RE: Time Extension for Case FLS2003-06024 at 700 Cleveland Street (Scott Mortgage)
Dear Mrs. Chinchar:
This letter is in response to your time extension request for case 06024, received on December 13,
2004. On July 17, 2003, the Development Review Committee (DRC) reviewed your application for
Flexible Standard Development approval to permit a change in use from retail sales and service to
office, addition of a new roof I building repainted, parking lot to be striped, and landscaping under
Section 2-902.G. The application was approved on July 17, 2003 with the following bases and
conditions:
Bases for approval:
1. The proposal complies with the Office Use criteria under the provisions of Section 2-902.G;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions for Approval:
1. That the parking configuration and landscaping match the site plan approved by the Development
Review Committee;
2. That the final colors be consistent with those approved by the Development Review Committee;
and
3. That any monument sign be submitted and reviewed by the Planning Department staff.
The application was valid for one year and expires on December 16,2004. Your request for a one-year
time extension (to complete the required landscaping) has been Denied. However, a six-month time
extension (to complete the required landscaping) has been Approved with the same, 3 conditions.
Section 4-303 ofthe Code, an application for a building permit shall be made within six months of the
time extension approval (June 14,2005). The Community Development Coordinator may approve one
additional extension of time after this extension for good cause shown and documented in writing.
Good causes may include but are not limited to, an unexpected national crisis (acts of war, significant
downturn in the national economy, etc.), excessive weather-related delays, and the like.

We did not have the funds to carry out the order earlier. We had unforeseen expenses

Dear Mrs. Chinchar:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On July 17, 2003, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to permit a change in use from retail sales and
service to office, addition of a new roof / building repainted, parking lot to be striped, and landscaping
under Section 2-902.G. The DRC recommended approval of the application with the following bases
and conditions:
Bases for Apl'roval:
1. The proposal complies with the Office Use criteria under the provisions of Section 2-902.G;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That the parking configuration and landscaping match the site plan approved by the Development
Review Committee;
2. That the final colors be consistent with those approved by the Development Review Committee;
and
3. That any monument sign be submitted and reviewed by the Planning Department staff.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with above three conditions. The approval is
based on and must adhere to the site plan and application dated received June 18, 2003 and additional
supporting materials dated received December 04, 2003.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (December 16, 2004). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit.

CHARACTER OF THE
IMMEDIATE VICINITY: The Downtown District allows for various uses. The immediate
character surrounding 700 Cleveland Street is retail sales to the east
with a jeweler and Walgreen's. To the south is a mix of retail along
Cleveland Street with a bicycle shop and government offices
extending further south. To the west is a Post Office and a mix of
other retail.
ANALYSIS:
The 0.32-acre site is located on the north side of Cleveland Street, approximately 300 feet west of
North Myrtle Avenue. The parcel is in the Downtown District and considered to be one of the
gateway buildings leading into the downtown corridor. The building sat vacant since August of
2001, with the former occupant, Fritz's Skate Shop, opting to move to another location. The
current applicant obtained an Occupation License on September 9, 2002, to occupy the parcel
under the office use as a mortgage broker. An occupation license was issued prior to the
application process for a change of use. This was agreed upon between the applicant and the city.
Due to existing conditions of the lot, building, and a change in use from retail to office, the
applicant has applied to make improvements to the parcel by striping the parking lot, painting the
building/adding a new roof, and providing landscaping on the property.

There are no outstanding enforcement issues associated with this site.

B. FLEXIBILITY CRITERIA FOR OFFICE IN THE DOWNTOWN DISTRICT (Section
2-902.G):
1. Height: The increased height results in an improved site plan and/or improved design
and appearance;
The applicant will not be increasing the height of the building on 700 Cleveland Street. The
proposed improvements to the parcel and existing building are the addition of a new roof,
striping the parking lot, painting the building, and providing landscaping on the property.
This should improve the overall design and appearance of the parcel in relation to the
downtown.
2. Off-street parking; (b.) The physical characteristics of a proposed building are such
that the likely uses of the property will require fewer parking spaces per floor area
than otherwise required or that the use of the significant portions of the building will
be used for storage or other non-parking demand-generating purposes:
The office use under the Downtown District has a minimum off-street parking requirement
of 1-3 per 1,000 gross floor area. The existing building is 1,390 square feet. The maximum
required parking would be 4 parking spaces at 3 per 1,000 gross floor area. The applicant is
proposing 17 parking spaces, which well exceeds the minimum off-street requirement.
3. Design: (a.) All street frontage is designed and used for commercial purposes;
Office is a permitted use for commercial purposes.
(b.) The design of all the building complies with the Downtown District design
guidelines in Division 5 of Article 3.
The design of the building will be in compliance with the Downtown District guidelines.
The applicant is providing landscaping where no landscaping currently exists. The existing
building fayade and paint has deteriorated over the years and is being repainted with colors
that are characteristic to the colors recommended for Downtown and traditional to Florida.
The roof will be replaced with a charcoal gray Mediterranean Style roof that is
characteristic to existing light toned roofs in the Downtown District. The proposed sign
will be complimentary in the color to the colors proposed for the building.
D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The redevelopment to take place on the parcel will be minor fayade changes including a
new roof, landscaping, building to be repainted, striping the parking lot, and a proposed

sign. Because the parcel is located in the Downtown District and considered one of the
gateway buildings into the downtown corridor, much consideration has gone to assure that
the redevelopment of this parcel will be in harmony with adjacent properties.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the value
thereof.
The visual improvements proposed to the building and lot will help to encourage
surrounding adjacent uses and property owners. The site will not impair the value of
neighboring properties or discourage appropriate development and uses.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The new mortgage company will have no adverse impacts affecting the health, safety, or
any people residing or working in the neighborhood where the use will take place.
4. The proposed development is designed to minimize traffic congestion.
The mortgage company will have more than the minimum required parking spaces. By
providing ample amount of parking on site, the mortgage company use will not generate a
demand greater than the parking lot can supply.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.

SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on July
17, 2003. The Planning Department recommends APPROVAL of the Flexible Standard
Development application to permit a change in use from retail sales and service to office, addition
of a new roof / building repainted, parking lot striped, new signage, and landscaping under Section
2-902.G., with the following bases.

As a property owner within 200 feet of 700 Cleveland Street, the City of Clearwater Planning Department gives
notice that an application for Flexible Standard Development has been filed for that property. The request is to
permit a change in use from retail sales and service to office under Section 2-902.G., along with the parking
surface to be striped, building painted, and landscaping.
On July 17, 2003 the Development Review Committee (composed of the City's professional staff) will review
and determine whether the application demonstrates compliance with the City's Community Development
Code. Following that review and determination, the Planning Director will issue a Development Order
approving with conditions or denying the application and a copy of this Development Order will be mailed to
you. The earliest date that the City will make a decision on the application will be July 17,2003.
