RE: Development Order - Case ~6 at ~4 North Fort Harrison A venue
Dear Ms. Goudereau1t:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On January 29,2004, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to maintain the color on a building that was
recently repainted Byzantine Purple 243-7 (trim, and a portion of the base) and Shimmer (light purple)
215-2 (main body) within the Downtown District under the provisions of Section 2-902. The proposal
also includes the installation of new windows (painted Byzantine Purple 243-7), new awnings over
second-story windows and new doors. The DRC recommended approval of the application with the
following bases and conditions:
Bases for Approval:
1. The proposal complies with the provisions of Section 2-903;
2. The proposal complies with requirements of the Clearwater Downtown Redevelopment Plan;
3. The plan complies with General Applicability Criteria under the provisions of Section 3-913;
4. The proposal, as amended, will conform to the pending Downtown Design Guidelines; and
5. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That the body of the building be repainted a neutral color (sand, beige, cream, etc.) to be submitted
to and approved by Staff prior to work performed;
2. That the window frames be a neutral color (white, sand, beige, cream, etc.) to be submitted to and
approved by Staff prior to installation;
3. That the trim along the roofline, edge of canopy and window sills may remain a brighter color
(existing Byzantine Purple 243-7) including a three-foot high (maximum) watercourse around the
base of the building;
4. That the awning material, consisting of a complimentary, color be submitted to Staff for final
review and approval prior to installation;

5. That all other future changes to the exterior of the building be reviewed by Staff for compliance
with Downtown Design Guidelines and all applicable Code requirements; and
6. That signage be limited to attached signage architecturally-integrated into the design of the building
subject to review and approval by Staff.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with above six conditions. The approval is based
on and must adhere to the elevations, color samples and application dated received December 23,2003
and as amended by Staff through this Development Order.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (January 30, 2005). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not

Coordmator for a penod not to exceed one year and ~iY!l;\'Mif!l~he ongmal penod of valIdIty. The
Community Development Coordinator may approve atl"m:tCfi'fioiiarextension of time not to exceed one
year for good cause shown and documented in writing. I l'tie coordinator must receive the request for
this extension within the one-year period of validity after the original time extension.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.
Pursuant to Section 4-502.A, an appeal may be initiated within seven days of the date the Development
Order is issued by an applicant or property owners within the required notice area and who presented
competent substantial evidence in the Level One review. A copy of the Development Order is being
sent to those surrounding property owners who presented competent substantial evidence in the Level
One review. The filing of an application/notice of appeal shall stay the effect of the decision pending
the final determination of the case. The appeal period for your case will expire on February 27, 2004,
(seven days from date of Development Order).

keep this one on your pending, future case log:
gina, cyndi and i met with josee goudreault who is buying the building just north of liquid blue (night club) on north fort
harrison (24 north fort harrison - maybe);
she painted the building lilac and purple without out permission; we told her she needed to go through a (modified)
flexible standard development process whereby she'll submit an application (only to include general first page
information, survey, elevations, photographs, signage and colors - no stormwater, tree survey, traffic analysis or site
plan, etc.); she will submit when ever she gets her documentation together - three copies of information (not 14); we
will determine completeness and send out notification letters to surrounding owners (with the standard language about
not making a decision in less than so many days, blah blah blah); then we will analyze and send a development order;
we told her this could take about 30 days from the day she submits
[we have used this process for other sites that are only making changes to architecture/building design; no formal drc
necessary]
