SUMMARY: This is one of three compamon items relating to Island Estates: neighborhood plan, rezomng and text amendments. . The Island Estates neighborhood is approximately 210 acres. It includes the residentially used properties located on land known as Island Estates, lying northerly of the northerly right of way line of Memorial Causeway between the mainland and Clearwater Beach. It is zoned Low Medium Density Residential, Medium Density Residential, Medium High Density Residential, High Density Residential, Institutional, and Commercial. · The Island Estates neighborhood has future land use designations of Residential Urban, Residential Medium, Residential High, Institutional, and Commercial General. Proposed Districts: ANALYSIS Pursuant to Section 4-608 of the Community Development Code, the Island Estates neighborhood submitted an application and the required petition to initiate the Neighborhood Conservation Overlay District (NCOD) planning process in December 2000. At the April 19, 2001 meeting the City Commission approved the application. Between September 2001 and Febmary 2002 the neighborhood, in conjunction with Planning Department staff, held a total of seven (7) public meetings with the neighborhood to develop the Island Estates Neighborhood Plan. The Plan focuses on neighborhood strengths and weaknesses and includes goals and objectives to address those issues. Furthermore, the Plan includes an implementation section, which supports applying a NCOD as an overlay district in addition to the neighborhood's existing zoning. This overlay district would apply development standards in addition to those required by the underlying zoning districts. The Island Estates neighborhood currently has five (5) different zoning designations. All the land uses are residential except the church located in the Institutional District. The 11 properties in the Commercial District are townhouses. I. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN (Section 4-602.F.1) Applicable Goals, Objectives and Policies from the Clearwater Comprehensive are as follows to support the proposed rezoning. 2. Goal - The City of Clearwater shall utilize innovative and flexible planning and engineering practices, an<;l urban design standards in order to protect historic resources, ensure neighborhood preservation, redevelop blighted areas, and encourage infill development. 2.2 Objective - The City of Clearwater shall continue to support innovative planned development and mixed land use development techniques in order to promote infill development that is consistent and compatible with the surrounding environment. COMPATIBILITY WITH SURROUNDING PROPERTY (Sections 4-602.F.2 and 4-602.FA) The Island Estates Neighborhood Conservation Overlay District permits only three of the permitted uses currently allowed in the Low Medium Density Residential zoning district, and permits all existing permitted uses currently allowed in the other zoning districts. The uses allowed in the IENCOD will therefore not dramatically alter what uses are currently permitted. Because Island Estates is geographically isolated from the rest of the City, the rezoning will not affect many surrounding properties. Some commercially zoned properties are located in the vicinity of the Island Estates NCOD and primarily service the residential uses surrounding them. The proposed rezoning is compatible with the surrounding uses and zoning because it will not alter the primary uses currently allowed in Island Estates. III. CHARACTER OF THE CITY AND NEIGHBORHOOD (Section 4-602.F.3) Island Estates is a unique neighborhood within the City of Clearwater in that almost every property is on the waterfront. Most of the neighborhood has residential land use, ranging from large single-family homes to multi-story, multi-unit condominiums. The most dominant land use is single-family residences on lots between 7,500 and 9,000 square feet. The multi-family areas range in density from duplexes and triplexes to large- scale, multi-story condominiums with hundreds of residents. Because each condominium has its own resident association, each condominium has its own regulations and character. The character of the City of Clearwater is also dominated by residential uses. Because Island Estates is geographically separate from the rest of the City, and because the City of Clearwater is very residential in character, the proposed rezoning will be in character with existing and surrounding uses and will not adversely or unreasonably affect the use of other property within the vicinity. IV. SUFFICIENCY OF PUBLIC FACILITIES (Section 4-602.F.5) The Island Estates neighborhood is approximately 210 acres in area. Because this neighborhood is completely developed, no redevelopment is expected that will impact public facilities. The underlying land use categories of Residential Urban (RU), Residential Medium (RM), Residential High (RR), Institutional (1), Commercial General (CG) would not to be changed. The rezoning will result in a minimum lot size requirement of 7,500 square feet for properties currently zoned LMDR instead of 5,000. This will ensure that densities will not increase over time and, as a result, impacts on City services will not increase either. 4 S:\Planning Department\NCOD\ISLAND ESTATES\resolution and ordinances\Rezoning\IE Rezoning Staff Report.doc Z 02-03-02 Roadways Based on the Countywide Plan Rules traffic generation standards, it was determined that rezoning will result in no change in average daily trips. The proposed rezoning will not degrade the existing LOS. Mass Transit There are no impacts projected for mass transit within the Island Estates vicinity. Water Under the proposed zoning district no changes will be experienced in water demand, therefore the proposed rezoning will not negatively affect the City's current Level of Service for water. Island Estates currently receives reclaimed water services. This service will continue to be available to the neighborhood, but no additional need will result from the rezoning. Wastewater The proposed rezoning will generate no changes in sanitary sewage flow rates; therefore the proposed amendment will create no impacts on the City's wastewater system or current LOS. Solid Waste The proposed zoning district will not generate any additional solid waste than currently generated, therefore, the proposed amendment will have no negative impacts on the City's current LOS for solid waste. Recreation and Open Space The proposed rezoning will not impact parkland needs and therefore will not affect the City's current LOS for core system parkland SUMMARY AND RECOMMENDATIONS The proposed IENCOD is consistent with the City's Comprehensive Plan. It is also consistent with and implements provisions of the Island Estates Neighborhood Plan, which is the special area plan required to be developed for any neighborhood conservation overlay district pursuant to Community Development Code Section 4-608. The proposed rezoning is compatible with the surrounding area, supports the needs and existing character of the neighborhood and City, does not require nor affect the provision of public services, and the boundaries are appropriately drawn. Proposed Districts: ANAL YSIS Pursuant to Section 4-608 of the Community Development Code, the Island Estates neighborhood submitted an application and the required petition to initiate the Neighborhood Conservation Overlay District (NCOD) planning process in December 2000. At the April 19, 2001 meeting the City Commission approved the application. Between September 2001 and February 2002 the neighborhood, in conjunction with Planning Department staff, held a total of seven (7) public meetings with the neighborhood to develop the Island Estates Neighborhood Plan. The Plan focuses on neighborhood strengths and weaknesses and includes goals and objectives to address those issues. Furthermore, the Plan includes an implementation section, which supports applying a NCOD as an overlay district in addition to the neighborhood's existing zoning. This overlay district would apply development standards in addition to those required by the underlying zoning districts. The Island Estates neighborhood currently has five (5) different zoning designations. All the land uses are residential except the church located in the Institutional District. The 11 properties in the Commercial District are townhouses. Goal - The City of Clearwater shall utilize innovative and flexible planning and engineering practices, and urban design standards in order to protect historic resources, ensure neighborhood preservation, redevelop blighted areas, and encourage infill development. 2.2 Objective - The City of Clearwater shall continue to support innovative planned development and mixed land use development techniques in order to promote infill development that is consistent and compatible with the surrounding environment. II. COMPATIBILITY WITH SURROUNDING PROPERTY (Sections 4-602.F.2 and 4-602.F.4) The Island Estates Neighborhood Conservation Overlay District permits only three of the permitted uses currently allowed in the Low Medium Density Residential zoning district, and permits all existing permitted uses currently allowed in the other zoning districts. The uses allowed in the IENCOD will therefore not dramatically alter what uses are currently permitted. Because Island Estates is geographically isolated from the rest of the City, the rezoning will not affect many surrounding properties. Some commercially zoned properties are located in the vicinity of the Island Estates NCOD and primarily service the residential uses surrounding them. The proposed rezoning is compatible with the surrounding uses and zoning because it will not alter the primary uses currently allowed in Island Estates. III. CHARACTER OF THE CITY AND NEIGHBORHOOD (Section 4-602.F.3) Island Estates is a unique neighborhood within the City of Clearwater in that almost every property is on the waterfront. Most of the neighborhood has residential land use, ranging from large single-family homes to multi-story, multi-unit condominiums. The most dominant land use is single-family residences on lots between 7,500 and 9,000 square feet. The multi-family areas range in density from duplexes and triplexes to large- scale, multi-story condominiums with hundreds of residents. Because each condominium has its own resident association, each condominium has its own regulations and character. The character of the City of Clearwater is also dominated by residential uses. Because Island Estates is geographically separate from the rest of the City, and because the City of Clearwater is very residential in character, the proposed rezoning will be in character with existing and surrounding uses and will not adversely or unreasonably affect the use of other property within the vicinity. IV. SUFFICIENCY OF PUBLIC FACILITIES (Section 4-602.F.5) The Island Estates neighborhood is approximately 210 acres in area. Because this neighborhood is completely developed, no redevelopment is expected that will impact public facilities. The underlying land use categories of Residential Urban (RU), Residential Medium (RM), Residential High (RR), Institutional (1), Commercial General (CG) would not to be changed. The rezoning will result in a minimum lot size requirement of 7,500 square feet for properties currently zoned LMDR instead of 5,000. Roadways Based on the Countywide Plan Rules traffic generation standards, it was determined that rezoning will result in no change in average daily trips. The proposed rezoning will not degrade the existing LOS. Mass Transit There are no impacts projected for mass transit within the Island Estates vicinity. Water Under the proposed zoning district no changes will be experienced in water demand, therefore the proposed rezoning will not negatively affect the City's current Level of Service for water. Island Estates currently receives reclaimed water services. This service will continue to be available to the neighborhood, but no additional need will result from the rezoning. Wastewater The proposed rezoning will generate no changes in sanitary sewage flow rates; therefore the proposed amendment will create no impacts on the City's wastewater system or current LOS. Solid Waste The proposed zoning district will not generate any additional solid waste than currently generated, therefore, the proposed amendment will have no negative impacts on the City's current LOS for solid waste. Recreation and Open Space The proposed rezoning will not impact parkland needs and therefore will not affect the City's current LOS for core system parkland SUMMARY AND RECOMMENDATIONS The proposed IENCOD is consistent with the City's Comprehensive Plan. It is also consistent with and implements provisions of the Island Estates Neighborhood Plan, which is the special area plan required to be developed for any neighborhood conservation overlay district pursuant to Community Development Code Section 4-608. The proposed rezoning is compatible with the surrounding area, supports the needs and existing character of the neighborhood and City, does not require nor affect the provision of public services, and the boundaries are appropriately drawn.
