The slight reduction is setback is consistent with other setbacks is the area. Because period materials are
specified, the project matches the look of the area.

a. A determination of the front setback shall consider the extent to which
existing structures in the neighborhood have been constructed to a regular or
uniform setback from the right-of-way.
The houses in the immediate area have not been constructed in a uniform
setback situation. Casler Avenue curves west to join Baker Avenue at a
roundabout. The curve results in odd shaped lots and houses build offset from
each other to accommodate the curve, with non-uniform setbacks. Evidence of this
can be shown through a map of the area.
A search of building department microfiche found only two nearby surveys.
One is across the street, and the other is in another block. These may not be
representative. Several photographs enclosed with addresses will illustrate the
character of the neighborhood.

b. The reduction in front setback will not adversely affect adjacent property
values
The slight reduction in setback will not, and has not negatively affected adjacent
property values as' evidenced by recent sales prices. Both adjacent houses have
sold at premiums over comparable sales values as evidenced by Pinellas County
Property Appraiser records (enclosed) these sales occurred after slab construction
had begun. 302 Casler (house next door north) sold in November 2002, for
$13,000 more than area comparable sales values. 220 Casler (house next door
south) sold in April 2003 for $5,500 more than area comparable sales values. One
should easily conclude, the reduction in front setback will not, and has not,
lidversely affected adjacent property values.

c. The reduction if front setback is consistent with neighborhood character.
Theneighborhobdhas several distinctive qualities. The neighborhood was
chosen to receive traffic.cah~lingdevices. This road project is near completion and
makes the neighborhood unique to Clearwater. The reduction in setback has no
effect with regards to the traffic calming treatment.
The odd numbered side; of Casler avenue has a parkway between the
sidewalk and the street of approximately 6 feet. The even side of the street has a
parkway width of 14 feet. This'makes both sides of the street visually different.
The odd side of the street has narrower lots. There are more houses on the odd
side of the street which alsa causes visual disparity. The subject property (226
Casler Avenue) is on the even sid~ of the street with a real 8' additional setback
from the street. Visually, the project matches the odd side of the street more
closely.
.
Another distinct nearby quality is the fact that several houses that face Drew
street have rear access from Casler One structure, a duplex at 1656 / 1658 Dre~
has a oversize garage facing Casler Avenue which is much closer to the street than
front or rear setback requirements allow.
Several other houses in tht? neighborhood have had extensive revisions, or
rebuilds which change the overall look of the neighborhood for the better. 408
Casler is one example. 21~ Richards is another. Many houses in the area have
garages bumped out to the front. 215 Casler is an example.
No trees on the property need be removed. The reduction of setback has no
effect on the look of area trees. Several nearby trees, as they grow and mature will
provide a partial screening or shading of the project.

The building height is well within the 30 foot height limit, and there are
other two story houses in the area. ' The ,building materials specify "slump block"
boarder to match the original house. This detail matches the addition to the original
house visually. One adjacent house also has the slump block detail. Slump block
has not been manufactured in Florida since 1980. All slump block used in this
project was custom manufactured to match this unique architectural trait so
common in older Clearwater neighborhoods.

d. The reduction in front setback results in an efficient house layout.
The main component of the project is the addition of a two car garage. Facing the
garage straight to the street is the most efficient design for several reasons. Facing
the garage to the street minimizes disruption of green areas by pavement. No trees
will be destroyed or disturbed in this layout. Facing the garage to the front
matches neighborhood character.
Interior design is also most efficient with the slight reduction in setback.. The
garage area is only eighteen feet deep, at most. Anything less than this slight
reduction is setback makes the garage useless except for a very small automobile,
or storage of junk.

K. TRAFFIC IMPACT STUDY: (Section 4-202.A.13 and 4-801.C)
Include as required if proposed development will degrade the acceptable level of service for any roadway as adopted in the Comprehensive plan.
Trip generation shall be based on the most recent edition of the Institute of Transportation Engineer's Trip General Manual. Refer to section 4-
801 C of the Community Development Code for exceptions to this requirement.

OWNER/BUILDER
Owner/Builder of a single-family dwelling are exempt from the regulations as set forth in Florida Statute 489 when building for
their own use and occupancy.
The sale or lease, or offering for sate or lease, of said structure for a period of one (1) year after construction is a criminal
violation punishable as a misdemeanor of the 2nd degree.
For your information, the Owner/Builder becomes liable and responsible for the employees he hires to assist in the
construction project. This responsibility may include the following when required by law:
A. Worker's compensation (for workers injured on the job).
B, Social Security Tax (must be deducted from the employee's wages and matched with the owner's funds).
C. Unemployment Compensation (mayor may not be required).

This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On January 29, 2004, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval for reduction to the front (east) setback from
25 feet to 22.33 feet to a proposed two story addition, in association with a single-family residence,
under the provisions of Section 2-203.B. The DRC recommended approval of the application with the
following base and conditions:
Base for Approval:
1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.B.
Conditions of Approval:
1. That no expansion of the non-conforming addition will be permitted in the future; and
2. That the landscaping and trees located in front of the structure be maintained and/or replaced when
needed so as to maintain the visual buffer that exists.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above one condition. The approval is
based on and must adhere to the site plan and application dated received November 22, 2003.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (January 30, 2004). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building

ANALYSIS:
The 0.217 acre lot is located on the west side of Casler Avenue approximately 400 feet north of
Drew Street. The surrounding area is characterized by detached single-family homes and is largely
residential in nature. The parcel contained an existing 1,644 square feet, one-story, single-family
home. The applicant has expanded the single-family home by placing a 1,310 square foot two story
addition onto the northeast corner of the home, reducing the existing front (east) setback along
Casler Avenue from 35.7 feet to 22.33 feet from property line to building. The proposed addition
brings the house to 2,954 total square feet.

One homeowner within this subdivision has submitted letters of no objection to the proposal. The
owner indicated they support the project and the addition looks great and blends in well.
All applicable Code requirements except Front Setback requirement of 25 feet have been met. All
Flexible Standard criteria including but not limited to General Applicability criteria (Section 3-
913) have not been met. See criteria listed below.
CODE ENFORCEMENT ANALYSIS:
There is one outstanding enforcement issue associated with this site. It is in regard to this addition
being constructed with out permits or inspections. The building department has recorded this
under case number CDC2003-00587.

Bases for Approval:
1. The proposal does not complies with the Flexible Standard Development criteria as a Detached

3. The development is not compatible with the surrounding area, but may enhance other
redevelopment efforts.
Conditions of Approval:
1. That no expansion of the non-conforming addition will be permitted in the future; and
2. That the landscaping and trees located in front of the structure be maintained and/or replaced
when needed so as to maintain the visual buffer that exists.

DEVELOPMENT APPROVAL AT 226 CASLER AVENUE (FLS2003.12064)
To Surrounding Property Owners:
As a property owner within 200 feet of 226 Casler A venue, the City of Clearwater Planning Department
gives notice that an application for Flexible Standard Development has been filed for that property. The
request is for reduction to the front (east) setback from 25 feet to 22.33 feet to a proposed two story
addition, in association with a single-family residence, under the provisions of Section 2-203.B.
On January 29, 2004, the Development Review Committee (composed of the City's professional staft)
will review and determine whether the application demonstrates compliance with the City's Community
Development Code. Following that review and determination, the Planning Director will issue a
Development Order approving, approving with conditions or denying the application. The earliest date
that the City will make a decision on the application will be January 29, 2004.
The City encourages you to participate in the review process of this application.. You may phone me at
727-562-4604 for further information, visit our office to review the files and/or submit written comments
to be considered in the City's review of the application.
An appeal of the decision of the Planning Director may be initiated by the applicant or property owners
within the required notice area who present competent substantial evidence at, or prior to, the
Development Review Committee meeting (January 29, 2004). An appeal must be filed, including an
appeal fee, with the Planning Department within seven days of the date of the Development Order.
