Brightwater Cove
Description of Request: To construct a three (3) story structure consisting of nine (9)
residential townhome units (two stories ofliving area over one level of parking) with
reductions to the required front setback from 15' to 13', a reduction to the required side
setbacks from 10 feet to zero feet for the walkway along the seawall on the east and west,
a reduction to the required side setback from 10 feet to 7 feet on the east, and from 10
feet to 6 feet to the building on the west, a reduction to the required rear setback from 20
feet to zero feet for decking and walkway and from 20 feet to 13 feet for the proposed
pool. Additionally, the applicant is requesting to be allowed to back out into the
Brightwater Drive right-of-way. The existing boat docks will remain on site for the sole
use of the property owners and contain nine existing boat slips.
Written Submittal Requirements (Section 3-913. A)
1. This site is located within the Small Motel district and is currently occupied by
three (3) small overnight accommodation uses consisting of 36 units. The land
coverage being requested is consistent with surrounding properties and in many
cases, less than that of existing structures as this area consists of more intense
uses such as older, small, motels with little to no on-site parking. The proposed
three (3) story, nine-unit residential townhome structure is consistent with the
scale and bulk of adjacent and surrounding residential properties and will be less
intense than that of the current overnight accommodation uses on site. The
requested front and side setback reductions are less intrusive than that of the
existing motel uses. The proposal includes totally enclosed individual garage
parking, accessed by typical individual single-family driveways. The existing boat
docks are to remain as is.
2. The proposed single-family townhome development will not hinder or discourage
redevelopment of the surrounding area as the proposal meets the intent of the
Beach by Design program for the Small Motel district. With the construction of
this upscale Key West style waterfront residential townhome use and tropical
landscaping, other surrounding property owners should be encouraged to come
closer into compliance with the intent of the Beach by Design program. The
"staggered" design ofthe proposed project lends to a "cove" effect that will be
aesthetically pleasing to passers-by and will be a significant improvement to the
surrounding community. Additionally, Strategies for Revitalization calls for the
conversion of this area to two to four level townhouses and time-shares above
parking as proposed.
3. The proposed nine-unit, single-family townhome use will create less of an
adverse impact to users of the area than the more intense surrounding and on-site
motel uses as the site will be occupied by long-term residents (homeowners) as
opposed to transient tenants. Visibility triangles will be maintained to ensure
pedestrian and vehicular safety. The request to back out into the right-of-way is
due to the single-family homeowners having individual driveways as opposed to

one mass parking area/garage. A retention area will be constructed at the rear of
the site eliminating runoff onto adjacent properties.
4. The minimization of traffic impact being generated from the site is realized by the
proposed single-family townhome use. Other permitted uses within the Tourist
zoning district such as restaurants, retail sales, marina facilities, etc, could
generate much heavier traffic for the immediate area and prove to be an adverse
impact in intensity for the Brightwater Drive right-of-way as opposed to the
proposed single-family development.
5. The majority of the immediate vicinity consists oflow scale motel buildings built
in the 60's and 70's with non-uniform signage. The future vision of the Small
Motel district is for two to four story townhomes and timeshares over parking.
This proposal is a step in the right direction in order to achieve that vision for the
immediate vicinity. No freestanding signage is proposed for this site which along
with the proposed enclosed parking will reduce visual blight along the
Brightwater Drive right-of-way.
6. The proposed development will enhance the visual character of the neighborhood,
increase surrounding property values and shall not be a negative impact in regards
to acoustics and olfactory issues as a more intense commercial use may be. On-
site lighting will not adversely impact surrounding properties, as all exterior
lighting will be limited to individual attached fixtures for each unit. No spillage
onto adjacent properties will occur. Noise intrusion onto adjacent properties is not
anticipated over and above what the typical single-family use would produce.
Individual roll-out trash cans will be utilized by each homeowner and will be kept
within the garage areas except on sanitation pick-up days.
Comprehensive InfIlI Redevelopment Project Criteria
1. This site is located within the Small Motel district. Currently the site is occupied
with overnight accommodation uses. The proposal includes razing the existing
motel uses on site and development of the site with a nine-unit, three-story
townhome structure. Similar side and rear setback reductions exist on site now
with the motel uses and the existing front setbacks are more intrusive than the
requested 13-foot setback for the proposed project. The proposed 13 foot front
yard setback is only for front porch of the most encroaching unit on the site and is
created by the "cove" type footprint. The applicant is proposing to construct
mid-level, luxury townhomes compatible with the Beach by Design program.
The proposed floor plans consist of individual enclosed garage parking on the first
level with two floors of living area above. Each garage space will accommodate
two vehicles for a total of 18 parking spaces. 'Every other driveway will be
separated from the adjacent drive by a landscape island. All units will have
individual driveways. These driveways will be typical of a single-family use.
The typical single-family driveway area proposed is the reason for the need to
back out into the Brightwater Drive right-of-way. Due to the proposal being a
single- family residential townhome use, the number of vehicles backing into the
right-of-way will be minimal. Additionally, the maintenance of visibility
triangles on site will ensure safety for vehicular and pedestrian traffic. The side

setback reductions being requested for the building itself are a result of an
irregularly shaped site. The requested side setback reductions of7.0 and 6.0 feet
to the building will allow the site to be developed with residential units of
adequate width for the upscale style waterfront type living being offered. A side
setback reduction of zero feet to the walkway along the seawall is also being
requested to allow easy access to the seawall area by the residents on site and in
order to provide a consistent appearance. Similar and more intrusive side setbacks
exist within the area so that the proposed side setback will not be inconsistent
with the surrounding area. The zero foot rear setback being requested is for the
accommodation of a walkway area running parallel to the seawall which will
connect to the existing docks and will allow for a pool deck area. The rear
setback of 13 feet for the proposed pool will allow for a minimal size pool for use
only by the residents on site. The applicant is proposing to retain the existing
docks as an amenity for the homeowners on site. The boat docks provide nine
existing boat slips. A minimum of nine townhomes of the size and caliber
proposed is needed to make this project financially viable.
2. The proposed residential use will likely enhance property values in the area by
providing new, quality, residential construction and significant landscaping on
site. Per the property appraiser's office, the existing value is $1,215,000.00.
This proposed townhome development would significantly improve the value of
the site to approximately $5,300,000.00. This increase in value and the draw of
long-term residential homeowners into the immediate area will generate
additional tax dollars for the City of Clearwater.
3. The City of Clearwater permits attached dwellings as proposed. Additionally, the
proposed three-story townhome project is consistent with the vision of the Beach
by Design program for the Small Motel district.
4. The proposed nine-unit single-family residential townhomes are compatible with
the surrounding land uses as many of the neighboring motels maintain long lease
tenants. Additionally, the infill of the proposed single-family use will allow for
less traffic congestion within the area which will be a positive impact for
surrounding uses. Also, Strategies for Revitalization call for the conversion of
this Small Motel district area to two to four level townhomes and time shares
above parking.
5. At this time, properties are not readily available for this type of upscale, single-
family, waterfront, townhome development within this immediate desirable area.
The location of Brightwater Drive being on the Intracoastal Waterway and in
between two residential fingers makes this proposal a compatible development for
the area in addition to being consistent with the intent of the Clearwater Beach by
Design program. '
6. The immediate vicinity of the subject parcel will be upgraded aesthetically not
only by the architectural design of the new townhomes but also by the proposed
landscaping and single-family residential use; -
7. The proposed development will playa role in the continuous positive changes of
Clearwater Beach. The City will benefit by having a newly revitalized site and
new buildings with long term residents. The proposal will provide on site parking,
thereby eliminating any need for related parking within the right-of-way. The

proposed site plan, inclusive oflandscaping, will be a significant improvement to
the surrounding area. In addition, the bringing in of affluent single-family
property owners will trigger the increase of tax dollars for the City and will
trigger an increase in revenue for businesses within the surrounding beach and
downtown communities.
8. The proposed development will visually enhance the immediate area through the
construction of an attractive, residential project on a site currently occupied by
outdated small overnight accommodation uses. The proposed project reflects the
City's vision of a revitalized Clearwater Beach and is consistent with Beach by
Design. The site is generally unmarketable and unusable without the approval of
the setbacks being requested and to back out from residential driveways into the
Brightwater Drive right-of-way. The setback reductions being proposed are
similar and less intrusive than the existing setbacks of the motels on site.
Allowing the backing out of vehicles into the right-of-way from this site will only
add to the realization of the typical passersby that this is a single-family use as
opposed to overnight accommodations.
9. Adequate, enclosed parking will be provided on site. The proposal, as part of a
Flexible Development for attached dwellings, would require 1.5 parking spaces
per dwelling unit or 13.5 spaces. The proposal includes two spaces per dwelling
unit for a total of 18 parking spaces thereby eliminating the need for parking
within the right-of-way. This feature alone will help to reduce on street parking
which only increases traffic congestion.
10. The design of the proposed townhome building complies with the Tourist
District/Beach by Design guidelines in many ways. On site parking is being
provided within fully enclosed garages on the first level. The proposal is for a
three-story townhome structure and Beach by Design contemplates conversion of
this area to two to four level townhouses and time shares above parking. The
proposed architecture is a Key West style design and landscaping, tropical, which
will be aesthetically pleasing. The proposed landscaping will lend in
differentiating Clearwater Beach from other beach areas as it will be helping to
bring the immediate area closer into compliance with Code. The residential
design ofthe proposed project will help to create a sense of a "beach community
neighborhood" and the street level ofthis project will be pedestrian and vehicular
friendly due to the maintenance of all required visibility triangles. The enclosed
garage spaces on site and lack of on-street parking will also lend to an
aesthetically pleasing project in lieu of open parking areas and parking within the
right-of-way.

The proposed project is located in Clearwater, Florida (Section 8, Township 29 South,
Range 15 East) on Brightwater Drive. The project consists of the design and development
of 0.52 acres of a developed tract. The re-developement project will include the removal
of an existing motel and construction of 9 unit townhomes area with associated
infrastructure improvements such as parking, utilities, storm water detention facilities,
and landscaping.
The existing site drains to the Gulf of Mexico. The proposed ponds for the project will
continue to outfall to the same water body. Since the project drains to the Gulf of Mexico
no attenuation will be provided. The storm water management system was designed to
retain and treat the first %" of runoff volume, for water quality purposes.
A review of the NCRS "Soil Survey of Pin ell as County, Florida" indicates that the soils
at this site are composed of Made Land type soils. There are no valid estimates for Made
Land. Therefore, seeing that the site is a coastal proj ect, the SHW was determined to be
the MHW of 1.40 elev.

o SIGNED AND SEALED SURVEY (including legal description of property) - One original and 12 copies;
o TREE SURVEY (including existing trees on site and within 25' of the adjacent site, by species, size (DBH 4" or greater), and location,
including drip lines and indicating trees to be removed);
o LOCATION MAP OF THE PROPERTY;
o PARKING DEMAND STUDY in conjunction with a request to make deviations to the parking standards (ie. Reduce number of spaces). Prior to the
submittal of this application, the methodology of such study shall be approved by the Community Development Coordinator and shall be in
accordance with accepted traffic engineering principles. The findings of the study will be used in determining whether or not deviations to the
parking standards are approved;
o GRADING PLAN, as applicable;
o PRELIMINARY PLAT, as required (Note: Building permits will not be issued until evidence of recording a final plat is provided);

Depiction by shading or crosshatching of all required parking lot interior landscaped areas;
Location of all solid waste containers, recycling or trash handling areas and outside mechanical equipment and all required screening {per
Section 3-201(D)(i) and Index #701};
Location of all landscape material;
Location of all jurisdictional lines adjacent to wetlands;
Location of all onsite and offsite storm-water management facilities;

Description of Request: To construct a three (3) story structure consisting of nine (9)
residential townhome units (two stories of living area over one level of parking) with
reductions to the required front setback from 15' to 13', a reduction to the required side
setbacks from 10 feet to zero feet for the walkway along the seawall on the east and west,
a reduction to the required side setback from 10 feet to 7 feet on the east, and from 10
feet to 6 feet to the building on the west, a reduction to the required rear setback from 20
feet to zero feet for decking and walkway and from 20 feet to 3 feet for the proposed
pool. Additionally, the applicant is requesting to be allowed to back out into the
Brightwater Drive right-of-way. The existing boat docks will remain on site for the sole
use of the property owners and contain nine existing boat slips.
Written Submittal Requirements (Section 3-913. A)
1. This site is located within the Small Motel district and is currently occupied by
three (3) small overnight accommodation uses consisting of 36 units. The land
coverage being requested is consistent with surrounding properties and in many
cases, less than that of existing structures as this area consists of more intense
uses such as older, small, motels with little to no on-site parking. The proposed
three (3) story, nine-unit residential townhome structure is consistent with the
scale and bulk of adjacent and surrounding residential properties and will be less
intense than that of the current overnight accommodation uses on site. The
requested front and side setback reductions are less intrusive than that of the
existing motel uses. The proposal includes totally enclosed individual garage
parking, accessed by typical individual single-family driveways. The existing boat
docks are to remain as is.
2. The proposed single-family townhome development will not hinder or discourage
redevelopment of the surrounding area as the proposal meets the intent of the
Beach by Design program for the Small Motel district. With the construction of
this upscale Key West style waterfront residential townhome use and tropical
landscaping, other surrounding property owners should be encouraged to come
closer into compliance with the intent of the Beach by Design program. The
"staggered" design of the proposed project lends to a "cove" effect that will be
aesthetically pleasing to passers-by and will be a significant improvement to the
surrounding community. Additionally, Strategies for Revitalization calls for the
conversion of this area to two to four level toWnhouses and time-shares above
parking as proposed.
3. The proposed nine-unit, single-family townhome use will create less of an
adverse impact to users of the area than the more intense surrounding and on-site
motel uses as the site will be occupied by long-term residents (homeowners) as
opposed to transient tenants. Visibility triangles will be maintained to ensure
pedestrian and vehicular safety. The request to back out into the right-of-way is
due to the single-family homeowners having individual driveways as opposed to

one mass parking area/garage. A retention area will be constructed at the rear of
the site eliminating runoff onto adjacent properties.
4. The minimization of traffic impact being generated from the site is realized by the
proposed single-family townhome use. Other permitted uses within the Tourist
zoning district such as restaurants, retail sales, marina facilities, etc, could
generate much heavier traffic for the immediate area and prove to be an adverse
impact in intensity for the Brightwater Drive right-of-way as opposed to the
proposed single-family development.
5. The majority of the immediate vicinity consists oflow scale motel buildings built
in the 60's and 70's with non-uniform signage. The future vision ofthe Small
Motel district is for two to four story townhomes and timeshares over parking.
This proposal is a step in the right direction in order to achieve that vision for the
immediate vicinity. No freestanding signage is proposed for this site which along
with the proposed enclosed parking will reduce visual blight along the
Brightwater Drive right-of-way.
6. The proposed development will enhance the visual character of the neighborhood,
increase surrounding property values and shall not be a negative impact in regards
to acoustics and olfactory issues as a more intense commercial use may be. On-
site lighting will not adversely impact surrounding properties, as all exterior
lighting will be limited to individual attached fixtures for each unit. No spillage
onto adjacent properties will occur. Noise intrusion onto adjacent properties is not
anticipated over and above what the typical single-family use would produce.
Individual roll-out trash cans will be utilized by each homeowner and will be kept
within the garage areas except on sanitation pick-up days.
Comprehensive Infill Redevelopment Project Criteria
1. This site is located within the Small Motel district. Currently the site is occupied
with overnight accommodation uses. The proposal includes razing the existing
motel uses on site and development of the site with a nine-unit, three-story
townhome structure. Similar side and rear setback reductions exist on site now
with the motel uses and the existing front setbacks are more intrusive than the
requested 13-foot setback for the proposed project. The proposed 13 foot front
yard setback is only for front porch of the most encroaching unit on the site and is
created by the "cove" type footprint. The applicant is proposing to construct
mid-level, luxury townhomes compatible with the Beach by Design program.
The proposed floor plans consist of individual enclosed garage parking on the first
level with two floors of living area above. Each garage space will accommodate
two vehicles for a total of 18 parking spaces. Every other driveway will be
separated from the adjacent drive by a landscape island. All units will have
individual driveways. These driveways will be typical of a single- family use.
The typical single-family driveway area proposed is the reason for the need to
back out into the Brightwater Drive right-of-way. Due to the proposal being a
single-family residential townhome use, the number of vehicles backing into the
right-of-way will be minimal. Additionally, the maintenance of visibility
triangles on site will ensure safety for vehicular and pedestrian traffic. The side

setback reductions being requested for the building itself are a result of an
irregularly shaped site. The requested side setback reductions of 7.0 and 6.0 feet
to the building will allow the site to be developed with residential units of
adequate width for the upscale style waterfront type living being offered. A side
setback reduction of zero feet to the walkway along the seawall is also being
requested to allow easy access to the seawall area by the residents on site and in
order to provide a consistent appearance. Similar and more intrusive side setbacks
exist within the area so that the proposed side setback will not be inconsistent
with the surrounding area. The zero foot rear setback being requested is for the
accommodation of a walkway area running parallel to the seawall which will
connect to the existing docks and will allow for a pool deck area. The rear
setback of 13 feet for the proposed pool will allow for a minimal size pool for use
only by the residents on site. The applicant is proposing to retain the existing
docks as an amenity for the homeowners on site. The boat docks provide nine
existing boat slips. A minimum of nine townhomes of the size and caliber
proposed is needed to make this project financially viable.
2. The proposed residential use will likely enhance property values in the area by
providing new, quality, residential construction and significant landscaping on
site. Per the property appraiser's office, the existing value is $1,215,000.00.
This proposed townhome development would significantly improve the value of
the site to approximately $5,300,000.00. This increase in value and the draw of
long-term residential homeowners into the immediate area will generate
additional tax dollars for the City of Clearwater.
3. The City of Clearwater permits attached dwellings as proposed. Additionally, the
proposed three-story townhome project is consistent with the vision of the Beach
by Design program for the Small Motel district.
4. The proposed nine-unit single-family residential townhomes are compatible with
the surrounding land uses as many of the neighboring motels maintain long lease
tenants. Additionally, the infill of the proposed single-family use will allow for
less traffic congestion within the area which will be a positive impact for.
surrounding uses. Also, Strategies for Revitalization call for the conversion of
this Small Motel district area to two to four level townhomes and time shares
above parking.
5. At this time, properties are not readily available for this type of upscale, single-
family, waterfront, townhome development within this immediate desirable area.
The location of Brightwater Drive being on the Intracoastal Waterway and in
between two residential fingers makes this proposal a compatible development for
the area in addition to being consistent with the intent of the Clearwater Beach by
Design program. I
6. The immediate vicinity of the subject parcel will be upgraded aesthetically not
only by the architectural design of the new townhomes but also by the proposed
landscaping and single-family residential use.
7. The proposed development will playa role in the continuous positive changes of
Clearwater Beach. The City will benefit by having a newly revitalized site and
new buildings with long term residents. The proposal will provide on site parking,
thereby eliminating any need for related parking within the right-of-way. The

proposed site plan, inclusive oflandscaping, will be a significant improvement to
the surrounding area. In addition, the bringing in of affluent single-family
property owners will trigger the increase of tax dollars for the City and will
trigger an increase in revenue for businesses within the surrounding beach and
downtown communities.
8. The proposed development will visually enhance the immediate area through the
construction of an attractive, residential project on a site currently occupied by
outdated small overnight accommodation uses. The proposed project reflects the
City's vision of a revitalized Clearwater Beach and is consistent with Beach by
Design. The site is generally unmarketable and unusable without the approval of
the setbacks being requested and to back out from residential driveways into the
Brightwater Drive right-of-way. The setback reductions being proposed are
similar and less intrusive than the existing setbacks of the motels on site.
Allowing the backing out of vehicles into the right-of-way from this site will only
add to the realization of the typical passersby that this is a single-family use as
opposed to overnight accommodations.
9. Adequate, enclosed parking will be provided on site. The proposal, as part of a
Flexible Development for attached dwellings, would require 1.5 parking spaces
per dwelling unit or 13.5 spaces. The proposal includes two spaces per dwelling
unit for a total of 18 parking spaces thereby eliminating the need for parking
within the right-of-way. This feature alone will help to reduce on street parking
which only increases traffic congestion.
10. The design of the proposed townhome building complies with the Tourist
District/Beach by Design guidelines in many ways. On site parking is being
provided within fully enclosed garages on the first level. The proposal is for a
three-story townhome structure andBeach by Design contemplates conversion of
this area to two to four level townhouses and time shares above parking. The
proposed architecture is a Key West style design and landscaping, tropical, which
will be aesthetically pleasing. The proposed landscaping will lend in
differentiating Clearwater Beach from other beach areas as it will be helping to
bring the immediate area closer into compliance with Code. The residential
design of the proposed project will help to create a sense of a "beach community
neighborhood" and the street level of this project will be pedestrian and vehicular
friendly due to the maintenance of all required visibility triangles. The enclosed
garage spaces on site and lack of on-street parking will also lend to an
aesthetically pleasing project in lieu of open parking areas and parking within the
right-of-way.

Dear Mr. Ghovaee:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On April 15, 2003, the Community Development Board reviewed your
Flexible Development application for attached dwellings within the Tourist District with
reductions of the side (east and west) setbacks from 10 feet to seven feet and six feet,
respectively, (to building), reduction in the rear (north) setback from 20 feet to zero feet (to
pavement) and 13 feet (to pool) and to permit parking that is designed to back into the public
right-of-way, as a Comprehensive Infill Redevelopment Project, under the provisions of Section
2-803.C and Preliminary Plat approval for nine townhomes lots. The proposal includes
constructing a three-story, nine-unit townhome building. The building will contain two floors of
living area above one floor of ground-level parking. The Community Development Board
(CDB) APPROVED the application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-803.C.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.

Conditions of Approval:
1. That the final design and color of the building be consistent with the conceptual elevations
submitted to, or as modified by, the CDB;
2. That all Solid Waste Code requirements be met prior to the issuance of any permits;
3. That all signage meet the requirements of Code and be architecturally integrated with the
design of the building with regards to color, materials and finish
4. That all Fire Code requirements be met prior to the issuance of any permits;
5. That a tree survey be submitted to and approved by Staff prior to the issuance of any permits;
6. That all Stormwater requirements be met prior to the issuance of any permits;
7. That a site plan indicating a sidewalk four feet in width within the right-of-way be submitted
to and approved by Staff prior to the issuance of any permits; and
8. That all required Transportation Impact Fees be paid prior to the issuance of any permits;
9. That evidence of a SWFWMD permit be submitted to and approved by Staff prior to the
issuance of any permits.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (April 15, 2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated
pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days
of the date of the CDB decision. The filing of an application/notice of appeal shall stay the effect
of the decision pending the final determination of the case. The appeal period for your case
expires on April 29, 2003.

REQUEST:
Flexible Development approval for attached dwellings within the
Tourist District with reductions of the side (east and west) setbacks
from 10 feet to seven feet and six feet, respectively, (to building),
reduction in the rear (north) setback from 20 feet to zero feet (to
pavement) and 13 feet (to pool) and to permit parking that is
designed to back into the public right-of-way, as a Comprehensive
Infill Redevelopment Project, under the provisions of Section 2-
803.C and Preliminary Plat approval for nine townhomes lots.
ANALYSIS:
The 0.52-acre site is located on the north side of Brightwater Drive, approximately 450 feet east of
Harnden Drive. The site contains 32 motel units within three buildings with three docks with a
total of nine slips to remain. Two of the buildings are one story and the third building is two
stories. It is located along a highly developed area within Clearwater Beach and has frontage
along Clearwater Bay. The site is located within the Small Motel District of Beach By Design
which provides for the redevelopment of Brightwater Drive with townhomes and timeshares
between two and four stories above parking.
The proposal includes constructing a nine-unit, three-story townhome building. The building will
contain two floors of living area above one floor of ground-level parking. Each unit will be
approximately 3,000 square feet in area, including the ground floor garage/storage area. An
additional 460 square feet are located within lanais. The parking under the building will include
two garage spaces per unit with individual driveways. The design requires that cars back out into
the right-of-way to exit the site. The Community Development Code prohibits "back out" parking
for any uses other than detached dwellings. The driveway length will permit a vehicle to
completely "back out" of the garage, thus eliminating the garage walls as a potential view
obstruction of the sidewalk and street. The development will operate as, and have the
characteristics of, single-family detached homes, including the individual garages. The site is
located on Brightwater Drive, which is a cul-de-sac street approximately 1,600 in length and
generally used only by persons with a destination on the street. From a traffic standpoint, this
concept of "back out" parking for townhomes may be acceptable on a low volume cul-de-sac street
such as this. It should not be considered, however, as a precedent for deviating from the Code
provision of restricting "back out" movement into the right-of-way for single-family residential
uses only, and will be reviewed on a case-by-case basis.
The request is to permit attached dwellings within the Tourist District for attached dwellings
within the Tourist District with reductions of the side (east and west) setbacks from 10 feet to
seven feet and six feet, respectively, (to building), reduction in the rear (north) setback from 20
feet to zero feet (to pavement) and 13 feet (to pool) and to permit parking that is designed to back
into the public right-of-way, as a Comprehensive Infill Redevelopment Project, under the
provisions of Section 2-803.C. The reductions in side setback is a function of the unit size and
will provide additional landscaping and a more economically, viable project. The reduction in the
rear setback is for a pool and surrounding patio and to provide pedestrian access to the water and
existing docks.

The Key West-style architecture of the buildings will include a variety of pastel colored siding
including tan, blue, yellow and peach, gray, standing seam metal roof, a number of windows on all
elevations and balconies on both the rear of the second and third floors. The building will also be
articulated with the second-floor unit entries recessed from the front fa<;ade and accessed from the
ground/first floor by individual stairs. On the rear of the building, units will be provided with
rooftop decks accessed via spiral staircases for additional outdoor living areas.
The landscape plan exceeds the intent of the Code utilizing a variety of a colorful groundcover
(lantana), shrubs (including variegated ginger, Indian hawthorn and viburnum) and trees (including
sabal and Washingtonian palms and crape myrtle). Additional landscaping will be possible on the
rooftop decks at the rear of the building.
Solid waste will be removed via black barrel service for each unit. All required Parks and
Recreation fees will be required to be paid prior to the issuance of any building permits. The
applicant will be selling the units fee simple, which includes land, and will record a Final Plat
prior to the issuance of building permits. No docks are proposed at this time and existing docks
will be maintained. Future docks over 500 square feet will require Flexible Development Level
Two approval through the Community Development Board.
SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on March
13, 2003. The Planning Department recommends APPROV AL of the Flexible Development
application for attached dwellings within the Tourist District with reductions of the side (east and
west) setbacks from 10 feet to seven feet and six feet, respectively, (to building), reduction in the
rear (north) setback from 20 feet to zero feet (to pavement) and 13 feet (to pool) and to permit

The Community Development Board of the City of Clearwater, Florida, will hold public hearings on Tuesday,

2. Menna - Pinellas. LLC are requesting a flexible development approval for an overnight accommodation
establishment with a reduction of the front (east) setback from 25 ft to 12 ft (to pavement), a reduction of the front
(south) setback from 25 ft to 15 ft (to pavement), a reduction of the side (west) setback from 10 ft to 5 ft (to
pavement), and a reduction of side (north) setback from 10 ft to zero ft (to pavement), an increase in building height
from 25 ft to 59 ft and to allow direct access to a major arterial street, as a Comprehensive Infill Redevelopment
Project, under the provisions of Section 2-704.C (Proposed Use: The demolition of an existing restaurant and the

4. Clearwater Homeless Intervention Project. Inc. are requesting a flexible development approval for a residential
shelter for 10 residents in 8 dwelling units with a reduction of the front (north) setback from 25 ft to 21 ft (to
building), a reduction of the side (west) setback from 10 ft to 5 ft (to pavement), reductions of the rear (south)

Dear Mr. Ghovaee:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On April 15, 2003, the Community Development Board reviewed your
Flexible Development application for attached dwellings within the Tourist District with
reductions of the side (east and west) setbacks from 10 feet to seven feet and six feet,
respectively, (to building), reduction in the rear (north) setback from 20 feet to zero feet (to
pavement) and 13 feet (to pool) and to permit parking that is designed to back into the public
right-of-way, as a Comprehensive Infill Redevelopment Project, under the provisions of Section
2-803.C and Preliminary Plat approval for nine townhomes lots. The proposal includes
constructing a three-story, nine-unit townhome building. The building will contain two floors of
living area above one floor of ground-level parking. The Community Development Board
(CDB) APPROVED the application with the following bases and conditions:

1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-803.C.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.

Conditions of Approval:
1. That the final design and color of the building be consistent with the conceptual elevations
submitted to, or as modified by, the CDB;
2. That all Solid Waste Code requirements be met prior to the issuance of any permits;
3. That all signage meet the requirements of Code and be architecturally integrated with the
design of the building with regards to color, materials and finish
4. That all Fire Code requirements be met prior to the issuance of any permits;
5. That a tree survey be submitted to and approved by Staff prior to the issuance of any permits;
6. That all Stormwater requirements be met prior to the issuance of any permits;
7. That a site plan indicating a sidewalk four feet in width within the right-of-way be submitted
to and approved by Staff prior to the issuance of any permits; and
8. That all required Transportation Impact F~es b~ paid prior to the issuance of any permits;
9. That evidence of a SWFWMD permit be subrpitted to and approved by Staff prior to the
issuance of any permits.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (April 15, 2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated
pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days
of the date of the CDB decision. The filing of an application/notice of appeal shall stay the effect
of the decision pending the final determination of the case. The appeal period for your case
expires on April 29, 2003.
