Rottlund Homes, the developer of the adjacent property commonly known as the Dimmitt property, approached the City about annexing this section of the 60-foot wide unimproved First Street East right-of-way. Rottlund Homes would ultimately like to request the vacation of this right-of-way so it may be incorporated into its proposed 46 unit single family detached subdivision (FLS2003- 10054/PLT2003-00013). The right-of-way is contiguous with the existing City boundaries to the south, east and west; therefore, the proposed annexation is consistent with Florida Statutes with regard to voluntary annexation. The subject site is approximately 0.22-acres in area and only provides access to the Dimmitt property. The Planning Department is requesting that an initial Future Land Use Plan designation of Residential Suburban (RS) and a consistent zoning designation of LDR, Low Density Residential be provided for the right-of-way. IMPACT ON CITY SERVICES: [Section 4-604.F] Since the property proposed for annexation is a public right-of-way, no demands will be placed on city services. The proposed annexation will therefore have no adverse effect on public facilities including water, sewer, solid waste, police, fire and medical services and their level of service. CONSISTENCY WITH CITY'S COMPREHENSIVE PLAN: [Section 4-604.F.1] It is the purpose of the proposed Residential Suburban (RS) category to depict those areas of the County that are now developed, or appropriate to be developed, in a suburban, low-density residential manner; and to recognize such areas as primarily well-suited for residential uses that are consistent with the suburban, non-intensive qualities and natural resource characteristics of such areas. Residential uses are the primary uses in this plan category up to a maximum of two- and-one-half (2.5) dwelling units per acre. Secondary uses include Residential Equivalent; Institutional; Transportation/Utility; Public Educational Facility; Ancillary Non-Residential and Revised Staff Report - Community Development Board - March 16, 2004 - Case ANX2003-12033 - Page 2 Recreation/Open Space. The annexation proposes to provide an initial Future Land Use Plan designation of Residential Suburban (RS) to the property which is consistent with the category of all surrounding property. Further, the proposed annexation is not inconsistent with the City's Comprehensive Plan both in the Future Land Use Map and the goals and policies of the Plan. CONSISTENCY OF DEVELOPMENT WITH COMMUNITY DEVELOPMENT CODE AND CITY REGULATIONS: [Sections 2-1201.1. & 4-604.F.5.] As stated earlier, the application for annexation involves an unimproved, 60-foot wide road right-of-way. The appropriate zoning district based on the surrounding area and the proposed Future Land Use Plan designation is the LDR, Low Density Residential District. As the subject site is currently a road right-of-way, the minimum requirements of the LDR zoning district do not apply. CONSISTENCY WITH THE COUNTYWIDE PLAN: The applicant requests an initial designation on the Countywide Future Land Use Plan Map of Residential Suburban (RS), with a maximum density of two-and-one-half (2.5) dwelling units per acre. The proposed category is consistent with the surrounding area. The proposed plan amendment is consistent with the purpose and locational characteristics of the Countywide Plan. CONSISTENCY WITH PINELLAS COUNTY AND FLORIDA LAW: Pursuant to Pinellas County Ordinance No. 00-63, the Pinellas Planning Council and County staffs have reviewed this annexation and determined it complies with the ordinance criteria. Florida Statutes require that a proposed annexation be both contiguous with the existing municipal boundaries and compact in its concentration (Florida Statutes Chapter 171). This site is contiguous with the existing City boundaries to the south, east and west and represents a logical extension of the existing boundaries. The compactness standard of Florida law requires that the annexation does not create an enclave or a serpentine pattern of municipal boundaries. The annexation of this property is consistent with this standard. In summary, the annexation of this property is consistent with Florida law. SUMMARY AND RECOMMENDATIONS: The purpose of this application is to provide initial City Future Land Use Plan and Zoning Atlas designations for this site. It is proposed that the Future Land Use Plan category be designated as Revised Staff Report - Community Development Board - March 16, 2004 - Case ANX2003-12033 - Page 3 Residential Suburban (RS), with a consistent initial City zoning designation of LDR, Low Density Residential District. The proposed annexation will not have any negative impacts on public facilities and the proposed use of the property is consistent with the City's Comprehensive Plan and the Countywide Plan. Finally, the proposed annexation is consistent with Florida law regarding municipal annexation through its adjacency with existing City boundaries and is compact in concentration. Based on the above analysis, the Planning Department recommends the following actions on the request: 1. Recommend APPROVAL of the annexation of the First Street East road right-of-way; 2. Recommend initial Future Land Use Plan designation of Residential Suburban (RS) (City); 3. Recommend initial zoning designation of LDR, Low Density Residential (City). Summary: -The Royal Palm Motel, owned by Mary Sochocki, is located at 1250 Cleveland Street, Clearwater. -According to Clearwater Police Department reports, there has been an ongoing pattern of drug dealing and use at the Royal Palm Motel since at least 1999. A sample of case reports filed by the Department are: 7 incidents between June - November, 1999 4 incidents between January-March, 2000 15 incidents between July - December, 2002 17 incidents between March - November, 2003 -On March 30, 2000, Chief Sid Klein sent a letter to Mary Sochocki that referenced the ongoing drug activities taking place at the Royal Palm Motel during 1999-2000 and offered police assistance to mitigate the illegal crime activity on the property. Chief Klein informed Ms. Sochocki that such use of the property could subject her to Nuisance Abatement proceedings. -On March 18, 2003, Chief Klein sent a follow-up letter to Mary Sochocki that referenced the ongoing drug activities continuing to take place during 2002 at the Royal Palm Motel. Chief Klein offered police assistance to mitigate the illegal crime activity on the property and informed Ms. Sochocki that such use of the property could subject her to Nuisance Abatement proceedings. The drug activity, however, has continued. -The above activities constitute a public nuisance in accordance with Section 823.10, Florida Statutes, because any building which is visited by persons for the purpose of unlawfully using any substance that is controlled under Chapter 893, Florida Statutes or which is used for the illegal keeping, selling, or delivering of the same, is deemed to be a public nuisance subject to abatement under Section 60.05, Florida Statutes. -The City has no remedy other than to pursue a permanent injunction against Mary Sochocki, enjoining her and any others involved with the operation of the business from maintaining a public nuisance at the Royal Palm Motel.
