Welcome. We are glad to have you join us. If you wish to speak, please wait to be recognized, then
state your name and address. Persons speaking before the City Council shall be limited to three (3)
minutes unless otherwise noted under Public Hearings. For other than Citizens to be heard regarding

trespassing relating thereto; and amending Section 22.33, bathing and swimming areas
and the Courtney Campbell recreation area, Subsection (3), deleting reference to park
hours due to a revision of applicable hours.
10.10 Adopt Ordinance No. 7377-05 on second reading, amending Chapter 33, Section
33.067, Code of Ordinances, relating to waterways and vessels, to change a defined
area for speed restrictions of vessels.
10.11 Adopt Ordinance 7384-05 on second reading, repealing Ordinance No. 6132-97, which
proposed to conditionally vacate the east/west alleyway lying south of Lots 9, 10, and
11, less the west 3 feet, Block 4, Gould & Ewings 2nd Addition.
City Manager Reports
11 Consent Agenda
11.1 Accept a Reclaimed Water Main & Utility Easement establishing two described
easements, and a Blanket Water Main and Utilities Easement, all to encumber Bayside
Arbors Apartments, 2729 Seville Boulevard, said easements being conveyed by
Bayside Arbors, Ltd., a Florida limited partnership, over and across portions of Section
17 and Section 20, Township 29 South, Range 16 East in consideration of receipt of
$1.00 and the benefits to be derived therefrom and authorize the appropriate officials
to execute same.
11.2 Reappoint Edward O'Brien, Jr. and appoint Mark A. Smith to the Marine Advisory Board
with terms expiring on February 28, 2009.
11.3 Reappoint Dana K. Tallman to the Community Development Board with the term
expiring on February 28, 2009.
11.4 Appoint Councilmembers as Representatives on Regional and Miscellaneous Boards:
Hibbard - Mayors' Council, Tampa Bay Partnership Board of Governors and Policy
Board, MPO; Jonson - Suncoast League of Municipalities Board of Directors, Tampa
Bay Estuary Policy Board, St. Pete/Clearwater Area Economic Development Council,

11.5 Authorize the City Attorney to settle all claims in the case of Ritz v. City of Clearwater, a
discrimination suit, for the amount of $18,750.00, inclusive of all fees and costs.

11.6 Great Southern Peterbilt Inc. - Four 2005 Peterbilt cab and chassis for $369,868.14.
11.7 Increase the contract with Fleet Products Inc. from $95,000 to $145,000 (Increase of

WHEREAS, the City of Clearwater has the authority pursuant to Rules Governing the
Administration of the Countywide Future Land Use Plan, as amended, Section 2.3.3.8.5, to adopt
and enforce a specific plan for redevelopment in an urban center in accordance with the Central
Business District plan category, and said Section requires that a special area plan therefore be
approved by the local government; and
WHEREAS, the City Council approved the 1995 Clearwater Downtown Redevelopment
Plan on August 17, 1995 and the Downtown Periphery Plan update on April 19, 2001; and
WHEREAS, the City Council approved the updated 2003 Clearwater Downtown
Redevelopment Plan on September 18, 2003 by adopting Ordinance No. 7153-03; and
WHEREAS, the Pinellas County Board of County Commissioners reviewed the Plan
adopted by Ordinance No. 7153-03 on October 21, 2003 and recommended that certain
amendments to the Ordinance be made regarding the use of tax increment financing by the City of
Clearwater); and
WHEREAS, the City Commission amended the updated 2003 Clearwater Downtown
Redevelopment Plan on December 4,2003 by adopting Ordinance No. 7231-04;
WHEREAS, the City Commission amended the updated 2003 Clearwater Downtown
Redevelopment Plan on November 4, 2004 by adopting Ordinance No. 7343-04; and
WHEREAS, the Pinellas County Board of County Commissioners approved the CRA Plan
adopted by Ordinance No. 7231-04 on December 16, 2003; and
WHEREAS, the City Commission approved the creation of a Redevelopment Trust Fund for
the expanded CRA by adopting Ordinance No. 7214-03; and
WHEREAS, the Pinellas County Board of County Commissioners approved the creation of
a Redevelopment Trust Fund for the expanded CRA adopted by Ordinance No. 7214-03 on
February 3, 2004; and

WHEREAS, the Countywide Planning Authority approved the updated and amended 2003
Clearwater Downtown Redevelopment Plan as the Special Area Plan for Downtown Clearwater on
February 3, 2004; and
WHEREAS, the effective date of the Clearwater Downtown Redevelopment Plan adopted
by Ordinance No. 7231-03 is February 3,2004; and
WHEREAS, the requirements of Florida Statutes Section 163.360 regarding the adoption of
community redevelopment plans have been met regarding that portion of the amendments
proposed hereby which affect the Downtown Community Redevelopment Area, and the
requirements of Florida Statutes Section 163.346 regarding notice to taxing authorities and other
required notice, as well as all other requirements of Florida Statutes Chapter 163, have been met;
and
WHEREAS, it is advisable to revise certain provisions to the Plan regarding the Fort
Harrison Streetscape Project and costs associated with that project, as well as a minor editorial
change; and
WHEREAS, the proposed amendments were reviewed by the Community Development
Board, which is the land planning agency for the City of Clearwater for purposes of the Local
Government Comprehensive Planning and Land Development Regulation Act, and the Community
Development Board found the proposed amendments to be consistent with the Comprehensive
Plan of the City of Clearwater; and
WHEREAS, the Community Redevelopment Agency has reviewed the proposed
amendments and recommends them to the City Commission, and the amended Plan shall serve as
the Community Redevelopment Plan for the downtown Community Redevelopment Area of the City
of Clearwater; and
WHEREAS, the proposed amendments conforms to the general plan of the City of
Clearwater as a whole; and
WHEREAS, the proposed amendments will afford maximum opportunity, consistent with the
sound needs of the City as a whole, for the rehabilitation or redevelopment of the Plan area by
private enterprise; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

AMENDMENT 1 - CHAPTER 1 INTRODUCTION
Amend the Purpose of this Plan section on page seven as follows:

In 1995, the City Commission approved a major revision to the Clearwater Downtown
Redevelopment Plan. While retaining the original boundaries of the earlier Downtown
plan, the Plan significantly expanded the policies for Downtown. The 1995 Plan
established five overall goals for Downtown which have been retained in major part in
this new plan. The 1995 Plan established a land use plan map for the Downtown defining
residential, commercial, office, mixed use, public/governmental, religious, and open
space/recreational land uses. The Plan also established development potential defining
commercial intensity and residential density by sub-area for the Downtown. A major
portion of the 1995 Plan was devoted to redevelopment projects with implementation to
be accomplished by either the public or private sector. Some of the public sector projects
are now under construction including the new Main Library and the ~Prospect Lake
Park" (to be renamed at a later date) for stormwater management.

Section. 22.24. Authority to regulate beaches, park property, and the Courtney

(1) The city manager is empowered in the exercise of the city manager's
discretion to regulate the time, place and manner in which the public
beaches, park property of the city, and the Courtney Campbell Recreation
Area, or any portion thereof, are to be used and enjoyed by the public and
to authorize the posting of signs regulating public use. In so doing, the
city manager is to give due regard to the safety facilities available thereat,
the preservation of public property, the number of persons who can be
safely protected and safeguarded at the particular location, and the health
and welfare of the public using and wishing to use such facilities. The
directions of the city manager given pursuant to the authority contained in
this section are declared to have the effect of law and shall be enforced
by the police officers of the city.

Section 2. That Section 22.33 of the Code of Ordinances, City of Clearwater,
Florida, is hereby amended to read as follows:
Section. 22.33. Bathing and swimming areas and the Courtney Campbell
Recreation Area.
(1) No person, regardless of age, sex or manner of dress shall swim,
wade or bathe in waters or waterways in any park other than at such
places set aside for such activities.

Section 1. Section 33.067 is amended to read:

All waters in the following described area are designated as a slow down-minimum
wake zone: Begin at a point approximately 75 yards. more or less. to a ooint

AN ORDINANCE OF THE CITY OF CLEARWATER,

11, LESS THE WEST 3 FEET, BLOCK 4, GOULD &
EWINGS 2nd ADDITION; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Haag Land & Building Development, Inc., ("Haag") as owner of certain
real property located in the City of Clearwater in 1997, requested that the City of
Clearwater ("City") vacate an alley owned by the City in order that Haag could construct a
structure described as the ''Rome Tower", as approved on that certified site plan dated
May 1, 1996 over and across said alley; and
WHEREAS, the City agreed to conditionally vacate said alley in response to the
request upon certain conditions precedent as articulated in Ordinance 6132-97, passed
by the Clearwater City Commission on April 3, 1997; and
WHEREAS, Haag failed to meet the conditions precedent to the vacation of the
alley.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. That Ordinance 6132-97 is hereby repealed and of no force and effect.
Section 2. That the following:

Is not now, or has never been vacated in accordance with Ordinance 6132-97, and
the City of Clearwater retains all of its right, title and interest thereto.
Section 3. The City Clerk shall record this ordinance in the public records of
Pinellas County, Florida, following adoption.

Accept a Reclaimed Water Main & Utility Easement establishing two described easements, and a
Blanket Water Main and Utilities Easement, all to encumber Bayside Arbors Apartments, 2729
Seville Boulevard, said easements being conveyed by Bayside Arbors, Ltd., a Florida limited
partnership, over and across portions of Section 17 and Section 20, Township 29 South, Range 16
East in consideration of receipt of $1.00 and the benefits to be derived therefrom and authorize
the appropriate officials to execute same.
Summarv:
The objective of the City's Seville-Sunset Reclaimed Water Distribution System project is to
design and construct piping infrastructure to deliver reclaimed water to communities adjacent to
Seville Boulevard and Sky Harbor Drive on the east side of Clearwater, and in the Sunset Drive
area along Clearwater Harbor.
Bayside Arbors Apartments is a large rental complex on Tampa Bay just south of Clearwater Mall.
The subject Reclaimed Water Main and Utility Easement granted by Bayside Arbors, Ltd.
("Grantor") establishes two delivery points for reclaimed water infrastructure to connect with the
property's existing lawn irrigation system. One easement extends beneath the apartment
community's drive and parking area off of Pearce Drive, the other providing a more northerly
connection to the system from Seville Boulevard.
Both easements define a centerline, five feet each side of which the City is authorized ingress and
egress to maintain the reclaimed water lines to be installed therein.
When Zom Development submitted a site plan to develop Bayside Arbors in 1993, a condition of
plan approval required the developer convey a blanket water main easement to the City for
utilities crews to monitor and maintain the community's potable water system. A recent title
search revealed the easement was never granted. The subject Blanket Water Main and Utilities
Easement fulfills the developer's 1993 obligation and provides the City maintenance authority five
feet each side of all potable water lines and utilities, excluding any mains under buildings or
within five feet of buildings.

I have 8 years invested in the Marine business, specifically as a boat retailer. I have
dealt with numerous dock issues, environmental issues and have state-wide
experience with just about every marina in Florida. I have a vested interest in
preserving one of our most precious assets along with the business sense to realize
that it is a big part of what draws people to our area.

I want to ensure that the decision makers on the board have a voice that is " pro
marine business" and at the same time " pro environment" which I think is rare to

BOARD QUESTIONNAIRE
1. What is your understanding of the board's duties and responsibilities?
This board reviews and votes on certain development proposals, including review of site
plans, building designs, and whether the proposal meets the standards for approval as set
forth by ordinance. The COB also hears appeals from staff decisions and makes
recommendations to the City Council as to rezonings, land use amendments, annexations,
and changes to the Comprehensive Plan and the Community Development Code.
2. Have you ever observed a board meeting either in person or on C- View, the
City's TV station?
Yes, many times.
3. What background and/or qualifications do you have that you feel would qualify
you to serve on this Board?
Although I am not a professional in the fields of architecture, engineering, etc., I do have
a huge interest in architectural design and have even designed several residences. I do
feel my background in business will be an asset in decision-making. I can be logical and
fair and can understand the economic benefits/negatives for a particular project. I would
also consider my commitment to making Clearwater the best it can be an important
qualification. This is an extremely powerful and important board. It requires someone
who will judge the merits of each case based on the guidelines set by the Council and the
Comprehensive Plan and on the best solution for the majority of the citizens of
Clearwater.
4. Why do you want to serve on this noaid?
As my resume shows, I have been deeply involved in this community for almost 30
years. Although most of my volunteer work has been in the social services sector,
particularly in the area of fund raising. I thoroughly enjoyed my term on the Charter
Review Committee last year and would like to expand my government service.

. The CDS decides discretionary land use approvals in accordance with the criteria
of the Community Development Code. The Board also hears appeals from
Planning Department decisions and makes recommendations to the City Council
on zoning and land use plan amendments.
2. Have you ever observed a board meeting either in person or on C-View, the
City's TV station?
I watch Clearwater CDS hearings regularly, and I have testified numerous times as
an applicant before zoning boards In other municipalities.
3. What background and/or qualifications do you have that you feel would qualify
you to serve on this Board?
I have extensive familiarity with the issues of land use regulation due to my
experience as both a zoning attorney and a real estate developer. I believe I can

_Since I am in the commercial real estate and development field, I deal with
engineers, attorneys and planners, tenants and other developers on a daily basis. I
also deal with other city governments, county government throughout the state. I
have lived out on the beach for the past 20 years, financed many homes in
Countryside while at the bank and developed many homes and office building and
the northwood plaza area while at Rutenberg. Recently helped in the redevelopment
of LaBelle Plaza, Publix, at highland and Belleair.
4. Why do you want to serve on this Board?
First and foremost to give back something, my time, to the community and help
forge the city into the place I want to live the remainder of my lifetime. I also enjoy
the interaction with the other board members and the sometimes tough decisions
we are asked to make. I also like to know what is going on in the city and the COB
board is next to being on the commission and I don't think the public could take
two Bill Johnson's on the board. Even though some people said that they did vote
for me this last election, Bill Jonson., they didn't notice the name difference.

Authorize the City Attorney to settle all claims in the case of Ritz v. City of Clearwater, a
discrimination suit, for the amount of $18,750.00, inclusive of all fees and costs.
Summary:
Former Library employee Paul Ritz [Librarian II] was terminated for performance and behavior
issues. The City prevailed in the employee's appeal to the Civil Service Hearing Officer and in
review by the Civil Service Board. Mr. Ritz then filed suit in federal court against the City
alleging discrimination under state and federal law on the basis of gender, sexual orientation,
and disability, and violation of the constitutional right to assemble.
Certain witness availability issues exist for the City in defending the action. It is anticipated that
expert witness costs and other costs for bringing the case through trial are in the neighborhood
of $10,000.00. It is likely that there would be an appeal to the Eleventh Circuit by the
unsuccessful party.
The settlement of this case will avoid exposure to a potential damage award which could include
lost wages since the October 2003 termination, compensatory damages, reinstatement, and
attorney's fees and costs. Mr. Ritz has also pleaded punitive damages, although the City
Attorney's Office believes that it is unlikely he would recover these.
The settlement agreement will provide that Mr. Ritz will dismiss his case with prejudice and that
each party will bear its own attorneys' fees and costs.

Important Info re Old Florida Study
Bill and Garry-a continuation of our discussion yesterday regarding the Old Florida Study-here is
some more info to share with the council.
There is another important reason to do the analysis now. If the Council decided NOW to change the
Beach Plan to allow higher density, that would still require an amendment to the Plan and must be
approved by the PPC, CPA and Board. An amendment to the plan must be supported by data and
analysis so we would still have to do the analysis to support the decision. Therefore, not doing the
analysis does not speed up the process-the analysis must still be done either NOW as we are
currently doing or after the fact to justify the Council's decision. Obviously, doing the analysis after
the policy decision is made is not only inappropriate practice but will be much more difficult for us to
justify after the fact. I hope this is helpful. Thanks.

The following adjustments have been made to the Ft. Harrison Avenue detour:
. Signal timing adjustments have been made at Drew and Ft. Harrison and Drew and Myrtle
Avenue.
. Additional VMB's have been deployed to make sure everyone knows Ft. Harrison is closed to
through traffic and that Myrtle Avenue is the alternate route. We have many observations from
our staff that the motorists are ignoring or missing the signage that was originally deployed as part
of the MOT.
. Americorp volunteers will be deployed along Drew Street to assist with the traffic flow from
Garden Avenue onto Drew Street and from Ft. Harrison to Myrtle Avenues.
. The project is scheduled to be completed and Ft. Harrison open to traffic Saturday morning.
. Traffic ops personnel are monitoring the signal timings as well as the traffic flow to make
adjustments as needed.

Dear Keith:
This letter is to provide comments on the latest submittal from Walker Parking made by fax
yesterday. City staff and our consultant, Jim Ebert, have reviewed this submittal and it still does
not address the fundamental concern with the residential garage entrance. The location and
orientation of the stairwell continues to create a situation where entering traffic must make a
sharp right turn which, if not executed perfectly, forces them into the oncoming traffic lane
coming down the ramp. It is the City's as well as our consultant's, opinion that this is an
unacceptable unsafe condition.
It is my understanding that suggestions have been made previously on ideas to address this
concern. These included relocating the stairwell or turning it ninety degrees. For some reason
it appears these were never considered. Today we also discussed the possibility of "flipping"
the garage and putting the resident entrance at the north and the public entrance at the south.
The ramp could be switched to go up from north to south, rather than south to north as it
currently does, eliminating the conflict.
City staff is committed to working with your design team to arrive at a satisfactory solution which
will provide a parking garage safe for both the public and the condominium residents; however,
we cannot recommend proceeding with the current design. Enclosed is a letter from Jim Ebert
reiterating these concerns, plus a chronology of the plan review process showing when these

Dear Mr. Quillen:
Over the past several months I have been reviewing the proposed parking garage schematic
layouts prepared by Spencer Architects. This is per Timothy Haahs and Associates, Inc. 's
scope of services for the City of Clearwater.
I have repeatedly raised the question of a potentially dangerous condition that exists at the entry
and exit lanes at the southeast corner of the garage, specifically:
· Entering drivers will be forced to make a sharp right turn after passing through the entry
lane gate, and if the turn is not perfectly made, they are forced into the opposite (left
hand) lane of traffic coming southbound down the ramp from above.
· Additionally at this location, there is a solid wall (stairway) that blocks the entering
driver's line of sight for the aforementioned down bound traffic.
· This wall also blocks the line of sight for down bound drivers to see entering, oncoming
traffic.
In several conversations with the Parking Consultant, this condition was discussed, and it was
agreed by both of us that the above created a "less than satisfactory" layout. A revised layout
by the Parking Consultant was later presented which attempted to mitigate these conditions;
however in the opinion of the writer, an unsatisfactory, perhaps even dangerous, condition still
remains. The entry geometry and visual driving conditions must be corrected.
Upon further review of these revisions, I will again advise the City of my opinion.

insufficiency but that it was possible for the applicant to make
application and plan revisions to address insufficiency
comments for a December 2, 2004 DRC meeting.
· DRC Meeting. Applicant told that staff comments needed to 11-12-04

by the DRC on 12-2-04, savin!! the applicant three weeks of

I do not expect the discussion to dwell on the planning aspects. The regulatory process is
plainly laid out and not in dispute. The Anastoupolous development team's concern is
focused on resolving the garage design issues in a way that doesn't kick them into the April
CDB or later. The team wants to treat the garage issues as conditional items. The problem is
they have yet to follow the garage design approval process outlined in our agreement. The
issue they face now is the real prospect of requesting the council to approve another
extension to get everything done. The purpose of the discussion tonight is to get a feeling of
how the council feels about the project at this point. Mark should be very comfortable
participating in this discussion if necessary. Thanks.

Bill-I will not be at the City Council meeting tonight due to a family member's major
surgery. Mark Parry will be representing Planning but he is not familiar with all of the
history on this case.
I can provide you with the following status of the regulatory process for this case:
The project was deemed incomplete and must resubmit. Their deadline is to resubmit
today, February 3. If the project is resubmitted, then it will be scheduled for the March 15
Community Development Board meeting. Depending on how the garage design is
revised in today's resubmitted, the Public Works department mayor may not object to the
design. After review by Public Works and Planning, a staff report will be written and sent
to the COB. I believe that the only major outstanding issue is the garage design and
function.
I will ask Mark to determine if the project is resubmitted by end of the day today and let
you know. I will further ask Mark to immediately deliver a set of the plans to Engineering
so that they can start their review.

At tonight's city council meeting under CM Reports, I would like to give the
council a short update on the garage design process aspect of the Pelican Walk
Garage project. This will generate questions related to regulatory process (CDB
schedule) and whether the Mr Anastoupolous will be required to request another
extension to begin construction. This discussion will give us an indication if the
council is receptive to supporting another extension.
