Vacant Single- family dwellings Residential/Office General (RIO G) Residential Urban (RU) 0, Office District LMDR, Low Medium Density Residential District Staff Report - Community Development Board - February 17, 2004 - Case LUZ2003-l1012 - Page 1 EXISTING SURROUNDING USES: North: Mobile home park, Retail & Single-family residential South: Single-family residential East: Single-family residential West: Office ANALYSIS This Future Land Use Plan amendment and rezoning application involves three vacant parcels of land, approximately 0.74-acres in area. The site has a Future Land Use Plan designation of Residential/Office General (RlOG), as well as a zoning classification of the 0, Office District. The applicant is requesting to amend the Future Land Use Plan designation of this site to the Residential Urban (RU) category and to rezone it to the LMDR, Low Medium Density Residential District to allow the development of five detached dwellings on the property. In accordance with the Countywide Plan Rules, the land use plan amendment is subject to approval by the Pinellas Planning Council and Board of County Commissioners acting as the Countywide Planning Authority. Based on the acreage and density involved in this plan amendment, review and approval by the Florida Department of Community Affairs is not required. I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Sections 4-602.F.l & 4-603.F.1] Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support of the proposed land use plan amendment are as indicated below: 3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to accommodate public demand and promote infill development. 13.1 Objective - Assure an adequate supply of housing in Clearwater by providing for additional new dwelling units in a variety of types, costs, and locations to meet the needs of the residents of the City of Clearwater. The proposed plan amendment is not in conflict with any Clearwater Comprehensive Plan Goals, Objectives or Policies, and is therefore consistent with the Plan. II. CONSISTENCY WITH COUNTYWIDE PLAN The purpose of the proposed Residential Urban (RU) category, as specified in Section 2.3.3.1.5 of the Countywide Rules, is to depict those areas of the County that are now developed, or appropriate to be developed, in an urban low density residential manner; and to recognize such areas as primarily well-suited for residential uses that are consistent with the urban qualities and natural resource characteristics of such areas. Residential uses are the primary uses in this plan category up to a maximum of 7.5 dwelling units per acre. Secondary uses permitted in Staff Report - Community Development Board - February 17,2004 - Case LUZ2003-ll012 - Page 2 Residential Urban areas include residential equivalent, institutional, transportation/utility, public educational facility, ancillary non-residential and recreation and open space uses. The Residential Urban (RU) category is generally appropriate to locations removed from, but in close proximity to urban activity centers; in areas where use and development characteristics are urban residential in nature; and in areas serving as a transition between more suburban and more urban residential areas. These areas are generally served by and accessed from minor and collector roadways that connect to the arterial and thoroughfare highway network. The proposed plan amendment is consistent with the purpose and locational characteristics of the Countywide Plan. III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE CITY & NEIGHBORHOOD [Section 4-602.F.2 & 4-603.F.3] Lakeview Road Corridor In the vicinity of the subject site, Lakeview Road is a two-lane undivided roadway. Lakeview Road between Missouri Avenue and Highland Avenue is characterized by a variety of development including single-family and multi-family residential, office, retail and institutional uses. The Countywide Future Land Use Plan has designated land in this area on the north and south sides of Lakeview Road as Residential Urban, Residential Medium, Residential/Office General, Commercial General and Institutional. Immediate Surrounding Area The Future Land Use Plan (FLUP) category for the immediate surrounding area to the west is Residential/Office General, with Residential Urban to the east and south. Areas to the north are designated Commercial General and Residential Medium. The existing surrounding uses include single-family dwellings to the east and south and offices to the west. A mobile home park, retail use and single-family dwellings are located to the north. The proposed Future Land Use Plan amendment and rezoning are compatible with the surrounding uses due to the residential character of the surrounding area and proposed use. IV. SUFFICIENCY OF PUBLIC FACILITIES [Sections 4-602.F.5. & 4-603.F.5] The subject site is approximately 0.74-acres in area and is currently vacant. Based on a maximum permitted intensity in the current R/OG category of a 0.50 FAR, a 16,117 square foot building could be constructed on the site. Based on a maximum permitted density in the proposed RU category of 7.5 dwelling units per acre, a maximum of five (5) dwelling units would be permitted on this site provided all code requirements are met. Roadways The accepted methodology for reviewing the transportation impacts of the proposed plan amendment is based on the Pinellas Planning Council's (PPC) traffic generation guidelines. The Staff Report - Community Development Board - February 17, 2004 - Case LUZ2003-ll 0 12 - Page 3 PPC's traffic generation rates have been calculated for the subject site based on the existing and proposed Future Land Use Plan categories and are included in the following table. The proposed land use plan amendment will not decrease the existing capacity of any of the surrounding roadways and will not have a negative effect on the segment's level of service as the proposed category is less intensive than the current category. Specific uses in the current and proposed zoning districts have also been analyzed for the level of vehicle trips that could be generated based on the Institute of Transportation Engineer's Manual. The transportation impacts associated with this land use plan amendment and rezoning will not result in the Staff Report - Community Development Board - February 17, 2004 - Case LUZ2003-11012 - Page 4 degradation of the existing LOS to the surrounding road network. In addition, no impact to the operational efficiency of the signalized intersections within the subject area is anticipated by the proposed amendment. Mass Transit The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The total miles of fixed route service will not change; the subject site is located within 14 mile of an existing transit route; and headways are less than or equal to one hour. Pinellas Suncoast Transit Authority (PSTA) bus service is available along Missouri Avenue. Water The current zoning district could demand approximately 1,611 gallons per day. Under the proposed zoning district, water demand could approach approximately 1,250 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for water. Wastewater The current zoning district could demand approximately 1,289 gallons of wastewater per day. Under the proposed zoning district, sewer demand could approach approximately 1,000 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for wastewater. Solid Waste The current zoning could result in 43 tons of solid waste per year for an office use. Under the proposed zoning district, there could be approximately 12 tons of solid waste generated per year. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for solid waste. Recreation and Open Space As the proposed land use and rezoning will change the permitted uses from non-residential to residential, payment of a recreation facilities and land impact fee will be required. The amount of this fee is dependent on the number of units constructed and will be addressed during the site plan review process. V. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Prior to development of the subject property, site plan approval will be required. At that time, the stormwater management system will be required to meet all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. In addition, at the time of site plan approval, a City Land Resource Specialist will be required to review the proposed site plan to ensure adherence with the City's tree preservation and protection standards. Staff Report - Conununity Development Board - February 17, 2004 - Case LUZ2003-ll 0 12 - Page 5 VI. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Due to the residential nature of the surrounding area, the location of the proposed LMDR, Low Medium Density Residential boundaries are logical and an appropriate classification. The district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines and existing improvements. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-201; 2-701 & 4-602.F.1. and .2.] The proposed LMDR, Low Medium Density Residential District permits a density of 7.5 dwelling units per acre and an ISR of 0.65, while the existing 0, Office District permits a FAR of 0.50 and an ISR of 0.75. The total area of the subject site is 32,234 square feet and it is 271 feet in width. Each of the three parcels alone exceed the 5,000 square foot minimum lot area requirement and the 50-foot minimum lot width requirement of the Low Medium Density Residential zoning district. The parcels meet the size requirements of the proposed District and the proposed detached dwelling use is permitted in the LMDR District. Approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. The existing and proposed use of this property is consistent with the Low Medium Density Residential zoning district regulations. SUMMARY AND RECOMMENDATIONS: An amendment to the Future Land Use Plan from the Residential/Office General (R/OG) category the Residential Urban (RU) category and a rezoning from the 0, Office District to the LMDR, Low Medium Density Residential District for the subject property is requested in order to develop five detached dwellings on the site. The site is surrounded by a mobile home park, single- family dwellings and a retail use to the north, offices to the west and single-family dwellings to the east and south. The proposed Residential Urban (RU) Future Land Use Plan classification and LMDR, Low Medium Density Residential zoning district are consistent with both the City and the Countywide Comprehensive Plans, is compatible with the surrounding area, does not require nor affect the provision of public services, is compatible with the natural environment and is consistent with the development regulations of the City. Amend the Future Land Use Plan designation for 1283 Lakeview Road from the Residential/Office General (R/OG) to the Residential Urban (RU) category, and 2. AN ORDINANCE AMENDING THE COUNTYWIDE FUTURE LAND USE PLAN OF PINELLAS COUNTY, FLORIDA, BY ACTION ON CASE NUMBERS CW 04-23 AND CW 04-24 INITIATED BY THE CITY OF CLEARWATER AND TRANSMITTED TO THE BOARD IN ACCORDANCE WITH THE SPECIAL ACT; PROVIDING FOR AMENDMENT TO THE PLAN; PROVIDING FOR SEVERABILITY; PROVIDING FOR FILING OF THE ORDINANCE AND FOR AN EFFECTWE DATE WHEREAS, proposed amendments to the Countywide Future Land Use Plan, which is an element of the Countywide Comprehensive Plan of Pinellas County, Florida, have been presented at a public hearing to the Board of County Conlmissioners in their capacity as the Countywide Planning Authority; and WHEREAS, notices and advertisements of public hearings have been accomplished as required by Chapter 73-594, Laws of Florida, as amended; and WHEREAS, procedures of the Special Act and County Charter have been followed . . concerning the Pinellas Planning Council and the Countywide Planning Authority for proposed amendment to the Countywide Future Land Use Plan; and WHEREAS, the City of Clearwater initiated proposed amendments which were considered at a public hearing by the Pinellas Planning Council on April 21, 2004, with recommendation made by the Council that is documented in the Council report referred to as. Attachment A; and WHEREAS, the Board has conducted a public hearing and taken action that is documented by ordinance for approvals or partial approvals and partial denials and by resolution for denials, with both documents including the relevant Council reports as attached. 10 ,0 t , . NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pinellas County, Florida, acting as the Countywide Planning Authority in regular meeting duly assembled on May 11, 2004,as follows: Section 1 - Amending the Countywide Future Land Use Plan The Countywide Future Land Use Plan for Pinellas County adopted in Section 3(a) of Ordinance 89-4 is amended to reflect the change adopted as follows: #CW 04-23 . l2 .g ~ .. 0.7 acres located on the south side of Lakeview Road, between Friend Avenue and Boylan Avenue, from Residential/Office General to Residential Urban. Section 3 - Filin~ of Ordinance: Effective Date A certified copy of this ordinance shall be filed with the Secretary of State with the Ordinance and Attachment "A" to be filed with Clerk of the Circuit Court. FINDINGS Based on the background data and analysis in this report, the following findings are submitted for consideration of the recommendation for approval of the amendment request: A. The proposed amendment is consistent with Division 5.3, Section 5.3.4 of the Rules Concerning the Administration of the Countywide Future Land Use Plan (Countywide Rules), the purpose of which is to recognize and provide for Level 1 subthreshold amendments of the Countywide Plan Map. Level I - Type A subthreshold amendments are subject to an annual aggregation limit of thirty acres. Since this is Clearwater's first subthreshold amendment, the City's total for the year 2004 is 0.7 acres. The site has a Future Land Use Plan designation of Residential/Office General (RIOG), as well as a zoning classification of the 0, Office District. The applicant is requesting to amend the Future Land Use Plan designation of this site to the Residential Urban (RU) category and to rezone it to the LMDR, Low Medium Density Residential District to allow the development of five detached dwellings on the property. In accordance with the Countywide Plan Rules, the land use plan amendment is subject to approval by the Pinellas Planning Council and Board of County Commissioners acting as the Countywide Planning Authority. Based on the acreage and density involved in this plan amendment, review and approval by the Florida Department of Community Affairs is not required. I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN [Sections 4-602.F.l & 4-603.F.l ] Applicable Goals, Objectives and Policies from the Clearwater Comprehensive Plan in support of the proposed land use plan amendment are as indicated below: 3.0 Goal - A sufficient variety and amount of future land use categories shall be provided to accommodate public demand and promote infill development. 13.1 Objective - Assure an adequate supply of housing in Clearwater by providing for additional new dwelling units in a variety of types, costs, and locations to meet the needs of the residents of the City of Clearwater. The proposed plan amendment is not in conflict with any Clearwater Comprehensive Plan Goals, Objectives or Policies, and is therefore consistent with the Plan. II. CONSISTENCY WITH COUNTYWIDE PLAN The purpose of the proposed Residential Urban (RU) category, as specified in Section 2.3.3.1.5 of the Countywide Rules, is to depict those areas of the County that are now developed, or appropriate to be developed, in an urban low density residential manner; and to recognize such areas as primarily well-suited for residential uses that are consistent with the urban qualities and natural resource characteristics of such areas. Residential uses are the primary uses in this plan category up to a maximum of 7.5 dwelling units per acre. Secondary uses permitted in Staff Report - Community Development Board - February 17,2004 - Case LUZ2003-11012 - Page 2 o o Residential Urban areas include residential equivalent, institutional, transportation/utility, public educational facility, ancillary non-residential and recreation and open space uses. The Residential Urban (RU) category is generally appropriate to locations removed from, but in close proximity to urban activity centers; in areas where use and development characteristics are urban residential in nature; and in areas serving as a transition between more suburban and more urban residential areas. These areas are generally served by and accessed from minor and collector roadways that connect to the arterial and thoroughfare highway network. The proposed plan amendment is consistent with the purpose and locational characteristics of the Countywide Plan. III. COMPATIBILITY WITH SURROUNDING PROPERTY/CHARACTER OF THE CITY & NEIGHBORHOOD [Section 4-602.F.2 & 4-603.F.3] Lakeview Road Corridor In the vicinity of the subject site, Lakeview Road is a two-lane undivided roadway. Lakeview Road between Missouri Avenue and Highland Avenue is characterized by a variety of development including single-family and multi-family residential, office, retail and institutional uses. The Countywide Future Land Use Plan has designated land in this area on the north and south sides of Lakeview Road as Residential Urban, Residential Medium, Residential/Office General, Commercial General and Institutional. Immediate Surrounding Area The Future Land Use Plan (FLUP) category for the immediate surrounding area to the west is Residential/Office General, with Residential Urban to the east and south. Areas to the north are designated Commercial General and Residential Medium. The existing surrounding uses include single-family dwellings to the east and south and offices to the west. A mobile home park, retail use and single-family dwellings are located to the north. The proposed Future Land Use Plan amendment and rezoning are compatible with the surrounding uses due to the residential character of the surrounding area and proposed use. IV. SUFFICIENCY OF PUBLIC FACILITIES [Sections 4-602.F.5. & 4-603.F.5] The subject site is approximately O.74-acres in area and is currently vacant. The total miles of fixed route service will not change; the subject site is located within 14 mile of an existing transit route; and headways are less than or equal to one hour. Pinellas Suncoast Transit Authority (PSTA) bus service is available along Missouri Avenue. Water The current zoning district could demand approximately 1,611 gallons per day. Under the proposed zoning district, water demand could approach approximately 1,250 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for water. Wastewater The current zoning district could demand approximately 1,289 gallons of wastewater per day. Under the proposed zoning district, sewer demand could approach approximately 1,000 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for wastewater. Solid Waste The current zoning could result in 43 toils of solid waste per year for an office use. Under the proposed zoning district, there could be approximately 12 tons of solid waste generated per year. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for solid waste. Recreation and Open Space As the proposed land use and rezoning will change the permitted uses from non-residential to residential, payment of a recreation facilities and land impact fee will be required. The amount of this fee is dependent on the number of units constructed and will be addressed during the site plan review process. v. IMP ACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Prior to development of the subject property, site plan approval will be required. At that time, the stormwater management system will be required to meet all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. In addition, at the time of site plan approval, a City Land Resource Specialist will be required to review the proposed site plan to ensure adherence with the City's tree preservation and protection standards. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Due to the residential nature of the surrounding area, the location of the proposed LMDR, Low Medium Density Residential boundaries are logical and an appropriate classification. The district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines and existing improvements. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-201; 2-701 & 4-602.F.1. and .2.] The proposed LMDR, Low Medium Density Residential District permits a density of 7.5 dwelling units per acre and an ISR of 0.65, while the existing 0, Office District permits a FAR of 0.50 and an ISR of 0.75. The total area of the subject site is 32,234 square feet and it is 271 feet in width. Each of the three parcels alone exceed the 5,000 square foot minimum lot area requirement and the 50-foot minimum lot width requirement of the Low Medium Density Residential zoning district. The parcels meet the size requirements of the proposed District and the proposed detached dwelling use is permitted in the LMDR District. Approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. The existing and proposed use of this property is consistent with the Low Medium Density Residential zoning district regulations. SUMMARY AND RECOMMENDATIONS: An amendment to the Future Land Use Plan from the Residential/Office General (RIOG) category the Residential Urban (RU) category and a rezoning from the 0, Office District to the LMDR, Low Medium Density Residential District for the subject property is requested in order to develop five detached dwellings on the site. The site is surrounded by a mobile home park, single-family dwellings and a retail use to the north, offices to the west and single-family dwellings to the east and south. The Countywide Future Land Use Plan has designated land in this area on the north and south sides of Lakeview Road as Residential Urban, Residential Medium, ResidentiaVOffice General, Commercial General and Institutional. Immediate Surrounding Area The Future Land Use Plan (FLUP) category for the immediate surrounding area to the west is ResidentiaVOffice General, with Residential Urban to the east and south. Areas to the north are designated Commercial General and Residential Medium. The existing surrounding uses include single-family dwellings to the east and south and offices to the west. A mobile home park, retail use and single-family dwellings are located to the north. The transportation impacts associated with this land use plan amendment and rezoning will not result in the Staff Report - Community Development Board - February 17,2004 - Case LUZ2003-11012 - Page 4 degradation of the existing LOS to the surrounding road network. In addition, no impact to the operational efficiency of the signalized intersections within the subject area is anticipated by the proposed amendment. Mass Transit The Citywide LOS for mass transit will not be affected by the proposed plan amendment. The total miles of fixed route service will not change; the subject site is located within ~ mile of an existing transit route; and headways are less than or equal to one hour. Pinellas Suncoast Transit Authority (PST A) bus service is available along Missouri Avenue. Water The current zoning district could demand approximately 1,611 gallons per day. Under the proposed zoning district, water demand could approach approximately 1,250 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for water. Wastewater The current zoning district could demand approximately 1,289 gallons of wastewater per day. Under the proposed zoning district, sewer demand could approach approximately 1,000 gallons per day. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for wastewater. Solid Waste The current zoning could result in 43 tons of solid waste per year for an office use. Under the proposed zoning district, there could be approximately 12 tons of solid waste generated per year. As the proposed amendment will only permit less intensive uses, there will not be a negative affect on the City's current LOS for solid waste. Recreation and Open Space As the proposed land use and rezoning will change the permitted uses from non-residential to residential, payment of a recreation facilities and land impact fee will be required. The amount of this fee is dependent on the number of units constructed and will be addressed during the site plan review process. V. IMPACT ON NATURAL ENVIRONMENT [Section 4-603.F.5.] Prior to development of the subject property, site plan approval will be required. At that time, the stormwater management system will be required to meet all City and Southwest Florida Water Management District (SWFWMD) stormwater management criteria. Water quantity and quality will be controlled in compliance with the Clearwater Comprehensive Plan. In addition, at the time of site plan approval, a City Land Resource Specialist will be required to review the proposed site plan to ensure adherence with the City's tree preservation and protection standards. LOCATION OF DISTRICT BOUNDARIES [Section 4-602 .F.6.] Due to the residential nature of the surrounding area, the location of the proposed LMDR, Low Medium Density Residential boundaries are logical and an appropriate classification. The district boundaries are appropriately drawn in regard to location and classifications of streets, ownership lines and existing improvements. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS [Sections 2-201; 2-701 & 4-602.F.1. and .2.] The proposed LMDR, Low Medium Density Residential District permits a density of 7.5 dwelling units per acre and an ISR of 0.65, while the existing 0, Office District permits aFAR of 0.50 and an ISR of 0.75. The total area of the subject site is 32,234 square feet and it is 271 feet in width. Each of the three parcels alone exceed the 5,000 square foot minimum lot area requirement and the 50-foot minimum lot width requirement of the Low Medium Density Residential zoning district. The parcels meet the size requirements of the proposed District and the proposed detached dwelling use is permitted in the LMDR District. Approval of this land use plan amendment and zoning district designation does not guarantee the right to develop on the subject property. Transportation concurrency must be met, and the property owner will have to comply with all laws and ordinances in effect at the time development permits are requested. The existing and proposed use of this property is consistent with the Low Medium Density Residential zoning district regulations. SUMMARY AND RECOMMENDATIONS: An amendment to the Future Land Use Plan from the Residential/Office General (RIOG) category the Residential Urban (RU) category and a rezoning from the 0, Office District to the LMDR, Low Medium Density Residential District for the subject property is requested in order to develop five detached dwellings on the site. The site is surrounded by a mobile home park, single-family dwellings and a retail use to the north, offices to the west and single-family dwellings to the east and south. The proposed Residential Urban (RU) Future Land Use Plan classification and LMDR, Low Medium Density Residential zoning district are consistent with both the City and the Countywide Comprehensive Plans, is compatible with the surrounding area, does not require nor affect the provision of public services, is compatible with the natural environment and is consistent with the development regulations of the City.
