The site is 0.47 acres located on the south side of

The applicant seeks to permit attached dwellings within the Tourist District. The proposal
includes 10, 1,800 square foot townhomes 25 feet in height within one building. The proposed
building will be located between 14 and 22 feet from any property line. One level of parking will
be provided under the building and will include 20 spaces that exceeds Code requirements.
Access to the site is ro osed along Bri htwater Drive to a two-car ara e provide for each unit.
The landscape plan will exceed the re uirements of Code. This includes a mixture of various
trees, shrubs, palms and annuals.
The plan includes a reference to a retention pond on the west side of the site.
All required building permits would need to be obtained prior to construction.

C. FLEXIBILITY CRITERIA FOR A TT ACHED DWELLINGS IN THE TOURIST
DISTRICT Section 2-803 (B)):
1. Height:
a. The increased height results in an improved site plan or improved design and
appearance;
A request for an increase in height is not a part of this request. The proposed height
will be 22 feet where the limitation on height in the Tourist District is 35 to 50 feet.
b. The increased height is necessary to allow the improvement of off-street
parking on the ground floor of the residential building.

2. Parking: Off-street parking within the footprint of the residential building is
designed and constructed to create a street level facade comparable to the

Each unit will have a two-car garage providing all required off street parking.
3. Location: The use of the parcel proposed for development will not involve direct
access to a major arterial street;
The use of the parcel will involve direct access to a local street, Brightwater Drive.
Brightwater Drive is not a through street and terminates in a cul-de-sac at its eastern end.
4. Setbacks:
a. The reduction in front setback contributes to a more active and dynamic street
life;

D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposal includes 10, 1,800 square foot townhomes 25 feet in height within one
building. The proposed building will be located between 14 and 22 feet from any

The use does not change with this proposal and will have no increased effect on traffic.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.

6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.

STAFF RECOMMENDATION:
Based on the on the application, the proposal is in compliance with the standards and criteria for
Flexible Standard Development approval, with the maximum development potential and with all
applicable standards of the Community Development Code.
Therefore, staff recommends APPROVAL of the application for Flexible Standard Development
approval to permit attached dwellings within the Tourist District under the provisions of Section
2-802 at 161 Brightwater Drive.
Basis for approval:
1. The proposal complies with Flexible Standard Development criteria under the provisions of
Section 2-802;
2. That the proposal complies with the Accessory Use criteria under the provisions of Section 3-
201;
3. The plan complies with General Applicability Criteria under the provisions of Section 3-913;
and
4. The proposed development is compatible with the surrounding area.

Dear Mr. Ghovaee:
The Development Review Committee reviewed your application to permit attached
dwellings within the Tourist District under the provisions of Section 2-802 at 161
Brightwater Drive on April 11, 2002. The following 19 comments have not been
addressed:
1. Provide Fire Department Connections at least fifteen (15) feet from buildings
accessible to the Fire Department and show on Site Plan;
2. Any Docking facilities must meet requirements of NFPA 22-1.1 and NFPA 303 and
must show on Site Plan;
3. Provide a hedge along the side properties line;
4. Provide a groundcover other than sod in between the driveways - revise site plan prior
to issuance of a Development Order;
5. Switch Washingtonian Palm with Sabal Palms and indicate size (clear trunk) - revise
landscape plan prior to issuance of a Development Order;
6. Revise size of Magnolias to be 10 foot, 2.5 inch caliper minimum;
7. Crepe myrtles to be 8 foot, 2 inch caliper minimum;
8. Willow to be 10 foot, 2.5 inch caliper minimum;
9. Revise landscape plans to show something smaller than a crepe myrtle at the head of
each driveway;
10. Indicate retention area on landscape plan;
11. Provide additional landscaping along the north east and north west comers - strongly
recommend (i.e. require with a smile) enlisting a landscape architect or designer to do
the landscape plans;
12. Submit four-sided, rendered elevations prior to the issuance of a Development Order;

13. Applicant will provide the difference between the Flexible Standard Development fee
($475) and Flexible Development fee ($1,205) of $730;
14. Applicant will provide a Comprehensive Infill application with complete criteria fully
addressed;
15. Add back-out parking as part of request;
16. Provide copy of SWFWMD application;
17. Show a trench at row line to collect stormwater runoff from driveway;
18. Need to clarify area in R!W - no vertical obstructions allowed - revise/clarify prior to
CDB review; and
19. No back out parking per Section 3-1402.C. - redesign site to provide a pull-through
parking garage or apply as a Comprehensive Infill Redevelopment Project.
The above comments must be fully addressed by August 11, 2002 in order to keep your
Flexible Development application valid. Should the above comments not be addressed
by that date your application shall be considered withdrawn and no further action will be
taken.

According to the current Recreation and Open Space Land Dedication Ordinance, the above referenced project
will be required to satisfy the Open Space, Recreation Land and Recreation Facilities dedication requirement
prior to issuance of any building permits.
In order to determine the amount owed, the developer or representative should complete the top portion of the
attached form and return it to the City of Clearwater Parks and Recreation Department with verification of the
just value for the land only according to the current year's property tax assessment.
Please note, this dedication requirement could be a substantial amount and an impact to your project.

To Surrounding Property Owners:
The purpose of this letter is to notify you that the Clearwater Planning Department has received
an application for Flexible Standard Development from Ms. Angelika Marcordes represented by
Mr. Housh Ghovaee (Northside Engineering Services, Inc.) for the property at 161 Brightwater
Drive. You are being sent this letter because you are a property owner within 200 feet of the site.
The request is to permit attached dwellings within the Tourist District under the provisions of
Section 2-802. The proposal includes 10, 1,800 square foot townhomes 25 feet in height.
The City encourages you to pmticipate in the review of this case. You may participate by calling
me to discuss the case, visit our office to review the application and/or send written comments to
be considered in the City's review of the project. The earliest possible date that the City will
make a decision on the project is April 25, 2002. Therefore, please contact me or send your
written comments no later than that date.
On April 11, 2002, the Development Review Committee (composed of the City's professional
staff) will review the project for compliance with the City's Community Development Code.
Following that review, the Planning Director will make a decision to either approve or deny the
application. As a nearby property owner, you will receive a copy of the Development Order that
describes the Planning Director's decision on the project. Should you be dissatisfied with the
City's decision, you have the right to appeal the decision to the Community Development Board.
Please be aware that the appeal must be filed with the City within seven days of the date of the
Development Order.
