SUM MARY: . The applicant proposes to develop the adjacent property with a 24 unit tow nhouse development. Florida Power, Time Warner, and Verizon Media Ventures, Inc. have no objection to the vacation request. Verizon has no objections provided that the vacated alley is retained as a utility easement. The City of Clearwater has a sanitary sewer main in the alley. Pubic Works Administration has no objections to the vacation request subject to retention of a drainage and utility easement over the entire width of the alley. . . . No. 6875-01 Location Map Appropriation Code: V Printed on recycled paper VACATION 2001-20 All Around Your House Inc ORDINANCE NO. 6875-01 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, VACATING THE 10-FOOT ALLEY LYING ADJACENT TO THE NORTH PROPERTY LINES OF LOTS 25 THROUGH 28, INCLUSIVE, OF SUNSET POINT REPLAT FROM THE WEST PROPERTY LINE OF LOT 25 ON THE WEST TO THE WEST PROPERTY LINE OF THE PINELLAS TRAIL ON THE EAST, SUBJECT TO A DRAINAGE AND UTILITY EASEMENT WHICH IS RETAINED OVER THE FULL WIDTH THEREOF; PROVIDING AN EFFECTIVE DATE. WHEREAS, All Around Your Home, Inc., owner of real property adjoining the alley described herein, has requested that the City vacate the alley depicted in Exhibit A attached hereto; and WHEREAS, the City Commission finds that said alley is not necessary for municipal use and it is deemed to be to the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: The 10-foot alley lying adjacent to the North property lines of Lots 25 through 28, inclusive, of Sunset Point Replat, as recorded in Plat Book 4, Page 25 of the Official Records of Pinellas County, Florida, from the west property line of Lot 25 on the west to the west property line of the Pinellas Trail on the east is hereby vacated, closed and released, and the City of Clearwater releases all of its right, title and interest thereto, except that the City of Clearwater hereby retains a drainage and utility easement over the described property for the installation and maintenance of any and all public utilities thereon. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
