Drunasky Tom Craig Remodeling and Building 5250 State Road 54 New Port Richey, Florida 34652 filE RE: Development Order regarding case FL m O~ 1 R of 1, rowhria Street Please be aware that the issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. Dear Mr. Drunasky: This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the Community Development Code. On July 17, 2001, the Community Development Board reviewed your application for Flexible Development approval to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residential Infill Project. The proposal includes the addition of a two-car garage to the east side of the house with an additional dwelling unit on top. The garage will replace an existing single-car carport and is designed to provide stacked parking for two cars. The additional dwelling unit will be accessed from the rear of the site by way of a staircase and rear deck. The proposed addition will match the architectural style of the existing house and include a pitched roof and wood siding. The entire structure will resemble a single-family dwelling as seen from Cambria Street. In addition, please be aware that an application/notice of appeal of any decision of the city, as provided in Section 4-501 (specifically decisions rendered by the Community Development Board), may be initiated by the applicant or any person granted party status within 14 days of the decision. The filing of an application/notice of appeal shall stay the effect of the decision pending the final determination of the case. No building permit shall be issued for a Level Two approval prior to the expiration of the appeal period. The appeal period for your case expires on July 31, 2001. Should you have any questions, please call Mark T. Parry, Planner at 727-562-4558. Based on the application and the staff recommendation, the Board found that the proposal is in compliance with the standards and criteria for a Comprehensive Infill Project, the maximum development potential standards and all other applicable standards of the Community Development Code. AUNGST, MAYOR-COMMISSIONER WHITNEY GRAY, COMMISSIONER HOYT HAMILTON, COMMISSIONER ED HART, COMMISSIONER * BIUJONSON, COMMISSIONER "EQUAL EMPLOYMENT AND AFFIRMATIVE ACTION EMPLOYER" - e CDB Meeting Date: Julv 17,2001 Case Number: FL 01-05-18 Agenda Item: D2 CITY OF CLEARWATER PLANNING DEPARTMENT STAFF REPORT BACKGROUND INFORMATION: OWNER: Linda and Angel Delgado LOCATION: 13 Cambria Street REQUEST: Flexible Development approval to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residential Infill Project. PLANS REVIEWED: Survey prepared by Florida Benchmark, Inc. and site plan materials submitted by Tom Drunasky SITE INFORMATION: PROPERTY SIZE: 0.09 acres; 4,350 square feet DIMENSIONS OF SITE: 50 feet of width by 87 feet of depth PROPERTY USE: Current use: Proposed use: Detached dwelling Two attached dwellings PLAN CATEGORIES: RH, Residential High Classification ZONING DISTRICTS: MHDR, Medium High Density Residential District ADJACENT LAND USES: North: Attached dwellings West: Attached dwellings East: Detached dwelling South: Attached dwellings Page 1 It tit CHARACTER OF THE IMMEDIA TE VICINITY: The immediate vicinity is a mix of land uses including attached and detached dwellings. ANALYSIS: The 0.09-acre site is located on the south side of Cambria Street, approximately 250 feet west of Mandalay A venue. The parcel is nonconforming with respect to lot area, lot width, and all setbacks. The site is comparable to many neighboring sites in terms of lot coverage and limited setbacks. The existing site contains a one-story Caribbean-style house with a one-car carport and a large front deck. The style resembles other "Old Florida" style structures typical of the beach environment. Overall, the site is in good condition and well landscaped. The immediate vicinity includes a mix of detached and attached dwellings. Two mid-rise residential buildings are located to the west with parking beneath. Single-family (detached) houses are located to the east and other small attached dwellings are located to the north. The majority of the structures are in fair to good condition and are located on relatively small lots. The neighborhood is identified in the special area redevelopment plan, Beach by Design, as the "Old Florida" District. The Plan identifies this area as a primarily residential neighborhood with limited retail uses that serve local needs. It recommends the redevelopment of the area with single-family dwellings and townhouses. Beach by Design acknowledges that a lack of parking in this area may hinder revitalization of existing improvements. The request is to reduce the minimum lot width from 150 feet to 50 feet and reduce the minimum lot area from 10,000 square feet to 4,350 square feet. The parcel is an existing nonconforming lot in the Medium High Density Residential District that otherwise permits higher densities and a mix of housing types. Give the lot dimensions, any substantial improvements would require approval by the Community Development Board as part of a Residential Infill Project. The proposal also includes a request to reduce the side (east) setback from 10 feet to five feet. The existing structure is nonconforming with the respect to setbacks as are the majority of other structures along Cambria Street. The reduction in the side setbacks is in keeping with the neighborhood character. The RH, Residential High Plan Category permits two dwelling units based on the property size. The final request is to permit a parking layout other than what is required by Code. With the exception of single-family dwellings, Code prohibits back out parking onto a road right-of-way. The proposal provides adequate parking on site for the two units; two in the garage for the owner- occupied unit and one space in the driveway for the second unit. Neither parking space blocks Page 2 e e access to the other and will not include parking in the right-of-way. The proposal meets Code in terms of required number of parking spaces. CODE ENFORCEMENT ANALYSIS: The site has no outstanding code enforcement violations. A. MHDR, MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT FLEXIBILITY CRITERIA FOR RESIDENTIAL INFILL PROJECTS: 1. The development or redevelopment of the parcel proposed for development is otherwise impractical without deviations from intensity and development standards. The site is an existing lot located on the Clearwater Beach. The parcel cannot be redeveloped and meet Code requirements due to its substandard size and dimensions. Any substantial improvements will require deviations from Code and approval by the Community Development Board as a Level Two application. 2. The development of the parcel proposed for development, as a Residential Infill Project will not reduce the fair market value of abutting properties. The proposal is an attractive addition to an existing house and is in keeping with the mixed-use character of this single and multi-family neighborhood. The proposal is not expected to reduce the fair market value of abutting properties. 3. The uses within the Residential Infill Project are otherwise permitted in the District. Attached dwellings are permitted in the MHDR, Medium High Density Residential District. 4. The uses within the Residential Infill Project are compatible with adjacent land uses. The immediate vicinity is composed of both attached and detached dwellings. The proposed use is consistent with the character of the area while preserving the appearance of a single-family home. 5. The development of the parcel proposed for development as a Residential Infill Project will upgrade the immediate vicinity of the parcel proposed for development. The existing house is in good condition and has an open carport. The proposal includes the addition of a two-car garage and an additional dwelling unit located atop the garage. The addition will be in keeping with the architectural style of the house. The proposal will greatly improve the parcel and the appearance of the immediate vicinity. Page 5 e e 6. The design of the proposed Residential Infill Project creates a form and function which enhances the community character of the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. The immediate vicinity has a mix of both attached and detached dwellings. Many of the existing houses resemble "Old Florida" style architecture. The proposed addition will match the style of the existing house and will appear as a single-family structure as seen from the street. 7. Flexibility in regard to lot width, required setbacks, height, off-street parking access or other development standards are justified by the benefits to community character and the immediate vicinity of the parcel proposed for development and the City of Clearwater as a whole. Clearwater Beach is in a state of redevelopment and Beach by Design encourages this in the residential neighborhoods. The parcel is an existing nonconforming lot and any substantial improvements will require deviations from the Code. The proposal is an attractive addition to an existing house and will match the architectural style of the house and surrounding properties to the east. The addition will improve the aesthetic appearance of the street and help serve as a catalyst to influence other improvements on neighboring properties. D. GENERAL APPLICABILITY: Conditions which are imposed by the Community Development Coordinator and the Community Development Board pursuant to a Level One or a Level Two Approval shall ensure that: 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density, and character of adjacent properties in which it is located. The immediate vicinity includes a mix of attached and detached dwellings. The proposal is in keeping with the architectural style of the existing house and other detached dwellings to the east. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The area is zoned MHDR which promotes higher densities. The property size permits two dwelling units based on the RH, Residential High Plan Classification. The design is consistent with the architectural style of the house and will resemble a single-family house as seen from the street. Page 6 e e 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The additional dwelling unit is not expected to adversely affect the health or safety or persons residing or working in the neighborhood. 4. The proposed development is designed to minimize traffic congestion. The additional dwelling unit is not expected to increase traffic congestion In this residential neighborhood. s. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The neighborhood includes detached dwellings to the east and mid-rise attached dwellings to the west. The proposed addition will be in keeping with the community character and will match the architectural style of several surrounding structures. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The addition is designed to be architecturally compatible with the existing house. The addition unit is not expected to produce adverse effects onto adjacent properties. SUMMARY AND RECOMMENDATION: The application and supporting materials were reviewed by the Development Review Committee on June 14, 2001. The development will further the City's goals of improving the character of area and promoting the private sector redevelopment. The proposal is in compliance with the Flexibility Criteria for a Residential Infill Project Criteria and the recommendations of Beach by Design. The Planning Department recommends APPROV AL of the Flexible Development application to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residential Infill Project at 13 Cambria Street, with the following three conditions: 1. That any future redevelopment initiatives include a parking design that complies with Code or is approved by the Community Development Board; 2. That the final building design is general consistent with the elevations submitted to staff April 24, 2001, or as modified by the Community Development Board; and 3. That should the existing/proposed units be rented, the terms shall comply with the Countywide Rules (no less than 30 days). DRAFT AGENDA DEVELOPMENT REVIEW COMMITTEE Thursday, June 14,2001 Staff Review: Attendees include: Lisa Fierce, Mark Parry, Rick Albee, Mike Gust, Tom Glenn, Ryan Givens and Don Melone Case: FL 00-11-54 - 803 Carlton Street Owner(s)/ Applicants: Overcoming Church of God in Christ Location: 0.19 acres located on the south side of Carlton Street, approximately 200 feet east of Roosevelt A venue. Atlas Page: 269A Request: Flexible Development approval to terminate the status of a nonconforming use of an existing church in the MDR District. Proposed Use: A church with on-site parking. Presenter: Ryan Givens, Planner. 10.00 a.m. This application was not reviewed by the DRe. It will be reviewed at a later date. Case: FL 01-05-18 - 13 Cambria Street Owner! Applicant: Linda and Angel Delgado. Representative: Mr. Tom Drunasky. Location: 0.09 acres on the north side of Cambria Street, approximately 100 feet west of Mandalay Boulevard. Atlas Page: 258A Zoning: MHDR, Medium High Density Residential District. Request: Flexible Development approval to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the side (west) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residentiallnfill Project. Proposed Use: An 818-square foot addition to include a garage and additional dwelling unit for a total of two dwelling units. Presenter: W. Ryan Givens, Planner. Attendees included: Ryan Givens, Al Carrier, Lisa Fierce, Tom Glenn, Mike Gust, Don Melone and Tom Orunasky, contractor. The ORC reviewed this application with the following comments: I) $200 Recreation Facility impact fee due prior to building permit for additional dwelling unit. 2) There must be another black barrel for the new dwelling unit - per solid waste (two total) 3) What is the character of the area? 4) Clarify use - seasonal rental? Tom D say expected it to be seasonally used. t-H ~ - e 5) Will this be overnight accommodations? Must be part of a different request if that is the case. We didn't review it for that use. Staff needs to determine if we would support. Mr. Drunasky says he can speak for client and it wont befor less than 30 days. 6) What type of occupational license will be required to verify parking and transportation impact fee. 7) Need three parking spaces - by code - mike can only recognize two spaces because code doesn't allow back out movement for anything other than single family use 8) Rain gutters required on the east side of the addition and direct runoff to street 9) Impact fees for water and sewer will be required if requesting separate water meter. 10) No comments from fire 11) Mr Drunasky will be out of town the week of June 25. He will alert someone else in his office to handle in his absence. 12) Need 15 sets of all revised plans and application including signed/sealed survey by Monday, June 18,2001 for review by the CDB at its July 17 meeting. 10:30 a.m. Case: FL 01-05-22 - 2652 McMullen Booth Road Owner(s)/ Applicants: City National Bank of Florida, Trustee. Location: 15.7 acre located on the southwest comer of Allen Avenue and McMullen Booth Road. Atlas Page: 223A Request: Flexible Development approval to permit a six-foot high fence with gate in the required front setback along McMullen Booth Road. Proposed Use: A six-foot high ornamental aluminum fence as part of an existing multi-family development. Presenter: Mark Parry, Planner. Attendees included: Mark Parry, Al Carrier, Lisa Fierce, Tom Glenn, Mike Gust, Don Melone, and Jane Sears, representing applicant. The DRC reviewed this application with the following comments: 1) Need to know what the fence/wall will look like - need detail with dimensions - Jane says it will be ornamental without columns 2) Staff strongly suggests that the material be aluminum and not iron 3) Need to clearly what is existing and what is proposed on the site plan and fence/wall location 4) Show fencing exactly where it is to go - not permitted in right of way, drainage and utility and sidewalk easements - per Stormwater - need to show easements on revised plan 5) No permanent structures over water lines - the city has a blanket water easement throughout the project - we need to see the fence location to verify there is nothing to be constructed there 6) Need an as built water line map - prior to building permit - Don has asked for this before and is holding current request for carports and other structures until this is received 7) Need a waiver of liability from applicant to city for water line in relation to gate sensors/vehicle detectors - prior to permit - only need ifthere are sensors over the water lines 8) No parks and rec comments 9) No land resource comments 10) Fire okay per letter from contractor 11) Need clarification of what is proposed for gates at the McMullen Booth - don't want cars backing up on McMullen Booth - the County will need to review as well - 50 foot throat depth - 50 feet back from property; Mike Gust to contact County initially 12) Clarify how the gate will open - guard? Remote? 13) Sliding gates are highly recommended - proposed opening inward to the site along McMullen Booth; 14) Need to clarify if there is a public sidewalk along Allen Avenue, across which this proposed fence will be located - no fence in the right of way - prior to going to CDB 15) Need 15 sets of all revised plans/applications with signed/sealed survey by Monday, June 18,2001 for review by the CDB at its July 17 meeting 16) Jane will consult with the contractor about timing for this - july 16 deadline for revised plans for August 21 CDB meeting. Staff strongly recommended that we receive the information earlier to review for sufficiency. '" . . REQUEST: Flexible Development approval to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residential Infill Project. Page 1 . . Neither parking space blocks access to the other and will not include parking in the right-of-way. The proposal meets Code in terms of required number of parking spaces. The Planning Department recommends APPROVAL of the Flexible Development application to reduce the minimum lot size from 15,000 square feet to 4,350 square feet, reduce the minimum lot width from 150 feet to 50 feet, reduce the side (east) setback from 10 feet to five feet and to permit a parking lot design other then what is required by Code, as part of a Residential Infill Project at 13 Cambria Street, with the following three conditions: 1. That any future redevelopment initiatives include a parking design that complies with Code or is approved by the Community Development Board; 2. Dronasky Tom Craig Remodeling and Building 5250 State Road 54 New Port Richey, Florida 34652 FilE RE: Development Order regarding case FL 01-05-18 at 13 Cambria Street Please be aware that the issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. Dear Mr. Dronasky: This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the Community Development Code. The appeal period for your case expires on July 31,2001. The Community Development Board approved the application with the following conditions: Very truly yours~ /0 . j \] .0CL ~ ) f '--- Gerald ~ki, Chairm Community Development Board . ~ S:\Planning Department\C D B\FLEX\Jnnactive or Finished Applicalions\Cambria 13 Delgado.
