WHEREAS, GFB Development LLC, owner of real property located in the City of Clearwater, has requested that the City vacate the drainage and utility easement depicted in Exhibit A attached hereto; and WHEREAS, the City Council finds that said easements are not necessary for municipal use and it is deemed to be in the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: Vacate two 5-foot drainage and utility easements, one lying along the north property line of Lot 4, Unit Two Island Estates of Clearwater, as recorded in Plat Book 47, Page 19A of the Public Records of Pinellas County, Florida and the other 5-foot drainage and utility easement lying along the south property line of Lot 5, of said Unit Two Island Estates of Clearwater, as recorded in Plat Book 47, Page 19A and 20, Public Records of Pinellas County, Florida, subject to the following condition: This vacation shall not become effective until the applicant deeds to the City of Clearwater a replacement easement satisfactory to the City Engineer. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption.
