7597-06 ORDINANCE NO. 7597-06 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE TRAFFIC AND MOTOR VEHICLES; REPEALING CHAPTER 30, ARTICLE V. CLEARWATER CODE OF ORDINANCES, RELATING TO TOLLS ON THE CLEARWATER PASS BRIDGE; PROVIDING AN EFFECTIVE DATE. WHEREAS, there are no tolls collected on the Clearwater Pass Bridge; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Chapter 30, Article V., Clearwater Code of Ordinances, is hereby amended as follows: Article V., Reserved. C.'e3rll:lt-or P:lSS Bridgo Sec. 30.161. Toll schedule. The rates adopted for the use of Clearv:ator Pass Bridge are as proscribed in appendix 1\ to this Code. Sec. 30.162. Failure to pay toll; exceptions. (1) It shall be unlawful for the operator of any motor vehiole, truck, bus, or taxicab to operate such vehicle through the toll booth located on Clearwater P3SS Avenue 3t the Cle::llv/3ter P3SS Bridge '::ithout first p3ying the posted toll f-or each motor 'Jehicle, truck, bus, or taxicab exoept as provided for in this section. (2) The f-ollo'""":ing persons shall be exempt from the p3yment of the toll: (a) Any person oper3ting an 3utomobile or other vehicle belonging to the military dep3rtment of the state used f-or tr3nsporting milit3ry personnel, stores and property, when properly identified, while on official milit3ry business; (b) Any handicapped person 'l.'ho has a valid driver's license, who oper3tes 3 vehicle specially equipped for use by the h3ndicapped, 3nd who is certified by a physician licensed under F.S. ch. 458 or 459, or by comparable licensing in another state or by tho .'\djudic3tion Offico of the Veterans Administration 3S boing severely physic311y disabled 3nd h3ving permanent upper limb mobility or dexterity imp3irmonts which subst3ntially impair the porson's ability to deposit coins in toll baskets. Sec. 30.163. Exemption applic3tion and rocords. Ordinance No. 7597-06 The finance director is authorized to develop a CleanNater Pass Bridge exemption application to be completed by all affected bridge users, excluding pedestrians, as specified in section 30.161. The exemption provided in section 30.161 shall not be eff-eotive until such applioation is oompleted and approved by the finance director. Such application shall speoify the reasonable identification procedure to be utilized by Clearwater Pass Bridge personnel in granting toll exempt use of Clearwater Pass Bridge and recording exempt user reports to the appropriate user class and benefiting agency. Suoh reports shall be maintained by bridge personnel and submitted periodioally to the finance direotor. Sec. 30.164. Token system. (1) The finanoe director shall be responsible for obtaining and selling tokens. The city manager shall determine the places '::ithin the oity 'Nhere such tokens 'Nill be sold and shall establish regulations rolating to the sale and distribution of the tokens. (2) The city shall have no obligation to repurchase any of the tokens sold in the manner pro'.'ided in this section. (3) The token system provided for in section 30.161 shall be limited to two axle vehicles, including motorcyoles, mopeds, and public agency buses, but excluding private buses and vehicles towing trailers.
