09/30/1993 OCCUPATIONAL LICENSE APPEAL TO THE CITY MANAGER By Douglas Hanson d/b/a/ Drew Street Video Present: Kathy S. Rice, Deputy City Manager Al Galbraith, City Attorney Luke Charles Lirot, Attorney representing Appellant Douglas Edward Hanson, Appellant Janet McMahan, Occupational License Detective Robert Pease, Clearwater Police Sergeant Bill Goatcher, Clearwater Police Camille Motley, City Clerk Department ISSUE: Denial of Occupational License for Drew Street Video Deputy City Manager, Kathy S. Rice, opened the Hearing at 9:00 a.m., September 30, 1993 witnesses were sworn in by Notary Gwen Legters, from the City Clerk Department. Ms. Rice referenced the sections of Clearwater Code of Ordinances which were in conflict with the Appellant's application for Occupational License to do business as Drew Street Video. Detective Robert D. Pease gave testimony and submitted paperwork regarding background investigation performed on applicant. He stated the investigation results disclosed Mr. Hanson had been arrested for reckless driving, fleeing and eluding, resisting arrest and DUI in May of 1987. The files also indicated Mr. Hanson had been convicted of armed robbery and theft in Lapeer, Michigan on April 24, 1978. Detective Pease referenced appellant's statement on his Occupational License Application for coin operated private viewing booths as a violation of City Code. Mr. Lirot questioned Detective Pease regarding the application. Detective Pease stated that Mr. Hanson had volunteered information regarding the additional charges during a conversation that took place when application was being investigated by Police Department. Janet S. McMahan, Occupational License, gave testimony regarding taking of the application for Drew Street Video. She indicated the category for Unspecified License ("which involves other personal services") was used because she felt the private viewing areas qualified the applicant for this category. Mr. Lirot questioned Ms. McMahan about the application process. She stated Mr. Hanson disclosed that private viewing booths were to be used on the premise during their conversation . Mr. Lirot called Mr. Hanson who gave his address as 13001 74th Avenue, Seminole, FL. and stated he had filled out the Occupational License application. He stated he has applied for and obtained other licenses in Pinellas County and St. Petersburg listing just the DUI and the other charges came up on investigation. Appellant stated his intent was not to hide charges or appear misleading. He was granted clemency in June 1993 (referenced as Exhibit C) to clear the charges of armed robbery and have his civil rights restored. Mr. Galbraith questioned the appellant about whether the clemency would expunge or seal the records and noted the clemency did not allow him to carry firearms. Mr. Galbraith asked appellant about his intentions regarding the video booths and coin operated viewing machines. Appellant stated he did not plan to include them within his business.
