Dear Mr. Seifried:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On September 16, 2003, the Community Development Board reviewed your
Flexible Development application to 1) permit a non-residential parking lot within the HDR
District with reduction in the front (east) setback along S. Hercules Avenue from 25 feet to 15
feet (to pavement) under the provisions of Section 2-504, and 2) reduce the setbacks for existing
parking areas for an office development within the Commercial District including the front
(south) setback along Gulf to Bay Boulevard from 25 feet to 15 feet (to pavement), the front
(west) setback along Aurora Avenue from 25 feet to three feet (existing pavement) and the side
(south) setback from 10 feet to three feet (to pavement), under the provisions of Section 2-703.1.
The Community Development Board (CDB) APPROVED the application with the following
bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria as a Comprehensive Infill
Redevelopment Project per Section 2-703.1.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (September 16, 2004). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do
not change with successive owners. The Community Development Board may grant an
extension of time for a period not to exceed one year and only within the original period of
validity.

The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated
pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days
of the date of this Development Order. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. The appeal period for your
case expires on September 30,2003, (14 days from the date of this Development Order).

CHARACTER OF THE
IMMEDIATE VICINITY: The surrounding character is a mixture of residential, retail sales
and institutional uses.
ANALYSIS:
The 1.38-acre site is located on the north side of Gulf to Bay Boulevard, between South Hercules
Avenue and Aurora Avenue. The site has been developed with two office buildings on the
western portion of the parcel. The primary building from which the parcel is addressed is 13,134
square feet and fronts along Gulf to Bay Boulevard and Aurora Avenue. The second building is
3,492 square feet and fronts along Aurora Avenue. Caldwell Banking currently owns the property
and provides administrative services to surrounding Caldwell Banking employees in the Pinellas
County region. The site itself consists of two separate zoning districts. The majority of the parcel
(1.08 acres) is located in the Commercial District. The remaining (0.30 acres) in the northeastern
portion ofthe parcel is zoned High Density Residential District.
The application is being processed as a Flexible Development due to the northeastern portion of
the parking lot being located in the High Density Residential District. The applicant seeks to
asphalt and stripe the existing crushed shell parking lot in accordance with City parking
standards.
The proposed improvements to the site will include the removal of parking that currently backs
out into the right-of-way on Aurora Avenue, additional interior green space, and a parking layout
optimally configured to supply the current parcel with the maximum amount of spaces possible.
The existing amount of parking on site is 45 spaces, which averages to be 2.7 parking spaces per
1,000 square feet. The proposed parking configuration will increase to 55 spaces at 3.3 parking

E. FLEXIBILITY CRITERIA FOR PARKING GARAGES AND LOTS IN THE HIGH
DENSITY RESIDENTIAL DISTRICT (Section 2-504.D):
1. Access to and from the parking garage or lot shall be based on the findings of a
transportation analysis approved by the city;
The High Density Residential zoned portion of the parking lot is part of the unity of title
for the subject property. It has been currently used as a parking lot in conjunction with
the commercial zoned portion of the property. Access to and from the parking lot has
been improved with the proposed layout. The points of ingress and egress will be
condensed to one location along S. Hercules Avenue instead of the previous two. This
will help reduce the amount of traffic congestion entering and exiting the parking lot
along S. Hercules Avenue. The amount of traffic volume the parking lot will generate is
based solely from the existing office use, therefore negating the need to perform a

transportation analysis.
2. The stacking spaces available for cars waiting to pass through a parking ticket
dispenser or booth to enter the garage or lot shall be based on the design and size
of the garage or lot;
Since the proposal includes improvements to an existing surface parking lot, this
criterion is not applicable.
3. Any frontage along a public street is landscaped or designed to be similar in
character and use to other uses fronting on each street for a distance of 250 feet in
either direction along the street or the nearest intersection, whichever is less;
The proposed enhancements to the existing parking lot include landscaping along the S.
Hercules. A hedge of sweet vibemum will run continually along the property line
buffering the parking lot to the adjacent street. Cabbage palm and magnolia trees will be
placed at 35-foot intervals along the 220-foot street frontage to help further establish a
canopied buffer along S. Hercules Avenue.
4. Parking structures are designed, constructed and finished so that the structure of
the garage is architecturally compatible with the design and character of adjacent
principal uses;
The proposed improvements include resurfacing and striping the lot according to City
parking standards. There will be no vertical parking structures built on the property.
5. There is an unmet existing demand for additional parking in the immediate
vicinity of the parcel proposed for development;
The parking improvements will serve the existing parcel only. The existing amount of
parking on site is 45 spaces, which averages to be 2.7 parking spaces per 1,000 square
feet. The proposed parking configuration will increase to 55 spaces at 3.3 parking
spaces per 1,000 square feet. This will help create more parking that is conforming to
City standards for the existing use.
6. Construction of a parking structure would not otherwise be physically or
economically feasible;
The construction of a parking structure would not be practical to serve the existing use
on site. The parking structure would not be physically needed or economically feasible.
7. The front and rear setbacks which are provided are improved as an arcade or with
other active pedestrian/commercial areas for sidewalk cafes, sidewalk vendors,
street furniture, or urban amenities;

This criterion is not applicable for surface parking lots. An existing 5-foot concrete
sidewalk will be maintained to provide pedestrian access along S. Hercules Avenue.
8. Side Setback:
a. The reduction in side setback will allow for the preservation of existing
vegetation which could not otherwise be preserved or;
There are two 22-inch Live Oaks and a 26-inch Oak that are being preserved with
the proposed parking lot configuration. An additional hedge will be placed to run
along the property boundary to buffer adjacent uses.
b. The reduction in side setback results in an improved site plan or improved
design and appearance.
The reductions in side and front setbacks help to maximize the amount of parking
on site and improve the appearance of the parking lot. Interior and perimeter
landscaping will be installed to further enhance the site.
F. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that (Section 3-913):
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposed improvements include paving and striping of an existing crushed shell
parking lot. This will to improve the parcel both functionally and aesthetically. This is in
keeping with the character ofthe area.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The proposed parking lot will not discourage or hinder the appropriate development and
use of adjacent land and building values. The improvements made to the parking surface
and additional landscaping will help improve the site and hopefully encourage adjacent
site improvements. The property is currently valued at $875,000. The proposed
improvements in addition to the current property value will be $965,000.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposal should have no adverse affect on the health or safety of persons residing or
working in the neighborhood. The parking lot improvements will upgrade the site with
pavement, landscaping, and reduced access onto Hercules Avenue.

4. The proposed development is designed to minimize traffic congestion.
The proposed improvements to the parking lot will help to minimize traffic congestion
by creating a directional flow of traffic on site. The available amount of parking spaces
will be increased from 45 spaces to 55 spaces with the proposed parking configuration.
The removal of one of the two points of ingress/egress along S. Hercules Avenue will
help to minimize traffic entering and exiting the parking lot.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The parking lot upgrade will provide additional parking spaces that are conforming with
current City parking standards and interior and perimeter landscaping.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The design of the parking lot will be buffered visually and acoustically from neighboring
residential properties to the north by a hedge and a six-foot wooden fence. The parking lot
use will be consistent with the hours of operation for the Caldwell Banking service.
SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on July
17, 2003. The Planning Department recommends APPROVAL of the Flexible Development
approval to 1) permit a non-residential parking lot within the HDR District with reduction in the
front (east) setback along S. Hercules Avenue from 25 feet to 15 feet (to pavement) under the
provisions of Section 2-504, and 2) reduce the setbacks for existing parking areas for an office
development within the Commercial District including the front (south) setback along Gulf to
Bay Boulevard from 25 feet to 15 feet (to pavement), the front (west) setback along Aurora
Avenue from 25 feet to three feet (existing pavement) and the side (south) setback from 10 feet
to three feet (to pavement), under the provisions of Section 2-703.1., with the following bases
and conditions:
Bases for Approval:
1. The proposal is in compliance with Flexibility Criteria for Parking Lots and Garages per
Section (2-504.D);
2. The proposal is in compliance with the General Applicability criteria, under Section 3-913;
and
3. The improvements are compatible with the surrounding area.

Dear Mr. Seifried:
The Planning staff has reviewed your application to permit a parking lot within the portion of the
parcel zoned High Density Residential (HDR) along S. Hercules Avenue at a front (east) setback of
15 feet from property line to pavement, a 3 foot side (south) setback from property line to
pavement, and a 10 foot side (north) setback from property line to pavement as part of a
Residential Infill Project per section 2-704.C. After a preliminary review of the submitted
documents, staffhas determined that the application itself is complete.
Please provide the following information:
1. The sticker on C-l only gives data for the proposed parking lot addition with
regards to lot area, paving area, green area, building area (existing), and new
parking spaces. Since the HDR parcel on 400 S. Hercules has been tied together
with 1988 Gulf to Bay and 407 S. Aurora through unity of title, I need the new
dimensions created with the unity of title for the overall site (400 S. Hercules, 407
S. Aurora, and 1988 Gulf to Bay Boulevard), including all paved area, all green
area, all building square footage, all parking (existing and proposed), etc. This
needs to be shown in a site data table.
2. Written Submittal Requirements in the application process are incomplete. Must
provide more than a yes answer to the questions. The Planning Departments'
recommendation will be based on your response. Yes answers are not sufficient.
3. Clarify: 32 new parking spaces identified on C-l sticker and 36 counted on the
actual site plan drawing.
4. Label all outdoor lighting for parking lot.

d) The applicant should consider adding landscape island at the northern driveway to discourage
vehicles from entering one-way drive aisle.

Once tree survey is complete, revise tree permit.
d) Once the tree survey is updated, redesign parking and storm system to preserve some of the trees
on site, mainly the Oaks in the right of way and the Sycamore tree at the NE comer of the

e) Once the site is redesigned, create a tree preservation plan. This plan must show how the
proposed parking and storm water system impacts the critical root zones (drip lines) and how you
propose to address these impacts ie; crown elevating, root pruning and/or root aeration systems.
Other data required on this plan must show actual tree barricade limits (2/3 of the drip line and/or
in the root prune lines if required), and the tree barricade detail. And any other pertinent
information relating to tree preservation.

a. Change out the Crape Myrtle trees in the interior island with Sabal palms or Live Oaks for better
visibility for vehicular and pedestrian traffic in parking area.
b. Continue the Viburnum hedge along the other two property lines abutting neighboring parcels.
c. Change the Crape Myrtle on the north property line to Live Oaks or Magnolia and wrap them
along the west side of retention pond.
d. Trees on perimeter buffer should be 35' on center.
e. There are a few areas that could have additional ground covers that will maintain better than sod.
Specifically between the single parking space and the two to the west, and the area just west of
those two spaces.
f. 6" curbing is required at ALL locations where parking surface meets sod or landscaping.
g. The parking area along Gulf to Bay is not shown as changing... as discussed in our pre-application
meeting there is a 15' minimum buffer required. Please adjust plans and show landscaping in the
first 15'.
NOTES:
All these items need to be resolved and reviewed by DRC at another meeting. To be scheduled
for the August 14,2003 DRC meeting, revisions need to be submitted by July 23,2003 by noon.
