City currently has a need for additional transient slips. This need will be partially met by the

1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density and character of adjacent properties in which it
is located.
The City of Clearwater is a boating-oriented community. The area where the slips are proposed
for construction already accommodates boats ingressing and egressing the slips at the Marine
Science Center as well as boats utilizing the Ross Yachts facility.
2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly
impair the value thereof.
The presence of the docks will serve to enhance the development and use of surrounding
properties by providing increased public access to the public and private facilities on Island
Estates. . . .. .
3. The proposed development will not adversely affect the health or safety or persons residing or working In the neighborhood of the proposed
use.
The proposed use should have no adverse impact on the health of persons residing or working
in the Island Estates neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The proposed docks will reduce vehicular traffic to Island Estates as the docks provide access
to the neiahborhood bv boats.
5. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development.
The proposed docks are in harmony with the boating-oriented character of the City of
Clearwater as well as being consistent with the character of the immediate vicinity where
Ross Yachts and the Marine Science Center, with its associated slips, are located.
6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts,
on adjacent properties.
The dock system is desiQned to accomodate only nine boats and the location is sufficiently
remote from residences such that there should be no noise issues. The floating dock design
will be visually appealing. The City will not allow overnight stays at the docks.

" Location of all existing and proposed sidewalks.

Please find enclosed a completed Flexible Development Application for the proposed Island
Estates Public Docks to be constructed on City-owned submerged lands in Island Estates.
Included in the package are the following items:
· The Flexible Development Application executed by William D. Morris, Director of Marine &
Aviation, on behalf of the City;
A computer-generated rendering of the completed docking system to provide assistance
to the reviewers in visualizing the proposed design;
· A narrative addressing the commercial dock criteria as contained in Section 3-601 C.3.(a)
through (g) of the City Ordinances (enclosed as Attachment A);
· A narrative addressing the dimensional criteria as contained in Section 3-601C.3.(h) of the
City Ordinances (enclosed as Attachment B);
· An updated submerged resources survey as performed by the firm of N. S. Nettles &
Associates dated July 10, 2002 (enclosed as Attachment C);
Sheet A of the plan set which depicts the proposed docks as overlayed on an aerial; and
Sheets 1 through 7 of engineering plans that provide the existing conditions and the details
for the proposed docks.
As required, an original and 12 copies of the above are enclosed.
Also enclosed is one copy of a completed Commercial Dock Application for Pinellas County. Once
the City has approved the dock design, the City will need to sign the application and the
accompanying plans.
Please note that we held an informational meeting with the Island Estates Civic Association on the
evening of October 21 , 2002 and the group stated their support of the project. We have also held
a meeting with the neighbor to the west, Ted Bair of Quality Boats. It is our understanding that the
City is working with Mr. Bair to try to provide alternative docking for the boats which are tied to the
buoys which are presently located in the basin where the docks are to be built. It is our
understanding that the buoys will be removed once the dock is permitted and ready for
construction.

We would also note that the adjacent upland property owner, Frank Chivas, owner of the Island
Way Grill, will provide an ingress/egress easement to the City for the public to access the proposed
docks. Once the details of the access (route and width of sidewalk, etc.) are defined, a legal
easement instrument will be prepared and, upon approval by the City, entered into the public
records.

(a)
Use and Compatibility

The docks will be for the use of the boating public to visit the restaurants, shops and homes in the Island
Estates Community. The use is a compatible use in that the City of Clearwater currently has inadequate
transient berths for visitors to the community.
(b) Impacts on Existing Water Recreation Activities
The dock is designed so as to not create any adverse impact on persons using the adjacent waterways
for recreational or commercial purposes. The docking facility is located at the end of a finger so there is
little or no impact on other boaters
(c) Impacts to Navigation
The dock as proposed should have no detrimental impact on users of the adjacent waters as it is located
at the end of a finger. See item 7 of the Fact Sheet (Attachment B) wherein it is noted that the dock
structure extends only approximately 68' from the seawall as compared to the waterway width at this
location of approximately 370' to 405'.
(d) Impacts on Marine Environment
As noted by examination of the plans, the dock has been designed and sited to minimize any impact on
existing seagrasses. The site was surveyed twice by the firm of N.S. Nettles & Associates to delineate
seagrasses with the last survey performed on July 10, 2002. The only seagrasses present are in a small
area of approximately 750 square feet located in the extreme northeast area of the site. The docking
facility has been designed to provide a seven foot buffer against the grassed area. Further, a piling is
located with a sign warning boaters to not enter the area containing seagrass.
(e) Impacts on Water Quality
As noted on the plans, the depth of water in the area where boats will berth ranges from approximately 9
to 12 feet. This depth provides well in excess of one foot of clearance between the lowest member of a
vessel and the bottom at mean low water.
The berthing of 9 vessels at the facility should not adversely impact water quality.
(f) Impacts on Natural Resources
The dock is designed to minimize environmental impacts on existing resources, primarily existing
seagrasses as discussed above.
(g) Impacts on Wetlands Habitat/Uplands
The dock will not have an adverse impact on the adjacent uplands but will serve to enhance the uplands
as they will provide a valuable asset to the community of Island Estates.

1. Proposed Use:
The proposed use is public docks for use by boaters wishing to visit the restaurant, shops and
homes within Island Estates. The docks are designed to provide mooring for 7 boats up to 40 feet
in length and 2 boats up to 55 feet in length.
2. Property Width:
The property width measured at the shoreline is 229.0
3. Setbacks:
The setback from the dock structure on the east to the extended property line is
approximately 72 feet as compares to the required setback of 10% of the width of the site
at the waterfront or 22.9 feet [10% of 229 = 22.9 feet].
· The setback from the dock structure to the extended property line on the west is 23.0 feet
compared to the required setback of 22.9 feet..
4. Length:
The dock extends 68' from the seawall which is less than 75% of the width of the property as
measured at the shoreline or 171.75'.
5. Width:
The proposed width of the structure is 159.3' which is less than 75% of the property width (171.75'.)
6. The area of the proposed dock is 2,299 square feet.
7. Width of Waterway:
The width of the waterway at the location of the proposed docks as measured perpendicular to the
shoreline ranges from approximately 370' to 405'. The proposed dock extends from the shoreline
68' with the outermost tie pile at 98.7'. The docking facility thus extends approximately 25% of the
waterway width.
8. Seagrass Survey
The firm of N.S. Nettles & Associates performed a survey to delineate and identify the types of
grass present. Please see the Nettles report dated July 10, 2002 enclosed as Attachment C.

RE: Sea grass survey at Island Way Grille.
Dear Bill,
On July 8 we surveyed the area reported to be occupied by seagrass along the southern seawall of the Island
Grille site. We established a baseline along the seawall, set up a 20 foot grid and swam transects
perpendicular to the seawall. The visibility, however, was less than 3 or 4 inches. Visual observation was
not possible so the surveys were done by feel and grabbing hand fulls of bottom sediments to observe signs of
grass or benthic biota. The only thick patch of seagrass is plotted on the attached map. There were a few
isolated sprigs of sea grass between this patch and the seawall. The organic silts were heaviest and thickest
close to the seawall and thinned as we traversed offshore. We did not find any other significant benthic biota,
possibly due to the high turbidity in the water column and high organic silt content of the sediments. I suspect
that the sediments are anoxic 1 to 2 inches below the sediment surface. Based on our survey, there appears to
be a significant reduction on the distribution of sea grasses south of the Island Grille seawall when compared
to the seagrass distribution mapped several years ago. Again, I suspect this decline is due to the high turbidity
and high silt content of the bottom sediments in this area of the marina basin.

NOTE: It is the applicant's responsibility to clearly demonstrate that any requested variances
are consistent with the variance criteria of the Pinellas County Water and Navigation Control
Authority Regulations. The applicant must submit a written variance request outlining the
nature of and need for any variances. The applicant must demonstrate that a literal enforcement
of the regulations would result in an extreme hardship due to the unique nature of the project
and the applicant's property. The hardship must not be created by action(s) of the property
owner(sJ. The granting of the variance must be in harmony with the general intent of the
regulations and not infringe upon the property rights of others. The variance requested must
be the minimum possible to allow for the reasonable use of the applicant's property. Should
the applicant fail to demonstrate that any variance request is consistent with the criteria outlined

CHARACTER OF THE
IMMEDIATE VICINITY: Multi-family residential uses exist to the northeast of the site. A
variety of nonresidential uses including gas stations, boat sales,
places of worship, retail sales and service and restaurants dominate
the immediate vicinity.
ANALYSIS:
The 2.1-acre site is located on the west side of Island Way, approximately 400 feet north of
Causeway Boulevard. The site consists entirely of submerged land and is located completely
within the public right-of-way. It is bordered by 20 Island Way (Island Way Grill) to the north and
Island Way to the east and is currently undeveloped. The site is located at the terminus of the
waterway in which it is located. The area is characterized by multi-family residential
developments, primarily to the northeast, and a variety of nonresidential uses including gas
stations, boat sales, places of worship, retail sales and service and restaurants.
Section 3-601.C.3 requires docks constructed or maintained by the City of Clearwater to be
reviewed as part of a Level Two, Flexible Development application. The applicant (the City of
Clearwater) seeks to construct a nine-slip dock within the public right-of-way along the south side
of 20 Island Way. The proposed City-owned and operated dock will serve as an amenity to the
citizens and tourists of Clearwater and is consistent with the existing pattern of docks in the area.
This dock will have no launching area. There will be no commercial activities at this dock
including bait sales, vending, etc. or overnight docking. The unstaffed dock will on a first
come/first served basis and will be free to the public.
The proposed dock has been specifically designed to discourage boat access over marine grassbeds
and other aquatic resources in the surrounding area, including a small grassbed, 750 square feet in
area, located in the far northeast comer of the site. Signage will be permanently installed
containing wording warning boaters of the existence of protected sea grasses and manatees in the
vicinity. There is approximately 300 feet between the end of the proposed dock and the southern
edge of the waterway along Causeway Boulevard.
The dock will be located in an area with a minimum water depth of nine feet, providing adequate
depths to avoid prop dredging. The surrounding waterway to the south has depths of up to 12 feet.
An access easement will be required to be granted by the property adjacent to the north of the
subject site. A five-foot wide sidewalk will be located along the seawall and will connect to an
existing sidewalk along Island Way. This should be granted prior to the issuance of any permits.
Prior to the issuance of building permits for the dock, the applicant will need to show compliance
with National Fire Protection Association (NFP A) standards for "marinas and boat yards" for the
construction and operation of the docking facilities. A Water Navigation Permit and a Department
of Environmental Protection permit will be required to be approved by Pinellas County and the
State prior to the issuance of building permits.

PROVISIONS OF SECTION 3-601.C.3:
1. Use and Compatibility.
a) The proposed dock shall be subordinate to and contribute to the comfort,
convenience or necessities of the users or the occupants of the principal use of the
property.
The site is located completely within the public right-of-way adjacent to the south side
of 20 Island Way. The proposed dock will serve as an amenity to the citizens and
tourists of Clearwater and is consistent with the existing pattern of docks in the area.

b) The proposed dock shall be in harmony with the scale and character of adjacent
properties and the neighborhood in general.
The proposed dock is in harmony with the scale and character of surrounding
properties. Adjacent uses include a boat sales use (with associated accessory docks)
located to the west of the site and the Clearwater Marine Aquarium located farther
west. Other properties in the area have also been developed with similarly-sized and
located docks.
c) The proposed dock shall be compatible with dock patterns in the general vicinity.
The proposed dock is compatible with navigation patterns in the general vicinity.
Existing surrounding docks are similar in length and in the number of slips. In
addition, the proposed dock is located at a terminus of the waterway with
approximately 300 feet between the end of the proposed dock and the southern edge of
the waterway along Causeway Boulevard.
2. Impacts on Existing Water Recreation Activities. The use of the proposed dock shall
not adversely impact the health, safety or well being of persons currently using the
adjacent waterways for recreational and/or commercial uses. Furthermore, it shall
not hinder or discourage the existing uses of the adjacent waterway by uses including
but not limited to non-motorized boats and motorized boats.
The proposed dock is located at a terminus of the waterway eliminating through traffic.
Any boat traffic generated will be generated primarily by the proposed dock. There is
approximately 300 feet between the end of the proposed dock and the southern edge of the
waterway. There will be little, if any, impacts on existing water recreation activities.
3. Impacts on Navigation. The existence and use of the proposed dock shall not have a
detrimental effect on the use of adjacent waters for navigation, transportation,
recreational or other public conveniences.
The waterway in the vicinity of the proposed dock is between 370 and 405 feet in width.
The proposed dock will be 68 feet in length providing at least 300 feet of water in which to
adequately navigate. The dock, therefore, does not have any negative impacts on
navigation, transportation, recreation or other public conveniences in this location.
4. Impacts on Marine Environment.
a) Docks shall be sited to ensure that boat access routes avoid injury to marine
grassbeds or other aquatic resources in the surrounding areas.
The proposed dock has been specifically designed to discourage boat access over
marine grassbeds and other aquatic resources in the surrounding area. There is a small
grassbed, 750 square feet in area, located in the far northeast comer of the site that will
be unaffected by this proposal. Signage will be posted advising boaters not to enter
that area.

b) Docks shall not have an adverse impact upon natural marine habitats, grass flats
suitable as nursery feeding grounds for marine life, or established marine soil
suitable for producing plant growth of a type useful as nursery or feeding grounds
for marine life; manatee sanctuaries; natural reefs and any such artificial reef
which has developed an associated flora and fauna which have been determined to
be approaching a typical natural assemblage structure in both density and
diversity; oyster beds; clam beds; known sea turtle nesting site; commercial or
sport fisheries or shell fisheries areas; and habitats desirable as juvenile fish
habitat.
The proposed dock has been sited to prevent negative impacts on surrounding marine
habitats. Reports submitted by the applicant appropriately address impact
minimization and avoidance.
5. Impacts on Water Quality.
a) All turning basin, access channels, boat mooring areas and any other area
associated with a dock shall have adequate circulation and existing water depths
to ensure that a minimum of a one foot clearance is provided between the lowest
member of a vessel (e.g. skegs, rudder, prop) and the bottom of the waterbody at
mean or ordinary low water (-0.95 NGVD datum).
The area in which the dock will be located includes a minimum water depth of nine feet
providing adequate room to avoid propeller dredging. The surrounding waterway to
the south has depths of up to 12 feet. Studies conducted by FDEP and submitted by the
applicant have shown that adequate circulation is present in the vicinity.
b) The dock shall not effectively cause erosion, extraordinary storm drainage,
shoaling of channels, or adversely affect the water quality presently existing in the
area or limit progress that is being made toward improvement of water quality in
the area in which the dock is proposed to be located.
The proposed dock is located entirely with the public right-of-way over submerged
land. The development will not affect the water quality in the area of the proposed
dock.

6. Impacts on Natural Resources.
a) The dock shall not have a material adverse impact upon the conservation of
wildlife, marine life, and other natural resources, including beaches and shores, so
as to be contrary to the public interest.
The proposed dock has been designed and located in such a manner to prevent any
negative impacts on surrounding wildlife and will be built in such a manner as to
comply with all FDEP regulations. An existing sea grassbed has been identified and
the proposed dock has been specifically configured to prevent any negative impacts to
it.
b) The dock shall not have an adverse impact on vegetated areas; vegetative,
terrestrial, or aquatic habitats critical to the support of listed species providing
one or more of the requirements to sustain their existence, such as range, nesting
or feeding grounds; habitats which display biological or physical attributes which
would serve to make them rare within the confines of the City; designated
preservation areas such as those identified in the comprehensive land use plan,
national wildlife refuges, Florida outstanding waters or other designated
preservation areas, and bird sanctuaries.
The proposed dock will not be located near any preservation areas, bird sanctuaries or
national wildlife refuges. The dock will serve the residents and visitors of Clearwater,
providing opportunities to visit the shops and restaurants located on Island Estates.
The dock has been located in such a manner as to avoid a sea grass bed on the
northeastern portion of the site. Any disturbances to local aquatic will be minimal and
temporary in nature. During dock construction/dredging the contractor will provide all
necessary turbidity barriers, silt screens, etc. to prevent negative impacts to the critical
habitats.
7. Impacts on Wetlands Habitat/Uplands. The dock shall not have a material adverse
affect upon the uplands surrounding.
There are no wetland or upland habitats in the vicinity ofthe subject site.

D. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The surrounding area is characterized by multi-family residential developments to the
northeast in addition to a variety of nonresidential uses including restaurants, retail sales
and service businesses, offices and the Clearwater Marine Aquarium. Surrounding,
waterfront properties have been developed with docks, similar in size, scale and location to
the proposed dock. The proposal will be in harmony with the character of adjacent
properties.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the value
thereof.
The site is zoned Preservation District and the proposed development will be in compliance
with that zoning classification. The proposed development will create an additional
amenity for residents and visitors to Clearwater Beach and Island Estates. The
development of this property with the dock proposed will be a potential catalyst for
redevelopment efforts in the surrounding area.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposed City-owned and operated dock is permitted in the Preservation District and
will be for the use by the general public. The proposed dock should not create any adverse
health or safety impacts in the neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The proposed, nine-slip dock will not include launching capabilities and will be only
accessible by boat. Therefore, the proposal will have no impact on automotive traffic in
the area. The dock is located at the terminus of a waterway and any traffic generated will
be for the dock itself.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
Surrounding properties have been developed with docks similar in length and scale to the
proposal. With a minimum of 300 feet between the end of the dock and the edge of the
waterway to the south and an average depth of 12 feet within that water there will be no
negative navigational impacts anticipated with the proposed dock. The proposed
development is consistent with the community character of the immediate vicinity.

6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The proposal includes the construction of a City-owned and operated, commercial dock
with nine slips within the public right-of-way of way adjacent to 20 Island Way. The dock,
serving the residents and visitors of Clearwater, should not result in any adverse effects.
SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on April
17,2003. The Planning Department recommends APPROVAL of the Flexible Development for
the construction of a City-operated, commercial dock (nine new slips) at 20 Island Way, under the
provisions of Section 3-601, with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria under the provisions of Section
3-601.C.3.
2. The proposal is in compliance with other standards in the Code including the general
applicability criteria per Section 3-913.
3. The dock development is compatible with the surrounding area.
Conditions of Approval:
1. That Pinellas County Water Navigation, Florida Department of Environmental Protection
(FDEP), U.S. Army Corps of Engineers and Southwest Florida Water Management District
(SWFMD) permits be approved, prior to the issuance of building permits;
2. That the National Fire Protection Association (NFP A) 303 standards for "marinas and
boat yards" be met to the satisfaction of the Fire Department, prior to the issuance of building
permits;
3. That there be no commercial activities at the dock (bait sales, vending, etc.);
4. That an access easement be granted by the property adjacent to the north of the subject site
prior to the issuance of any permits; and
5. That signage be permanently installed containing wording warning boaters of the existence of
protected sea grasses and manatees in the vicinity.

compromise with the adjoining property owner to relocate the mooring buoys. We have suggested that
the leaseholder "Ross Yachts/Quality Boats" get on the city waiting list for use of city owned slips
along the seawall around the Clearwater Marine Aquarium.

Dear Mr. Woods:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On May 20, 2003, the Community Development Board reviewed your
application for Flexible Development for the construction of a City-operated, commercial dock
(nine new slips) at 20 Island Way, under the provisions of Section 3-601.
The Community Development Board (CDB) APPROVED the application with the following
bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria under the provISIOns of
Section 3-601.C.3.
2. The proposal is in compliance with other standards in the Code including the general
applicability criteria per Section 3-913.
3. The dock development is compatible with the surrounding area.

Conditions of Approval:
1. That Pinellas County Water Navigation, Florida Department of Environmental Protection
(FDEP), U.S. Army Corps of Engineers and Southwest Florida Water Management District
(SWFMD) permits be approved, prior to the issuance of building permits;
2. That the National Fire Protection Association (NFPA) 303 standards for "marinas and
boat yards" be met to the satisfaction of the Fire Department, prior to the issuance of building
permi ts;
3. That there be no commercial activities at the dock (bait sales, vending, etc.);
4. That an access easement be granted by the property adjacent to the north of the subject site
prior to the issuance of any permits; and
5. That signage be permanently installed containing wording warning boaters of the existence of
protected sea grasses and manatees in the vicinity.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (May 20,2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Please be aware that an appeal of a Level Two approval (Flexible Development) may be initiated
by a property owner abutting the property (which is the subject of the approval) within 14 days of
the date of the CDB decision. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case will
expire on June 3, 2003.

Dear Ms. Fierce:
My wife and I object to the construction and installation of nine new boat slips at the
location at 20 Island Way, Clearwater.
The area now has limited boat traffic. Any increase in such boat traffic will be a
detriment to the environment. It also will create a dangerous condition. The City of
Clearwater could be liable for injuries to individuals and/or property damage.
It will also create unwanted noise; be a source of public nuisance when party goers over
indulge on alcoholic or other mind altering drug consumption; and cause vehicular traffic
to increase when visitors go to join the boat people. Traffic conditions are bad enough
now especially in the evenings and on weekends.
This proposal appears to be only for customers of a commercial enterprise. The City of
Clearwater should give preference to the residents. Why should the City of Clearwater
incur such an expense for the profit of some corporation?
Please do not spend our tax dollars for such an objectionable proposal.

Dear Mr. Woods:
The Planning staff has reviewed your application for the construction of a City-operated,
commercial dock (nine new slips) within the public right-of-way adjacent to the south
side of 20 Island Way, under the provisions of Section 3-601. After a preliminary review
of the submitted documents, staff has determined that the application is complete.
The following items are required:
1. Site survey;
2. Clarify the east setback to the dock structure. The distance indicated in your
narrative states that the setback is 72 feet where 50 feet is scaled by Staff;
3. Clarify if patrons of the dock will pay for the use of the site or if it is a free dock;
4. Clarify whether any Studies conducted by FDEP which show that adequate
circulation is present in the vicinity;
5. Clarify whether, during dock construction/dredging, the contractor will be provide
necessary turbidity barriers, silt screens, etc. to prevent impacts to the critical
habitats;

6. Clarify the following:
~ Prior to the issuance of building permits for the dock, the applicant will
need to show compliance with National Fire Protection Association
(NFP A) standards for "marinas and boat yards" for the construction and
operation of the docking facilities to provide fire protection of boats
moored in the slips;
~ Floating and dock supported signage will need to be permanently installed
warning boaters of the existence of protected sea grasses and manatees in
the vicinity; and
~ A Water Navigation Permit and a Department of Environmental Protection
permit will be required to be approved by Pinellas County and the State
prior to the issuance of building permits.
The application has been entered into the Department's filing system and assigned the
case number FLD2003-03013. The Development Review Committee will review the
application for sufficiency on April 17, 2003, in the Planning Department conference
room - Room 216 - on the second floor of the Municipal Services Building, 100 South

We are in receipt of your letter, this date, and respond to your questions as follows:
1. We will have our surveyor, Gene Caudell, mail you a signed and sealed survey of the site showing the
measured bathymetry.
2. The east setback to the seawall is 50 feet, as noted by the Planning staff. The setback from the eastern
end of the floating dock structure to the extended property line is 72 feet.
3. There will be no charge for use of the dock as it is considered a public dock.
4. We are unaware of any studies by the FDEP that address circulation. The DEP approach is to not
require flushing studies if the number of proposed slips is less than 10.
5. The FDEP does not require that standard dock construction, including the placement of pilings by jetting
and driving, be performed within turbidity barriers. They do require the barriers for dredge but no dredge
is proposed for this project.
Please note that the DEP bases its decision to not require turbidity barriers based on turbidity
demonstrations that have been performed for their staff over the years by Speeler Enterprises. The latest
demonstration was held in Tierra Verde on March 17,2003 at the request for the FDEP.
6. Th.: Applicant agrees that the requirements of the NFPA standards for marinas and boat yards will be
required to be met. In this regards the Applicant will meet with the City' sFire Marshal to discuss what
fire protection measurements are required.
Please note that the DEP will require signage to warn boaters of the presence of seagrasses as well as
the potential for manatees to be in the area. This will be permanently mounted signage.
We would like to note that to our knowledge floating signage cannot be permitted through the Florida Fish
and Wildlife Conservation Commission or the US Coast Guard.
We acknowledge that a permit will be required from the County, FDEP and the Army Corps.

PROPOSED ISLAND ESTATES PUBLIC DOCKS
COMMERCIAL DOCK CRITERIA
SECTION 3-601 C.3.(a) through (g)
(a) Use and Compatibility
The docks will be for the use of the boating public to visit the restaurants, shops and homes in the Island
Estates Community. The use is a compatible use in that the City of Clearwater currently has inadequate
transient berths for visitors to the community.
(b) Impacts on Existing Water Recreation Activities
The dock is designed so as to not create any adverse impact on persons using the adjacent waterways
for recreational or commercial purposes. The docking facility is located at the end of a finger so there is
little or no impact on other boaters
(c) Impacts to Navigation
The dock as proposed should have no detrimental impact on users of the adjacent waters as it is located
at the end of a finger. See item 7 of the Fact Sheet (Attachment B) wherein it is noted that the dock
structure extends only approximately 68' from the seawall as compared to the waterway width at this
location of approximately 370' to 405'.
(d) Impacts on Marine Environment
As noted by examination of the plans, the dock has been designed and sited to minimize any impact on
existing seagrasses. The site was surveyed twice by the firm of N.S. Nettles & Associates to delineate
seagrasses with the last survey performed on July 10, 2002. The only seagrasses present are in a small
area of approximately 750 square feet located in the extreme northeast area of the site. The docking
facility has been designed to provide a seven foot buffer against the grassed area. Further, a piling is
located with a sign warning boaters to not enter the area containing seagrass.
(e) Impacts on Water Quality
As noted on the plans, the depth of water in the area where boats will berth ranges from approximately 9
to 12 feet. This depth provides well in excess of one foot of clearance between the lowest member of a
vessel and the bottom at mean low water.
The berthing of 9 vessels at the facility should not adversely impact water quality.
. (f) Impacts on Natural Resources
The dock is designed to minimize environmental impacts on existing resources, primarily existing
seagrasses as discussed above.
(g) Impacts on Wetlands HabitaUUplands
The dock will not have an adverse impact on the adjacent uplands but will serve to enhance the uplands
as they will provide a valuable asset to the community of Island Estates.

1. Proposed Use:
The proposed use is public docks for use by boaters wishing to visit the restaurant, shops and
homes within Island Estates. The docks are designed to provide mooring for 7 boats up to 40 feet
in length and 2 boats up to 55 feet in length.
2. Property Width:
The property width measured at the shoreline is 229.0
3. Setbacks:
· The setback from the dock structure on the east to the extended property line is
approximately 72 feet as compares to the required setback of 10% of the width of the site
at the waterfront or 22.9 feet [10% of 229 = 22.9 feet].
· The setback from the dock structure to the extended property line on the west is 23.0 feet
compared to the required setback of 22.9 feet..
4. Length:
The dock extends 68' from the seawall which is less than 75% of the width of the property as
measured at the shoreline or 171.75'.
5. Width:
The proposed width of the structure is 159.3' which is less than 75% of the property width (171.75'.)
6. The area of the proposed dock is 2,299 square feet.
7. Width of Waterway:
The width of the waterway at the location of the proposed docks as measured perpendicular to the
shoreline ranges from approximately 370' to 405'. The proposed dock extends from the shoreline
68' with the outermost tie pile at 98.7'. The docking facility thus extends approximately 25% of the
waterway width.
8. Seagrass Survey
The firm of N.S. Nettles & Associates performed a survey to delineate and identify the types of
grass present. Please see the Nettles report dated July 10, 2002 enclosed as Attachment C.

RE: Sea grass survey at Island Way Grille.
Dear Bill,
On July 8 we surveyed the area reported to be occupied by seagrass along the southern seawall of the Island
Grille site. We established a baseline along the seawall, set up a 20 foot grid and swam transects
perpendicular to the seawall. The visibility, however, was less than 3 or 4 inches. Visual observation was
not possible so the surveys were done by feel and grabbing hand fulls of bottom sediments to observe signs of
grass or benthic biota. The only thick patch of seagrass is plotted on the attached map. There were a few
isolated sprigs of sea grass between this patch and the seawall. The organic silts were heaviest and thickest
close to the seawall and thinned as we traversed offshore. We did not find any other significant benthic biota,
possibly due to the high turbidity in the water column and high organic silt content of the sediments. I suspect
that the sediments are anoxic 1 to 2 inches below the sediment surface. Based on our survey, there appears to
be a significant reduction on the distribution of sea grasses south of the Island Grille seawall when compared
to the seagrass distribution mapped several years ago. Again, I suspect this decline is due to the high turbidity
and high silt content of the bottom sediments in this area of the marina basin.
