They cannot have a horse on the property (property being annexed). When it is joined with the property to the west,
they could have up to 2 horses based on current County codes that allow up to 3 per acre.
The County is currently in the process of a full code rewrite, but I do not know when that is expected to be complete.
They mentioned they are hoping to clarify this section as it has been applied inconsistently to date, but there were no
indications that they were considering changing the 3 animals per acre standard.

Ordinances Nos. 8547-14, 8548-14, and 8549-14:
Section 3. Notwithstanding any current or future provision of the City of Clearwater Community Development
Code, the property owners shall have the right to engage in the permitted use of "general agricultural activities"
which is currently allowed pursuant to Pinellas County Code Section 138-432(1) within the Pinellas County R-R,
Residential Rural, Zoning District. However, such use shalt be limited to the keeping of the number of horses
allowed by said Pinellas County Code Section based upon the acreacae of the parcel beinq annexed, alone or in
combination with any other parcel joined to it by a recorded Unitv of Title.
If this language is acceptable, I will request Gina Dewitt to prepare the necessary Amendment on First Reading for
tomorrow's City Council meeting.
Additionally, further review of the history of the area shows that this applicant and the prior Crest area annexing
property owners were advised that the use could continue despite any discontinuance or abandonment, based upon the
use being a legal conforming use per the annexation ordinances, and that this appears to be the expectation of the
current applicant. Available information indicates that there are currently no horses on the property already in the City
which is to be joined to the annexed property via Unity of Title.

Please be advised that the City of Clearwater is in receipt of an application for voluntary
annexation for property located at 2205 McMullen Booth Road (ANX2014-01003). The subject
parcel is located within the City of Clearwater Planning Area and upon annexation into the City
of Clearwater will be served by city solid waste service. Sanitary sewer is not readily available
to the site.
The proposed annexation is consistent with Florida law regarding municipal annexations
pertaining to contiguousness with existing city boundaries and compact concentration. A copy of
