(Section 2-902):
1. Height: The increased height results in an improved site plan and/or improved
design and appearance;
The proposed height of the building is lower than the height specified by Code. Many of
the surrounding uses include single-story attached dwellings. The proposal is similar is
size and scale to surrounding structures. The height of the building is 25 feet and is
within the requirements of the Code
2. Off-street parking:
a. The physical characteristics of a proposed building are such that the likely uses
of the property will require fewer parking spaces per floor area than otherwise
required or the physical context, including adjacent buildings and uses are
such that there is a high probability that patrons will use modes of
transportation other than the automobile to access the use;
The proposed office is required to provide between 5 and 14 parking spaces. The
proposal includes nine parking spaces.
b. Adequate parking is available on a shared basis as determined by all existing
land uses within one thousand (1,000) feet of the parcel proposed for
development, or parking is available through any existing or planned and
committed parking facilities or the shared parking formula in Article 3,
Division 14;

C. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposal includes a small, a 4,720 square foot office to be located on a vacant lot. It
will be within impervious surface ratio limitations. The site is located in the heart of
Downtown Clearwater and within the Southeast Periphery Plan Area (SPP A). The SPP A
provides for office and attached dwelling uses. The site is also within an area of the
Clearwater Downtown Redevelopment Plan which permits office uses. The immediate
area consists of nonresidential uses including government uses and single- and multi-
family residential. A significant number of surrounding parcels are vacant. The
development will be in harmony with the scale and character of adjacent properties.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned Downtown District and the proposed use will be in compliance with that
zoning. The site is located in the heart of Downtown Clearwater and within the Southeast
Periphery Plan Area (SPP A). The SPP A provides for office and attached dwelling uses.
The site is also within an area of the Clearwater Downtown Redevelopment Plan which
permits office uses. The proposed development should not discourage appropriate
development and use of adjacent land buildings.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The development will not negatively affect the health or safety or persons residing or

4. The proposed development is designed to minimize traffic congestion.

I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plan dated received October 14,2002, elevations and landscape plan dated received November 7,
2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (November 15, 2003). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property (which is the subject of the approval) within
seven days of the date the development orderis issued. A copy of the Development Order is being sent
to the surrounding property owners. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case will expire on
November 22, 2002.

The purpose of this letter is to notify you that the Clearwater Planning Department has received
an application for Flexible Standard Development from Mr. Charles Sabbides for the property at
1131 Gould Street. You are being sent this letter because you are a property owner within 200
feet of the site. The request is to permit an office within the Downtown District under the
provisions of Section 2-902. The proposal includes a new 3,720 square foot, one-story office
building.
The City encourages you to participate in the review of this case. You may participate by calling
me to discuss the case, visit our office to review the application andJor send written comments to
be considered in the City's review of the project. The earliest possible date that the City will
make a decision on the project is May 23, 2002. Therefore, please contact me or send your
written comments no later than that date.
May 16, 2002, the Development Review Committee (composed of the City's professional staff)
will review the project for compliance with the City's Community Development Code.
Following that review, the Planning Director will make a decision to either approve or deny the
application. As a nearby property owner, you will receive a copy of the Development Order that
describes the Planning Director's decision on the project. Should you be dissatisfied with the
City's decision, you have the right to appeal the decision to the Community Development Board.

Dear Mr. Sabbides:
The Planning staff has reviewed your application to permit an office within the
Downtown District under the provisions of Section 2-902 at 1131 Gould Street. The
proposal includes a new 3,720 square foot, one-story office building. After a preliminary
review of the submitted documents, staff has determined that the application is complete.
The application has been entered into the Department's filing system and assigned the
case number: FLS 02-04-36.
The Development Review Committee will review the application for sufficiency on May
16, 2002 in the Planning Department conference room - Room 216 - on the second floor
of the municipal service building, 100 South Myrtle A venue in Clearwater. Please call

the approximate time that your case will be reviewed.

Dear Mr. Sabbides:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On May 16, 2002, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development to permit an office within the Downtown District under
the provisions of Section 2-902. The proposal includes a new 3,720 square foot, one-story office
building. The DRC recommended approval of the application with the following bases and conditions:
Bases for approval:
1. The proposal complies with Flexible Standard Development criteria under the provisions of Section
2-902;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of ApjJroval:
1. That there be no outdoor storage of materials or supplies;
2. That all signage meet the requirements of Code prior to the issuance of a Certificate of Occupancy;
3. That a 10-foot right-of-way, sidewalk, drainage and utility easement be granted prior to the
issuance of a Certificate of Occupancy;
4. That $7,100 be paid into the Town Lake fund in lieu of stormwater facilities prior to the issuance of
any building permits;
5. That all signage meet the requirements of Code; and
6. That an engineered site plan be submitted prior to the issuance of any building permit.

I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plan dated received October 14, 2002, elevations and landscape plan dated received November 7,
2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (November 15, 2003). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property (which is the subject of the approval) within
seven days of the date the development order is issued. A copy of the Development Order is being sent
to the surrounding property owners. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case will expire on
November 22, 2002.
