with Code or is approved by the Community Development Board; and

to staff April 24, 2001, or as modified by the Community Development Board
specifically that Florida, cracker-style architectural details be added to the front
(north) fayade of the building such as a faux railing at the window/door on the
second floor.

July 27, 2001
Pursuant to Section 4-407, an application for a building permit shall be made within one
year of Flexible Development approval (July 17, 2002). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building
permit. Time frames do not change with successive owners. The Community
Development Board may grant an extension of time for a period not to exceed one year
and only within the original period of validity.

this prior development approval.
Dear Mr. Drunasky:
This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On July 17, 2001, the Community Development Board
reviewed your application for Flexible Development approval to reduce the minimum lot
size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150
feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a
parking lot design other then what is required by Code, as part of a Residential Infill
Project. The proposal includes the addition of a two-car garage to the east side of the house
with an additional dwelling unit on top. The garage will replace an existing single-car
carport and is designed to provide stacked parking for two cars. The additional dwelling
unit will be accessed from the rear of the site by way of a staircase and rear deck. The
proposed addition will match the architectural style of the existing house and include a
pitched roof and wood siding. The entire structure will resemble a single-family dwelling
as seen from Cambria Street.
In addition, please be aware that an application/notice of appeal of any decision of the
city, as provided in Section 4-501 (specifically decisions rendered by the Community
Development Board), may be initiated by the applicant or any person granted party status
within 14 days of the decision. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. No building permit
shall be issued for a Level Two approval prior to the expiration of the appeal period. The
appeal period for your case expires on July 31, 2001.

Based on the application and the staff recommendation, the Board found that the proposal
is in compliance with the standards and criteria for a Comprehensive Infill Project, the
maximum development potential standards and all other applicable standards of the

The Development Review Committee has reviewed your submittal for the property
located 13 Cambria Street and determined that several revisions are needed before the
issuance of a Development Order and being scheduled for a hearing with the Community
Development Board. The following lists these items:
SITE PLAN
1. Clarification is needed to determine if the additional unit with be overnight
accommodations (rentals less than 30 days) or a dwelling unit; clarify intended use on
the site plan.
2. The parking space for the additional dwelling unit shall not block vehicular access to
the garage (used by the primary dwelling); revise site plan to designate a parking
space for the resident of the additional unit.
3. Rainwater shall not be forced on to the neighboring properties; revise site plan to
include a rain gutter along the east side of the addition.
MIse INFORMATION
1. A Recreational Facility impact fee of $200 is due at building permit for the
additional unit. Contact Debbie Ruchter at 562-4847 for details.
2. An additional black barrel for trash collection may be required for the additional

3. Impact fees for water and sewer will be required if separate water meter is
installed.
4. An additional address may be assigned to the additional dwelling unit. Contact

IMMEDIA TE VICINITY: The immediate vicinity is a mix of land uses including
attached and detached dwellings.
ANALYSIS:
The 0.09-acre site is located on the south side of Cambria Street, approximately 250 feet west of
Mandalay A venue. The parcel is nonconforming with respect to lot area, lot width, and all

setbacks. The existing site contains a one-story Caribbean-style house with a one-car carport and a
large front deck. The style resembles other "Old Florida" style structures typical of the beach
environment. Overall, the site is in good condition and well landscaped.
The immediate vicinity includes a mix of detached and attached dwellings. Two mid-rise
residential buildings are located to the west with parking beneath. Single-family (detached) houses
are located to the east and other small attached dwellings are located to the north. The majority of
the structures are in fair to good condition and are located on relatively small lots.
The neighborhood is identified in the special area redevelopment plan, Beach by Design, as the
"Old Florida" District. The Plan identifies this area as a primarily residential neighborhood with
limited retail uses that serve local needs. It recommends the redevelopment of the area with
single-family dwellings and townhouses. Beach by Design acknowledges that a lack of parking in
this area may hinder revitalization of existing improvements.
The proposal includes the addition of a two-car garage to the east side of the house with an
additional dwelling unit on top. The garage will replace an existing single-car carport and is
designed to provide stacked parking for two cars. The additional dwelling unit will be accessed
from the rear of the site by way of a staircase and rear deck. The proposed addition will match the
architectural style of the existing house and include a pitched roof and wood siding. The entire
structure will resemble a single-family dwelling as seen from Cambria Street.
The request is to reduce the minimum lot width from 150 feet to 50 feet and reduce the minimum
lot area from 10,000 square feet to 4,350 square feet. The parcel is an existing nonconforming lot
in the Medium High Density Residential District that otherwise permits higher densities and a mix
of housing types. Give the lot dimensions, any substantial improvements would require approval
by the Community Development Board as part of a Residential Infill Project. The proposal also
includes a request to reduce the side (east) setback from 10 feet to five feet. The existing structure
is nonconforming with the respect to setbacks as are the majority of other structures along
Cambria Street. The reduction in the side setbacks is in keeping with the neighborhood character.
The RH, Residential High Plan Category permits two dwelling units based on the property size.
The final request is to permit a parking layout other than what is required by Code. With the
exception of single-family dwellings, Code prohibits back out parking onto a road right-of-way.
The proposal provides adequate parking on site for the two units; two in the garage for the owner-
occupied unit and one space in the driveway for the second unit. Neither parking space blocks

access to the other and will not include parking in the right-of-way. The proposal meets Code in
terms of required number of parking spaces.

C. MHDR, MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT FLEXIBILITY
CRITERIA FOR RESIDENTIAL INFILL PROJECTS:
1. The development or redevelopment of the parcel proposed for development is
otherwise impractical without deviations from intensity and development
standards.
The site is an existing lot located on the Clearwater Beach. The parcel cannot be
redeveloped and meet Code requirements due to its substandard size and dimensions.
Any substantial improvements will require deviations from Code and approval by the
Community Development Board as a Level Two application.
2. The development of the parcel proposed for development, as a Residential Infill
Project will not reduce the fair market value of abutting properties.
The proposal is an attractive addition to an existing house and is in keeping with the
mixed-use character of this single and multi-family neighborhood. The proposal is not
expected to reduce the fair market value of abutting properties.
3. The uses within the Residential Infill Project are otherwise permitted in the
District.
Attached dwellings are permitted in the MHDR, Medium High Density Residential
District.
4. The uses within the Residential Infill Project are compatible with adjacent land
uses.
The immediate vicinity is composed of both attached and detached dwellings. The
proposed use is consistent with the character of the area while preserving the
appearance of a single-family home.
5. The development of the parcel proposed for development as a Residential Infill
Project will upgrade the immediate vicinity of the parcel proposed for
development.
The existing house is in good condition and has an open carport. The proposal includes
the addition of a two-car garage and an additional dwelling unit located atop the garage.
The addition will be in keeping with the architectural style of the house. The proposal
will greatly improve the parcel and the appearance of the immediate vicinity.

6. The design of the proposed Residential Infill Project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole.
The immediate vicinity has a mix of both attached and detached dwellings. Many of the
existing houses resemble "Old Florida" style architecture. The proposed addition will
match the style of the existing house and will appear as a single-family structure as seen
from the street.
7. Flexibility in regard to lot width, required setbacks, height, off-street parking
access or other development standards are justified by the benefits to community
character and the immediate vicinity of the parcel proposed for development and
the City of Clearwater as a whole.
Clearwater Beach is in a state of redevelopment and Beach by Design encourages this in
the residential neighborhoods. The parcel is an existing nonconforming lot and any
substantial improvements will require deviations from the Code. The proposal is an
attractive addition to an existing house and will match the architectural style of the
house and surrounding properties to the east. The addition will improve the aesthetic
appearance of the street and help serve as a catalyst to influence other improvements on
neighboring properties.
D. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The immediate vicinity includes a mix of attached and detached dwellings. The proposal
is in keeping with the architectural style of the existing house and other detached
dwellings to the east.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The area is zoned MHDR which promotes higher densities. The property size permits
two dwelling units based on the RH, Residential High Plan Classification. The design is
consistent with the architectural style of the house and will resemble a single-family
house as seen from the street.

3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The additional dwelling unit is not expected to adversely affect the health or safety or
persons residing or working in the neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The additional dwelling unit is not expected to increase traffic congestion In this
residential neighborhood.
s. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The neighborhood includes detached dwellings to the east and mid-rise attached
dwellings to the west. The proposed addition will be in keeping with the community
character and will match the architectural style of several surrounding structures.
6. The design of the proposed development minimizes adverse effects, including
visual, acoustic and olfactory and hours of operation impacts, on adjacent
properties.
The addition is designed to be architecturally compatible with the existing house. The
addition unit is not expected to produce adverse effects onto adjacent properties.
SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on June 14, 2001. The development will further the City's goals of improving the character of
area and promoting the private sector redevelopment. The proposal is in compliance with the
Flexibility Criteria for a Residential Infill Project Criteria and the recommendations of Beach by
Design.
The Planning Department recommends APPROV AL of the Flexible Development application to
reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum
lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to
permit a parking lot design other then what is required by Code, as part of a Residential Infill
Project at 13 Cambria Street, with the following three conditions:
1. That any future redevelopment initiatives include a parking design that complies with
Code or is approved by the Community Development Board;
2. That the final building design is general consistent with the elevations submitted to staff
April 24, 2001, or as modified by the Community Development Board; and
3. That should the existing/proposed units be rented, the terms shall comply with the
Countywide Rules (no less than 30 days).

REQUEST:
Flexible Development approval to reduce the minimum lot
size from 15,000 square feet to 4,350 square feet, reduce
the minimum lot width from 150 feet to 50 feet, reduce the
side (east) setback from 10 feet to five feet and to permit a
parking lot design other then what is required by Code, as
part of a Residential Infill Project.
ANALYSIS:
The 0.09-acre site is located on the south side of Cambria Street, approximately 250 feet west of
Mandalay A venue. The parcel is nonconforming with respect to lot area, lot width, and all
setbacks. The site is comparable to many neighboring sites in terms of lot coverage and limited
setbacks. The existing site contains a one-story Caribbean-style house with a one-car carport and a
large front deck. The style resembles other "Old Florida" style structures typical of the beach
environment. Overall, the site is in good condition and well landscaped.
The immediate vicinity includes a mix of detached and attached dwellings. Two mid-rise
residential buildings are located to the west with parking beneath. Single-family (detached) houses
are located to the east and other small attached dwellings are located to the north. The majority of
the structures are in fair to good condition and are located on relatively small lots.
The neighborhood is identified in the special area redevelopment plan, Beach by Design, as the
"Old Florida" District. The Plan identifies this area as a primarily residential neighborhood with

this area may hinder revitalization of existing improvements.
The proposal includes the addition of a two-car garage to the east side of the house with an
additional dwelling unit on top. The garage will replace an existing single-car carport and is
designed to provide stacked parking for two cars. The additional dwelling unit will be accessed
from the rear of the site by way of a staircase and rear deck. The proposed addition will match the
architectural style of the existing house and include a pitched roof and wood siding. The entire
structure will resemble a single-family dwelling as seen from Cambria Street.
The request is to reduce the minimum lot width from 150 feet to 50 feet and reduce the minimum
lot area from 10,000 square feet to 4,350 square feet. The parcel is an existing nonconforming lot
in the Medium High Density Residential District that otherwise permits higher densities and a mix
of housing types. Give the lot dimensions, any substantial improvements would require approval
by the Community Development Board as part of a Residential Infill Project. The proposal also
includes a request to reduce the side (east) setback from 10 feet to five feet. The existing structure
is nonconforming with the respect to setbacks as are the majority of other structures along
Cambria Street. The reduction in the side setbacks is in keeping with the neighborhood character.
The RH, Residential High Plan Category permits two dwelling units based on the property size.

The final request is to permit a parking layout other than what is required by Code. With the
exception of single-family dwellings, Code prohibits back out parking onto a road right-of-way.
The proposal provides adequate parking on site for the two units; two in the garage for the owner-
occupied unit and one space in the driveway for the second unit. Neither parking space blocks
access to the other and will not include parking in the right-of-way. The proposal meets Code in
terms of required number of parking spaces.
SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on June 14, 2001. The development will further the City's goals of improving the character of
area and promoting the private sector redevelopment. The proposal is in compliance with the
Flexibility Criteria for a Residential Infill Project Criteria and the recommendations of Beach by
Design.
The Planning Department recommends APPROVAL of the Flexible Development application to
reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum
lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to
permit a parking lot design other then what is required by Code, as part of a Residential Infill
Project at 13 Cambria Street, with the following three conditions:
1. That any future redevelopment initiatives include a parking design that complies with
Code or is approved by the Community Development Board;
2. That the final building design is general consistent with the elevations submitted to staff
April 24, 2001, or as modified by the Community Development Board; and
3. That should the existing/proposed units be rented, the terms shall comply with the
Countywide Rules (no less than 30 days).
