05/22/2003 CIVIL SERVICE BOARD CITY OF CLEARWATER May 22,2003 Present: Colbert Henley Cathy Adams James Maglio John DeBella Joseph Roseto Leslie Dougall-Sides Deborah Ford Chair Board Member Board Member Board Member Human Resources Director Assistant City Attorney Human Resources Analyst Chair Henley called the meeting to order at 5:03 p.m. at the Municipal Services Building.. Consideration of the Hearinq Officer's Recommended Order Re: City of Clearwater vs. Carlos Ulloa- Joseph Roseto, Human Resources Director, read the charges into the record. Leslie Dougall-Sides, Assistant City Attorney, presented into evidence the exhibits and the transcript of the hearing before Hearing Officer Anthony Comparetto.. A motion was made and carried unanimously to establish time limits for presentations by both parties. Mr. Ulloa presented his case as to why he should not have been terminated. He stated the City did not investigate the allegations against him thoroughly or question why a fifteen-year employee would become a problem all of a sudden. He stated he spoke to management in Customer Service regarding several issues that he had concerns with but no investigation of those issues ever took place. Ms. Dougall-Sides addressed the Board as to why the Hearing Officer's recommendation to uphold the termination should be upheld by the Board. Mr. Ulloa violated the Civil Service Rules and the City's Performance and Behavior Management Program's (PBMP's) standards. He was placed on an action plan in accordance with the PBMP but failed to comply with this plan. He was given a decision making leave day, but even after that he continued to have problems Several incidents occurred with coworkers and customers that prompted the department to recommend his termination. The Board members were provided copies of the exhibits for their review. These included Mr. Ulloa's action plan. At the conclusion of the presentation, Member Cathy Adams moved to accept the Hearing Officer's Recommended Order and Mr. Ulloa's termination be upheld. The motion was duly seconded by Member John DeBella. The motion passed by a vote of 3 to 1 with Member Maglio voting nay.
