. Dubois:
This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On April 18, 2001, the Community Development Board
reviewed your application for Flexible Development approval to increase the height of a
fence from four feet to six feet as replacement fencing for outdoor patio areas, as part of a
Residential Infill Project.
Based on the application and the staff recommendation, the Board found that the proposal
is in compliance w' . eria for a Residential Infill Project, the
maximum opment potential standards and a r applicable standards of the
Com Ity Development Code. The Community Develop t Board approved the
ication with the following three conditions:

CHARACTER OF THE
IMMEDIATE VICINITY: The immediate VICInIty includes a mix of single-family
dwellings, a cluster of attached dwellings and retail uses.
The area remains suburban in character.
ANALYSIS:
The parcel is 11.56 acres located on the southeast comer of Winding Wood Drive and
Countryside Boulevard, approximately 1,000 feet east of U.S. Highway 19 North. The site is one
of the ten phases of the larger Winding Wood Condominium Development. The Rustlewood
Condominiums are located to the north and the Cypress Bend of Countryside subdivision is
located to the south and east. Generally, the immediate vicinity is suburban in character with both
attached and detached dwellings.
The site has 72 units housed in 36 wood buildings each with two dwellings. The architecture is
characteristic of a modem design. Each unit has an outdoor patio enclosed by a six-foot wood
privacy fence. The fences are a shadow box design with horizontal rails and finished with a taupe
color. The fences are in need of repair and replacement.
The proposal includes upgrading all patios with new fence posts and panels. The Code states that
no fence or wall over four feet in height shall be permitted on any attached dwelling lot, except
where the fence or wall is installed along the boundary of the property, in which case the fence or
wall shall be uniformly designed and shall meet the height limits and other standards otherwise
applicable to the fence or wall. Therefore, the only mechanism to allow the replacement of the
existing fences is this level two application.
The proposal includes the replacement of existing fences with the same design, height and taupe
color. Residents have enjoyed private, outdoor patios since they were constructed in an
environment that is otherwise composed of only common outdoor spaces. Staff has consistently
applied policy to discourage tall fences near public rights-of-way for aesthetic and safety
purposes. However, these fences are set back in excess of 26 feet from Countryside Boulevard
and many face interior greenspaces. Replacing the existing fences with shorter panels would
degrade the privacy that condominium residents currently enjoy. There are some existing trees
throughout the property and landscaping material including sparse hedges along Countryside
Boulevard and Winding Wood Drive. Staff believes this hedge should be enhanced with
additional plantings to further screen the fences from the right-of-way. There is also an existing
split rail fence along the Countryside Boulevard right-of-way and is in a state of disrepair. The
existing fencing has been in place since the condominium development was initially constructed
and staff recommends the perimeter split rail fence be repaired as part of this application.

C. MDR, MEDIUM DENSITY RESIDENTIAL DISTRICT FLEXIBILITY CRITERIA
FOR RESIDENTIAL INFILL PROJECTS:
1. The development or redevelopment of the parcel proposed for development is
otherwise impractical without deviations from intensity and development
standards.
The existing courtyards at each unit provide private outdoor spaces for the
condominium residents. The replacement of the existing six-foot fences with like fences
ensures the continued enjoyment of private patios.
2. The development of the parcel proposed for development, as a Residential Inflll
Project, will not materially reduce the fair market value of abutting properties.
The proposal includes the replacement of the existing six-foot fences that are in a state
of disrepair. The new fences will improve the overall appearance of the condominium
complex. Additionally, the fences are primarily seen from the Winding Wood
condominium residents since many are oriented towards interior greenspaces.
Approximately 10 fences may be seen from Countryside Boulevard and will be
landscaped with a continuous hedge.
3. The uses within the Residential Inflll Project are otherwise permitted in the
District.
Attached dwellings are permitted in the MDR District.
4. The uses within the Residential Inflll Project are compatible with adjacent land
uses.
The existing six-foot wood privacy fencing was constructed with the condominiums.
The other phases of the Winding Wood Condominium development also have six-foot
wood fences.
5. The development of the parcel proposed for development as a Residential Inflll
Project will upgrade the immediate vicinity of the parcel proposed for
development.
Many of the existing fences are in poor to fair condition. Replacement of these fences
and the additional landscaping will upgrade the condominium property and its
appearance from adjacent properties and the public right-of-way.

6. The design of the proposed Residential Infill Project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole.
The condominium residents currently enjoy private, outdoor courtyards, which has
established a defined community character. The fence replacement will ensure that the
community character of the condominium complex is maintained.
7. Flexibility in regard to lot width, required setbacks, height, off-street parking
access or other development standards are justified by the benefits to community

SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on March 15, 2001. The development will further the City's goals of maintaining private
property and helping to ensure neighborhood sustain ability. The proposal is in compliance with
Flexibility Criteria of a Residential Infill Project.
The Planning Department recommends APPROV AL of the Flexible Development application to
increase the height of courtyard fences from four feet to six feet as part of a Residential Infill
Project for the Winding Wood Condominiums X generally located at 2634 Barkdale Court with
the following conditions:
1. That a continuous hedge be planted along the patio fences near Countryside Boulevard
and Winding Wood Drive to improve their appearance as seen from the rights-of-way;
2. That the existing hedge along the Countryside Boulevard frontage be augmented with
additional plantings to create a continuous buffer; and
3. That the existing split rail fence along Countryside Boulevard be repaired, as needed.

CHARACTER OF THE
IMMEDIA TE VICINITY: The immediate VICInIty includes a mix of single-family
dwellings, a cluster of attached dwellings and retail uses.
The area remains suburban in character.
ANALYSIS:
The parcel is 11.56 acres located on the southeast comer of Winding Wood Drive and
Countryside Boulevard, approximately 1,000 feet east of U.S. Highway 19 North. The site is one
of the ten phases of the larger Winding Wood Condominium Development. The Rustlewood
Condominiums are located to the north and the Cypress Bend of Countryside subdivision is
located to the south and east. Generally, the immediate vicinity is suburban in character with both
attached and detached dwellings.
The site has 72 units housed in 36 wood buildings each with two dwellings. The architecture is
characteristic of a modem design. Each unit has an outdoor patio enclosed by a six-foot wood
privacy fence. The fences are a shadow box design with horizontal rails and finished with a taupe
color. The fences are in need of repair and replacement.
The proposal includes upgrading all patios with new fence posts and panels. The Code states that
no fence or wall over four feet in height shall be permitted on any attached dwelling lot, except
where the fence or wall is installed along the boundary of the property, in which case the fence or
wall shall be uniformly designed and shall meet the height limits and other standards otherwise
applicable to the fence or wall. Therefore, the only mechanism to allow the replacement of the
existing fences is this level two application.
The proposal includes the replacement of existing fences with the same design, height and taupe
color. Residents have enjoyed private, outdoor patios since they were constructed in an
environment that is otherwise composed of only common outdoor spaces. Staff has consistently
applied policy to discourage tall fences near public rights-of-way for aesthetic and safety
purposes. However, these fences are set back in excess of 26 feet from Countryside Boulevard
and many face interior greenspaces. Replacing the existing fences with shorter panels would
degrade the privacy that condominium residents currently enjoy. There are some existing trees
throughout the property and landscaping material including sparse hedges along Countryside
Boulevard and Winding Wood Drive. Staff believes this hedge should be enhanced with
additional plantings to further screen the fences from the right-of-way. There is also an existing
split rail fence along the Countryside Boulevard right-of-way and is in a state of disrepair. The
existing fencing has been in place since the condominium development was initially constructed
and staff recommends the perimeter split rail fence be repaired as part of this application.

FOR RESIDENTIAL INFILL PROJECTS:
1. The development or redevelopment of the parcel proposed for development is
otherwise impractical without deviations from intensity and development
standards.
The existing courtyards at each unit provide private outdoor spaces for the
condominium residents. The replacement of the existing six-foot fences with like fences
ensures the continued enjoyment of private patios.
2. The development of the parcel proposed for development, as a Residential Inlill
Project, will not materially reduce the fair market value of abutting properties.
The proposal includes the replacement of the existing six-foot fences that are in a state
of disrepair. The new fences will improve the overall appearance of the condominium
complex. Additionally, the fences are primarily seen from the Winding Wood
condominium residents since many are oriented towards interior greenspaces.
Approximately 10 fences may be seen from Countryside Boulevard and will be
landscaped with a continuous hedge.
3. The uses within the Residential Inlill Project are otherwise permitted in the
District.
Attached dwellings are permitted in the MDR District.
4. The uses within the Residential Inlill Project are compatible with adjacent land
uses.
The existing six-foot wood privacy fencing was constructed with the condominiums.
The other phases of the Winding Wood Condominium development also have six-foot
wood fences.
5. The development of the parcel proposed for development as a Residential Inlill
Project will upgrade the immediate vicinity of the parcel proposed for
development.
Many of the existing fences are in poor to fair condition. Replacement of these fences
and the additional landscaping will upgrade the condominium property and its
appearance from adjacent properties and the public right-of-way.

6. The design of the proposed Residential Infill Project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole.
The condominium residents currently enjoy private, outdoor courtyards, which has
established a defined community character. The fence replacement will ensure that the
community character of the condominium complex is maintained.
7. Flexibility in regard to lot width, required setbacks, height, off-street parking
access or other development standards are justified by the benefits to community
character and the immediate vicinity of the parcel proposed for development and
the City of Clearwater as a whole.

The Community Development Board of the City of Clearwater, Florida, will hold public hearings on Tuesday,

1. DRC had lots of concerns about the use of the alley for egress - may need to be improved - currently is 16 feet
of width of alley easement; discussed paving 12 feet of it and making stormwater improvements
2. lots of discussion about the use of the alley and future requests to vacate it may not work
3. staff suggest using existing driveway on the west side of the site - would need an easement on neighboring site
to the west
4. currently 19-foot width on existing driveway - okay by mike gust;
5. will provide 5 feet on east side of building with new design
6. buffer between this site and site to the west?
7. If no unity of title - site needs to stand on its own for landscaping and stormwater and solid waste; or need to
have easements for access, etc.
8. Preserve 34-inch oak tree in front of building
9. Is the alley one way or two way? May need to sign it so there is no entrance onto the site from the alley or
designate the alley one way eastbound - need engineering's recommendation here;
10. Need information of garbage collection - not clear how this will work - black barrel may be ok but cannot leave
on the street
