Economic Development and Housing
1. Review of the City of Clearwater's "Shared-Equity Policy" pertaining to the City's
Affordable Housing Programs.
Fire and Rescue Department
1. Ratify and confirm an indemnification agreement between the City and D.H. Griffin
Wrecking Co. Inc. and the City and Triangle Development Company L.L.C. for
Clearwater Fire and Rescue to perform training exercises on vacant land owned by the
company and grant authority to the City Manager or designee to enter into and approve
standard indemnification agreements for future use of private properties by the Fire
and Police Departments to conduct training exercises. (consent)
2. Approve a work order to Cumby & Fair, Inc. (EOR) for $159,477.00 to provide civil
engineering and architectural services for the Fire Training facilities, EOC building, and
Fire Station #48 at 1700 Belcher Road and that the appropriate officials be authorized
to execute same. (consent)
3. Approve a work order with Curnbey & Fair, Inc. (EOR) for $101,269.00 to provide civil
engineering and architectural services for Fire Station 45 and Administration and
authorize the appropriate officials to execute same. (consent)
Finance
1. Approve settlement of the liability claims, including attorney fees, of Robert Ralston and
Marilyn Ralston for payment of $125,000. (consent)
Marine and Aviation
1. Approve amendment to Chapter 22, Section 22.33 of the Code of Ordinances
authorizing a defined area for skim boards and surf boards on Clearwater Public Beach
and pass on first reading Ordinance No. 7542-05.
Engineering
1. Approve the applicant's request to vacate a 5-foot sidewalk easement which lies along
the east property lines of Lots 126 and 127, L1oyd-White-Skinner Subdivion, (a.k.a. 421
South Gulfview Boulevard), and pass Ordinance Number 7539-05 on first reading,
(VAC2005-14 Canterbury Property Management, Inc. and TLS Holding, Inc.),

2. Approve the applicant's request to vacate the drainage and utility easement that was
retained over a vacated portion of the right-of-way of Pine Street lying along the platted
southerly property lines of Lots 6 through 10, inclusive, Block 21, Magnolia Park, (a.k.a.
610 South Myrtle Avenue), and pass Ordinance 7540-05 on first reading, (VAC2005-15
Wells Court Development, LLC),
3. Approve the final plat for "SUNSET POINT SUBDIVISION" located at 2945 Sunset
Point Road, approximately 2000 feet west of McMullen Booth Road. (consent)
4. Ratify and confirm supplemental professional engineering design services by McKim &
Creed for site re-design and permitting of the Union Street Booster Pumping Station
component of the Drew/Union RCW, Contract 2 - Booster Pumping Stations project,
and approve payment to McKim & Creed for this work in the amount of $43,900.00,
and that the appropriate officials be authorized to execute same. (consent)
5. Approve the work order to Wade-Trim of Tampa, an Engineer of Record, for the design
and permitting of the Bayfront Promenade in the amount of $143,914.98 and authorize
the appropriate officials to execute same. (consent)
6. Continue to November 3, 2005, the declaration of surplus a 1,200 square foot parcel of
land, more or less, lying and being situate in the Northeast % of the Northeast % of the
Southeast % of Section 8, Township 29 South, Range 16 East for the purpose of
granting non-exclusive irlgr~::>::> i::lflU Egress Easement thereupon to Vanie W. Brinson,

City Attorney
1. Adopt Ordinance 7388-05 on second reading, making amendments to the
Comprehensive Plan of the city as adopted on May 18, 2000 and amended on July 12,
2001 and October 7,2004, by amending the future land use element by adding the
Resort Facilities Overlay (RFO) future land use as a land use map classification;
replacing references to the 1995 Clearwater Downtown Redevelopment Plan with the
2004 Clearwater Downtown Redevelopment Plan; and by deleting policies regarding
the mixed-use zoning district.
2. Adopt Ordinance 7486-05 on second reading, annexing certain real property whose
post office address is 2695 Second Avenue South, into the corporate limits of the city,
and redefining the boundary lines of the city to include said addition.
3. Adopt Ordinance 7487-05 on second reading, amending the future land use plan
element of the Comprehensive Plan of the city, to designate the land use for certain
property whose post office address is 2695 Second Avenue South, upon annexation
into the City of Clearwater, as Residential Suburban and Preservation.
4. Adopt Ordinance 7488-05 on second reading, amending the zoning atlas of the city by
zoning certain real property whose post office address is 2695 Second Avenue South,
upon annexation into the City of Clearwater, as Low Density Residential (LDR) and
Preservation (P).
5. Adopt Ordinance 7359-05 on second reading, amending the future land use plan
element of the Comprehensive Plan of the city to change the land use designation for
certain real property whose post office address is 2506 Countryside Boulevard from
Recreational/Open Space to Residential Urban.
6. Adopt Ordinance 7360-05 on second reading, amending the zoning atlas of the city by
rezoning certain property whose post office address is 2506 Countryside Boulevard,
from Open Space/Recreation (OS/R) to Medium Density Residential (MDR).
7. Approve a Settlement Agreement regarding National Advertising Co. v. City of
Clearwater, Circuit Court Case No. 00-003844-CI-11, consolidated with Lamar Whiteco
Outdoor Corp. v. City of Clearwater, Consolidated Circuit Court Case No.

Review of the City of Clearwater's "Shared-Equity Policy" pertaining to the City's Affordable
Housing Programs.
Summary:
In our rapidly appreciating real estate market, it has become necessary for the City to design
certain elements into our Housing programs to prevent borrowers from capitalizing on the City's
investment in the short-term (7 years). We have designed a Shared Equity Policy to prevent
City of Clearwater Housing Program borrowers from using the City's assistance to profit by
selling their home in the short term, at the City's expense. In most cases, if it were not for the
City's assistance, many, if not all, of the clients that we serve would not be able to purchase the
homes.
An example would be, if the City were to provide $25,000 of Down Payment Assistance (DPA) for
a household to purchase a $150,000 home. They finance $120,000, and put $5,000 down.
They keep the home for two years, and if we assume, on the conservative side, 15%
appreciation per year. They sell the home for approximately $200,000, payoff their first
mortgage and the City's loan and make approximately $50,000 in profit.
This policy would initially apply to loans that the City provided to households for down payment
assistance (DPA), infill housing and new construction loans. By building an "Equity Sharing"
provision into our loan documents, the amount of appreciation that a household can obtain is
graduated over a time period. Our policy would have a time period of seven (7) years. If they
sell during the first several years, the City would get the majority of the appreciation and as
they progressed into the seven year period, they would get the majority of appreciation.
We must continue to develop new tools to expand our toolkit to produce and preserve housing
for our lower income populations. While at the same time, we must be good stewards of public
funds and prevent misuse of a public benefit, for a private gain.

SHARED EQUITY PROVISION
Special Provisions: The Mortgagor agrees that ifit were not for the Mortgagee's funds,
the Mortgagor would not have been able to purchase the above-described property.
Accordingly, the following Special Provisions will apply to this mortgage in terms of
future rights to appreciation associated with the mortgaged property:
A. The parties agree that the Mortgagee, the City of Clearwater, or its successor shall
be entitled to a portion of any appreciation that is realized on the mortgaged
property in the following manner:
1. If the Mortgagor sells, transfers, rents, and/or refinances the property, or if
the property ceases to be the principle homestead property of the
Mortgagee, during the first year, and through year seven, the percentage of
appreciation as calculated and outlined in Section A 2 of this special
provision directly below shall be returned to the Mortgagee.
2. The amount of appreciation shall be determined by taking sales price, less
applicable closing costs, less original owner investment, less any
outstanding liens, less eligible improvements to property, less the
outstanding principal balance on the City of Clearwater Mortgage. The
remainder shall be considered appreciation and the applicable portion shall
be returned to the City dependent on the year ofthe sale as follows:
1. Year One

75% of appreciation
50% of appreciation

3. In the event there is no Net Appreciation or Net Appreciation is a negative
number, the amount of the original loan will still be due and payable.
4. In the event there are insufficient proceeds to payoff the City of
Clearwater Mortgage, the proceeds that are available, after deducting out
applicable closing costs, will be sufficient. In cases where there are non-
sufficient proceeds to repay any amount to the City, the City will release
the obligation on the borrower.
B. Throughout the thirty (30) year life of the mortgage, if the Mortgagee should sell,
refinance, rent, refinance, transfer ownership, or if the property ceases to be the
principle homestead residence of Mortgagee, the entire original loan balance, plus
the applicable equity during the first seven years, is due and payable to the City of
Clearwater.

C. If the Mortgagee pays off the City of Clearwater Mortgage during the first five (5)
years, the City will not record our satisfaction until after the fifth (5th) year.
D. If a borrower desires to pay off their loan during the first seven (7) years, and if
they are not refinancing and/or selling the property, the borrower will be
responsible for obtaining an appraisal to determine the value at that time.
