Dear Mr. Bond:
At its meeting of April 11, 2002, the Development Review Committee (DRC) approved with conditions the
above referenced Flexible Standard Development application to permit a 150,690 square foot, four-story, 542-
space parking garage within the Downtown (D) District under the provisions of Section 2-902 of the Community
Development Code with an accessory 9,000 square foot (approx.) central commissary and laundry facility.
On July 17, 2006, a request was received that proposed revisions to the above referenced approval. Those
revisions are as follows:
o Modification of the southwest entrance/exit from a two-way drive aisle to a one-way egress only
drive aisle;
o Deletion ofthe central commissary, laundry facility and associated loading dock;
o Modification of the north and west fas;ades of the parking garage in association with the removal of
the central commissary, laundry facility and loading dock;
o The increase of the east (front) building setback from 10 feet to 21 feet due to the location of the
existing "chiller lines";
o The increase of the north (front) building setback from 8 feet to 13 feet due to the location of the
existing "chiller lines";
o Establishment of a 10-foot separation between the south wall of the parking garage and the existing
adjacent Central Energy Plant; and
o Relocation of the stormwater vault from the southwest comer of the building to the center of the
building.
In accordance with the provisions of Section 4-406.A of the Community Development Code, the proposed
revision has been deemed to be a Minor Revision and is hereby APPROVED with the following conditions:
1. That prior to the issuance of any building permits, a landscape plan must be submitted to and
approved by Staff;
2. That prior to the issuance of a Certificate of Occupancy, any/all required easements must be granted;

3. That the decorative screening on the ground level is comprised of either wrought-iron or aluminum
and be painted/powder-coated black;
4. That the signage incorporated into the decorative screening on the ground level is eliminated;
5. That all signage meet the requirements of Code and be architecturally integrated with the design of
the building with regard to proportion, color, material and finish as part of a final sign package
submitted to and approved by Staff prior to the issuance of any permits which includes:
a. All signs fully dimensioned and coordinated in terms of including the same color and font style
and size; and
b. All signs be constructed of the highest quality materials which are coordinated with the colors,
materials and architectural style of the building;
6. That the final design and colors of the buildings are consistent with the architectural elevations
approved by Staff; and
7. That the final Certificate of Occupancy is obtained by December 31,2006.

While a Development Order cannot be issued for the minor revision at this time, the location of the parking
garage and its general design are considered to be finalized. The only item that remains outstanding with regard
to the minor revision is the design/appearance of the decorative "grillwork" to be installed on the ground level of
the parking garage.
Upon the final agreement of the design/appearance of the aforementioned decorative "grillwork", a formal
Development Order will be issued for the minor revision.

Dear Mr. Rice:
This letter addresses the proposed stormwater vault in the ground floor of the nev
parking garage. The submittal of July 21st with minor revisions to the approved plan included ,
request to relocate the vault from the southwest comer of the garage to the center of the garage.
The original stormwater vault is shown, on the approved site plan that is part of the
October, 2002 Development Order. A plan and section view of that vault is included with thh
letter. Note that the approved vault has vertical walls under the floor slab, and a sloping bottom.
We are requesting that the vault be relocated in order to provide a better design which
creates more storage capacity. The increased storage capacity allows the runoff from the parking
garage to be treated and mitigated withinthe vault (called Pond #2 in the cales), and allowed us
to remove a vertical wall from the earlier design ofthe wet pond (Pond #1).

The relocated vault will have vertical walls on 4 sides, with a barrier wall and curb to
provide safety. A locked gate and ladder will provide access to maintenance personnel doing
routine operation checks ofthe function ofthe facility.
In the Stormwater Drainage Design Criteria, page 7, vertical walls are discouraged
except as may be specifically approved due to reason of undue hardship to the developer. The
severe space limitations dictated by the design of the parking garage do not allow the use of
sloped sides. Vegetation will not grow there, anyway. A vault with sloped sides would not work
in its original or relocated position because of the geometry of the parking garage design.
We acknowledge that the vault is not located adjacent to the right-of-way, or along the
boundaries of adjacent parcels of land, or on any side of a pond serving only as a water quality
facility. The underdrain is located in the bottom ofthe pond.
The remaining point on page 7, "on more than two sides of a detention pond", is what we
are asking relief from.

The Church's parking garage located at 624 Court Street has a
Development Order approved in 2002 and extended to 2006 to
construct a 4 levelf542 parking space garage (Case FLS 02-03-26). As
you are aware, this garage has an active building permit for the site
work and for the foundation. Since the original approval, the City
assigned a new address for the garage as 645 Franklin Street and this
new address is used in the City building permit fIles.
During the detailed construction design, several minor changes have
been identified which reflect current issues and will improve the overall

Modify the southwest entrance / exit from a two- way drive to a
one-way drive. The related pavement width will also be
modified to decrease from 28' feet in width to 12' in width.
This revision was shown on the new garage design that was
reviewed by the DRC on June 29,2006. At that DRC meeting,
there were no concerns or objections to this type of access
from the staff.
2. Delete the approved loading dock on the northwest corner of
the parking garage. A loading dock is no longer necessary
{} when the commissary and laundry are removed from the
structure (see detailed explanation below). The area previously
used as loading dock is proposed for two parking spaces.

3. Delete the approved commissary and laundry from the first
floor of the garage. The approved plan included a commissary
and laundry on the first floor of the parking garage fronting on
Franklin Street. The original intent was that food service
preparation would be primarily done in the commissary and
then transported to the Flag Building cafeteria. Upon further
review, this plan resulted in several inefficiencies and the
Church plans to consolidate all food preparation within the
Flag Building cafeteria.
In addition, the Church has refined its food service delivery
throughout the campus by establishing three cafeterias in the
north, central and south sections of the downtown campus.
Therefore, there no longer is a need for a central commissary
in the parking garage.
With regard to the laundry approved in the parking garage, the
Church has decided to move the laundry to a location outside
of downtown. The laundry would be co-located within a
Church-owned warehouse on Calumet Street. It is not
necessary for the laundry to be located on highly desirable
downtown property and the warehouse location is more
appropriate due to the laundry operating characteristics.
With the deletion of the Commissary and laundry, there is a
related slight decrease in the size of the building footprint from
53,230 square feet to 49,800 square feet. The first floor space
that previously was devoted to the commissary and laundry is

proposed for use as additional parking spaces. The approved
plan contains 542 parking spaces; the proposed plan would
contain 581 spaces, a net increase of 39 spaces.
Increase the approved eastern building setback on East
Avenue from 10' to 21'. The reason for this increase is due to
the existing 20" diameter chilled water lines that currently
exist along East Avenue. The increased setback will provide
adequate separation between the water line and the parking
garage wall.
5.
Increase the approved northern building setback on Franklin
Street from 8' to 13'. The reason for this increased setback is
due to the same reason as described in Item 4 above, namely
to provide adequate separation between the existing water
lines and the structure.

Establish a separation between the south wall of the garage
and the existing Central Energy Plant. On the approved plan,
there was no separation established for the distance between
the electrical plant and the south edge of the garage. The fire
code requires a separation of 10', therefore, this separation is
requested. We believe that this item reflects a clarification to
the approved plan rather than a change to the plan.

Relocate the stormwater vault under the parking garage from
the southwest section of the building to the center of the
building. The purpose in this relocation is to provide
additional storage area in a cost-effective manner.
Analysis of Proposed Changes Compared to Code
Criteria
1. Does not alter the location of any private street and/or
driveway by more than 20 feet.
Response: There are no changes to the location of private streets or driveways.
The approved Franklin Street driveway remains in the same location. The
approved southwestern driveway remains in the same location with the only
change being from an entrance/exit to an exit only type of access.

2. Does not change the use unless such change is of a similar or
less intensity, as determined by the community development
coordinator.
Response: The use is not changed since the approved use is for a
parking garage and it is intended that the use remain as a garage.
The change proposed to delete the commissary and laundry is
clearly a decrease in intensity in both use characteristics as well
as traffic impacts. With the elimination of the commissary and
laundry, there will be a major decrease in employees assigned to
this building, thus reducing their travel to and from the facility.
In addition, the loading and delivery trips previously necessary for
both the commissary and the laundry will be eliminated thus
reducing the traffic impacts of the facility. Elimination of these
trips also eliminates the potential conflicts between passenger
and commercial vehicles.
3. Does not increase the density or intensity of the
development.
Response: The proposed changes do not increase the intensity of the project. As
described above, the elimination of two uses previously approved in the garage
will reduce the intensity of the development. The slight increase in total number
of parking spaces from the approved 542 spaces to the proposed 581 (+ 39
spaces) is also not an increase in intensity since the parking garage is accessory
to the Flag Building. The garage will contain more spaces than the City Code
requires, thus operating only to improve the functionality of the principal use of
the Flag Building and any other Church facilities using the garage.
4. Does not result in a reduction of setback or previously
required landscape area.
Response: There is no reduction in any setback or landscape area. As discussed
in Proposed Change Items 4 and 5, the setbacks on East Avenue and Franklin
Street will be increased to accommodate existing large water lines.

cancellation of any condition placed upon the application as
origjnally approved.
Response: There is only one minor change to the conditions of approval.
Condition #1 ofthe Development Order had two requirements ofthe Fire Code.
The first condition required that a fire separation be constructed between the
parking portion of the building and the commissary area. Since the commissary
is proposed for elimination, this condition is moot. The second condition
required a fire sprinkler system throughout the building. It is our understand
that the open design of the garage will eliminate this requirement; however, a
fire pump will be installed in the garage and all other applicable fire code
requirements will be met.
7. Does not add property to the parcel proposed for
development.
Response: There is no change to the site associated with the project.
8. Does not increase the height of the buildings in a manner
that will change the overall height of the project, will not
alter the scale of the project, does not exceed the maximum
height permitted in by the applicable special area plan and
zoning district.

The garage is located in the Downtown Redevelopment Plan area of the City in

PROJECT NARRATIVE

The Parking Structure/Central Service Facility is the next phase of construction as
part of the new Technical Delivery Building already under construction, and the
proposed Central Energy Plant.
The existing conditions within the project area include five vacant structures and
infrastructure. It is proposed to demolish the structures and infrastructure, and
construct the parking structure/central service facility with service road,
landscaping and storm water management. The retention/detention pond is
designed as a master drainage facility for Technical Delivery Building (North Lot),
Central Energy Plant, Parking Structure/Central Service Facility and future 4000
seat concert hall (South Lot). The parking structure is designed for 542 cars, with
parking for 8 buses along the west side of the structure.
It is proposed to construct the storm water management system to treat and
attenuate the runoff from the North and South lots. Runoff will be piped to tpe
proposed detention pond, and the grading of the surrounding ground will direct
surface runoff to the pond. The discharge will release into the existing storm sewer
on Franklin Street. The detention pond is designed to be in compliance with the
current development standards of SWFWMD and the City of Clearwater.
SWFWMD also requires that the first yz" of runoff be retained for water quality.
The City requires that the pond attenuate the runoff from a modified pre., post- 25
year, 1 hour storm event. The recovery of the pond after the storm event is
calculated to occur within 24 hours with the installation of 152 feet of 6"
perforated PVC underdrain.
A concrete control structure is proposed to control the volume and discharge of
water within the detention pond. The top of the control structure is set at elevation
26.6, with the pond bottom at elevation 23.0. The control structure will attenuate
the peak discharge by using a rectangular weir in accordance with City and
SWFWMD requirements. A baffle will be installed around the top of the control
structure to control the release of oils, and other objectionable materials from the
pond.

THIS SECOND AMENOME~BUILOING PERMIT ISSUANCE

Permit 'asuance Agreement between the.CITY OF CLEARWATER FLORIDA, a.Florida
munlclpat corporation ("CIty"), and the CHURCH OF SCIENTOLOGY RELIGIOUS
TRUST ("Church". as follows:

A. 0n March 21, 2000, the City and the Church entered into that certain
Building Permit Issuance Agreemont ("Agreement"). which Is hereby incorporated by
reference.
B. On December 26, 2000, the CIty and Church entered Into that certain First
Amendment to Building Pennlt '$suance Agntement, which la h.,reby incorporated by
reference.
C. At this time, it appaars that the opening of the Church's "Super Power"
Building will occur in the Spring of 2003.
D. The Church desIres to extend the period at time for which it must submit
plans for the con~rUctlon of the garage to meet the required parKing for the Super
Power Building.
E. The City has agreed to such an extension, on the terms and Conditions set
forth below.
NOW, THEREFORE. In consIderation of the mutual promises contained herein, It
is agreed agfollows:
1. Recitals. The above recitals are true end correct and are hereby
incorporated by reference. !
2. TJmeframe Extensions. The Church snell have until February 28, 2002 in
which to submit to the City building plans for its parking facility. Tha Church
understands and acknowl8dges that it will not bo able to obtain a certificate of
occupancy. on the Super Power Building until such time 8S it has built its remaining
required parking, made payment In lieu of constructing p8~ng, or a combination
thereof, all as Get forth in the Agreement.
3. Reolacernent of Letter of Credit The original letter of cr6dit delivered to
the City pursuant to the Agreem&nt aha II be retumed to the Church, and simultansQus)y
replaced with a Letter of Cradit in the form attached hereto as Exhibit "A," to reflect the
change of date referred to In paragraph 2 above.

BUILDING PERMIT ISSUANCE AGREEMENT
THIS BUILDING PERMIT ISSUANCE AGREEMENT ("Agreement") is made on
March~, 2000. between the CITY OF CLEARWATER. FLORIDA, a Florida municipal
corporation. ("City"), and the CHURCH OF SCIENTOLOGY RELIGIOUS TRUST
("Church")

A. The Church wishes the City to issue it a building permit for construction of
a building known as the Church of Scientology Ministerial Training and Pastoral
Counseling Center (Center)
B. The certified site plan required by City Ordinance for the Center provides
for the construction of 809 parking spaces ("Required Parking"), however. the Church is
not prepared to submit construction plans for the garage prior to the issuance of the
building permit for the Center, as required by the City.

D. The Church desires to pay simultaneous with the execution of this
Agreement, the sum of One Million Five Hundred Three Thousand and 00/100 Dollars
($1,503,000.00), representing payment in lieu for Three Hundred Thirty Four (334
spaces) of the Required Parking.
E. The City and the Church have agreed that the Church will post a letter of
credit with the Cit~ the Church will make provision for the balance of the
Required Parking:___(475 spaces ither by payment of a fee in lieu of construction or
construction of parkl combination of the two. for the Center as required by City
ordinance.
F. The City and the Church wish to set forth their understanding in writing.
NOW, THEREFORE, in consideration of the mutual promises contained herein, it
is agreed as follows:
1. Recitals. The above recitals are true and correct and are incorporated
herein by reference.
2. Letter of Credit: Issuance of Building Permit. The Church shall deliver to
the City an original letter of credit in the form attached hereto as Exhibit A ("Letter of
Credit") and payment of One Million Five Hundred Three Thousand and 00/100 Dollars
($1,503,000) represents payment in lieu for Three Hundred Thirty Four (334) spaces of
the Required Parking. Simultaneously with such delivery, the City will issue to the
Church the building and other permits which are reQuired for the Church to commence

construction of the Center pursuant to the construction drawings previously filed by the
Church with the City.
3. Reduction and/or Return of Letter of Cre<;lit. From time to time (prior to the
City having drawn down the Letter of Credit in full), the City will allow a reduction in the
amount of the Letter Of Credit, dollar for dollar, with amounts paid by the Church to the
City as Parking Fee (as defined in the Letter of Credit). This reduction may be in the
form of an amendment of the Letter of Credit or substitution of a replacement letter of
credit in the new amount, which replacement shall then become the Letter of Credit. At
such time (prior to the City having drawn down the Letter of Credit in full) as the Church
has made provision for parking for the Center, whether by providing construction
drawings to the City for Four Hundred Seventy Five (475) spaces, payment of the
Parking Fee for Four Hundred Seventy Five (475) spaces, or some combination of
submission of construction drawings and payment of the Parking Fee. the City shall
return the Letter of Credit to the Church.
4. Effect of Drawdown of Letter of Credit. A drawdown by the City of the
Letter of Credit shall serve as payment or partial payment of any Parking Fee which
may be owing to the City in connection with construction of the Center. The obligation
of the Church to construct the balance of Four Hundred Seventy Five (475) parking
spaces to serve the Center shall be reduced by the number of parking spaces paid for
by a drawdown of the Letter of Credit.
5. Issuance of Certifi~ate of Occuoancy. The City shall issue a certificate of
occupancy for the Center upon satisfaction of all conditions precedent to such issuance.
The parking requirement for the Center shall be deemed to have been met by the
payment (whether by draw down under the Letter of Credit, direct payment by the
Church to the City, or otherwise) of the Parking Fee for Four Hundred Seventy Five
(475) parking spaces, the construction of Four Hundred Seventy Five (475) parking
spaces, or some combination of construction and payment of the Parking Fee as
authorized and approved by the City all of which are in excess of the Three Hundred
Thirty Four (334) parking spaces satisfied by payment in lien concurrent herewith.
6. Reopenino of AClreement. This Agreement is based upon the assumption
that the Parking Fee will remain at Four Thousand Five Hundred Dollars ($4,500) per
space. Should the City increase the Parking Fee, then the parties shall renegotiate this
Agreement in geod faith and the City shall not draw under the Letter of Credit until such
negotiations have deadlocked, provided, however, that no certificate of occupancy shaH
be issued for the Center until the City's parking requirements have been met. The City
and Church acknowledge that, depending on the actual number of spaces constructed
by the Church, the Church may voluntarily pay to the City an amount in excess of what
it would otherwise be obligated to pay the City as a fee in lieu of parking.
7. Certificate of Occuoancy. No Certificate of Occupancy shall be issued for
the Center until such time as the City's parking requirements have been met.
8. Notices. Any notice to be given to or served upon any party hereto, in,
connection herewith. must be in writing, and may be given by certified mail or

guaranteed ovemight delivery service, retum receipt requested and shall be deemed to
have been given given and received when a certified letter containing such notice,
properly addressed, with postage prepaid, is deposited in the United States Mail or
when delivered into the custody of the overnight delivery service; if given otherwise
than by certified mail or guaranteed overnight delivery service, it shall be deemed to
have been given when delivered to and received by the party to whom it is addressed.

Either party hereto may. at any time by giving five (5) days' written notice to the other
party hereto, designate any other address in substitution of the foregoing address to
which notice shall be given and other parties to whom copies of all notices hereunder
shall be sent.
9. Entire Agreement Modification. This Agreement embodies and
constitutes the entire understanding between the parties with respect to the matters
described herein. All prior or contemporaneous agreements, understandings,
representations and statements, oral or written, are merged into this Agreement.
Neither this Agreement nor any provision hereof may be waived, modified, amended,
discharged, or terminated except by an instrument in writing signed by the party against
which the enforcement of such waiver, modification, amendment, discharge or
termination is sought, and then only to the extent set forth in such instrument.
10, Aoplicable !,..aw. This Agreement shall be governed by, and construed in
accordance with. the laws of Florida.
11. Headinas. Descriptive headings are for convenience only and shall not
control or affect the meaning or construction of any provision of this Agreement.
12. Binding Effect. This Agreement shall be binding upon and shall inure to
the benefit of the parties hereto and their successors and assigns.
13. Counteroarts. This Agreement may be executed in several counterparts,
each constituting a duplicate original, but all such counterparts constituting one and the
same Agreement.

14. Interpretation. Whenever the context hereof shall $0 require, the singular
shall include the plural, the male gender shall include the female gender and the neuter,
and vice versa, and the use of the terms "include, n "includes!t and "including" shall be
without limitation to the items which follow.
15. Severabilitv. In case anyone or more of the provisions hereof shall for
any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity,
. illegality or unenforceability shall not affect any other provision hereof, and this
Agreement shall be construed as if such invalid, illegal or unenforceable provision had
never been contained herein.
16. Joint Drafting. The parties acknowledge that each has played an equal
part in the negotiation and drafting of this Agreement, and in the event any ambiguities
should be realized in the construction or interpretation of this Agreement, such
ambiguities shall not be construed against either party solely on account of authorship.
17. Waiver. T~he waiver of one or more defaults by any party to this
Agreement shall not be deemed a waiver of any subsequent default of the same or any
other provision of this Agreement under the same or other circumstances.
18. Attornev's Fees. etc. Should either party employ an attorney or attorneys
to enforce any of the provisions hereof, or to protect its interest in any matter arising
hereunder, or to recover damages for the breach hereof, the party prevailing shall be
entitled to recover from the other party all reasonable costs, charges and expenses,
including attorneys' fees, the value of time charged by paralegals and/or other staff
members operating under the supervision of an attorney, and other legal costs,
expended or incurred in connection therewith.
19. Time is of the Essence. The parties acknowledge that time IS of the
essence for each time and date specifically set forth in this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of
the day and year first above written; provided, however, that for the purpose of
determining "the date hereof, II as used in this Agreement, such date shall be the last
date any of the parties hereto executes this Agreement.

FIRST AMENDMENT TO BUILDING PERMIT ISSUANCE AGREEMENT
THIS FIRST AMENDMENT TO BUILDING PERMIT ISSUANCE AGREEMENT,
dated this ~o day of December. 2000, amends that certain Building Permit Issuance
Agreement between the CITY OF CLEARWATER FLORIDA, a Florida municipal
corporation ("City"), and the CHURCH OF SCIENTOLOGY RELIGIOUS TRUST
("Church"), as follows:

A. On March 21, 2000, the City and the Church entered into that certain
Building Permit Issuance Agreement ("Agreement"), which is hereby incorporated by
reference.
B. The Agreement required the Church to either obtain a building permit for
the construction of certain required parking, or pay certain fees in lieu of parking as
provided for in the Clearwater City Ordinances, or a combination thereof by December
31,2000.
C. The City is desirous of exploring alternative parking solutions in the
downtown area in an attempt to formulate a comprehensive parking solution.
D. The Church is willing to cooperate with the City in its efforts to formulate
such a comprehensive parking solution.
E. The City and the Church desire to extend the Agreement to allow the City
to proceed in this endeavor.
NOW, THEREFORE, in consideration of the mutual promises contained herein, it
is agreed as follows:
1. Recitals. The above recitals are true and correct and are hereby
incorporated by reference.
2. Timeframe Extensions. The City shall have until June 1, 2001 in which to
determine the feasibility of implementing a comprehensive downtown parking proposal.
In the event that the City is unable to fashion such a solution, or the proposed solution is
unacceptable to the Church, the Church shall proceed to build its remaining required
parking, make payment in lieu of constructing parking. or a combination thereof, all as
set forth in the Agreement. In such case, the Church shall have until October 1, 2001 in
which to submit building plans for its parking facility.
3. Replacement of Letter of Credit. The original letter of credit delivered to
the City pursuant to the Agreement shall be returned to the Church, and simUltaneously

parking spaces in downtown Clearwater. Also will house a central commissary kitchen and a central
laundry facility.
4. The proposed development is designed to minimize traffic congestion.
Ingress and Egress are designed to minimize traffic congestion.
5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development.
The Parking Structure is consistent with the character and standards of the current church buildings under
construction within the Downtown District.
6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts,
on adjacent properties.
The design of the Parking Structure will produce no adverse visual, acoustic or olfactory effects.

Introduction and Study Area
This technical letter serves as a supplement to a traffic impact report that was previously
submitted in October 1997. In that report, a detailed evaluation of a new Ministerial
Training and Pastoral Counsel Center and associated parking garage for the Church of
Scientology in Clearwater, Florida was conducted.
Additional office space and the addition of a cafeteria is proposed. The parking garage
that was originally proposed on the northeast comer of Court Street and Garden A venue
is to be relocated eastward to the southwest comer of Franklin Street and East A venue.
Direct access to the garage would change from Garden Avenue to Franklin Street
This supplemental analysis stems from a meeting with City staff in which task items that
would address these proposed changes were discussed and agreed upon. The results of
our analysis and our conclusions and recommendations are summarized below.
Figure 1 shows the overall study area. Figure 2 shows the project vicinity in greater
detail.
Trip Generation
The trip generation of the original center was detailed in the October 1997 study. In that
report, trip generation was based on applying ITE rates to each unique component of the
center.
Two changes to the original land use are proposed which differ from the original report.
. Expansion of the comer towers of the center, resulting in a total of 306,300 square
feet for office use.
. Addition of a cafeteria for on premises staff only.
Because the cafeteria is designed to serve only church members and representatives
within the building and not to the public, no additional trip generation is anticipated for
this use. Additionally, the cafeteria replaces an existing facility that is located off site.
By providing an on site location, pedestrian traffic is anticipated to be reduced.
Approximately 300' to 400 people who now walk would use the cafeteria inside the
facility instead.
Table 1 summarizes the additional trip generation values based on the description above.
As in the original report, the office space was treated both as a Corporate Headquarters
(ITE code 714) and as a single tenant office (ITE code 715) for comparative purposes.

The total trip generation based on these revisions is still lower than the original Walker
Parking consultants study estimate of 1025 vehicles. Therefore, the trip generation
estimates used in the original traffic impact study is applicable and are used in trip
distribution in this report..
Trip Distribution
Trips generated from the proposed center (1025 trips) were distributed onto the adjacent
street system as described in the original report. Trips were distributed from the garage,
which has a proposed driveway on Franklin Street.
In the original report, two trip distribution scenarios were developed: one using the
existing geometric configuration of the adjacent street system and one which considered a
proposed asymmetrical pair geometry for Fort Harrison A venue and Myrtle Street.

Based on our meeting with City staff, the asymmetrical pair geometry was not considered
in this analysis.
Trip distribution from the garage only changes in the immediate quadrant around the site.
The overall distribution to the garage wouldn't change: trips coming from the east would
still come from the east, etc.
Figures 3 through 6 illustrate the pre-project and post-project trips on the adjacent street
system based on the relocation of the garage.

Of these, the intersections of Myrtle at Court, Myrtle at Chestnut, and Franklin at Myrtle
are anticipated to be influenced by the relocation of the garage.
A level of service analysis based on the Highway Capacity Software (HCS) of these three
intersections was conducted for the post project condition. Table 3 summarizes the
previous analysis results with the updated ones. The HCS analyses have been included.

The intersection of Franklin and Myrtle is unsignalized. The Level of Service
summarized above is for the sidestreet movements. HCS does not model unsignalized
intersections well. As discussed in the previous report, many acceptable gaps should be
presented to drivers waiting at Franklin Street. It is expected that the intersection of
Franklin and Myrtle will operate at LOS C or better during the PM peak hour.

Recommendations and Conclusions
Based on analysis provided above, there is no additional impacts on the adjacent street
system that comes as a result of the land use revisions and parking garage relocation.
Therefore, the conclusions developed in the original Traffic Impact Study are still
applicable and no further detailed analysis is necessary.

This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On April 11, 2002, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development to permit a parking garage within the Downtown
District under the provisions of Section 2-902. The application includes a 150,690 square foot, four-
story, 542-space parking garage. The structure will also contain an approximately 9,000 square foot
central commissary and laundry facility. The DRC recommended approval of the application with the
following bases and conditions:

2-902;

Conditions of Approval:
1. That a site plan be submitted to and approved by Staff prior to the issuance of any permits showing
the following:
. A two-hour fire separation between the parking facility and laundry/food preparation area per
NFPA 101, Section 38-1.2.2;
. A fire sprinkler system throughout the building in accordance with Chapter 553, Florida State
Statutes, and Florida Building Code, Sections 411 and 903;
2. That all required easements be granted prior to the issuance of a Certificate of Occupancy;
3. That all signage meet the requirements of Code and be designed according to a common theme
including similar style, color, material and other characteristics to provide a sense of uniformity;
and
4. That a landscape be submitted to, and approved by, Staff prior to the issuance of any permits
showing the following:
. The area around the stormwater pond to include shrubs in addition to palm trees and
groundcover;
. Properly labeling all plant material;
. The southern wax privet within the landscape areas along Court Street be replaced with
ornamental trees or more appropriate shrub mass, to the satisfaction of Staff;
. The landscape area at the northwest corner of the building include shrubs in addition to palm
trees and groundcover; and
. The area around and to the north of the dumpster be planted with palm trees, shrubs and
groundcover.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the four conditions as stated above. The
approval is based on and must adhere to the site plan dated received July 14, 2002 and rendered
elevations dated received July 16, 2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (October 4, 2003). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property (which is the subject of the approval) within
seven days of the date the Development Order is issued. A copy of the Development Order is being
sent to the surrounding property owners. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. The appeal period for your case will
expire on October 11, 2002.

ST AFF ANALYSIS
The 1.75-acre site is located on the north side of Court Street approximately 350 feet east of
South Garden A venue. The site contains six existing one to two-story, buildings with a total of
27,862 square foot.
The site is located in the heart of Downtown Clearwater.
The application includes a 150,690 square foot, four-story, 542 space parking garage. The
structure will also contain approximately 9,000 square foot central commissary and laundry
facility. The building will be finished in a Mediterranean-revival style of architecture with a sand
colored stucco exterior and a terra cotta, barrel tile roof. The proposed parking facility will
service the Counseling and Training Center, currently under construction and a proposed 4,000-
seat concert hall. The future concert hall is not a part of this application and will require a
minimum of a Flexible Standard Development Review.
Landscaping will be provided which will exceed the intent of Code utilizing date palms, flower
shrubs and ornamental trees and groundcover.
All required building permits would need to be obtained prior to construction.

B. FLEXIBILITY CRITERIA FOR PARKING GARAGES AND LOTS IN THE
DOWNTOWN DISTRICT (Section 2-902):
1. The parcel proposed for development is not contiguous to land designated as
residential in the Zoning Atlas;
All surrounding land uses are designated as Downtown District in the Zoning Atlas.
2. Access to and from the parking garage or lot shall be based on the findings of a
transportation analysis approved by the City;
Two ingress/egress points are provided for the parking garage. One ingress/egress will be
along a side street, Franklin Street and the second will be along Court Street accessible
via a 115 long driveway as measured from the back of curb to the proposed structure.
3. The stacking spaces available for cars waiting to pass through a parking ticket
dispenser or booth to enter the garage or lot shall be based on the design and size of
the garage or lot;
It is not clear whether both ingress/egress points will be gated. No stacking spaces are
proposed for the north access point along Franklin Street. Approximately 100 feet (five
vehicles) of stacking spaces is provided on site for the south access point along Court
Street.
4. Any frontage along a public street is designed and improved to be similar in
character and use to other uses and structures fronting on each street for a distance
of 250 feet in either direction along the street or the nearest intersections, whichever
is less;

C. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The application includes a 150,690 square foot, four-story, 542 space parking garage. The
structure will also contain approximately 9,000 square foot central commissary and
laundry facility. The building will be finished in a Mediterranean-revival style of
architecture with a sand colored stucco exterior and a terra cotta, barrel tile roof. The
proposed parking facility will service the Counseling and Training Center, currently
under construction and a proposed 4,000-seat concert hall. The future concert hall is not
a part of this application and will require a minimum of a Flexible Standard Development
Review. It will have no impact on density and will be within impervious surface ratio
limitations. The immediate area consists of nonresidential uses including retail, a
proposed nightclub, and governmental uses including the Municipal Services Building
and the Police Station. The development will be in harmony with the scale and character
of adjacent properties.

2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The site is zoned Downtown District and the proposed use will be in compliance with that
zoning. The proposed development should not discourage appropriate development and
use of adjacent land buildings.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The development will not negatively affect the health or safety or persons residing or
working in the neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The use will have no little effect on traffic.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The proposed development is consistent with and will improve the community character

6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
There will be no adverse effects generated by the proposed development.

STAFF RECOMMENDATION:
Based on the on the application, the proposal is in compliance with the standards and criteria for
Flexible Standard Development approval, with the maximum development potential and with all
applicable standards of the Community Development Code.
Therefore, staff recommends APPROV AL of the application for Flexible Standard Development
approval to permit a parking garage within the Downtown District under the provisions of
Section 2-902 at 624 Court Street.
Bases for approval:
1. The proposal complies with Flexible Standard Development criteria under the provisions of
Section 2-902;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913;
and
3. The proposed development is compatible with the surrounding area.

including similar style, color, material and other characteristics to provide a sense of uniformity;

groundcover;
. Properly labeling all plant material;
. The southern wax privet within the landscape areas along Court Street be replaced with
ornamental trees or more appropriate shrub mass, to the satisfaction of Staff;
. The landscape area at the northwest comer of the building include shrubs in addition to palm
trees and groundcover; and
. The area around and to the north of the dumpster be planted with palm trees, shrubs and
groundcover.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the four conditions as stated above. The
approval is based on and must adhere to the site plan dated received July 14, 2002 and rendered
elevations dated received July 16, 2002.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (October 4, 2003). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property (which is the subject of the approval) within
seven days of the date the Development Order is issued. A copy of the Development Order is being
sent to the surrounding property owners. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. The appeal period for your case will
expire on October 11, 2002.

The purpose of this letter is to notify you that the Clearwater Planning Department has received
an application for Flexible Standard Development from Church of Scientology Religious Trust
represented by Mr. Kenneth Roush for the property at 624 Court Street. You are being sent this
letter because you are a property owner within 200 feet of the site. The request is to permit a
parking garage within the Downtown District under the provisions of Section 2-902. The
application includes a 159,690 square foot, four-story, 542 space parking garage.
The City encourages you to participate in the review of this case. You may participate by calling
me to discuss the case, visit our office to review the application and/or send written comments to
be considered in the City's review of the project. The earliest possible date that the City will
make a decision on the project is April 25, 2002. Therefore, please contact me or send your
written comments no later than that date.
On April 11, 2002, the Development Review Committee (composed of the City's professional
staff) will review the project for compliance with the City's Community Development Code.
Following that review, the Planning Director will make a decision to either approve or deny the
application. As a nearby property owner, you will receive a copy of the Development Order that
describes the Planning Director's decision on the project. Should you be dissatisfied with the
City's decision, you have the right to appeal the decision to the Community Development Board.

Dear Mr. Parry:
Enclosed please find eight (8) sets of revised site/civil plans and two (2) revised
drainage reports, along with the following responses to the comments contained in your
letter of April 12, 2002. The DRC comments will be answered separately in the areas of
Stormwater, Traffic Engineering, General Engineering, Planning, Solid Waste, Land
Resource, Fire and Landscaping as follows:
2. STORMW ATER
a. Provide a copy of application for a modification of the existing SWFWMD permit
prior to the issuance of a D.O.
A copy of the permit modification application will be forwarded to your office as soon as
the pond design is accepted by the city.
New pond calculations are provided in the revised drainage report to comply with the city
standards.
b. Based on the meeting with Bob Maran on May 16th, it was agreed to redesign the
previously approved dry pond to a wet detention pond. The pond changes are provided
on Sheets C4.0, C4.1 and C6.1. Revised pond calculations are in the revised drainage
report.
3. TRAFFIC ENGINEERING:
a.b. The parking layout for each floor is provided by the architect, including handicap
parking, handicap ramps and elevator location.
c. Traffic control signs and pavement markings are shown on Sheet C3.1. Pavement
markings and signage within the parking structure will be provided by the architect
during the plan review by the building department.

d.e.f. As discussed, the traffic will flow both ways from Court Street north to the parking
structure entrance. Beyond the entrance traffic will flow one way to the north, exiting on
Franklin Street. Buses will enter from Court Street and back into the angled stalls. They
will exit onto Franklin Street.
g. Pedestrian access to the parking structure from Court Street is provided as a sidewalk
adjacent to the drive. Access from Franklin Street and East Avenue is provided as
sidewalks to the comer towers, where the stairs and elevator are located. These revisions
are shown on Sheet C3.1 and on the architectural drawings.
4. GENERAL ENGINEERING:
a. The structures #2 & #3 have been removed from the plans.
b.c. The relocation of the utilities in the former city property will be done when the L.
Ron Hubbard Hall site design starts. Utility relocation is not a part of the scope of the
parking structure project.
5. PLANNING:
a. No. Loading dock access will be from the south, proceeding north to allow for
backing into the loading areas.
b.c. Property lines and project boundaries have been modified for better clarity.
d. ~us parking angles and dimensions are shown on Sheet C3.1. Car parking within the
structure is shown on the architectural drawings.
e. No architectual signage is proposed for this project.
6. SOLID WASTE:
a. The dumpster has been relocated in order to provide better access. See Sheets C3.1
and C6.1.
7. LAND RESOURCE:
a. All trees are shown on Sheet C3.1.
b. Tree barricade details have been modified to meet City standards. See Sheet L1.2.

8. FIRE:
a.b. A Standpipe system, as required, will be shown on the architectural drawings when
submitted for review by the building department.
c. The bridge over the detention pond has been removed.
9. LANDSCAPING:
a. New landscape material is provided along Franklin Street and East Avenue between
the building and the street. See Sheet L 1.1.
b. Additional landscape is shown around the pond. See Sheet L 1.1.
c. This area will receive additional landscape treatment.
d. This area will be landscaped with palms and ground cover because the chilled and hot
water pipes are under this area.
e. Variegated jasmine it is.
