Dear Mr. Arcieri:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On May 20, 2003, the Community Development Board reviewed your
application for Flexible Development to permit a fence six feet in height beginning 25 feet from
the front (southeast) property line off North Bayshore Boulevard and continuing along the front
property line to a distance of 13 feet from the front (southeast) property line off North Bayshore
Boulevard, under the provisions of Section 3-804.A.l.
The Community Development Board (CDB) APPROVED the application with the following
bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria under the prOVISIons of
Section 3-804.A.l.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The fence is compatible with the surrounding area.
Conditions of Ap?roval:
1. That turf blocks are removed from the right-of-way, prior to issuance of a building permit.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (May 20, 2004). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.

The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
Please be aware that an appeal of a Level Two approval (Flexible Development) may be initiated
by a property owner abutting the property (which is the subject of the approval) within 14 days of
the date of the CDB decision. The filing of an application/notice of appeal shall stay the effect of
the decision pending the final determination of the case. The appeal period for your case will
expire on June 3, 2003.

ANALYSIS:
The 0.5-acre site is located on the north side of North Bayshore Boulevard, approximately 400 feet
south of Mateo Street. The site contains an existing single-family home. It is located in a part of
the City characterized by attractive, well-maintained residential properties.
The proposal includes a wrought iron-style, aluminum picket fence six feet in height with
masonry-stucco columns. The proposed total price of the fence is $14,000. The fence will be
constructed 25 feet from the front (southwest) property line as measured from North Bayshore
Boulevard. It will continue along the front property line to a distance of 13 feet from the front
(southeast) property line off North Bayshore Boulevard. The proposed fence will adjoin a
similarly-styled fence on the property adjacent to the west. The proposed fence will terminate at
the side (east) property line. It is consistent with other fences and walls in the area with regard to
style, scale and placement. There are turf blocks located in the right-of-way that will need to be
removed.
Section 3-804.A.l. of the Code limits fences within the front setback to 36 inches in height. The
Code states, however, that brick or other masonry columns linked by substantial grill work shall
be permitted to a maximum height of six feet in a required front setback area as a Level Two,
Flexible Development application.
CODE ENFORCEMENT ANALYSIS
There are no outstanding enforcement issues associated with this site.
B. FLEXIBILITY CRITERIA FOR FENCES UNDER THE PROVISIONS OF SECTION
3-804.A.l :
1. In the MDR and MHDR zoning districts, brick or other masonry walls or walls with
masonry columns linked by substantial grill work shall be permitted to a maximum
height of six feet in a required front setback area as a Level Two (Flexible
Development) approval. Such walls shall be architecturally compatible with the
principal structure on the property and compatible with the surrounding properties.
The proposed fence will adjoin a similarly-styled fence on the property adjacent to the
west. It will terminate at the side (east) property line. The site has been developed with a
large, single-family dwelling. The proposal is consistent and compatible with other fences
in the area with regards to material, scale and location and is architecturally compatible
with the existing home.
GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:

1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposed fence will be located between 13 and 25 feet from the front (south) property
line along North Bayshore Boulevard and will align with a similar fence located on the
property to the west. The site has been developed with a large, single-family dwelling. The
proposal is consistent and compatible with other fences in the area with regard to material,
scale and location.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the value
thereof.
The site is zoned Medium Density Residential District and the proposed development will
be in compliance with that zoning classification. The proposed development is similar to
other fences and walls in the area with regard to size and placement and will be a $14,000
addition to the existing property.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposed fence is permitted in the Medium Density Residential District and should not
create any adverse health or safety impacts in the neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The proposal will have no effect on traffic congestion and is well outside any required sight
visibility triangles.
5. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
Surrounding properties have been developed with similarly-sized and placed fences and
walls. The proposed fence will align with an existing, similar fence on the property
adjacent to the west. The proposed development is consistent with the community
character of the immediate vicinity.
6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The proposal includes a non-opaque, wrought iron-style aluminum picket fence six feet in
height located within the front (south) setback along North Bayshore Boulevard. There
should be no adverse effects generated by the proposed development.

The Development Review Committee reviewed the application and supporting materials on April
17, 2003. The Planning Department recommends APPROVAL of the Flexible Development to
permit a fence six feet in height within the front (south) setback along North Bayshore Boulevard
on property within the Medium Density Residential District, under the provisions of Section 3-
804.A.l, with the following bases and conditions:

CHARACTER OF THE
IMMEDIA TE VICINITY: Single-family residential and City park uses dominate the immediate
vicinity.
ANALYSIS:
The 0.5-acre site is located on the north side of North Bayshore Boulevard approximately 400
south of Mateo Street. The site has been developed with a single-family dwelling and assorted
accessory uses. The area is characterized by single-family residential developments. The site is
located in a desirable part of the City that has maintained a significantly high quality of
architecture.
The proposal includes a wrought iron-style, aluminum fence six feet in height between 13 and 25
feet from the front (south) property line along North Bayshore Boulevard in association with an
existing single-family dwelling. Section 3-804.A.1. requires that fences within front setbacks on
property located within the Medium Density Residential District be reviewed as part of a Level
Two, Flexible Development application.
The proposed fence will be located along the front (south) property line, lining up with a similar
fence on the property adjacent to the west. The proposed fence will terminate at the side (east)
property line. The proposed fence is consistent with other fences and walls in the area with
regards to style, scale and placement.
CODE ENFORCEMENT ANALYSIS
There are no outstanding enforcement issues associated with this site.
B. FLEXIBILITY CRITERIA FOR FENCES UNDER THE PROVISIONS OF SECTION
3-S04.A.l:
1. In the MDR and MHDR zoning districts, brick or other masonry walls or walls with
masonry columns linked by substantial grill work shall be permitted to a maximum
height of six feet in a required front setback area as a Level Two (Flexible
Development) approval. Such walls shall be architecturally compatible with the
principal structure on the property and compatible with the surrounding properties.
The proposed fence will be located between 13 and 25 feet from the front (south) property
line along North Bayshore Boulevard and will line up with a similar fence located on the
property to the west. The fence will terminate at the side (east) property line. The site has
been development a large, single-family dwelling. The proposal is consistent and
compatible with other fences in the area with regards to material, scale and location.

D. GENERAL APPLICABILITY: Conditions which are imposed by the Community
Development Coordinator and the Community Development Board pursuant to a Level
One or a Level Two Approval shall ensure that:
1. The proposed development of the land will be in harmony with the scale, bulk,
coverage, density, and character of adjacent properties in which it is located.
The proposed fence will be located between 13 and 25 feet from the front (south) property
line along North Bayshore Boulevard and will line up with a similar fence located on the
property to the west. The fence will terminate at the side (east) property line. The site has
been development a large, single-family dwelling. The proposal is consistent and
compatible with other fences in the area with regards to material, scale and location.
2. The proposed development will not hinder or discourage the appropriate
development and use of adjacent land and buildings or significantly impair the value
thereof.
The site is zoned Medium Density Residential District and the proposed development will
be in compliance with that zoning classification. The proposed development is similar to
other fences and walls in the area with regards to size and placement.
3. The proposed development will not adversely affect the health or safety or persons
residing or working in the neighborhood of the proposed use.
The proposed fence is permitted in the Medium Density Residential and should not create
any adverse health or safety impacts in the neighborhood.
4. The proposed development is designed to minimize traffic congestion.
The proposal will have no effect on traffic congestion and is well outside any required sight
visibility triangles.
s. The proposed development is consistent with the community character of the
immediate vicinity of the parcel proposed for development.
Surrounding properties have been developed with similar sized and placed fences and
walls. The proposed fence will line up with an existing, similar fence on property adjacent
to the west. The proposed development is consistent with the community character of the
immediate vicinity.

6. The design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operation impacts, on adjacent properties.
The dock will serve the residents and visitors of Clearwater and there should be no adverse
effects generated by the proposed development.
SUMMARY AND RECOMMENDATION:
The Development Review Committee reviewed the application and supporting materials on April
17, 2003. The Planning Department recommends APPROVAL of the Flexible Development to
permit a fence six feet in height within the front setback on property within the Medium Density
Residential District, under the provisions of Section 3-804.A.l, with the following bases and
conditions:
Bases for Approval:
1. The proposal complies with the Flexible Development criteria under the provisions of Section
3-804.A.l.
2. The proposal is in compliance with other standards in the Code including the general
applicability criteria per Section 3-913.
3. The dock development is compatible with the surrounding area.

2. Clarify the following:
~ Prior to the issuance of building permits for the dock, the applicant will
need to show compliance with National Fire Protection Association
(NFP A) standards for "marinas and boat yards" for the construction and
operation of the docking facilities to provide fire protection of boats
moored in the slips;
~ Floating and dock supported signage will need to be permanently installed
warning boaters of the existence of protected sea grasses and manatees in
the vicinity; and
~ A Water Navigation Permit and a Department of Environmental Protection
permit will be required to be approved by Pinellas County and the State
prior to the issuance of building permits.
The application has been entered into the Department's filing system and assigned the
case number FLD2003-03015. The Development Review Committee will review the
application for sufficiency on April 17, 2003, in the Planning Department conference
room - Room 216 - on the second floor of the Municipal Services Building, 100 South
Myrtle A venue, in Clearwater. Additional comments and requirements may result from
