Conditions of a previous development approval (e.g. conditions imposed by the Community Development Board);

Dear Mr. Bednarski:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On July 15, 2003, the Community Development Board reviewed your
Flexible Development application for approval to reduce the required rear (northwest) setback
from 10 feet to zero feet for swimming pool and pool deck, as part of an Island Estates
Neighborhood Conservation Overlay District Residential Infill project per Section 2-1602.F.2.
The Community Development Board (CDB) APPROVED the application with the following
bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development as a Residential Infill Project in the
Low Medium Density Residential/Island Estates Neighborhood Conservation Overlay
District Table 2-1602.F.2
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Conditions of Approval:
1. That the pool and deck be constructed less than, or equal to one-foot above existing grade;
2. That permit be obtained for the existing masonry wall; and
3. That a variance be obtained to allow the pool and deck to be constructed as proposed
(Administrative or Flood Board), prior to issuance of a building permit (pool and deck).
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (July 15, 2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not

change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Additionally, an appeal of a Level Two approval (Flexible Development) may be initiated
pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days
of the date of this Development Order. The filing of an application/notice of appeal shall stay the
effect of the decision pending the final determination of the case. The appeal period for your
case expires on July 29,2003 (14 days from the date of this Development Order).

CHARACTER OF THE
IMMEDIATE VICINITY: The character of the immediate vicinity is single-family residential.
STAFF ANALYSIS:
The site is 0.24 acre located on the northwest side of the terminus of Palm Island SW,
approximately 500 feet west of Island Way. It is located within the Island Estates subdivision.
Adjacent lots are all waterfronts and contain single-family homes.
The request is to reduce the required rear (northwest) setback from 10 feet to zero feet for a pool
deck and swimming pool as part of an accessory use as a Residential Infill Project per Section 2-
1602.F.2, of the Island Estates Neighborhood Plan. The proposal includes a swimming pool and
deck at-grade or less than one-foot above existing grade. The pool and deck is consistent with the
placement of the pool and deck on the adjacent lot to the south, although the adjacent pool and
deck is elevated. There are other pools to the east on the south side of Palm Island SW that also
are at a zero setback.
Because of existing rear yard dimensions, the applicant has applied for a reduction from the
minimum rear accessory setback in single-family areas of 10 feet to zero feet. In order to build a
swimming pool and pool deck at a zero foot setback, it must be in compliance with the criteria
set forth in the IENCOD. Page 25 of the Island Estates Neif!hborhood Plan states, "Any pool
exceeding 1 foot in height above grade shall comply with the required rear setback for the
principal structure." The grade-raised seawall is at an elevation of 1 foot above the neighboring
seawall at 210 Palm Island SW. A building permit was approved and issued for the raising and
strengthening of the seawall. In addition, an existing masonry wall was built 2 feet and 7 inches
on top of the grade-raised seawall. A fence permit was never applied for nor granted to build this
existing masonry wall.
On page 18 of the Island Estates Neighborhood Plan, the first objective under the second goal is
to, "Preserve water views by restricting the heights of fences and structures in the waterfront yard
and by maintaining established side building setbacks, rear building setbacks and site triangles."
In the Community Development Code Book under Section 3-904.B. Sight Visibility Triangles
are established, "To enhance views ofthe water from residential waterfront property, no structure
or landscaping may be installed, other than a fence around a swimming pool or any non-opaque
fences not exceeding 36 inches, in the 45 angle formed by ten feet back from the property line on
the water and along the side property line." On June 13,2003, a demolition permit was submitted
and issued to bring the masonry wall into compliance with the Waterfront Sight Visibility
Triangles. The wall is now even with the grade-raised sea wall cap at 1 foot in height and extends
from the rear (northeast) property line back 20 feet along the side property line. Although the
wall is now in compliance with Waterfront Sight Visibility Triangles, a building permit was
never issued for the fence and will still need to be obtained.

C. FLEXIBLE DEVELOPMENT CRITERIA FOR RESIDENTIAL INFILL PROJECTS
IN THE LMDR, LOW MEDIUM DENSITY RESIDENTIAL / ISLAND ESTATES
NEIGHBORHOOD CONSERVATION OVERLAY DISTRICT (Table 2-1602.F.2):
1. The development or redevelopment of the parcel proposed for development is
consistent with the Island Estates Neighborhood Plan;
The purpose of the Island Estates Neighborhood Conservation Overlay District
(IENCOD) is "to provide a means of ensuring that infill and redevelopment activities in
existing, stable, residential neighborhoods requiring special consideration are consistent
with the protection of the existing character of the neighborhood," per Community
Development Code Section 4-608. The applicant's general proposal to build a swimming

pool and pool deck in the rear of his property is a permitted accessory use within the
Island Estates Neighborhood; Low Medium Density Residential Zoning District. It is
consistent with the majority of homeowners having swimming pools and pool decks.
2. Single-family detached dwellings and community residential homes with six or
fewer residents are the only permitted uses eligible for residential infill project
application;
A residential infill project application for an accessory use is permitted.
3. The development or redevelopment of the parcel proposed for development is
otherwise impractical without deviations from the intensity and other development
standards;
The current development standard for rear setbacks in the IENCOD single-family areas
for accessory structures, including screen pool enclosures, is 10 feet. Without deviation
from the required rear setback, the pool width would be limited to 5 feet.
4. The development of a parcel proposed for development as residential infill project
will not materially reduce the fair market value of abutting properties;
The addition of an inground swimming pool and deck will not reduce the market value
of abutting properties.
5. The uses within the residential infill project are compatible with adjacent land
uses;
The swimming pool and deck is designed to be consistent with the placement ofthe pool
on the adjacent lot to the south at a zero foot setback. The swimming pool and pool deck
on the adjacent lot is elevated and was constructed in 1998 prior to the Island Estates
Neighborhood Plan and current Community Development Code. The proposed
swimming pool and pool patio is required by IENCOD and code to be at-grade or less
than one-foot above existing grade.
6. The development of the parcel proposed for development as a residential infill
project will upgrade the immediate vicinity of the parcel proposed for
development;
The proposed pool value is $9,650 and patio is $2,300 equaling an $11,950 improvement
to the existing property. This project should upgrade the immediate vicinity.
7. The design of the proposed residential in fill project creates a form and function
which enhances the community character of the immediate vicinity of the parcel
proposed for development and the City of Clearwater as a whole;

The form and function is one that uses the close proximity and availability to waterfront
access. Many of the residents with Island Estates have pools and pool decks that enhance
the character as a waterfront community. This addition will add to the established
waterfront character of Island Estates and the City of Clearwater.
8. Flexibility in regard to lot width, required setbacks, height, off-street parking,
access or other development standards is justified by the benefits to community
character and the immediate vicinity of the parcel proposed for development and
the City of Clearwater as a whole;
The addition of an accessory swimming pool and pool deck through a reduction of the
required rear setback, is justified by the improvement to the property. This property
improvement will add to the established character of Island Estates in that the majority of
homeowners currently have swimming pools and pool decks. The improved property
value should have a positive impact on adjacent property owners, Island Estates
Neighborhood and the City of Clearwater.
D. GENERAL APPLICABILITY (Section 3-913): Conditions which are imposed by the
Community Development Coordinator and the Community Development Board
pursuant to a Level One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The swimming pool and deck is designed to be consistent with the size and placement of
the pool on the lot to the south and it will be constructed at less than one-foot above
existing grade. The swimming pool and pool deck on the adjacent lot was constructed in
1998 with a rear setback of zero feet. There are additional pools at a zero setback to the
east on the south side of Palm Island SW.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the
value thereof.
The proposed swimming pool and deck should not hinder or discourage appropriate
development or use of neighboring properties, nor significantly impair any property
values. The proposed pool will be constructed at less than one-foot above existing
grade, which meets Code provisions.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The swimming pool and deck will not adversely affect the health or safety of persons
residing or working in the neighborhood. The proposed pool and deck will be

constructed less than or equal to one-foot above existing grade, allowing the pool and
deck to meet Code setbacks for pools rather than the principal dwelling setback.
4. The proposed development is designed to minimize traffic congestion.
The proposal will have no increased affect on traffic.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
The proposed swimming pool and deck is consistent with the setbacks of the adjacent
pool to the south and with others to the east on the south side of Palm Island SW.
6. The design of the proposed development minimizes adverse effects, including
visual, acoustic and olfactory and hours of operation impacts, on adjacent
properties.
There will be no adverse effects generated by the proposed swimming pool and deck.
STAFF RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on May
15,2003. The proposal is in compliance with the standards and criteria for Flexible Development
approval, with the maximum development potential, with the requirements of Residential Infill
Projects, and with all applicable standards of the Community Development Code.
Therefore, staff recommends APPROVAL of the application for Flexible Development approval
to reduce the required rear (northwest) setback from 10 feet to zero feet for a pool and pool deck,
as part of a Residential Infill Project under the provisions of Section 2-203 at 200 Palm Island
SW, with the following bases and condition:
Basis for Approval:
1. The proposal complies with the Flexible Standard as a Residential Infill Project in the
Low Medium Density Residential/Island Estates Neighborhood Conservation Overlay
District Table 2-1602.F.2.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Condition

Mr. and Mrs. Turrell plarmed to be at today's hearing to strenuously object to the
referenced application because the development at 200 Palm Island SW is totally out of character
with the neighborhood and adverse to the Turrclls specifically. However. Mr. Turrell has had a
medical emergency and had to go to the hospital and the Turrells cannot attend the hearing.
Accordingly. on behalf of Mr. and Mrs. A. Roger Turrell, owners of the property noted

1. The application is not in hannony with the community or with the
immediate properties in the area. The applicant razed the home existing on the site and
built an entirely new, and extremely large, home. Incident to original design, the
applicant could have planned for a pool within the setback ordinances and elected not to
do so. Other pools in the area al'e generally consistent with development ordinances and

setbacks, SO this application is not in harmony with the neighborhood and should be
denied.
2. The proposed development will in fact adversely impact the Turrel1s'
contiguous home. Incident to construction, fill dirt has been brought to the site, which
raises grade; although the pool is projected to be no more than one 0') foot above grade
on the applicant's lot1 there is nevertheless adverse impact on the Turrell property
because of the increased height from the fill dirt, and the pool constructed out to the
seawall. Thi.s is inconsisfentwith the Island Estates development overall, and in our
clients' view, inconsistent with the Island Estates NeighborhOOd Plan.
3. Nor is the proposal consistent with the oommunity character of the
inunediate vicinity, The applicant has elected to constnlct a house mUch larger than any
others on the street; he could have accommodated a swimming pool without relief from
the:: code, incident to his original design and eleoted not to do so. He should not now be
allowed to come in and get relief from the code under such cucwnstances, when the
request is not in conformity with the immediate vicinity as required by eode.
In closing, our clients' request that the code be enforced in thia instance. There simply is
no basis to support any relief from the Development Codes. r 0 the extent the application is
approved, it will have adverse impacts on the Turrell property) and will not be consistent with the
Island Estates guidelines.

Dear Mr. Berry:
I am unable to attend the hearing of July
15, 2003. I reside at 216 Palm Island S.W., two doors
dovtn from the Bednarski'S house. I obj ect to thei r
request for a var iance. Their home is an imposing
structure built in oppOSition to what proportion and
neighborheod aesthetics would dictate.
Grounds for variance do not include that a
building lot is too small for a desired structure.
There is no way to justify a pool and deck out to the
sea wall as the Bednarski's propose. They've simply
elected to build more house than their building lot
will accorlUllodate. They should conflne their living
space to what was allowed by the code when they broke
ground. The fact that they already cOI'cunenced
excavation for the pool should weigh against them.
I have lived at 216 Palm Island SW for 26
years and I have witnessed the Island Estate's
sweepstakes first hand. In designing new or remodeled
structures, set back requirements are more the honored
In the breach than the observance by owners and
builders. Keep in mind properties are valued here by
the square foot. There exists a philosophy in some
circles to grab what you can. The Community
Development Board stands for those citizens who have
jobs and are unable to attend hearings or who are
reluctant to publicly oppose a neighbor's request for
a variance. The Bednarski's have their home designer

to blame for not having room for a pool. The
situation might be different if they had purchased an
existing structure. With due respect to staff, this
pool and deck when viewed in conjunction with the
structure already erected fails on the criteria for
infill projects at paragraphs (6), (7) and (8). The
values of adjacent properties will fall and it is
unfair to compare the applicant'S home site with that
aesthetically correct home site at lot 11, now
incidentally for sale because of the Bednarski's home.
This is a new structure which could have been designed
otherwise.

Dear Jerry Bednarski,
On Monday May 5th, a preliminary internal staff review for the upcoming DRC Meeting was
held and the following comments were made from the respective departments concerning your
application. The comments made need to be addressed at the upcoming DRC Meeting on the
15th of May. These are all preliminary comments that are subject to change and expand between
now and May 15th DRC Meeting.

Dear Mr. and Mrs. Bednarski:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On January 17, 2002, the Development Review Committee (DRC) reviewed your
application for Flexible St<u1dard Develop~ent approvalto reduce the required rear (northwest) setback
from 10 feet to zero feet for a pool deck (with an in-ground pool located four feet from the property
line), as part of a Residential Infill Project under the provisions of Section 2-203. The application
includes a swimming pool and pool deck in conjunction with the construction of a new single-family
dwelling. The DRC unanimously recommended approval of the application with the following bases
and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Standard Development criteria per Section 2-203.
2. The proposal is in compliance with other standards in the Code including the General Applicability
Criteria per Section 3-913.
3. The development is compatible with the surrounding area and will enhance other redevelopment
efforts.
Conditions of Approval:
1. That all applicable reqy.jrements of Chapter 39 of the Building Code be met related to seawall
setbacks;
2. That the pool and deck be constructed at-grade or less than one-foot above existing grade; and
3. That a tree permit be secured prior to Building Permit.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The.approval is based on and must adhere to the
site plan submitted as received on January 22,2002.

Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (February 8, 2003). All required certificates of occupancy
shall be obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners.
Please be aware that the issuance of this Development Order does not relieve you of the necessity to
obtain any building permits or pay any impact fees that may be required. In order to facilitate the
issuance of any permit or license affected by this approval, please bring a copy of this letter with you
when applying for any permits or licenses that require this prior development approval.
In addition, please be aware that an appeal of a Level One approval (Flexible Standard Development)
may be initiated by a property owner abutting the property which is the subject of the approval within
seven days of the date the development order is issued. A copy of the Development Order is being sent
to the surrounding property owners. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case will expire on
February 15, 2002.
