ANALYSIS: The 0.37-acre site is located at the southern terminus of Anthony Avenue, approximately 300 feet south of Saber Drive. The surrounding area is characterized by detached residential homes. The proposal is to add a pool cage enclosure over an existing pool and deck exactly 6 feet from the rear (south) property line. The existing single-family dwelling was constructed in 1991 with the pool and deck approved and permitted on February 28, 1991. The approved site plan for the pool and deck revealed a 9-foot rear (south) setback from decking to property line. The submitted survey revealed that the decking has been extended to less than 1 foot from the rear property line. This was confirmed from a site visit. The rear property lines within the surrounding neighborhood are shown to have designed drainage features according to the City's subdivision drainage plat. By placing decking at less than 1 foot from the rear property line it is clearly shown to impede the drainage capability for the existing and surrounding residential homes. Surveys were retrieved from City of Clearwater microfilm for adjacent properties at 2936 Hillcreek Circle South, 2924 Hillcreek Circle South, and 2930 Hillcreek Circle South. All of these properties were found to have pool cage enclosures, with the closest rear setback from property line being 14 feet to edge of pool cage. The proposal to reduce the rear accessory setback from 10 feet to 6 feet is therefore not characteristic to the neighboring rear setbacks for pool cage enclosures. The development complies with density and impervious surface ratio standards within the Low Medium Density Residential District.
