Dear Mr. Hardin::
The Department has completed a review of the information submitted by your consultant requesting
usage of the existing driveways due to a non-significant change. Should an operational or safety
problem occur as a result of driveway use, any corrections would be done by the owner at his
expense. The current entrances on Gulf to Bay and the south bound frontage of US19 can be
used with the following stipulations:
1. Vehicle trips per day can not exceed 7143 or more for this development as this would
constitute a significant change and require additional evaluation and a driveway
permit from the Department.
2. Any work in or use of the state right of way is prohibited unless permitted.
3. A Letter of Drainage Exemption has also been issued from the F.D.O.T. District
Drainage Department.

sheet C3. Landscape Architect has contact the City of
Clearwater for a list of complaints regarding the trees that
have been trimmed on the existing Sam's Club site; the
City's Inspector has been non-responsive. We have
prepared an evaluation of the overall site with an
inventory of existing trees but to date have not been able
to get anyone to tell us specifically what is required of us
at this time. This project should be considered for permit
as a .48 acres site. Sam's Club will comply with the city's
Landscape requirement on the existing site for the Club
but we do not want to hold up the review process for this
project based on a Landscape issue with the overall site.
We have taken steps to correct the problem and are
currently waiting for the inspector to respond to our
Landscape Architect. We are not opposed to approval for
this project being conditional to replacing the required
trees on the Sam's Club overall site. We respectfully
request the review process proceed.

We are utilizing the existing storm water system on site;
we are not changing the impervious/pervious ratio. We
are proposing construction on an existing paved parking
area. Finished Floor elevation is shown on the grading

area was already impervious and draining to the existing
system.

This letter constitutes a Development Order pursuant to Section 4-202. E of the Community
Development Code. On March 13, 2002, the Development Review Committee (DRC)
reviewed your application for Flexible Standard Development to permit an automotive service
station under the provisions of Section 2-703 and to reduce the required parking for a retail
sales and service establishment from five spaces per 1,000 square feet of gross floor area (676
spaces) to 4.72 spaces per 1,000 square feet of gross floor area (638 spaces), within the
Commercial District under the provisions of Section 2-702. The application includes the
establishment of a six island, 12 pump automotive service station with a 77 square foot
attendant booth in association with an existing retail sales and service establishment (Sam's
Club). The DRC unanimously recommended approval of the application with the following
bases and conditions:
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In order
to facilitate the issuance of any permit or license affected by this approval, please bring a copy
of this letter with you when applying for any permits or licenses that require this prior
development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may ~e initiated by a property owner abutting the property which is the subject
of the approval wlthm seven days of the date the Development Order is issued. A copy of the
Development Order is being sent to the surrounding property owners. The filing of an
application/notice of appeal shall stay the effect of the decision pending the final
determination of the case. The appeal period for your case will expire on July 19,2002.

as listed on the site plan in the Site Data Table. To justify the reduction of parking, we have broken down

Clearwater requires 5 spaces per 1000 square foot of floor area. The original requirement was 676 spaces,
Sam's Club Provided 697 spaces. The reduction due to the addition of the Fuel service center is -59
spaces. The total remaining spaces are 638. Calculating the parking as suggested in the comment letter
using Public Access Areas verses Non-Public Access Areas we have the following calculation:
108,542.47/1000= 108.54 X 5 = 542.70 or 543 spaces; the number provided is 638 spaces.
Please call me if you have questions or comments. Please note that the square footage for the
Entrance/Vestibule area was not calculated in the Total Public Access Area on the plans submitted.
Please let this letter serve as a correction to those plans and as a response to comment #4 in your

The proposal includes the removing 59 of the 697 existing parking spaces leaving 638 spaces and
locating a six island, 12 pump automotive service station with a 77 square foot attendant
building. The proposed gas station will be located on the east side of the site along the U.S.
Highway 19 North access road.
While the building consists of 135,161 square feet, the portion of the building devoted to
customer sales area is 107,059 square feet. That square footage, at five spaces per 1,000 square
feet of gross floor area would require 535 parking spaces where 638 spaces will be provided and
should be adequate to serve the needs of the retail establishment.

1. The physical characteristics of a proposed building are such that the likely uses of
the property will require fewer parking spaces per floor area than otherwise
required or that the use of significant portions of the building will be used for
storage or other non-parking demand-generating purposes;

107,059 square feet. That square footage, at five spaces per 1,000 square feet of gross
floor area would require 535 parking spaces where 638 spaces will be provided and
should be adequate to serve the needs of the retail establishment.
E. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The site is located in a highly developed commercial portion of the City along two
significant arterial roads; Gulf to Bay Boulevard and U.S. Highway 19 North. The area
consists of various commercial, office and retail establishments north along Gulf to Bay
Boulevard and U.S. Highway 19 North. The proposal is similar to other uses in the
vicinity.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned Commercial District and the proposed use will be in compliance with
that zoning. The proposal is similar to other developments in the area including an
automotive service stations located along Gulf to Bay Boulevard to the west. The
proposed development should not discourage appropriate development and use of
adjacent land buildings.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The use will be similar to surrounding commercial uses. The development will not
negatively affect the health or safety or persons residing or working in the neighborhood.

4. The proposed development is designed to minimize traffic congestion.
The use includes an automotive service station to be used in conjunction with an existing
retail sales and service establishment. Sam's Club is a members-only, wholesale retail
establishment. The proposed automotive service station will be utilized only be members
of the club. The proposed development will have little increased effect on traffic.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The proposed development is consistent with and will improve the community character
of the immediate vicinity.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
There will be no adverse effects generated by the proposed development.
STAFF RECOMMENDATION:
Based on the on the application, the proposal is in compliance with the standards and criteria for
Flexible Standard Development approval, with the maximum development potential and with all
applicable standards of the Community Development Code.
Therefore, staff recommends APPROVAL of the application for Flexible Standard Development
approval to permit an automotive service station within the Commercial District under the
provisions of Section 2-703 and to reduce the required parking for a retail sales and service
establishment within the Commercial District from five spaces per 1,000 square feet of gross
floor area (676 spaces) to 4.72 spaces per 1,000 square feet of gross floor area (638 spaces) under

This letter constitutes a Development Order pursuant to Section 4-202. E of the Community
Development Code. On March 13, 2002, the Development Review Committee (DRC)
reviewed your application for Flexible Standard Development to permit an automotive service
station under the provisions of Section 2-703 and to reduce the required parking for a retail
sales and service establishment from five spaces per 1,000 square feet of gross floor area (676
spaces) to 4.72 spaces per 1,000 square feet of gross floor area (638 spaces), within the
Commercial District under the provisions of Section 2-702. The application includes the
establishment of a six island, 12 pump automotive service station with a 77 square foot
attendant booth in association with an existing retail sales and service establishment (Sam's
Club). The DRC unanimously recommended approval of the application with the following
bases and conditions:

1. The proposal complies with the Flexible Standard Development criteria per Section 2-702.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area.

Conditions of Approval:
1. That all declining trees be removed through approved tree removal permits prior to the
issuance of any building permits;
2. That all Fire Department requirements for automotive service stations under the provisions
of NFP A 30A and 1 be met prior to issuance of a Certificate of Occupancy;
3. The colors used for the automotive service station match the colors used for the existing
Sam's Club building; and
4. That a sign package which meets all the requirements of Code be submitted to and
approved by Staff prior to the issuance of any building permits.
I concur with the findings of the Development Review Committee and, through this letter,
approve your application for Flexible Standard Development. The approval is based on and
must adhere to the site plan dated April 9, 2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year
of Flexible Standard Development approval (July 12, 2003). All required certificates of
occupancy shall be obtained within one year of the date of issuance of the building permit.
Time frames do not change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the
necessity to obtain any building permits or pay any impact fees that may be required. In order
to facilitate the issuance of any permit or license affected by this approval, please bring a copy
of this letter with you when applying for any permits or licenses that require this prior
development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard
Development) may be initiated by a property owner abutting the property which is the subject

Sam's Wholesale Club represented by Mr. Jason McMillan for the property at 2575 Gulf to Bay Boulevard.
The request is to permit an automotive service station (gas station) within the Commercial District under the
provisions of Section 2-703 and to reduce the required parking for a retail sales and service establishment
within the Commercial District from five spaces per 1,000 square feet of gross floor area (676 spaces) to 4.72
spaces per 1,000 square feet of gross floor area (638 spaces) under the provisions of Section 2-703. The
application includes the establishment of a six island, 12 pump automotive service station with a 77 square
foot attendant booth to be located on the east side of the property along the U.S. Highway 19 North service
road.
The City encourages you to participate in the review of this case. You may participate by calling me to
discuss the case, visit our office to review the application and/or send written comments to be
considered in the City's review of the project. The earliest possible date that the City will make a
decision on the project is April 4, 2002. Therefore, please contact me or send your written comments
no later than that date.
On March 14, 2002, the Development Review Committee (composed of the City's professional staff)
will review the project for compliance with the City's Community Development Code. Following that
review, the Planning Director will make a decision to either approve or deny the application. As a

This Station will be manned by a full time attendant.
Attendant will radio into the store for relief when he must
use the restroom or take a break, someone from the store
will relieve himlher and site will be supervised at all times.
Elevations required showing the proposed structure will match
the color and architecture of the existing Sam's Club Building.
Refer to enclosed color rendering.
Clarify how solid waste will be handled prior to the issuance of a
Development Order.
Full time attendant will empty trash receptacles daily into
the existing Sam's Club dumpsters.
The 5.5" elm at the NE comer and the 5.5" Laurel Oak at the SW
comer are declining and should be removed. Submit for tree
removal permit at time of building permit application.
Response: Refer to Sheet L-1. Trees listed to be removed.
8. Fire
a. Comment: Must meet Fire Code requirements for SeNice Stations as per
NFPA 30A and NFPA 1 prior to final inspection for C. O.
Response: So Noted.
b. Comment: Fire suppression system for each pump will be required prior to
final inspection for C. O.
Response: No suppression system is required for fully manned facility.
9. Landscaping
a. Comment: There is an area along the west side of the construction site that
is paved and may be able to be turned into landscaping - revise
or clarify site plans prior to the issuance of a Development Order.
Response: Added Landscape Island, refer to sheet C-3 & sheet L-1.
b. Comment: Replant declining and topped trees prior to the issuance of a
Development Order.
Response: Existing Sam's Club landscaping has been put out to bid.
Work will commence within 5 days of bid acceptance.

provisions of NFPA 30A and 1 be met prior to issuance of a Certificate of Occupancy.

A note has been added to sheet C-3 and sheet C-4 for the above reference
project, which states: Existing Pond shall be restored to the originally
permitted conditions prior to completion of
construction.
The note was added at the request of Elliot Shoberg. Please forward a copy of
