The Muscular Dystrophy Association of St. Petersburg would like to thank you for allowing us, along with our local
International Association of Fire Fighters (IAFF), the opportunity to come before you and address the issue of prohibitive
street-side solicitation.
For more than half a century, IAFF members have stood by MDA, striving to make a difference in the lives of those affected
by neuromuscular disease. All across the country fire fighters participate in their signature event benefiting MDA, the Fill-the-
Boot program. In its most successful form, IAFF union member departments hit the streets in unifarm and solicit donations
from passing motorists — with the support of both management and government.
The issue of prohibitive ordinances poses a huge obstacle in sustaining the long, proud tradition of the IAFF's pledge to
provide help and hope far "Jerry's Kids". In 2005, Fire Fighters from St. Petersburg, St. Petersburg Beach, Pinellas Park and
Pasco County were on the streets collecting for MDA. This collection totaled $76,539. In comparison, more non-traditional
fundraising at supermarkets in Palm Harbar, Clearwater and Hernando County only totaled $12,541. Comparing these totals
allows you to see how important the Fill-the-Boot program is to our fundraising efforts. This money is crucial in funding
research projects to find effective treatments and cures as well as comprehensive medical care that directly benefits the lives of
tens of thousands, including over 305 families right here in Pinellas county. The MDA receives no government assistance or
help from the United Way so we greatly depend on the support of our local fire fighters.
We are aware that safety is a concern, however, fire fighters have extensive experience warking on roadways, often under the
most extreme hazardous conditions. Furthermore, the Muscular Dystrophy Association maintains a$1,000,000 insurance
policy for any unlikely mishap occurring during the Fill-the-Boot Drive with the IAFF named as an additional insured on the
policy.

We offer two solutions to this obstacle. The first solution would be for the City to revise the proposed ordinance providing
exemption for trained public safety officers soliciting for a charity adopted by their governing agents. The second suggestion
would be for the Council to create a permitting process. It is our hope that the enclosed samples of ordinances from other
localities, including neighboring Pinellas Park, may prove helpful in the development of an ordinance for Clearwater that will
allow our fire fighters to continue to help those in our community who have neuromuscular diseases.

AT THE lnternationa! Convention in 1953, the International Associatron
of Frre Fighters officially committed, by proclamation, to supportinc� the
Muscular Dystrophy Associafion untrl, togefher, our two organizations
succeed in eliminating neuromuscular diseases. Fire Fighters, on that
day, "committed themselves to a cure" and added another page to a
legacy of service dedicated to the preservation of life and property.
Since that time, fire frghter efforts across the United States and Canada
have distinguished their organization as the single greatest contributor tu
MDA through the signature drive, "Fill-the-Boot".

Florida Professional Firefighters Are #1 in State Rankin�s for The Muscular
Dystrophv Association
The Florida Professional Firefighters under the banner of the International Association of
Fire Fighters (IAFF) have been recognized by the Muscular Dystrophy Association
(MDA) as the #1 state in the nation for their 2005 Fill the Boot fundraising campaign.
In 1998 The Florida Professional Firefighters Association (FPF), under the leadership of
President Bob Carver, issued a challenge to the Texas Professional Firefighters
Association, the leader in MDA fundraising since the early 90's. It's been a long, hard
fight, but Florida union firefighters finally upset their rivals during their 2005 program
which raised a record breaking $2,149,710, outdistancing Texas by $133,130.
The real beneficiaries of this exciting competition, which has raised several extra million
dollars since the Challenge began, are the children and adults served by the Muscular
Dystrophy Association in both states and throughout the country.
The competition is ongoing and union firefighters in both states are already making plans
far another "Battle of the Boot Drives" for "Jerry's kids" 2006.
The money raised by the Florida Professional Firefighters is used to support MDA's
programs of inedical clinics, summer camp, support groups and research funded by the
Association in Florida.

has two siblings: Madeline, 9, andAustin, 4.The

She is a kindergartner at Warren Elementary
HEALTH HISTORY:
Morgan has spinal muscular atrophy, a progressive

disease that causes weakness in the arms, legs and
torso. Morgan is able to stand and take a few steps
with leg braces and a walker, and uses a standing
wheelchair for mobility.
INTERESTS:
Morgan enjoys swimming, horseback riding,
playing with her siblings, collecting purses
and stickers, and likes anything with a"Hello
Kitry" or "Disney Princesses" theme. She likes Co
take pictures, and is interested in becoming a
photographer when she grows up.
The Fritz family is extensively involved in
many MDA activities.They were profiled and
interviewed live on the 2003 and 2004 Jerry
Lewis MDATelethon broadcasts. Morgan and Ron
were pictured on the cover of Parade Magazine
on the weekend of theTelethon in 2004.The
family was featured in the magazine's article
about the 50"' anniversary of the parrnership
between MDA and the InternationalAssociation
of Fire Fighters. Locally, the Fritz fanzily takes
part in many MDA events, Morgan was serving as
MDA's 2004 GoodwillAmbassador for Missouri
when she was selected far the national role.

Bill Summary: T'his bill amends Sections 804.805 and 614.138 and creates Section 804.806, Ordinance Code, to

(D) 1. Public safety officers may solicit for a charitable organization in the
road rights-of-way that the City of Pinellas Park has original jurisdiction after
having obtained a permit. Permits to solicit on a state or federal maintained road
right-of-way shall require the approval of the state or federal agency, whicFi has
jurisdiction. The permit will allow the solicitation.
2. For the purposes of this subsection, a"charitable organization"
means an organization that is qualified under s. 501(c)(3) of the Internal Revenue
Code and registered pursuant to Chapter 496 of the State of Florida.
3. For the purposes of this subsection, public safety officers means
members of the Pineilas Park Fire De�artment and members of the Pinellas Park
Police Department.

4. The permit for solicitations in the road rights-of-way may be obtained
from the Traffic Division and approved by the City Councii provided the appiicant
meets the following criteria:
(a) The applicanYs name and address in the City of Pinellas Park,
including the name and address of the charitable organization to receive funds

V (b) The applicant shall provide a plan for review and comment by
tt�e City's Traffic Division Director, which plan will maximize the safety of the
applicant's representatives, as well as the motoring public, at the locations where
the solicitation will take place.
(c) The applicant shall indicate in specific detail the location of such
solicitation, together with the hours thereof, not to exceed twenty-four (24) hours
in any forty-eight (48) consecutive hour period.
(d) The applicant shall provide an indemnification and hold
harmless in favor of the city in a form satisfactory to the city attorney.
(e) No person under the age of eighteen (18) years shall participate
in any solicitation in the right-of-way pursuant to a permit granted under tt�is
Section.
(f) All solicitation shall occur during daylight hours only.
(g) The applicant shall provide proof of commercial general liability
insurance against claims for bodily injury and property damage occurriny on city
roadways and rights-of-way or arising from the applicant's solicitation activities or
use of the city roadways and rights-of-way by applicant or the applicant's agents,
contractors or employees having limits of not less than $1,000,000 per
occurrence for the general aggregate (per location). The certificate of insurance
shall name the City of Pinellas Park as an additional insured and shall be filed
with the Risk Management Division by no later than forty-eight (48) hours before
the date of solicitation.
(h) All funds raised from the solicitation shalf be donated to a not-
for-profit charitable organization licensed and registered to do business in the
state of Florida.
(i) The applicant shall comply with all other laws, city codes and
reyulations pertaining to public safety, traffic and solicitation.
(j) The Traffic Division may decline to issue subsequent permits to
any individual or group violating the parameters of a previously issued permit or
violating any requirements of this section, any other city ordinance or any state
statute.
(k) During active solicitation, at least one solicitor at each location
shall be in possession of a copy of the authorizin
insurance and shall display the copy to any I wp enfor ement off celr aueon
