Once again, thank you very much for explaining the Homeowner's and City of
Clearwater's processes required to gain approval for erecting a sunning deck in the rear
of my property at 1648 Sand Key Estates Court. I have spoken with my neighbor Jack
Stanski, who, incidentally, went through your approval process; he suggested that I

My objective is to erect a deck, very similar to Jack's in appearance, but smaller in size,

Dear Mr. Richardson:
This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On March 19, 2002, the Community Development
Board reviewed your application to reduce the required rear (north) setback from 15 feet
to zero feet (to deck) and reduce the required side (east) setback from 10 feet to five feet
(to deck), as part of a Residential Infill Project under the provisions of Section 2-504.
The proposal includes locating a 330 square foot, wood deck within the backyard between
the existing house and seawall resulting in a zero foot rear (north) setback. Based on the
application and the staff recommendation, the Community Development Board (CDB)
APPROVED the application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Residential Infill
Project per Section 2-504 F.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the sUlTounding area and will enhance other
redevelopment efforts.
Conditions of Approval:
1. That all applicable requirements of Chapter 39 of the Building Code be met
related to seawall setbacks; and
2. That all building pelmits be secured, as applicable.

Pursuant to Section 4-407, an application for a building permit shall be made within one
year of Flexible Development approval (March 19, 2003). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building
permit. Time frames do not change with successive owners. The Community
Development Board may grant an extension of time for a peIiod not to exceed one year
and only within the oIiginal peIiod of validity.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay al).y impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this pIior development approval.
In addition, please be aware that an appeal of a Level Two approval (Flexible
Development) may be initiated by a property owner abutting the property which is the
subject of the approval within 14 days of the date of the CDB decision. The filing of an
application/notice of appeal shall stay the effect of the decision pending the final
determination of the case. The appeal peIiod for your case will expire on ApIiI 2, 2002.

of my property at 1648 Sand Key Estates Court. I have spoken with my neighbor Jack
Stanski, who, incidentally, went through your approval process; he suggested that I

CHARACTER OF THE
IMMEDIATE VICINITY: Single- and multi-family dwellings uses dominate the immediate
vicinity.
ANALYSIS:
The rectangular site is 0.15 acres located on the north side of, and at the terminus of, Sand Key
Estates Court. It is located within the Moorings of Sand Key subdivision that was platted in 1991
and approved through a Certified Site Plan 1993. The subject property was developed in 1998 as a
single-family dwelling.
The site has a two-story, 2,139 square foot, single-family dwelling similar in size, scale and
location to other dwellings in the neighborhood. The site is generally flat with a moderate slope
from the house to the seawall.
The proposal includes locating a 330 square foot, wood deck within the backyard between the
existing house and seawall resulting in a zero foot rear (north) setback. The deck will provide safe
access to the existing dock and better use of the backyard. The backyard is generally unusable
currently. No changes are otherwise proposed for the site or building.
The proposed deck is similar in size, scale and location to other eXIstmg decks in the
neighborhood, including the property immediately to the east, that have similarly sized and placed
decks. The deck will be located 10 feet from the side (west) property line and five feet from the
side (east) property line and will be approximately two feet above grade with the railing extending
up to four feet above grade. The proposed deck will have no impact on stormwater drainage. The
only option available to the applicant is to apply as part of a Residential Infill Project.
Building Code requires an 18-foot separation between seawalls and any structures. Because this
deck is within this setback, relief form the Building Code will be required.
CODE ENFORCEMENT ANALYSIS:
There are no outstanding enforcement issues associated with this site.

C. FLEXIBILITY CRITERIA FOR RESIDENTIAL INFILL PROJECTS IN THE HIGH
DENSITY RESIDENTIAL DISTRICT (Section 2-804 (B)):
1. The development or redevelopment of the parcel proposed for development in
otherwise impractical without deviations from the intensity and development
standards;
The subject property was developed in 1998 as party of the Moorings of Sand Key
subdivision. The proposed 330 square foot deck will be located to the rear of the existing
home. The site has a moderate slope from the house to the seawall. The installation of
the deck will provide for greater enjoyment of the backyard.
2. The development of the parcel proposed for development as a residential infill
project will not materially reduce the fair market value of abutting properties;
The proposed deck will enhance property values in the area by providing a usable
backyard. The current assessed valuation of the site is $505,000. With the deck addition,
the assessed valuation is projected at $533,000. This is not expected to negatively impact
surrounding properties.
3. The uses within the residential infill project are otherwise permitted in the district;
The City of Clearwater permits single-family dwellings with associated accessory uses
such as the proposed deck.
4. The uses within the residential infill project are compatible with adjacent lands
uses;
The proposal includes locating a 330 square foot deck, approximately four feet in height,
in association with an existing single-family dwelling. Several, surrounding single-family
dwellings, including the property immediately to the east, have similarly sized and placed
decks. The proposal is compatible with adjacent land uses.
5. The development of the parcel proposed for development as a residential infill
project will upgrade the immediate vicinity of the parcel proposed for development;
The proposal will provide for a livable backyard and enhance the enjoyment of the
property. It is consistent with other decks in the area.
6. The design of the proposed residential infill project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole;
The proposed deck will create a safe, useable space for an existing single-family
dwelling. It will enhance the enjoyment of the property.

7. Flexibility in regard to lot width, required setbacks, height and off-street parking
are justified by the benefits to community character and the immediate vicinity of
the parcel proposed for development and the City of Clearwater as a whole.
Building height, may only exceed 80 feet, however, if the parcel proposed for
development fronts on Clearwater Bay or is only separated from Clearwater Bay by
a public open space.
The proposed development will enhance the property by increasing the use of the
backyard. In addition, several, surrounding single-family dwellings, including the
property immediately to the east, have similarly sized and placed decks. The proposal is
consistent with the development in the neighborhood. Flexibility in the rear and side
setbacks for the accessory deck is compatible with the area.
D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The area is developed with single-family dwellings and multi-family dwellings
immediately to the west. The site slopes to the seawall from the existing house and is not
easily useable. The proposal will reclaim a portion of the backyard with a safe, flat deck
similar in size, scale and placement to other decks in the neighborhood.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The subdivision and site is zoned High Density Residential District and developed with
single-family homes with between zero-foot and five-foot side setbacks. The character
and intensity of the proposed development will be in compliance with that zoning
classification. The proposed development, a wood deck, is accessory to an existing
single-family dwelling and is similar is size, scale and placement to other decks in the
neighborhood. It should have no impact on the development and use of adjacent land and
buildings.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposed accessory structure in association with an existing single-family dwelling is
permitted in the zoning district, and should not create any adverse health or safety
impacts in the neighborhood.

4. The proposed development is designed to minimize traffic congestion.
The proposed development will have no impact on traffic congestion.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
Several, surrounding single-family dwellings, including the property immediately to the
east, have similarly sized and placed decks. The proposal creates a more useable backyard
with a safe, flat deck similar to other decks in the neighborhood enhancing the value of
the home.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The proposal includes the installation of a 330 square foot deck approximately four feet
above grade. The proposal is similar to other decks in the area including a raised deck
immediately to the east. The deck will be setback five feet from the side (east) property
line preserving the existing view of the property to the east. The deck will be setback 10
feet from the property to the west. The proposal will generate no adverse effects,
including visual, acoustic and olfactory on adjacent properties.
SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on February 14, 2002. The Planning Department recommends APPROVAL of the Flexible
Development application to reduce the required rear (north) setback from 15 feet to zero feet (to
deck) and reduce the required side (east) setback from 10 feet to five feet (to deck), as part of a
Residential Infill Project under the provisions of Section 2-504, for the site at 1648 Sand Key
Estates Court, with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Residential Infill Project
per Section 2-504 F.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Conditions of Approval:
1. That all applicable requirements of Chapter 39 of the Building Code be met related to
seawall setbacks; and
2. That all building permits be secured, as applicable.

CHARACTER OF THE
IMMEDIATE VICINITY: Single- and multi-family dwellings uses dominate the immediate
vicinity.
ANALYSIS:
The rectangular site is 0.15 acres located on the north side of and at the terminus of Sand Key
Estates Court. It is located on the northeast side of Sand Key within the Sand Key Estates
subdivision.
The site has a two-story, XX square foot, single-family dwelling similar in size, scale and location
to other single-family dwelling in the neighborhood. The site is generally flat with a moderate
slope from the house to the seawall.
The proposal includes locating a 330 square foot, wood deck within the backyard between the
existing house and seawall resulting in a zero foot rear (north) setback. No changes are otherwise
proposed for the site or building.
The proposed deck is similar in size, scale and location to other, eXIstmg decks in the
neighborhood';...I,;?lll3to the slope down from the house to the seawall, the deck will provide safe
access to the ~~i~ting dO(;.ki and also the safe use of the backyard. The backyard is generally
unusable without the requested allowance to permit a deck spanning between the house and
seawall. The only option available to the applicant is to apply as part of a Residential Infill
Project.
The deck will be located 10 feet from the side (west) property line and 17 feet from the side (east)
property line and will be approximately four feet in height.

C. FLEXIBILITY CRITERIA FOR RESIDENTIAL INFILL PROJECTS IN THE HIGH
DENSITY RESIDENTIAL DISTRICT (Section 2-804 (B)):
1. The development or redevelopment of the parcel proposed for development in
otherwise impractical without deviations from the intensity and development
standards;
The subject property was developed in 1998 and has been used as a single-family
dwelling. T~~sul?ject site is within a subdivision that was approved through a certified
site plan on I?i\'J::a. The applicant seeks to locate a 330 square foot, approximately ~gg~
feet in height to the rear of the existing home. The site has a moderate slope from the
house to the seawall with a height differential of XX feet making the backyard unsafe to
use. The applicant desires to reclaim a portion of the backyard through the utilization of
the proposed deck.
2. The development of the parcel proposed for development as a residential infill
project will not materially reduce the fair market value of abutting properties;
The proposed deck will likely enhance the subject site's property value enhancing
property values in the area by providing a usable backyard. The current assessed
valuation of the site is $385,000. With the redevelopment proposal, the assessed
valuation is projected at $J3,2()QQ.()QQ~ This increase in property value is expected to
have a beneficial effect on surrounding properties.
3. The uses within the residential infill project are otherwise permitted in the district;
The City of Clearwater permits single-family dwellings with associated accessory uses
such as the proposed deck.
4. The uses within the residential infill project are compatible with adjacent lands
uses;
Adjacent land uses to the north, south and east are single-family residential dwellings.
Attached dwelling are located immediately to the west at the terminus of Sand Key
Estates Court. The proposal includes locating a 330 square foot deck approximately four
feet in height is association with an existing single-family dwelling. Several, sUlTounding
single-family dwellings, including the property immediately to the east, have similarly
sized and placed decks. The proposal is compatible with adjacent land uses.
5. The development of the parcel proposed for development as a residential infill
project will upgrade the immediate vicinity of the parcel proposed for development;
The proposal will benefit the community both functionally and aesthetically by
reclaiming an unusable backyard thereby increasing the value of the subject.

6. The design of the proposed residential infill project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole;
The proposed deck will create a safe useable space in an otherwise unusable backyard
enhancing the value of the subject site.
7. Flexibility in regard to lot width, required setbacks, height and off-street parking
are justified by the benefits to community character and the immediate vicinity of
the parcel proposed for development and the City of Clearwater as a whole.
Building height, may only exceed 80 feet, however, if the parcel proposed for
development fronts on Clearwater Bay or is only separated from Clearwater Bay by
a public open space.
The proposed development will aesthetically enhance the immediate area. The backyard
of the site is generally unusable without the requested reduction in rear setback.
D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The area is characterized with modest single-family dwellings and multi-family dwellings
immediately to the west. The site slopes down to the seawall from the existing single-
family dwelling making the backyard unusable. The proposal will reclaim a portion of
the backyard with a safe, flat deck similar in size, scale and placement to other decks in
the neighborhood.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned High Density Residential District and the character and intensity of the
proposed development will be in compliance with that zoning classification. The
proposed development will help generate a better mix of residential uses and encourage
the like redevelopment of other sites.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposed accessory structure in association with an existing single-family dwelling is
permitted in the zoning district, and should not create any adverse health or safety
impacts in the neighborhood.

4. The proposed development is designed to minimize traffic congestion.
The proposed development will have no impact on traffic congestion.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The proposed development is consistent with and will raise the standards of the
community character of the immediate vicinity.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The proposal includes the location of a 330 square foot deck. There will be no adverse
effects generated by the proposed development.
SUMMARY AND RECOMMENDATION:
The application and supporting materials were reviewed by the Development Review Committee
on January 17, 2002. The Planning Department recommends APPROVAL of the Flexible
Development application to reduce the required rear (north) setback from 15 feet to zero feet (to
deck), as part of a Residential Infill Project under the provisions of Section 2-504, for the site at
1648 Sand Key Estates Court, with the following bases and conditions:

1. The proposal complies with the Flexible Development criteria as a Residential Infill Project
per Section 2-504 F.
2. The proposal is in compliance with other standards in the Code including the General

This letter constitutes a Development Order pursuant to Section 4-206 D.6 of the
Community Development Code. On March 19, 2002, the Community Development
Board reviewed your application to reduce the required rear (north) setback from 15 feet
to zero feet (to deck) and reduce the required side (east) setback from 10 feet to five feet
(to deck), as part of a Residential Infill Project under the provisions of Section 2-504.
The proposal includes locating a 330 square foot, wood deck within the backyard between
the existing house and seawall resulting in a zero foot rear (north) setback. Based on the
application and the staff recommendation, the Community Development Board (CDB)
APPROVED the application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Residential Infill
Project per Section 2-504 F.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the sUlTounding area and will enhance other
redevelopment efforts.
Conditions of Approval:
1. That all applicable requirements of Chapter 39 of the Building Code be met
related to seawall setbacks; and
2. That all building permits be secured, as applicable.

Pursuant to Section 4-407, an application for a building permit shall be made within one
year of Flexible Development approval (March 19, 2003). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building
permit. Time frames do not change with successive owners. The Community
Development Board may grant an extension of time for a period not to exceed one year
and only within the original period of validity.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In
order to facilitate the issuance of any permit or license affected by this approval, please
bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.
In addition, please be aware that an appeal of a Level Two approval (Flexible
Development) may be initiated by a property owner abutting the property which is the
subject of the approval within 14 days of the date of the CDB decision. The filing of an
application/notice of appeal shall stay the effect of the decision pending the final
determination of the case. The appeal period for your case will expire on April 2, 2002.

The Community Development Board of the City of Clearwater, Florida, will hold public hearings on Tuesday,
March 19, 2002, beginning at 2:00 p.m., in the City Commission Chambers, in City Hall, 3rd floor, 112 South

2. Equity Holdings, Inc / Gregory Politis are requesting a flexible development approval to reduce the following:
front (east) setback along Patricia Avenue from 25 ft to 12 ft to pavement, front (south) setback along Drew Street

Interested parties may appear and be heard at the hearings or file written notice of approval or objection with the
Planning Director or City Clerk prior to the hearings. Any person who decides to appeal any decision made by the
Board, with respect to any matter considered at such hearings, will need a record of the proceedings and, for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based per Florida Statute 286.0105.
