ANALYSIS: The site contains approximately 16 acres located on the southwest comer of Allen Avenue and McMullen Booth Road within a residential area along the McMullen Booth Road corridor. The lot has 680 feet of frontage on McMullen Booth Road (east) and extends over 1,000 feet in depth. The site contains 320 attached dwellings located within 13, two- and three-story, masonry-block buildings that were developed in 1989 under a former Code. The buildings are located between a minimum of 50 feet from any property line and stand up to 35 feet in height. Existing parking spaces are located throughout the site and within five feet of any side or rear property line. The request is to install a six-foot fence within the front (east) setback along McMullen Booth Road. The fencing will provide additional security to the multi-family development as part of an overall upgrade of the site. It will be similar in style and size to other fences in the area. Code permits fences within the front setback in the MHDR District to a height of three feet. Brick or masonry walls or walls with masonry columns linked by substantial grill work may be permitted up to a height of six feet as part of a Level Two (Flexible Development) application. The proposal includes a fence with decorative, iron posts linked by wrought-iron fencing and meets the requirements of Code. Extensive landscaping exists throughout the site that meets the intent of the Code. The fence will be located 13 feet from the east property line. It will run along the north (side) property line approximately 170 feet east of the rear (west) property line and will extend for 630 feet to the east. The fence will continue south across the northern drive aisle to the main office. The proposal also includes a gate located at the driveway along McMullen Booth Road. The proposal also includes gates across the north drive aisle and within the east parking lot just north of Building One. The limit of this request is the portion of the fence and one gate along the east property line along McMullen Booth Road. Emergency vehicles will be able to access the site using a "knox box" or other approved entry system. A private company currently provides solid waste management for the development and access will be maintained with this proposal. CODE ENFORCEMENT ANALYSIS There are no code enforcement issues associated with this property. Page 2 - - A. GENERAL APPLICABILITY: Conditions which are imposed by the Community Development Coordinator and the Community Development Board pursuant to a Level One or a Level Two Approval shall ensure that: 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density, and character of adjacent properties in which it is located. The proposal includes a fence with decorative, iron posts linked by wrought iron fencing with a gate at the drive entrance along McMullen Booth Road. The site is extensively landscaped and meets the intent of Code. The proposed fence will be similar in size and scale to other fences and walls in the area. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The existing use (attached dwellings) will not change with this proposal. The proposal is to provide for additional property security through the use of a decorative fence. The proposal should not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The use will not change with this proposal. The proposed development is designed to minimize traffic congestion. The intensity of use of the site will not change with this proposal. The proposal will not increase the density or intensity of use. There will be 50-feet between the gated entry and the edge of McMullen Booth Road for car stacking. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The use of the site is a large multi-family development. The site is well buffered from all adjacent properties by walls and extensive landscaping. The buildings are located a minimum of 50 feet from any property line. This proposal will be compatible with adjacent land uses. The attached dwellings have been and will continue to be compatible with adjacent land uses. The proposed development is similar to and consistent with the community character of the immediate vicinity. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The site will continue to operate as it has since 1989. There are no outstanding Code violations or complaints associated with this site. The proposal will result in an improved appearance and increased security for the multi-family residents. The intensity of use will not change with this proposal. There will be no adverse effects generated by the proposed development. SUMMARY AND RECOMMENDATION: The application and supporting materials were reviewed by the Development Review Committee on June 14, 2001. The Planning Department recommends APPROVAL of the Flexible Development approval to permit a six-foot high fence within the required front setback along McMullen Booth Road within the MHDR, Medium High Density Residential District, for the site at 2652 McMullen Booth Road with the condition that a knox gate entry system be installed for emergency equipment entry prior to the final inspection of the site. ANALYSIS: The site contains approximately 16 acres located on the southwest comer of Allen Avenue and McMullen Booth Road within a residential area along the McMullen Booth Road corridor. The lot has 680 feet of frontage on McMullen Booth Road (east) and extends over 1,000 feet in depth. The site contains 320 attached dwellings located within 13, two- and three-story, masonry-block buildings that were developed in 1989 under a former Code. The buildings are located between a minimum of 50 feet from any property line and stand up to 35 feet in height. Existing parking spaces are located throughout the site and within five feet of any side or rear property line. The request is to install a six-foot fence within the front (east) setback along McMullen Booth Road. The fencing will provide additional security to the multi-family development as part of an overall upgrade of the site. It will be similar in style and size to other fences in the area. Code permits fences within the front setback in the MHDR District to a height of three feet. Brick or masonry walls or walls with masonry columns linked by substantial grill work may be permitted up to a height of six feet as part of a Level Two (Flexible Development) application. The proposal includes a fence with decorative, iron posts linked by wrought-iron fencing and meets the requirements of Code. Extensive landscaping exists throughout the site that meets the intent of the Code. The fence will be located 13 feet from the east property line. It will run along the north ( side) property line approximately 170 feet east of the rear (west) property line and will extend for 630 feet to the east. The fence will continue south across the northern drive aisle to the main office. The proposal also includes a gate located at the driveway along McMullen Booth Road. The proposal also includes gates across the north drive aisle and within the east parking lot just north of Building One. The limit of this request is the portion of the fence and one gate along the east property line along McMullen Booth Road. Emergency vehicles will be able to access the site using a "knox box" or other approved entry system. A private company currently provides solid waste management for the development and access will be maintained with this proposal. CODE ENFORCEMENT ANALYSIS There are no code enforcement issues associated with this property. Page 2 e e A. GENERAL APPLICABILITY: Conditions which are imposed by the Community Development Coordinator and the Community Development Board pursuant to a Level One or a Level Two Approval shall ensure that: 1. The proposed development of the land will be in harmony with the scale, bulk, coverage, density, and character of adjacent properties in which it is located. The proposal includes a fence with decorative, iron posts linked by wrought iron fencing with a gate at the drive entrance along McMullen Booth Road. The site is extensively landscaped and meets the intent of Code. The proposed fence will be similar in size and scale to other fences and walls in the area. 2. The proposed development will not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. The existing use (attached dwellings) will not change with this proposal. The proposal is to provide for additional property security through the use of a decorative fence. The proposal should not hinder or discourage the appropriate development and use of adjacent land and buildings or significantly impair the value thereof. 3. The proposed development will not adversely affect the health or safety or persons residing or working in the neighborhood of the proposed use. The use will not change with this proposal. The development will not adversely affect the health or safety or persons residing or working in the neighborhood. It is designed to enhance the safety of residents in the development. 4. The proposed development is designed to minimize traffic congestion. The intensity of use of the site will not change with this proposal. The proposal includes decorative, iron posts linked by wrought iron fencing with a gate at the drive entrance along McMullen Booth Road. The proposal will not increase the density or intensity of use. There will be 50-feet between the gated entry and the edge of McMullen Booth Road for car stacking. The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The use of the site is a large multi-family development. The site is well buffered from all adjacent properties by walls and extensive landscaping. The buildings are located a minimum of 50 feet from any property line. This proposal will be compatible with adjacent land uses. The attached dwellings have been and will continue to be compatible with adjacent land uses. The proposed development is similar to and consistent with the community character of the immediate vicinity. 6. The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts, on adjacent properties. The site will continue to operate as it has since 1989. There are no outstanding Code violations or complaints associated with this site. The proposal will result in an improved appearance and increased security for the multi-family residents. The intensity of use will not change with this proposal. There will be no adverse effects generated by the proposed development. SUMMARY AND RECOMMENDATION: The application and supporting materials were reviewed by the Development Review Committee on June 14, 2001. The Planning Department recommends APPROVAL of the Flexible Development approval to permit a six-foot high fence within the required front setback along McMullen Booth Road within the MHDR, Medium High Density Residential District, for the site at 2652 McMullen Booth Road with the condition that a knox gate entry system be installed for emergency equipment entry prior to the final inspection of the site. Bases for Approval: 1. The proposal complies with the general applicability criteria and criteria for Flexible Development approval. 2. The proposal will enhance the existing development. 3. REQUEST: Flexible Development approval to permit a six-foot high fence with gate in the required front setback along McMullen BOt~th Road within the MHDR, Medium High Density Residential District. ANAL YSIS: The site contains approximately 16 acres located on the southwest comer of Allen Avenue and McMullen Booth Road within a residential area along the McMullen Booth Road corridor. The lot has 680 feet of frontage on McMullen Booth Road (east) and extends over 1,000 feet in depth. The site contains 320 attached dwellings located within 13, two- and three-story, masonry-block buildings that were developed in 1989 under a former Code. The buildings are located between a minimum of 50 feet from any property line and stand up to 35 feet in height. Existing parking spaces are located throughout the site and within five feet of any side or rear property line. The request is to install a six-foot fence within the front (east) setback along McMullen Booth Road. The fencing will provide additional security to the multi-family development as part of an overall upgrade of the site. It will be similar in style and size to other fences in the area. Code permits fences within the front setback in the MHDR District to a height of three feet. Brick or masonry walls or walls with masonry columns linked by substantial grill work may be permitted up to a height of six feet as part of a Level Two (Flexible Development) application. The proposal includes a fence with decorative, iron posts linked by wrought-iron fencing and meets the requirements of Code. Extensive landscaping exists throughout the site that meets the intent of the Code. The fence will be located 13 feet from the east property line. It will run along the north (side) property line approximately 170 feet east of the rear (west) property line and will extend for 630 feet to the east. The fence will continue south across the northern drive aisle to the main office. The proposal also includes a gate located at the driveway along McMullen Booth Road. The proposal also includes gates across the north drive aisle and within the east parking lot just north of Building One. The limit of this request is the portion of the fence and one gate along the east property line along McMullen Booth Road. Emergency vehicles will be able to access the site using a "knox box" or other approved entry system. A private company currently provides solid waste management for the development and access will be maintained with this proposal. Page 1 ... . . Also enclosed is a copy of the Easement, in favor the City of Clearwater, recorded in O.R. Book 5473, Page 1388, Public Records of Pinellas County, Florida, granting a 25-foot sanitary sewer easement. We believe that the site plan will reflect that the fence will be located within the area of the sanitary sewer easement; however the owner is willing to give the City a Waiver of Liability. Enclosed is a proposed letter from the owner agreeing that any repairs to the fence caused by the City's work in the area would be at the owner's expense.
